Characteristics Comparison between Policy of Tempering Justice with Mercy and Policy of Punishment in Accordance with Crime

Abstract:The criminal policy of tempering justice with mercy takes into account the protection of human rights and protection of society.In order to maximize the criminal justice and efficiency,the policy,based on the rules of the formation and development of crime,emphasizes treating differently on tempering justice with mercy,and focuses on tempering justice with mercy and justified remedy.The policy of punishment in accordance with crime,formed in the social background where crimes become increasingly rampant,is oriented to the protection of social values,and emphasizes the thoughts and systems which take mercy and rigor into consideration,and consequently the minor offender may be granted forgiveness and the serious criminals can move to the center to sit on the hedge,which thereby forms a new order of criminal justice and efficiency on punishment of serious crimes.
