Abstract:March 14,2012 amendment to the Criminal Procedure Law,adopted the decision of the technical investigative measures and enforcement powers specifically conferred by the public security organs,which makes the public security organs in the investigation stage of criminal proceedings has ever been another strong investigative powers enhanced.Stage in our country is a special period of social transition,especially in criminal cases have a significant social impact on the whole vicious criminal cases showed multiple,high incidence of severe situation,the community mental endurance to public security continuous impact the bottom line.Thus allowing the use of the public security organs to monitor telecommunications technology as the representative of investigative measures,for the rapid and effective criminal cases cracked and actively fight against serious crime,and earnestly safeguard the public safety is particularly necessary.At the same time,for the protection of citizens ' fundamental rights and safeguarding the suspect, the defendant procedural rights considerations should also strengthen the public security organ for telecommunications monitoring and other technical legal supervision of investigative measures,and thus balance the state power and civil rights of violent conflict,both crime control and the dual purpose of protection of human rights,justice and procedural justice to achieve both physical value orientation.
