Abstract:As one of the important subcontracts, nominated subcontractor has been clearly defined in FIDIC, ICE. It also has the similar contents in NEC, even though it has no exactly provisions of nominated subcontracting. However, there are little contents related to nominated subcontractor in China, which makes it have no basement in the real construction case. Hence, this paper aims to find out the shortages about the Chinese nominated subcontractor. To achieve this aims, A comparative analysis about the nominated subcontractor is made, which is based on different construction contracts. Four main contents are found, and there are applicable laws, contract relationship, main contractor’s right and responsibility. Eventually, some recommendations are made to improve nominated subcontractor in China.

Abstract:As an opened developing country, China is attracting more and more foreign investment, and many large construction projects have been carried out with international funding. Meanwhile many overseas construction consultants have been retained to advice clients on the various aspects of the management of projects. This management advice is often given in the unfamiliar context of the Chinese construction industry, Chinese legal and administrative systems, and Chinese culture. There is a real potential for divergence between what the overseas consultants consider to be normal practice and traditional management concepts in China. Accordingly, many risks exist for the unwary consultant in these fields. The paper explores the main risks for consultants working on construction projects, and provides some countermeasures under the FIDIC form of contract and the Chinese version of the Engineering and Construction Contract (ECC), based on the research and experience for FIDIC and ECC.

Abstract:Construction supervision companies (CSCs) in China are engaged by owners mainly to ensure a project is constructed safely and to the quality standards as required under the law in a supervision system that has existed for decades, their credibility and integrity being vital for project safety assurance and quality control. Recently, the Chinese government has proposed a credit scoring mechanism to assess the credibility of CSCs and requested the incorporation of credit scores into the CSC selection processes for public projects. This study investigates the status quo of the credit scoring mechanism and evaluates how credit scores have impacted the competitiveness of CSCs when bidding for supervising public projects by analyzing the bidding results of 5582 public projects and credit scores of 514 CSCs in Nanjing, the capital city of Jiangsu Province in China. The results show that (1) the average CSC credit scores have followed a downward trend in recent years; (2) the score weights in the selection process have significantly increased and the scores start to impact on bidding results when their weights are at or above 4%; (3) signs of local protectionism have been observed as local CSCs have significantly higher credit scores than non-local CSCs; and (4) high scoring CSCs are more competitive than others in terms of revenue generation. The study provides an insightful understanding of China's existing credit scoring mechanism and its impact on the selection of CSCs for public sector projects, often a major concern of policymakers, researchers, and industry practitioners.

Abstract:This paper analyzes the connotation of the architect responsibility system and the supervision-engineer system,and compares the effects in the following 4 aspects:design intention implementation and architectural design improvement,construction quality and safety assurance,communication efficiency,and owner's project management services. Research shows that the architect responsibility system works better on ensuring the design intention to be followed in construction,and promoting the coordination of design and construction during construction phase,under the clear distribution of quality liability between the architect and the contractor. Chinese supervision-engineer system should have served the owner better on its specialized construction project management services. However,this value was badly impaired by the opaque definition of the supervision-engineer's on-site liability and the absence of pre-construction services. China should follow the core idea of architect responsibility system,and encourage the engineering consulting services to cover all the project implementation processes and to work in an integrative way.

Abstract:Purpose Megaprojects contribute greatly to China's socio-economic development. However, the diverse stakeholders of megaprojects tend to be prone to conflict and plunge the project into lower performance than expected. This study aims to investigate (1) the optimal supervision mechanism under direct supervision of the owner and (2) the optimal indirect supervision mechanism of the owner, with involvement of integrated construction consultancy (ICC) in supervision and considerations into the impact of collusion between the ICC and the general contractor on supervision efficiency. Design/methodology/approach This study applies the principal–agent theory and game theory to design effective incentive and punishment mechanisms for direct and indirect supervision by the owner. Through the theoretical framework of game theory, it analyses the strategic interactions between the owner, the ICC and the general contractor, and evaluates the effectiveness of various supervision mechanisms based on Nash equilibrium theory. Findings The results showed adopting the direct supervision mechanism when the probability of the general contractor's opportunistic behavior being detected was higher or the occurrence had a greater impact on the owner. However, the increase in supervision cost would reduce the motivation of owner's direct supervision and prompt the owner to choose the indirect supervision mechanism. Additionally, the indirect supervision mechanism was more likely to inhibit the collusion between the ICC and the general contractor. Thus, increasing penalties for ICC would result in improved supervision of ICC, thereby improving the benefits to the owner. Originality/value This study examines the dynamic interaction between the owner, the general contractor and the ICC. The study establishes a game tree and game matrix based on principal–agent theory, and analyses direct and indirect supervision models to determine the Nash equilibrium and optimal supervision strategy that is in the best interest of the owner. The study advocates for improved management and supervision mechanisms and argues that tailored supervision mechanisms can significantly improve the performance of megaprojects, which is well validated in megaprojects in China.

Abstract:With the development of theory and practice of the international project claim management, the contractor carrying out the contract claims is no longer based solely on the contract agreement, but rather towards the combination of contractual and legal trends. In FIDIC Conditions of Contract for Civil Engineering Construction (Red Book, 1987 edition), there has a more comprehensive description and requirements of the rights of the employer, engineer and the contractor. So the specific acts of the parties involved the contract may result in "Breach of Contract" and trigger claims of time and cost. In this paper, according to a further analysis of a series of claim cases based on the Red Book we have studied the background of the contractual and legal of "Breach of Contract" in depth.

Abstract:Nowadays, the need for scientific and modernized engineering cost management has been increasingly prominent. Hence, this study compared the differences of the quantities’ terms, the management philosophy, the related institutions (or specifications), and other factors in engineering cost management between China and Germany accompanied by a case study for a warehouse building project in China. There are two main parts. Firstly, according to the literature research, the comparative analysis was conducted on the engineering cost-control mode, the list of bills of quantities, and other parameters between China and Germany. On the basis of this, the “differences” between China and Germany especially in the bidding process were further studied with the empirical analysis of engineering cases, which is a supplementary argument to the theoretical analysis. Finally, several related suggestions were put forward, including proposing a set of “universal” bills of quantities (which can be understood by Chinese enterprises and also accepted by foreign-funded enterprises), the establishment of the whole process, a dynamic and information-based project cost-management system, cultivation of talents with the advanced management concept, and the development of international engineering companies and project-management companies with core competitiveness. The conclusions are expected to provide some references for China’s construction industry to further expand the international market and to increase the influences in global markets.

Abstract:The FIDIC (Fédération lnternationale Des lngénieurs Conseils) Conditions of Contract for Construction are widely used in international engineering contracts, and their translation also plays an active role in the construction of China's own engineering contract texts. Due to the complexity and variety of the logical levels and modifiers, understanding and translation have become a major challenge. This paper will use functional equivalence theory as the theoretical guide, take the English and Chinese versions of FIDIC Conditions of Contract for Construction (1999 Red Book) as the main research text, analyze the long sentences of FIDIC Conditions of Contract for Construction and its translation techniques in Chinese translation, and explore how Chinese translation can deal with complex long sentences to achieve the closest and most natural equivalence between the target language and the source language.

An Overview of China’s Construction Project Tendering

Abstract:In order to achieve a fair, probity, transparent and open competition environment in the construction industry, the Chinese government has developed and applied a multi-criteria competitive tendering system for the procurement of construction projects. However in many cases, the system only works on compilation of requirements and problems still frequently occur. The aim of this paper is to review the current construction tendering system and practice and propose strategies for improvement. A number of methods have been used to obtain research data, including focused group workshops and discussions, on-site observations, desk top study of relevant regulations and policies and review of three actual project tendering cases. It was found that China has gone a long way from project assignment to the current competitive tendering practice. However, the current tendering system has prevented bidders from focussing on value for money and construction innovation. Furthermore, the tender evaluation processes were rather formal and compilation of procedures and requirements than in-depth and project-specific. In addition, the time (half a day) given for evaluating tender submissions was insufficient. In some cases, the tender evaluation criteria was set after the bidders had been selected and there was no mechanism in place to review or audit the contract award decisions made by the tender evaluation committees. Based on these findings, it is suggested that as part of the market economic system, the Chinese government should allow bidders to calculate project cost on the basis of market price information and the company’s technical and management capabilities, instead of following quotation books and regulations and guidelines issued by the government. It is also suggested that detailed evaluation criteria be prepared prior to calling for tender and more time be given to evaluate tender submission documents. Finally, it is suggested that random audit of archived cases be conducted to ensure the decisions made were fair, open and probity.

Abstract:Deeply influenced by the planning economic system, China's engineering consulting industry still lag behind the international norm, although the consulting concept has been introduced into mainland for about 20 years. The insufficient regulations and irrational enterprise system severely restrains the development of China's engineering consulting industry. After entering the WTO, China's consulting enterprises will confront more crucial competition. In order to make Chinese consulting firms survive in the competition, the industry must be reformed. This paper will first analysis the current problem exists in industry and then find out the root of weakness, finally propose recommendations on financial, legislative and institutional aspects, to promote the reformation in China's engineering consulting industry.
