Abstract:Abstract A significant portion of the misunderstanding surrounding China’s human rights protection stems from a failure to consider its legal progress in light of China’s unique cultural, ideological, and political contexts. The Criminal Procedure Law of China is closely linked to constitutional principles and the fundamental first generation of human rights, providing a clear framework for understanding China’s efforts in human rights protection. As widely accepted standards for human rights codification, Articles 9, 17, and 14 of the International Covenant on Civil and Political Rights (ICCPR) outline the right to personal liberty, privacy, and the defense of the accused. Initially, China’s Criminal Procedure Law of 1979 fell short of meeting these global standards. However, with substantial revisions in 1996, 2012, and 2018, this specific code has progressively aligned with the covenant’s requirements, marking significant strides in human rights protection in China. Despite these advances, there remains room for improving the Criminal Procedure Law, especially under the challenges of the digital age. China, alongside other nations, will focus on building a more comprehensive, robust, and globally integrated legal framework to address the forthcoming issues.

Abstract:Public cases with major social impact in recent years reflect issues in China's authentication system.Lack of public credibility in authentication opinions,lack of right to know and right to act of on the part of clients,and reluctant attitude of public security and judicial authorities towards court appearance of authentication appraisers,all these issues are hindering the perfection of China's authentication system.We should take the opportunity of amendments to Law of Criminal Procedure,with the guidance of proper legal principle,in an effort to perfect relevant system concerning authentication opinions used as scientific evidence.

Abstract:The 1996 Criminal Procedure Law aimed to bring major changes to China’s criminal trial procedure by adding more adversarial components into trials and providing more protection to criminal defendants. Nevertheless, its effectiveness has been questioned continuously by scholars. Based on students’ evaluations of online criminal trials, this study was designed to explore public opinions on China’s criminal trial procedure. In addition, comparisons between mainland students and Hong Kong students, and between law students and non-law students were explored to examine potential differences between two legal systems and between students with different educational background and training. Data showed that the majority of students were satisfied with the three-phase trial procedure and the performance of major players in court. Nevertheless, they also identified a number of problems, all dovetailed with previous scholarly studies. Despite some nuanced differences, cross-group comparisons between the mainland sample and the Hong Kong sample and between law students and non-law students produced largely similar results.

An Empirical Study on Operation of Chinese Criminal Procedure Law

Abstract:Based on data collected from China Law Year Book and practice in one district in east of China from 1997 to 2007,this paper conducts an empirical study on the operation of current Chinese Criminal Procedural Law.Although there are some variations,the data from the district demonstrates all the characteristics demonstrated by China Law Year Book,that is,very low rate of non—prosecution and non— guilty decision,low percentage of defendant appeal and high rate of affirmation of original judgment in second instance trial and trial supervision procedure,which strengthens the conclusion that Chinese criminal process is decided by criminal investigation. A process decided by investigation procedure means once a case is transferred by the investigative organ to be reviewed and prosecuted,it is very likely to be convicted.Most of the first instance trial just reviews and verifies the evidence collected in the investigation procedure.Such process is different from the "trial—center" criminal procedure of western countries.Such process has some advantages,such as encouraging investigative organs to find out the truth of the case by all means and to screen out most of the suspects in the early stage of criminal process to save procedural resources and make suspects get rid of criminal proceedings earlier.However,it does have some disadvantages.It makes investigative organs under great pressures to collect guilty evidence, which would infringe the human rights of the suspects.Moreover,it also makes the public trial a "rubber stamp" to the investigation procedure and cannot revise errors made in investigation. Current judicial reform chooses trail procedure as the breakthrough,and the investigation procedure seems quiet by comparison.This approach of reform is wrong.To be successful in criminal judicial reform,we must start from investigation procedure.The reform of investigation procedure is too ambitious a topic for this paper to look into.But the decision made by the investigative organ at the end of the investigation is the turning point of criminal proceeding.Establishing effective supervision of this turning point is the key to Chinese criminal process.

Abstract:March 14,2012 amendment to the Criminal Procedure Law,adopted the decision of the technical investigative measures and enforcement powers specifically conferred by the public security organs,which makes the public security organs in the investigation stage of criminal proceedings has ever been another strong investigative powers enhanced.Stage in our country is a special period of social transition,especially in criminal cases have a significant social impact on the whole vicious criminal cases showed multiple,high incidence of severe situation,the community mental endurance to public security continuous impact the bottom line.Thus allowing the use of the public security organs to monitor telecommunications technology as the representative of investigative measures,for the rapid and effective criminal cases cracked and actively fight against serious crime,and earnestly safeguard the public safety is particularly necessary.At the same time,for the protection of citizens ' fundamental rights and safeguarding the suspect, the defendant procedural rights considerations should also strengthen the public security organ for telecommunications monitoring and other technical legal supervision of investigative measures,and thus balance the state power and civil rights of violent conflict,both crime control and the dual purpose of protection of human rights,justice and procedural justice to achieve both physical value orientation.

Abstract:Due to the limitations and constraints of the research methods and perspectives,China's criminal procedure studies are facing an unprecedented challenge.In order to overcome the academic difficulties and usher a prosperous criminal procedure law study,researchers on criminal procedure law should not only commit to improving the traditional research methods,but also introduce into it the social science research methods which mainly focus on extracting the viable legal theories from the empirical facts.To this end,we should proceed from China's own legal problems,and extract some theoretical concepts and categories which are of some explanatory power to those problems;we should give up the perfunctory study attitudes of "praise the western legal system" and "criticize China's legal system",and try to find something regularities from a number of experiences and lessons learned from the process of transplanting western legal system into Chinese legal system;we should try to find some theories and disciplines from China's own judicial reform,so as to not only find those systems of true and real vitality,but also advance and bring forward China's domestic legal theory;and finally,we also should redress the wrong tendency of emphasizing too much on the introduction of western concepts and theories of evidence,and try to summarize some evidential rules form China's judicial philosophy,legal history and legal practice,so as to create and bring about our own theory of evidence.

Abstract:This article explains how recent changes in China’s legal culture are being influenced by the two philosophies of good governance currently emphasised by the country’s leadership; that is, the rule of law and social harmony. Focusing specifically on criminal procedure, the article uncovers the essence of China’s current legal culture – that is, the juxtaposition of the rule of law and social harmony, and analogises it with the alloy of Confucianism and Legalism in dynastic China. This article pos its that the effort to amend the Criminal Procedure Law (‘CPL’) (2012) completes the transition of China’s legal culture because it accomplishes a substantive mixture of the rule of law and social harmony. The article then scrutinises the CPL amendments by classifying them into two groups in the light of their main functions – that is, to consolidate the rule of law and to legalise social harmony – and discusses how the rule of law and social harmony are further promoted in the criminal justice system through the first-year implementation of the CPL. A preliminary examination of the questions arising from the juxtaposition of the rule of law and social harmony under the CPL – which touches upon the basis of the criminal justice system and even the entire legal regime – precedes the conclusion of the article.

What Kind of Criminal Legal Aid System does China Need

Abstract:Modern criminal procedure has a presupposition that all cases involve defense lawyers. When a suspect or defendant is not able to afford a lawyer,the legal aid system becomes an important channel to provide professional assistance. Although the 2012 amendment to China's Criminal Procedure Law expanded the scope of criminal legal aid and extended criminal legal aid from first instance trial stage to pretrial investigation stage,a universal and prompt legal aid system is still in distance,so the scope of criminal legal aid should be expanded and an effective guaranteeing system should be established. Given the unbalance situation of lawyer resource regional distribution,establishing a China style public defender system,rational allocating lawyer resource in specific area,or including the basic level legal service persons to the criminal legal aid subject will meet the need of China's criminal legal aid practice.

The Study of the Application of the Designated Residential Surveillance System

Abstract:The revised edition of 2012 Criminal Procedure Law adds a designated residential surveillance system in the chapter on compulsory measures. The designated residential surveillance is regarded as the special case of residential surveillance. Though the existence of the designated residential surveillance is reasonable,its legitimacy is challenged. What's more,as the current law of the designated residential surveillance, its provisions are too principle and simple,leading to the difficulties of application. Therefore,it is necessary to take some measures to improve the relevant provisions of the designated residential surveillance and thus to ensure its effective application in judicial practice and play its due role.

Abstract:The article discusses the latest changes in the Criminal Code of the People’s Republic of China that were introduced at the end of 2020. The amendments were adopted after numerous revisions and discussions, and were officially published on December 26, 2020. As a result, fifteen new offences were added to the Criminal Code, and 47 articles were modified or amended. These amendments refer to financial security, intellectual property, security of public healthcare, production of food and medications, and the regulation of criminal liability for crimes connected with minors. Thus, they reflect the reaction of criminal legislation to public life through the criminalization and penalization of some publically dangerous actions. At the same time, they indicate the direction of Chinese criminal policy that combines «leniency» and «strictness». For example, most of the newly added offences are minor. On the whole, changes and amendments to the current Criminal Code of China are connected with different institutes of criminal law: reduction of the age of criminal liability for some offences; addition of new offences; introduction of changes and amendments to the dispositions and sanctions of some of the existing offences; provision of an opportunity to impose penalties that are under the lower limit determined by the corresponding Article of the Special Part of the Criminal Code of China if the property obtained in the crime is recovered, or the economic damage to the victim is compensated.

Abstract:The legislature should take many factors into account when amending criminal procedure law.The proper balance between national power and civil rights is a premier institutional arrangement preventing the abuse of national power and avoiding the unwarranted violation of civil rights.With regard to the behaviors of violating legal procedures and civil rights,formulating appropriate judicial remedy measures on substantial decision and litigation procedures is the design of procedures ensuring that a criminal procedure can be effectively carried out.In order to avoid pitfalls and risks of the conventional system of "legislation dominates principle",the legislature should observe and summarize scientifically the experience in reform initiated by the judiciary and introduce the effective reform measures into law in time.

Abstract:The time is ripe for the construction of a doctrinal legal discourse system with Chinese characteristics for criminal law in the stage of subjectivity awakening. The targeted discourse system should achieve at least the following two effects: namely legal effect and social effect. In order to achieve the desired effect, the process of the construction of a doctrinal legal discourse system with Chinese characteristics for criminal law requires the establishment of a general construction idea and specific issues of inquiry.The general construction idea consists of four parts: the historical investigation of China’s doctrinal legal discourse system with Chinese characteristics for criminal law, the identification and reference of foreign doctrinal legal discourse systems for criminal law, the clarification of the principles of China’s doctrinal legal discourse system with Chinese characteristics for criminal law, and the construction of China’s doctrinal legal discourse system with Chinese characteristics for criminal law. In each part, the theoretical issues that need to be concentrated on are clarified according to the general construction idea, so as to enhance the focus of the construction of the discourse system and finally complete the construction of the doctrinal legal discourse system with Chinese characteristics for criminal law.

Abstract:Chinese criminal procedural law has recently been undergoing rapid transformation. While the search for ‘truth’, embodied in a confession by the accused, has traditionally dominated the criminal process, efforts are now being made to secure more procedural fairness. This is exemplified by the introduction of rules to render inadmissible at trial confessions extorted from suspects by ill treatment. Unsurprisingly, it has proved difficult to shift the mindsets of the players in the criminal justice process. The new rules have not been fully implemented in many respects and there is still confusion over the criteria to be used by the courts in making decisions about inadmissibility. Further, it has proved difficult to enable defence lawyers to play a more active role in defending their clients and to render it normal for witnesses to testify at trial. This handicaps the drive to secure a better balance between the search for truth and procedural fairness in the Chinese criminal trial.

Abstract:The re-amendment to the criminal procedure law is the focus of academe.Based on 675 questionnaires of grassroots police on the current situation and re-amendment to the criminal procedure law,this article specifies six measures in the re-amendment to criminal procedure law.Current resources should be objectively assessed to promote the integration of theory and practice.An appropriate standard of efficiency should be rationally set and the scope of investigation should be defined.Mandatory measures should be scientifically standardized and the limitation of actions should be properly adjusted.Implementary procedures should be simultaneously formulated.The right and responsibility for relevant subject should be defined to form equal and confrontational legal relations.Legitimate investigating methods should be supplemented to enrich investigating resources.
