Abstract:In china's entrusted management system, without ounership, the managers don't take much responsibilities as owhers do. Therefore in the process of property right reform, it is necessary to pay actention to the establishmeat and perfection of power separation for corporate goverance, according to the partiadar back ground in state-owned entreprises. And the perfection should be acheved by reestablishment of organizational stracture, proper order of interactional relations, setting up arbitration agent, rearrangement of senior managers and redelimitation of their power, etc.

Abstract:This paper analyzes current land grant system in transition development from three perspectives including local financial system,role of land policy in macro-control and property law framework.The results indicate that land grant system has three functions including financial revenue,macro-control and property right,which are embedded in the framework of land public-ownership.Despite of the negative effects of land grant system,we should continue to insist on the institutional framework that municipal or county governments are responsible for state-owned land grant.Under this premise,we should strengthen its role as the foundation of land usufruct rights system with Chinese characteristic,improve and refine their financial and regulatory functions.
The Logic Conversion and Scheme Formation about the Automatic Renewal of Residential Land Use Right

Abstract:The purpose of this paper is to explore the theory and solution to the “automatic renewal” system based on the cognition about the conversion of legal logic, political logic and neo-legal logic. Methods employed are literature analysis, comparative analysis and comprehensive analysis. The results indicate that the right of automatic renewal is a statutory right enjoyed by the obligee of residential land use right. The design for automatic renewal system should be explored within the range of the statutory right. Moreover, no negotiation, agreement and payment for the renewal price should be taken as its preconditions. It is concluded that the establishment and implementation of the “automatic renewal” system must jump out of the legal logic of current transfer system of state-owned land use right, and must follow the track of political logic in order to meet real public demands. Additional estate holding taxes should be levied on the real estate which have already been automatic renewal, thus to form a new legal logic of giving rights to citizens. Such a transition canachieve a major revision and revolution on our current transfer system of state-owned land use right in an accumulative way.

Abstract:By reviewing the history after establish the country, the paper considers that there are inherent inevitabilities in the process of market mechanism and government mechanism substituting each other in land resources allocation in China's city. And the basic cause, of which the low efficiency in land resources allocation and the excessive expanding of city land scale can't be, eliminated is that both of market mechanism and government mechanism is not perfect. Therefore, the of mechanisms should be the selection in which we(d decide the degree of the importance of the two choices. The paper considers that market mechanism is primary in city land resources allocation because of the characteristic of city land. Government mechanism should be used fully in the situation of market failure.

Abstract:Character regulation of collective land ownership is the key to perfect collective land ownership institution. Based on the eight representative viewpoints summary, the author objectively analyzes the character and cames to a conclusion that the eight viewpoints has more or less defect or shortage which can not become an ideal choice to perfect or reconstruct collective land ownership. The author insistes that the essence of collective land ownership should be the solo ownership enjoyed by farmer collectivity and the law should endow it a legal status of special civil subject, which will inevitablely establish a solid fundament for improving collective land ownership institution.

Abstract:The main problem of China's responsibility system for real estate register is that the making building of the greffiers is rather laggard,and there is short of explicit responsibility and amends system,so that the register quality and public confidence for the register is low.To solve this problem,this paper puts forward that strict qualification admittance system,examination and appointment system,register responsibility system,and amends system should be implemented in China's real estate register agencies,as well as the qualification training and examination system for practitioner,promotion assessing system for four levels of greffiers,and instauration of compensation fund,register liability insurance and claim system for compensation.

Abstract:By interpreting main research aspects,contradictions and dilemmas,and future reform of rural land system,this paper makes an outlook for the follow-up studies in the process of urbanization.Results show that domestic and foreign scholars have made many achievements by deep discussions on rural land system,but there are still shortcomings.There are many contradictions in the process of urbanization such as contradiction between urbanization and arable land,contradiction between peasant migration and the fixed location of homestead,etc.The imperfections of property rights and highlights of land fragmentation phenomenon are the main dilemmas.In the future,agricultural land property system should be improved,a unified land market is supposed to be established and homestead system should be innovated to effectively safeguard farmers' rights and interests.

Abstract:The purpose of this paper is to probe into the path for the reform of China's land property and its transfer policies.Method employed in this paper is to analyze the evolutional process of land property and its transfer policies in rural and urban areas of China since 1949 through the four-level-analysis framework of Williamson.The results indicate that the evolutions of China's land property and transfer policies are not only the issues of law,but also related to cultural,governance and economic behaviors,etc.Although the evolutions inside rural and urban sectors are separated in terms of time sequence,the common logic within their path-chosen progress could provide referential experiences both ways.

Abstract:The purpose of the paper is to give some advices to land management in China by reviewing the 100 years history of the development of "equalization of land ownership" thought.Methods of documentation and comparison were employed.The 100 years history shows that the "equalization of land ownership" thought has been well developed not only in China before liberation,but also in Taiwan and Mainland China.Besides,it is becoming more and more important.The following points should be emphasized on land management:(a) to establish a more definite guidance for land management;(b) to develop and improve the "equalization of land ownership" thought,including defining the public land right,reforming the land price system and taxation policy and so on.

Abstract:The institutional reform of land property rights is confronted with various challenges from all aspects of the economic and social lives in the current stage.The original property reform theory does not agree with the current practical requirement of land use and management.How to fully reflect the political,social,organizational and juristic nature of land property right in the newly-formed concepts of land property reform and its institutional innovation,and further provide a trajectory for future reforms in China,are the main purposes of our theoretical research.It needs to combine together the theories of economics and sociology to analyze related issues.The four-level-social-analysis framework proposed by Williamson provides a good logic to link property right with resource allocation,sociology with economics.Through such a logic,a comprehensive analysis on the nature and the assessment of Chinese land property can be achieved,which can further provide a theoretical basis for the trajectory choice of the current land property reform.The analysis offers scientific references for the new-round of land property reform in China.

Abstract:There is enormous heterogeneity at the village level in the property rights that households enjoy.One of the most important messages to take away from this essay is that a solid empirical basis does not currently exist for making an assessment of the impact of the land system on efficiency,equity,and overall development of China's rural sector.Over the past two decades, reallocations by village leaders may have facilitated access to land and the food it produces for a ma- jority of China's households and overcome some of the imperfections in land rental markets. Nonetheless,in many parts of China there are significant and growing costs of the current property right regime in terms of short and long-run productivity that are not being offset by lower income inequality.

Abstract:Based on modern property law theories, this paper analyzes the relations between the land use right and housing ownership, revealing the restriction on the integrity of housing ownership by certain Chinese law about the term of land use right. Under the restriction, the free transfer of housing ownership will be influenced. Abstract:China has formed a land survey flow that is based on land classification has the core of internal judgement and external investigation,which efficiently guided the land survey work in China.As economy goes on,however,a higher precision is required for land survey so that the traditional method can not meet the needs.This paper,based on the cores of land survey system,optimizes the land classification system,establishes a quantifying and standardization relation between land attributes and land utilization,which reverts the land survey process to land attributes survey and record process,and presents some suggestions improving the existing land survey system.

Abstract:In China's land market, the government plays multiple roles in land transaction as the land owner, the regulator and a purchaser. Conflicts of interests among different roles lead to the failure of government intervention in the land market and many serious problems, such as substantial reduction in cultivated land, extensive use of construction land, and disorder of land market. It is crucial to identify the appropriate functions of the government in order to enhance its regulatory role in the land market and to keep prosperity of the land market. This paper discussed the governmental behaviors in land market, and analyzed the main causes of abnormal behaviors of the government. Based on these analyses, this study specified the appropriate functions of the central government and the, local government respectively, and proposed some approaches to promote the transformation of the government functions.

Abstract:At present, the long time for approval of the transfer of industrial land, low allocation efficiency and serious waste of land resources are still very serious, restricting the high-quality development of my country’s economy. This paper adopts a single-case research method, based on the analysis of the specific practices of the optimization and innovative application of industrial land procedures in the Deqing “standard land” reform, summarizes the optimization procedures for industrial land transfer, and finally draws the following conclusions: (1) Improving the market-based allocation of factors is an inevitable trend and effective choice for improving the efficiency of resource allocation; (2) Improving the construction of the system is an effective legal guarantee for the transfer of industrial land; (3) The coordinated work mechanism of various government departments and the formulation of standards and indicators before transfer are Land transfer provides standardized guidance; (4) Optimizing the approval process and shortening the approval time will increase corporate satisfaction and create a good business environment for the company; (5) The whole process supervision and joint reward and punishment mechanism ensure the effective implementation of relevant regulations, which is a reform Provide guarantee for the continuity of the process. It is hoped that the research in this article can provide some useful enlightenment for solving the dilemma of industrial land transfer.
