On Civil Evidence Contract

Abstract:The evidence contract in civil procedure is a type of action contract which is an agreement concluded by the litigation parties about evidence admission to limit a judge’s mental impression or an agreement that is inconsistent with law. There is a variety of action contracts that fall into three categories: action contract about burden of proof, action contract about credibility, and action contract about probative force. On the basis of the doctrine of discretional evaluation of evidence, the academic attitude towards the force of the action contract is that it should be strictly limited. Action contract is just with respect to adversary doctrine and the right to disposition, and other value interests favorable for the parties to an action. The force of contract action should depend on the judgment by judges in accordance with the principle of balancing interests, trying best to recognize its force to show the principle of the parties being subjects.
