Abstract:Purpose – The purpose of this paper is to identify and discuss key risk factors in the use of forensic science in the criminal justice system by adopting a holistic and systemic approach that examines the collection and use of forensic evidence from crime scene to court. Design/methodology/approach – The research on which the paper is based was a mixed-method five-year study of the effectiveness of forensic science in the criminal justice system in Australia using qualitative and quantitative methods. The paper draws on the in-depth analysis of qualitative data from 11 case studies of investigations of serious crime to identify key risk factors in the use of forensic science from crime scene to court. Findings – Six key risk factors in the forensic process from crime scene to court are identified: low level of forensic awareness among first responders; crime scene examiners (CSEs) as technicians rather than professionals; inefficient and/or ineffective laboratory processes; limited forensic literacy among key actors in the criminal justice system; poor communication between key actors in the criminal justice system; and, financial resources not directed at the front end of the forensic process. Overall the findings demonstrate that forensic science is not well embedded in the criminal justice system. Practical implications – The paper suggests that the risks inherent in the current practice of forensic science in the criminal justice system can be reduced dramatically through: forensic awareness training among first responders; the professionalisation of CSEs; continued improvements in efficiency and effectiveness at the laboratory with a focus on timeliness and quality; greater forensic literacy among actors in the criminal justice system; appropriate avenues of communication between agencies, practitioners and policymakers in the criminal justice system; and increased allocation of resources to the front end of the forensic process. Originality/value – By adopting a holistic, systemic approach to the analysis of forensic science in the criminal justice system, and identifying inherent risks in the system, this paper contributes to the emerging body of research on the social processes that impact on the effectiveness of forensic science.

Abstract:Forensic science is usually taken to mean the application of a broad spectrum of scientific tools to answer questions of interest to the legal system. Despite such popular television series as CSI: Crime Scene Investigation and its spinoffs--CSI: Miami and CSI: New York--on which the forensic scientists use the latest high-tech scientific tools to identify the perpetrator of a crime and always in under an hour, forensic science is under assault, in the public media, popular magazines [Talbot (2007), Toobin (2007)] and in the scientific literature [Kennedy (2003), Saks and Koehler (2005)]. Ironically, this growing controversy over forensic science has occurred precisely at the time that DNA evidence has become the ``gold standard'' in the courts, leading to the overturning of hundreds of convictions many of which were based on clearly less credible forensic evidence, including eyewitness testimony [Berger (2006)].

Abstract:Since the National Academy of Sciences released their report outlining paths for improving reliability, standards, and policies in the forensic sciences NAS (2009), there has been heightened interest in evaluating and improving the scientific validity within forensic science disciplines. Guyll et al. (2023) seek to evaluate the validity of forensic cartridge-case comparisons. However, they make a serious statistical error that leads to highly inflated claims about the probability that a cartridge case from a crime scene was fired from a reference gun, typically a gun found in the possession of a defendant. It is urgent to address this error since these claims, which are generally biased against defendants, are being presented by the prosecution in an ongoing homicide case where the defendant faces the possibility of a lengthy prison sentence (DC Superior Court, 2023).

Abstract:Forensic Scientometrics (FoSci) is emerging as a vital discipline at the intersection of scientific integrity and security. Scholarship and scholarly communication are critical for maintaining scientific integrity, influencing public trust in science, health, technology, policy, and law. Yet, these foundations are threatened by the misuse of scientific research for personal, commercial, ideological, and geopolitical gains, including questionable practices and misconduct. The rise of paper mills and predatory publishers, along with ideological and geopolitical motivations, undermines academic integrity. This field pioneers the integration of traditional scientometric methods with ethics to address pressing challenges in research integrity and security, crucial in an era of heightened scrutiny over science's reliability. FoSci's development signifies a collective commitment to maintaining scientific trust, marked by a call for official recognition and support from stakeholders across the scientific ecosystem.

Towards more relevance in forensic science research and development

Abstract:Many different issues have been identified in forensic science for more than 10 years. While quality management has often been suggested as a path forward, research is generally considered as an essential part of the solution. Through an overview of current forensic science research, this paper aims at evaluating if and how research answer the challenges forensic science is currently facing. While forensic related publications have massively increased over the years, approximately half of the publications were published in non-forensic sources, indicating that forensic science research tends to be led by other disciplines. Over the years, forensic science research has remained largely oriented towards methodological and technological development rather than relevance to the forensic science discipline and practice. Practical implementation of the techniques is rarely discussed from a forensic perspective, and thus research rarely move from the "proof-of-concept" stage to its utilisation in case investigation. The digital transformation also generated a massive increase of data, making it challenging to find the relevant pieces of information in the mass of "forensic" publications available on-line. Thus, we propose to refocus forensic science research on forensic fundamental and practical questions to strengthen the discipline and its impact on crime investigation and security issues. Our propositions represent an incentive to further discuss forensic science research and knowledge transmission through the definition of a common culture within the community, focusing on common fundamental knowledge such as a better understanding of the concept of trace and its case-based information content.
Adversarial Scrutiny of Evidentiary Statistical Software

Abstract:The U.S. criminal legal system increasingly relies on software output to convict and incarcerate people. In a large number of cases each year, the government makes these consequential decisions based on evidence from statistical software -- such as probabilistic genotyping, environmental audio detection, and toolmark analysis tools -- that defense counsel cannot fully cross-examine or scrutinize. This undermines the commitments of the adversarial criminal legal system, which relies on the defense's ability to probe and test the prosecution's case to safeguard individual rights. Responding to this need to adversarially scrutinize output from such software, we propose robust adversarial testing as an audit framework to examine the validity of evidentiary statistical software. We define and operationalize this notion of robust adversarial testing for defense use by drawing on a large body of recent work in robust machine learning and algorithmic fairness. We demonstrate how this framework both standardizes the process for scrutinizing such tools and empowers defense lawyers to examine their validity for instances most relevant to the case at hand. We further discuss existing structural and institutional challenges within the U.S. criminal legal system that may create barriers for implementing this and other such audit frameworks and close with a discussion on policy changes that could help address these concerns.

Methodological Problems in Every Black-Box Study of Forensic Firearm Comparisons

Abstract:Reviews conducted by the National Academy of Sciences (2009) and the President's Council of Advisors on Science and Technology (2016) concluded that the field of forensic firearm comparisons has not been demonstrated to be scientifically valid. Scientific validity requires adequately designed studies of firearm examiner performance in terms of accuracy, repeatability, and reproducibility. Researchers have performed ``black-box'' studies with the goal of estimating these performance measures. As statisticians with expertise in experimental design, we conducted a literature search of such studies to date and then evaluated the design and statistical analysis methods used in each study. Our conclusion is that all studies in our literature search have methodological flaws that are so grave that they render the studies invalid, that is, incapable of establishing scientific validity of the field of firearms examination. Notably, error rates among firearms examiners, both collectively and individually, remain unknown. Therefore, statements about the common origin of bullets or cartridge cases that are based on examination of ``individual" characteristics do not have a scientific basis. We provide some recommendations for the design and analysis of future studies.

Abstract:Background: Forensic DNA testing is a powerful tool used to identify, convict, and exonerate individuals charged of criminal offenses, but there are different views on its benefits and risks. Knowledge about public views on forensic DNA testing applied in the criminal field is socially valuable to practitioners and policymakers. This paper aims to synthesize quantitative evidence about the factors that influence public views on forensic DNA testing in the criminal field. Based on a systematic search conducted in January 2019, a scoping review was performed, targeting studies presenting original empirical data that were indexed in Web of Science and PubMed. The two authors performed eligibility and data extraction. Results: The 11 studies were conducted mainly in European countries (Italy, Portugal, Serbia, Spain, Switzerland) and the remaining derived from the USA and New Zealand. Non-representative samples were mostly used to explore the benefits and risks of criminal DNA databases, criteria for insertion and retention of DNA samples and profiles, knowledge, willingness to donate a DNA sample, and custody. The value of forensic DNA databases in protecting society from crime was emphasized. Concerns about improper access to forensic genetic data and risks to civil liberties associated with its uses were expressed. The scarce literature on Forensic DNA Phenotyping and familial searching revealed the same trend of positively valuing forensic DNA testing. Only factors related with socioeconomic position were assessed by more than two studies. Results suggested that public views on forensic DNA testing are influenced by the level of education, age, and exposure to law enforcement occupations although not in a straightforward manner. Conclusion: Further empirical research should assess standardized factors related with social and structural levels (e.g., scientific literacy, public trust in the justice system and concerns about victimization or police activity) and be performed in different national jurisdictions to enable generalization and comparison of findings. It is needed to expand empirical studies on public views about the commercialization of forensic science and the use of recent controversial techniques and new transparency and accountability models.

Abstract:A press release from the National Institute of Standards and Technology (NIST)could potentially impede progress toward improving the analysis of forensic evidence and the presentation of forensic analysis results in courts in the United States and around the world. "NIST experts urge caution in use of courtroom evidence presentation method" was released on October 12, 2017, and was picked up by the <a class="link-external link-http" href="http://phys.org" rel="external noopener nofollow">this http URL</a> news service. It argues that, except in exceptional cases, the results of forensic analyses should not be reported as "likelihood ratios". The press release, and the journal article by NIST researchers Steven P. Lund & Harri Iyer on which it is based, identifies some legitimate points of concern, but makes a strawman argument and reaches an unjustified conclusion that throws the baby out with the bathwater.

Abstract:abstract: In 2023 and 2024, a wave of anti-DEI (diversity, equity, and inclusion) legislation has been passed in multiple states, representing a dramatic reversal from 2019–2022, when violence and systemic injustices against minority individuals were highlighted and DEI measures increased. In forensic anthropology, where practitioners frequently work with remains of individuals from marginalized identities, these events have forced a necessary period of disciplinary and individual self-reflection regarding our complicity in the entrenched racism and cis-heteropatriarchy that underlies our society. This article reflects on the role that professional forensic science organizations play in perpetuating and/or combatting inequity. It discusses how recent anti-DEI legislation negatively impacts forensic science, hurting both practitioners and scholarly output, and the ethical responsibilities of professional organizations to publicly affirm support for minority members and contradict scientific misinformation around these legislative measures. In particular, the authors highlight how the American Academy of Forensic Sciences (AAFS) has responded—often with silence and a lack of meaningful change—and propose potential remedies to promote long-term equitable changes both within the AAFS and external to it. The role of professional organizations in supporting all of their members, and good science, is more important now than ever, and it is time we expect and demand more from them.

Abstract:Purpose Criminology both as a field of study and as a practice draws on a broad range of disciplines from the social, behavioural, human, natural and medical sciences. However, over recent times, the natural and medical sciences have been dismissed, overlooked and even ridiculed, largely since the rise of critical criminology and related contemporary conflict and social harm approaches from the 1960s onwards. This has led to a chasm emerging between the study of criminology and the practice of criminology such as within a policing context. This paper aims to provide a review of an emerging forensic biological method, that of neuroscience, within a criminological context, to illustrate the importance of criminology embracing and reawakening its natural and medical science roots. Design/methodology/approach The paper draws on a conceptual design to realign criminology with the full range of disciplines used to inform its theory and application. Findings Through illustrating the role of forensic neuroscience, the paper reawakens the scientific method and inquiry of criminology reflecting the importance of the discipline being, and remaining, multi- and trans-disciplinary in nature. The paper, while reflecting on the limitations of scientific method and inquiry, outlines the strengths this approach to criminology engenders, promoting and delivering a scientific-based research agenda that aims to support industry partners in the prevention, disruption and reduction of crime, disorder and threats to public security. Practical implications Firstly, it is important for criminology as a field of study to (re)engage with its scientific method and inquiry. Secondly, criminology, by engaging in robust scientific method and inquiry, has a significant contribution to make to professional practice and the work of industry professionals. Thirdly, while there are limitations to such scientific method and inquiry, it should not lead to this component of criminology being discarded. Fourthly, there is a need for contemporary research in the area of scientific method and inquiry and its application to criminological contexts, including that of police practice. Finally, by engaging in scientific method and inquiry that is evidence based, a chasm between the field of study and the practice associated with criminology can be addressed. Originality/value This paper addresses the gap between criminology as a field of study and as a practice by reengaging with scientific method and inquiry, illustrating the need and value of criminology being and remaining multi- and trans-disciplinary, ensuring professions underpinned by criminology are supported in their practice.
UK parliamentary inquiry reports in forensic science - Plus ça change?

Abstract:Forensic Science provision in England and Wales underpins scientific evidence in many criminal cases. The quality of scientific investigation by scientists and the presentation of science insights has been under scrutiny and it is increasingly established that multiple significant, deep-rooted and persistent issues exist in the Forensic Science ecosystem. A thematic analysis of seven UK parliamentary inquiry reports that addressed Forensic Science and published since 2000, identified key themes and contextual factors. A matrix model that illustrates the connectivity between these themes and factors was produced. The primary issue identified was the challenge of the traditionally narrow focus of inquiries on specific elements of the Forensic Science ecosystem, rather than considering that ecosystem holistically. Through the analysis of these seven inquiry reports, it was possible to develop a matrix which provides a structured framework to critically consider the interconnections, interdependencies and connectivity between the key elements of the Forensic Science ecosystem. The matrix serves to highlight the need for an integrated approach that brings together an understanding of each component of the system and their intersections and connections to address the Forensic Science ecosystem more holistically and address the root causes of key Forensic Science challenges within the criminal justice system. It is hoped that the insights identified in this study offer a starting point for broader discussions and strategic activities across the Forensic Science community to find pathways forward to address persistent deep-seated challenges that have been identified in Forensic Science and find solutions.
Rethinking scientific communication in courts: A question of credibility

Abstract:The high value placed on forensic information in the criminal justice process is demonstrated by the fallout resulting when questions are raised as to the validity of methods used, deficiencies in the understanding of the limitations of results, or uncertainties around the professional expertise or ethical practices of the provider of the information. To effectively act as the "speaker" for the scientific evidence in court, forensic science needs to have credibility. The workshop "Rethinking scientific communication in courts" held at the Australian National University College of Law in November 2023 explored the subject of science communication in the legal context through the lens of philosophy, law, forensic service provision and meta-science, demonstrating the unique challenges placed on the field of forensic science as a scientific profession confined and defined within a non-scientific system. Stemming from the discussions at the workshop, this paper examines the notion of credibility in science, how forensic science aligns with the hallmarks of a credible scientific community and the influence this has on our understandings of scientific communication in courts.

Abstract:The Queensland DNA Inquiry, conducted by Walter Sofronoff KC, unearthed substantial deficiencies in forensic DNA practices, highlighting the need for rigorous scientific standards and improved management within forensic laboratories. The inquiry's final report made 123 recommendations to overhaul these practices, prompting the Queensland Government to pledge over $95 million towards restructuring forensic services. This paper reflects on a workshop convened by the Victorian Chapter of the Australian Academy of Forensic Sciences, which explored the implications of these recommendations for other jurisdictions. The workshop facilitated a rich dialogue among legal, scientific, and government sectors, emphasizing the necessity of a holistic approach to forensic science within the justice system. It underscored the importance of impartiality in forensic services, the need for fit-for-purpose operational frameworks, and robust quality management to uphold the integrity of forensic evidence. By examining these themes, the paper contributes to ongoing discussions about enhancing forensic science's role in ensuring justice and underscores the potential for significant reforms catalysed by the inquiry's findings.

The invisible evidence: Digital forensics as key to solving crimes in the digital age

Abstract:Digital transformation rapidly changes how we live our lives in the post pandemic world. Unfortunately, digital technology is not limited to law abiding organisations and citizens. Criminal organisations and individuals are quick to identify new opportunities with new technologies, and digital transformation is dramatically changing the character of crimes, terror, and other threats. The fast emergence of new crimes is facilitated by possibilities brought by disruptive technologies such as AI, Internet of Things, drones, and cryptocurrencies that can be disastrous tools in the hands of criminals. Consequently, our society needs far better capacity to prevent and investigate criminal acts to protect organisations and citizens. This brings an urgent need to proactively reform digital forensics to significantly increase our capability to meet the strain on society brought by crimes evolving in the digital transformation era. The future of forensic science is already here, characterized by a mix of opportunities and challenges. It is essential to make it harder to effectively use digital technologies for criminal activities, while leveraging the possibilities of digital technologies by those affected, law enforcement agencies, business and organisations. As digital technologies continue to evolve, we need to stay up to date with the latest developments to effectively investigate and prosecute crimes in the digital age. There is an increased reliance on digital evidence, and the amount of heterogeneous digital evidence in criminal cases keep increasing. The forensic science techniques thus become more sophisticated and play an increasingly important role. However, the scientific area is extremely broad, and beyond the capability of most forensic science labs to keep up with the technology forefront development speed. Besides an urgent need to bring up the subject to the political arena, examples of how we can meet the challenges are discussed such as by extending our cooperation, encourage and facilitate cooperation for training and education to handle the extremely broad and rapid development, working out methods for explaining and visualising evidence for the treatment and legal values of digital evidence in prosecution, and cooperation between product developers and crime investigators for swift innovation of digital forensics tools and methodologies for quickly emerging threats. This paper will highlight specific examples where modern digital techniques are used to solve crimes in the physical world as well as crimes committed in the digital domain and discuss how "good AI" can be used to fight "evil AI" and finally touch on the sensitive balance between the increased power of the new digital forensic tools and private integrity.

Abstract:The present commentary reviews the considerations of the famous American criminalist Paul Kirk in his seminal publication of 'The Ontogeny of Criminalistics,' written sixty years ago, regarding the status of forensic science and its fundamental principles. Professor Kirk aimed to examine forensic science as an independent scientific discipline, resulting in the identification of six key topics: 1) The need for fundamental principles; 2) the distinction between 'identification' and 'individualization;' 3) the qualifying elements of a profession; 4) the qualifying aspects of a science; 5) the need for a research-oriented basis; 6) the need for application of statistics and probability. In particular, Kirk deemed the nature of the progress made during his time as technical, practical, and transient at the cost of being fundamental, theoretical, and permanent. Predominantly, it is still the case today, with a post-effect fragmentation of forensic science into a myriad of ultra-specialized subdisciplines and applications. The lack of proper articulation of the most fundamental principles of forensic science was one of Kirk's most pressing concerns. The Sydney Declaration aimed to recapture the current fundamental (ontological and epistemological) status of forensic science, resulting in the redefinition of forensic science and its prime object of study, the trace , and in the consolidation of seven principles. The present commentary attempts to address Kirk's arguments in the Ontogeny in the context of the principles of the Declaration, with particular emphasis on the fundamental principles as well as Kirk's distinction between 'identification' and 'individualization,' which is considered critical to understanding the overall scope of forensic science.

Abstract:From 1990s, a rising number of international and hybrid criminal tribunals and since 2002, the International Criminal Court have conducted various investigations on international crimes including crime against humanity, genocide and war crimes in various countries worldwide. These judicial organs have repeatedly relied upon witness’s testimonies, information and assistance from a wide variety of sources including governments, journalists, peacekeepers, human rights researchers and intelligence specialists and few forensic scientists, wherein some of these information and reports were driven by politics. Even though such information were very benefitting “there have also been many mishaps, misunderstandings in terms of differentiating information and evidence and missed opportunities in view of finding out the truth in way that information that could potentially have been of great use to criminal cases was lost or was collected or preserved in a manner that made it unusable at trial.” In today’s era, where there is a remarkable technological development in forensic science, it is time to use forensic methods in investigation of international crimes since a number of scientific and technological advances have improved the ability to document large-scale crimes with efficiency and precision. Yet, only in recent years have international criminal courts and other fact-finding institutions begun to embrace these innovations. There is a need of forensic science in investigating and prosecuting offenders of atrocities than traditional use of testimonies which are not easy to be relied on but still some legal and administrative issues still hinder the successful use of forensic evidences in investigating and prosecuting in international criminal proceedings. Finally, the research proposed reforms by establishing specific regulations related to the admissibility of forensic evidences in international criminal proceedings and chain of custody of forensic evidences as well as harmonizing the standard operating procedure of forensic investigation to regulate scientific investigation activities including, Crime Scene Management, Evidence Collection, Examination of forensic evidences and forensic expert report writing in investigation and prosecution of international criminal proceeding and also detailed mandate to solve administrative issues.
The effect of following best practice reporting recommendations on legal and community evaluations of forensic examiners reports

Abstract:Commentators have recommended that forensic scientists' reports contain various disclosures to facilitate comprehension. However, little research has explored whether following best practice recommendations for disclosure impacts on receivers' impressions of the evidence. We examined whether forensic science reports that are more compliant with these best practice recommendations reduced overvaluing of the evidence and sensitized legal and community decision-makers to evidence quality. Across three experiments, 240 legal practitioners/trainees and 566 community decision-makers were presented with a fingerprint or footwear report that was either compliant or non-compliant with best practice recommendations. Participants were then asked to make evaluations and decisions based on the report. We found mixed effects of report compliance. Report compliance affected community participant's evaluations of the persuasiveness of the evidence but had limited impact on the judgments of legal practitioners/trainees. When presented with compliant reports, we found that community participants regarded unknown reliability evidence as less reliable and less persuasive than high reliability evidence, suggesting disclosures helped reduce overvaluing of the evidence and create sensitivity to differences in evidence quality. These results suggest compliance with reporting recommendations does affect community impressions, while only minimally influencing legal impressions of forensic science evidence. The costs and/or benefits of this outcome require further examination.

Abstract:This review shows that there is now a solid scientific evidence base for the "expert" evaluation of disputed confession cases in judicial proceedings. Real-life cases have driven the science by stimulating research into "coercive" police questioning techniques, psychological vulnerabilities to false confession, and the development and validation of psychometric tests of interrogative suggestibility and compliance. Mandatory electronic recording of police interviews has helped with identifying the situational and personal "risk factors" involved in false confessions and how these interact. It is the combination of a detailed evaluation and analysis of real-life cases, experimental work, and community (and prison/police station) studies that have greatly advanced the science over the past 40 years. In this review, the story of the development of the science during this "golden era" is told through the three established error pathways to false confessions and wrongful convictions: misclassification, coercion, and contamination. A case study of a major miscarriage of justice is used to highlight the key issues at each stage of the error pathways and it shows the continued resistance of the judiciary to admit mistakes and learn from them. Science is a powerful platform from which to educate the police and the judiciary.
