Abstract:In china's entrusted management system, without ounership, the managers don't take much responsibilities as owhers do. Therefore in the process of property right reform, it is necessary to pay actention to the establishmeat and perfection of power separation for corporate goverance, according to the partiadar back ground in state-owned entreprises. And the perfection should be acheved by reestablishment of organizational stracture, proper order of interactional relations, setting up arbitration agent, rearrangement of senior managers and redelimitation of their power, etc.

Abstract:This paper has introduced the basic connotation and characteristics of mineral resources property rights,discussed the evolution path of establishment and development of the mineral resources property management system. On this basis, this paper has analyzed the main theoretical defects and actual problems that we face in the design and operation of current mineral resources property rights system. This can be seen most clearly in the following aspects:the ownership does notreach the designated position;confusing administrative licensing with property right; the administrative power infringes the property rights; property acting is ambiguous; and the economic relationship isn't in sequence. According to the reform requirements of improving national natural resources assets management system, this paper not only puts forward the thinking framework for further deepening the reform of mineral resources property rights institutions, but also proposes some measures for strengthening top-level design of mineral resource institutions, implementing the national ownership of mineral resources,perfecting both property entrusted agency relationship and paid use system of resources.

Abstract:The purpose of the paper is to discuss the relationship between underground right and ground right of reclaimed land in the process of opencast working of coal mine. Method of property right economics was employed. The results show that:(1)there are primary and secondary relationship as well as perpetual and temporary relationship between underground right and ground right;(2)the approach to the division of the two rights is that underground right should be bought or expropriated, and ground right should be leased by enterprises under the control of state. It is concluded that safeguarding peasants' rights will be beneficial to reduce the burden of mining enterprises and form an interest community of mining enterprises and peasants.

Abstract:With the deepening of the reform in China's rural economy, the system of contracted responsibility linking remuneration to output of whose core lies in the right of management of contracted land has come into being and been perfected. This land contracting management right is a real right in nature, belonging both to the real right over the property of another, and to the usufructuary right over the property of another, or rather, a new type of usufructuary right. Land contracting management right has become one of the very important contents in the enactment of real right law. Real right law (draft) enacted by Legal Committee of SCNCPR has stipulated explicitly the appellation of agriculture land management right as land contracting management right, which is a usufructuary right in the nature. The paper attempts to make an analysis of the following existing imperfections in real right law (draft): undefined concept of land contracting management right; implicit provision of targets; the unscientific design of ways of establishment; unreasonable or inconclusive alterations; substandard withdrawal or adjustment of land contracting form and imperfect variety of termination for land contracting management right. Using tenure right and ususfructus for reference from overseas usufructuary right law and absorbing achievement in relevant domestic theoretical research, the paper systematically puts forward a comprehensive draft suggestion on clause design for land contracting management right. The main contents of the draft covers the concept of land contracting management right, its targets, its involving party, its term, establishment, change, transferring and transferred-contracting and its termination.

Abstract:The institutional reform of land property rights is confronted with various challenges from all aspects of the economic and social lives in the current stage.The original property reform theory does not agree with the current practical requirement of land use and management.How to fully reflect the political,social,organizational and juristic nature of land property right in the newly-formed concepts of land property reform and its institutional innovation,and further provide a trajectory for future reforms in China,are the main purposes of our theoretical research.It needs to combine together the theories of economics and sociology to analyze related issues.The four-level-social-analysis framework proposed by Williamson provides a good logic to link property right with resource allocation,sociology with economics.Through such a logic,a comprehensive analysis on the nature and the assessment of Chinese land property can be achieved,which can further provide a theoretical basis for the trajectory choice of the current land property reform.The analysis offers scientific references for the new-round of land property reform in China.

Abstract:Based on modern property law theories, this paper analyzes the relations between the land use right and housing ownership, revealing the restriction on the integrity of housing ownership by certain Chinese law about the term of land use right. Under the restriction, the free transfer of housing ownership will be influenced. Finally, The authors propose some suggestions on how to improve the land use right re-leasing application system and the integrity of housing ownership at the expiration of the term of land use right.

Abstract:This paper discusses the distortion of land price mechanism and the unreasonable land compensation in the exploitation of mineral resources.The paper focuses on the formation of land price and the distribution of interests under the premises of the land possession of the rural.In addition,the paper analyses the transfer of the land possession,the optimal management of environment and the allocation of the property rights of environment.The results show that the effective evaluation mechanism of land price is the basis of the healthy land market;the transfer of the land possession should fully reflect the interests of rural;the land price should include the negative external cost and local people’s subjective loss;in order to maximize the social welfare,the rural should be endowed with parts of property rights of environment and combine with the government to manage the environment.

Abstract:A clearly defined property rights is a prerequisite to value compensation of mineral resources.In this paper we proposed a theoretical framework on value compensation of mineral resources in which the property rights of mineral resource are shared by three principal parts including its owner,the individual who holds mining rights and the citizen living around the resource areas respectively.The value of mineral resource is consisted of marginal user cost (value of owner rights),marginal direct cost (value of exploration and mining rights) and external damage cost (value of the residents environmental rights).Therefore,the effective compensation to each part of the values as represented by different principal parts of property rights,is a key to sustainable development of mining industry.The theoretical framework is used to figure out the mechanism related to value compensation of mineral resources in the market-oriented countries.We found that in these countries,a major approach compensating the rights of mineral owner is to pay them mineral rents,which comprise royalties,rents and bonus.The value of exploration rights is achieved in the principle of “who invests,who benefits”.In the meanwhile,the fiscal subsidies and preferential taxation ensure value compensation of mining rights.According to the rule of “polluters pay”,the mining firm is under obligation to compensate the citizens affected by the mining for the damages.Usually,value compensation mechanism of mineral resource takes two ways,one is to bargain between the developers and surrounding communities,and the other is to stipulate a unified compensation policy and formula by the government.And the implementation of mining firms compensation obligation relies on the effective administrative monitoring and financial arrangements.Such a compensation system has been established through continuous trial in the long-term mineral development in developing countries,which has significant meaning for China although some concrete instruments may not be suitable for the context of Chinese culture and legal setting.

Abstract:The core of the reform of scientific and technical system is the property right reform of sci-tech achievements. This paper focuses on the distribution of the right of disposal and earnings of the sci-tech achieve-ments between the government, R&D institution and sci-tech personnel, and reviews the process of property right reform of sci-tech achievements. The study found that the current property right reform of sci-tech achievements has been straighten out the division of the right of disposal and earnings of the sci-tech achievements between the government and R&D institution, and endowed R&D institution with completely independent right of disposal and earnings of sci-tech achievements gradually. Put forward, the key point of the property right reform of sci-tech achievements in the future is to establish the incentive compatible and sustainable relations of the right of disposal and earnings of the sci-tech achievements between the R&D institution and sci-tech personnel.

Abstract:With a progressive establishment of the socialist market economic system and rapid development of mining economictechnology in China,current Mineral Resources Law does not seem to be able to adapt to reality.Amelioration of Mineral Resources Law is the core proposition of the transformation of mineral resources law.It is important for the sustainable use and protection of mineral resources.This study examined deficiencies in the law and difficulties in the system,and the legislative concepts.The legal relationships between the use and development of mineral resources were stated.The legal text using the inductive and deductive methods was utilized.The novelty of this study was development of a new framework of Mineral Resources Law,with ways to revise the key systems being proposed.Specifically,there are many problems of the law's structure and system,such as mining right,mineral resource tax,mineral resources planning,mineral resources reserves,environmental protection,and legal responsibility,which formed obstacles on the development and utilization of mineral resources.As for the mode of law,the amended law should account for public interests and private rights together.It should be an integrated law encompassing the content of the civil law and the administrative law.Clarifying the legal relationship between ownership and usufructuary right holder,share interests,and the legal relationship between resource development and environmental protection is the premise of modification of Mineral Resources Law.Improvement of the law's structure and system should highlight the whole process of exploitation and utilization of mineral resources,but not the mining right.As for its framework,the amended law should include general principles,mineral resources planning,mining right,mineral resources exploration,mineral resources development,mineral resource tax,land use for mining,mine environmental management and monitoring,supervision and inspection,liability,and supplementary provisions.Among these,the mining right and mineral resource tax are both more important than others.
