Abstract:Neurotechnology has traditionally been central to the diagnosis and treatment of neurological disorders. While these devices have initially been utilized in clinical and research settings, recent advancements in neurotechnology have yielded devices that are more portable, user-friendly, and less expensive. These improvements allow laypeople to monitor their brain waves and interface their brains with external devices. Such improvements have led to the rise of wearable neurotechnology that is marketed to the consumer. While many of the consumer devices are marketed for innocuous applications, such as use in video games, there is potential for them to be repurposed for medical use. How do we manage neurotechnologies that skirt the line between medical and consumer applications and what can be done to ensure consumer safety? Here, we characterize neurotechnology based on medical and consumer applications and summarize currently marketed uses of consumer-grade wearable headsets. We lay out concerns that may arise due to the similar claims associated with both medical and consumer devices, the possibility of consumer devices being repurposed for medical uses, and the potential for medical uses of neurotechnology to influence commercial markets related to employment and self-enhancement.

Abstract:Abstract As we approach an era of potentially widespread consumer neurotechnology, scholars and organizations worldwide have started to raise concerns about the data privacy issues these devices will present. Notably absent in these discussions is empirical evidence about how the public perceives that same information. This article presents the results of a nationwide survey on public perceptions of brain data, to inform discussions of law and policy regarding brain data governance. The survey reveals that the public may perceive certain brain data as less sensitive than other ‘private’ information, like social security numbers, but more sensitive than some ‘public’ information, like media preferences. The findings also reveal that not all inferences about mental experiences may be perceived as equally sensitive, and perhaps not all data should be treated alike in ethical and policy discussions. An enhanced understanding of public perceptions of brain data could advance the development of ethical and legal norms concerning consumer neurotechnology.

Abstract:Human brain activity collected in the form of Electroencephalography (EEG), even with low number of sensors, is an extremely rich signal. Traces collected from multiple channels and with high sampling rates capture many important aspects of participants' brain activity and can be used as a unique personal identifier. The motivation for sharing EEG signals is significant, as a mean to understand the relation between brain activity and well-being, or for communication with medical services. As the equipment for such data collection becomes more available and widely used, the opportunities for using the data are growing; at the same time however inherent privacy risks are mounting. The same raw EEG signal can be used for example to diagnose mental diseases, find traces of epilepsy, and decode personality traits. The current practice of the informed consent of the participants for the use of the data either prevents reuse of the raw signal or does not truly respect participants' right to privacy by reusing the same raw data for purposes much different than originally consented to. Here we propose an integration of a personal neuroinformatics system, Smartphone Brain Scanner, with a general privacy framework openPDS. We show how raw high-dimensionality data can be collected on a mobile device, uploaded to a server, and subsequently operated on and accessed by applications or researchers, without disclosing the raw signal. Those extracted features of the raw signal, called answers, are of significantly lower-dimensionality, and provide the full utility of the data in given context, without the risk of disclosing sensitive raw signal. Such architecture significantly mitigates a very serious privacy risk related to raw EEG recordings floating around and being used and reused for various purposes.

Abstract:We review how existing trends are relevant to the discussion of brain-computer interfaces and the data they would generate. Then, we posit how the commerce of neural data, dubbed Neurocapitalism, could be impacted by the maturation of brain-computer interface technology. We explore how this could pose fundamental changes to our way of interacting, as well as our sense of autonomy and identity. Because of the power inherent in the technology, and its potentially ruinous abuses, action must be taken before the appearance of the technology, and not come as a reaction to it. The widespread adoption of brain-computer interface technology will certainly change our way of life. Whether it is changed for the better or worse, depends on how well we prepare for its arrival.

Abstract:Abstract Brain reading technologies are rapidly being developed in a number of neuroscience fields. These technologies can record, process, and decode neural signals. This has been described as ‘mind reading technology’ in some instances, especially in popular media. Should the public at large, be concerned about this kind of technology? Can it really read minds? Concerns about mind-reading might include the thought that, in having one’s mind open to view, the possibility for free deliberation, and for self-conception, are eroded where one isn’t at liberty to privately mull things over. Themes including privacy, cognitive liberty, and self-conception and expression appear to be areas of vital ethical concern. Overall, this article explores whether brain reading technologies are really mind reading technologies. If they are, ethical ways to deal with them must be developed. If they are not, researchers and technology developers need to find ways to describe them more accurately, in order to dispel unwarranted concerns and address appropriately those that are warranted.

Advocating for neurodata privacy and neurotechnology regulation

Abstract:The ability to record and alter brain activity by using implantable and nonimplantable neural devices, while poised to have significant scientific and clinical benefits, also raises complex ethical concerns. In this Perspective, we raise awareness of the ability of artificial intelligence algorithms and data-aggregation tools to decode and analyze data containing highly sensitive information, jeopardizing personal neuroprivacy. Voids in existing regulatory frameworks, in fact, allow unrestricted decoding and commerce of neurodata. We advocate for the implementation of proposed ethical and human rights guidelines, alongside technical options such as data encryption, differential privacy and federated learning to ensure the protection of neurodata privacy. We further encourage regulatory bodies to consider taking a position of responsibility by categorizing all brain-derived data as sensitive health data and apply existing medical regulations to all data gathered via pre-registered neural devices. Lastly, we propose that a technocratic oath may instill a deontology for neurotechnology practitioners akin to what the Hippocratic oath represents in medicine. A conscientious societal position that thoroughly rejects the misuse of neurodata would provide the moral compass for the future development of the neurotechnology field.

Abstract:The growth of wearable technology has enabled the collection of even more personalized information on individuals. New health-related devices marketed to consumers collect health information that might not fall under the traditional category of Protected Health Information, and thus, HIPAA protections do not fully apply. Meaning, commercial wearable health devices do not fall under FDA oversight, and data not paired with a doctor–patient relationship do not fall under HIPAA privacy protection; thus, much of the gathered health-related metrics are left without regulation and open to be sold to data brokers. As such, these data can be leveraged by health insurance, law enforcement, and employers, to name a few. This manuscript explores the loopholes in current regulations and suggests a framework that categorizes wearable data and addresses challenges in data transfer. Furthermore, taking a user perspective, the suggested framework offers solutions that aim to guide users and policymakers in navigating privacy issues in wearable technology.

Abstract:The non-certified e-health segment is gaining momentum around the world. The trend was significantly advanced by the introduction of several sports and medical measuring devices in the form of smartwatches. There has also been a resurgence of other medical Internet of Things class devices. Several devices connect to a product or platform-specific online (Cloud) service for storing, exchanging, analysing and monitoring the customer-collected e-health data. The devices and the data collected allow the consumers to continuously track their sports achievements, movement, vital signs, essential health state, etc. while receiving some recommendations and warnings based on the measurements. As some recent examples showed, the data collected can contain sensitive information that could be used creatively and unexpectedly, either positively or negatively. Unlike professional healthcare systems, which should comply with the strict GDPR, there is much less pressure on commercial entities in the consumer technological sector to provide more privacy options for data collection through their devices. In this work, we analyse the data typically collected by consumer e-health devices and assess possible risks that commercial entities present to their customer in unauthorised use of the data for their commercial advances. They use obscure legal language to prevent users from consenting to various data usages while providing primary data storing functionality. Moreover, there is a significant risk of using the data for repression in some contexts. We analyse the sector's current state and provide some recommendations to consumers and legislation to improve consumer rights to privacy while enhancing their health. At the same time, we recommend how the professional health sector should benefit from the collected data to improve their operations.

Abstract:Wearable devices that measure and record physiological signals are now becoming widely available to the general public with ever-increasing affordability and signal quality. The data from these devices introduce serious ethical challenges that remain largely unaddressed. Users do not always understand how these data can be leveraged to reveal private information about them and developers of these devices may not fully grasp how physiological data collected today could be used in the future for completely different purposes. We discuss the potential for wearable devices, initially designed to help users improve their well-being or enhance the experience of some digital application, to be appropriated in ways that extend far beyond their original intended purpose. We identify how the currently available technology can be misused, discuss how pairing physiological data with non-physiological data can radically expand the predictive capacity of physiological wearables, and explore the implications of these expanded capacities for a variety of stakeholders.

Abstract:Background: States and families are facing growing challenges provide adequate care for older persons. Smart home health technologies (SHHTs) in the forms of sensor or robotic devices have been discussed as technical solutions for caregiving. Ethical and social concerns are raised with the use of such technologies for caregiving purposes, a particularly prominent one being privacy. This paper contributes to the literature by distinguishing privacy concerns into both the type of technologies and conceptual dimensions. Methods: Data for this paper stem from sixty semi-structured interviews with older persons, informal, and formal caregivers living in the German-speaking regions of Switzerland. All information related to privacy, that were initially inductively coded, were thematically sorted into four dimensions of privacy (physical, psychological, social, and informational) and by the type of technologies studied. Results: Participants were especially concerned about privacy intrusions from smart wearables and ambient sensors than robotic technologies, which may be due to the relative lack of familiarity with the latter. Informational privacy was evident in the context of data collection capacities and potential for misuses of data. The installation and implementation of both visual and ambient sensors induced discomfort to their senses of physical space. Alerts of smart wearables and obtrusive sightings of SHHTs garnered worries related to stigmatization and manipulation, indicating intrusions into end-users' psychological privacy. Little discussions of social dimensions of privacy were evident in the data, even toward robotic technologies for their functions to promote social interactions for older persons. Conclusions: This paper is one of the first that use the stratification approach on empirical data to highlight the multi-faceted privacy concerns when technologies may be implemented in elder care. Our paper could thus supports potential end-users in deciding which technologies to use and how to balance different privacy concerns against other values that they may hold important.

Abstract:With the joint advancement in areas such as pervasive neural data sensing, neural computing, neuromodulation and artificial intelligence, neural interface has become a promising technology facilitating both the closed-loop neurorehabilitation for neurologically impaired patients and the intelligent man-machine interactions for general application purposes. However, although neural interface has been widely studied, few previous studies focused on the cybersecurity issues in related applications. In this survey, we systematically investigated possible cybersecurity risks in neural interfaces, together with potential solutions to these problems. Importantly, our survey considers interfacing techniques on both central nervous systems (i.e., brain-computer interfaces) and peripheral nervous systems (i.e., general neural interfaces), covering diverse neural modalities such as electroencephalography, electromyography and more. Moreover, our survey is organized on three different levels: (1) the data level, which mainly focuses on the privacy leakage issue via attacking and analyzing neural database of users; (2) the permission level, which mainly focuses on the prospects and risks to directly use real time neural signals as biometrics for continuous and unobtrusive user identity verification; and (3) the model level, which mainly focuses on adversarial attacks and defenses on both the forward neural decoding models (e.g. via machine learning) and the backward feedback implementation models (e.g. via neuromodulation and stimulation). This is the first study to systematically investigate cybersecurity risks and possible solutions in neural interfaces which covers both central and peripheral nervous systems, and considers multiple different levels to provide a complete picture of this issue.

Abstract:Sharing data is a scientific imperative that accelerates scientific discoveries, reinforces open science inquiry, and allows for efficient use of public investment and research resources. Considering these benefits, data sharing has been widely promoted in diverse fields and neuroscience has been no exception to this movement. For all its promise, however, the sharing of human neuroimaging data raises critical ethical and legal issues, such as data privacy. Recently, the heightened risks to data privacy posed by the rapid advances in artificial intelligence and machine learning techniques have made data sharing more challenging; the regulatory landscape around data sharing has also been evolving rapidly. Here we present an in-depth ethical and regulatory analysis that examines how neuroimaging data are currently shared against the backdrop of the relevant regulations and policies in the United States and how advanced software tools and algorithms might undermine subjects' privacy in neuroimaging data sharing. The implications of these novel technological threats to privacy in neuroimaging data sharing practices and policies will also be discussed. We then conclude with a proposal for a legal prohibition against malicious use of neuroscience data as a regulatory mechanism to address privacy risks associated with the data while maximizing the benefits of data sharing and open science practice in the field of neuroscience.

Privacy Barriers in Health Monitoring: Scoping Review

Abstract:Background: Health monitoring technologies help patients and older adults live better and stay longer in their own homes. However, there are many factors influencing their adoption of these technologies. Privacy is one of them. Objective: The aim of this study was to provide an overview of the privacy barriers in health monitoring from current research, analyze the factors that influence patients to adopt assisted living technologies, provide a social psychological explanation, and propose suggestions for mitigating these barriers in future research. Methods: A scoping review was conducted, and web-based literature databases were searched for published studies to explore the available research on privacy barriers in a health monitoring environment. Results: In total, 65 articles met the inclusion criteria and were selected and analyzed. Contradictory findings and results were found in some of the included articles. We analyzed the contradictory findings and provided possible explanations for current barriers, such as demographic differences, information asymmetry, researchers' conceptual confusion, inducible experiment design and its psychological impacts on participants, researchers' confirmation bias, and a lack of distinction among different user roles. We found that few exploratory studies have been conducted so far to collect privacy-related legal norms in a health monitoring environment. Four research questions related to privacy barriers were raised, and an attempt was made to provide answers. Conclusions: This review highlights the problems of some research, summarizes patients' privacy concerns and legal concerns from the studies conducted, and lists the factors that should be considered when gathering and analyzing people's privacy attitudes.

Abstract:Background: Artificial intelligence (AI)-based computer perception technologies (e.g., digital phenotyping and affective computing) promise to transform clinical approaches to personalized care in psychiatry and beyond by offering more objective measures of emotional states and behavior, enabling precision treatment, diagnosis, and symptom monitoring. At the same time, passive and continuous nature by which they often collect data from patients in non-clinical settings raises ethical issues related to privacy and self-determination. Little is known about how such concerns may be exacerbated by the integration of neural data, as parallel advances in computer perception, AI, and neurotechnology enable new insights into subjective states. Here, we present findings from a multi-site NCATS-funded study of ethical considerations for translating computer perception into clinical care and contextualize them within the neuroethics and neurorights literatures. Methods: We conducted qualitative interviews with patients ( n = 20), caregivers ( n = 20), clinicians ( n = 12), developers ( n = 12), and clinician developers ( n = 2) regarding their perspective toward using PC in clinical care. Transcripts were analyzed in MAXQDA using Thematic Content Analysis. Results: Stakeholder groups voiced concerns related to (1) perceived invasiveness of passive and continuous data collection in private settings; (2) data protection and security and the potential for negative downstream/future impacts on patients of unintended disclosure; and (3) ethical issues related to patients' limited versus hyper awareness of passive and continuous data collection and monitoring. Clinicians and developers highlighted that these concerns may be exacerbated by the integration of neural data with other computer perception data. Discussion: Our findings suggest that the integration of neurotechnologies with existing computer perception technologies raises novel concerns around dignity-related and other harms (e.g., stigma, discrimination) that stem from data security threats and the growing potential for reidentification of sensitive data. Further, our findings suggest that patients' awareness and preoccupation with feeling monitored via computer sensors ranges from hypo- to hyper-awareness, with either extreme accompanied by ethical concerns (consent vs. anxiety and preoccupation). These results highlight the need for systematic research into how best to implement these technologies into clinical care in ways that reduce disruption, maximize patient benefits, and mitigate long-term risks associated with the passive collection of sensitive emotional, behavioral and neural data.

Breaking the Data Value-Privacy Paradox in Mobile Mental Health Systems Through User-Centered Privacy Protection: A Web-Based Survey Study

Abstract:Background Mobile mental health systems (MMHS) have been increasingly developed and deployed in support of monitoring, management, and intervention with regard to patients with mental disorders. However, many of these systems rely on patient data collected by smartphones or other wearable devices to infer patients’ mental status, which raises privacy concerns. Such a value-privacy paradox poses significant challenges to patients’ adoption and use of MMHS; yet, there has been limited understanding of it. Objective To address the significant literature gap, this research aims to investigate both the antecedents of patients’ privacy concerns and the effects of privacy concerns on their continuous usage intention with regard to MMHS. Methods Using a web-based survey, this research collected data from 170 participants with MMHS experience recruited from online mental health communities and a university community. The data analyses used both repeated analysis of variance and partial least squares regression. Results The results showed that data type (P=.003), data stage (P<.001), privacy victimization experience (P=.01), and privacy awareness (P=.08) have positive effects on privacy concerns. Specifically, users report higher privacy concerns for social interaction data (P=.007) and self-reported data (P=.001) than for biometrics data; privacy concerns are higher for data transmission (P=.01) and data sharing (P<.001) than for data collection. Our results also reveal that privacy concerns have an effect on attitude toward privacy protection (P=.001), which in turn affects continuous usage intention with regard to MMHS. Conclusions This study contributes to the literature by deepening our understanding of the data value-privacy paradox in MMHS research. The findings offer practical guidelines for breaking the paradox through the design of user-centered and privacy-preserving MMHS.

Abstract:A brain-computer interface (BCI) establishes a direct communication pathway between the human brain and a computer. It has been widely used in medical diagnosis, rehabilitation, education, entertainment, and so on. Most research so far focuses on making BCIs more accurate and reliable, but much less attention has been paid to their privacy. Developing a commercial BCI system usually requires close collaborations among multiple organizations, e.g., hospitals, universities, and/or companies. Input data in BCIs, e.g., electroencephalogram (EEG), contain rich privacy information, and the developed machine learning model is usually proprietary. Data and model transmission among different parties may incur significant privacy threats, and hence, privacy protection in BCIs must be considered. Unfortunately, there does not exist any contemporary and comprehensive review on privacy-preserving BCIs. This article fills this gap, by describing potential privacy threats and protection strategies in BCIs. It also points out several challenges and future research directions in developing privacy-preserving BCIs.

Abstract:Background The UN's High Commissioner's request for a moratorium on the use and adoption of specific Artificial Intelligence (AI) systems that pose serious risk to human rights, this commentary explores the current environment and future implications of using third-party wearable technologies in research for participants’ data privacy and data security. While wearables have been identified as tools for improving users’ physical and mental health and wellbeing by providing users with more personalized data and tailored interventions, the use of this technology does not come without concern. Objective Primarily, as researchers, we are concerned with enmeshment of corporate and research interests and what this can mean for participant data. Methods By drawing on specific sections of the UN Report ‘The right to privacy in the digital age’, we discuss the conflicts between corporate and research agendas and point out the current and future implications of the involvement of third-party companies for participant data privacy, data security and data usage. Finally, we offer suggestions for researchers and third-party wearable developers for conducting ethical and transparent research with wearable tech. Conclusion We propose that this commentary be used as a foothold for further discussions about the ethical implications of using third-party wearable tech in research.

Abstract:The Brain-Computer Interface (BCI) is a rapidly evolving technology set to revolutionize our perception of the Internet of Things (IoT). BCI facilitates direct communication between the brain and external devices, enabling the control or interaction of devices without physical intervention. BCI technology is becoming more sophisticated, allowing third-party software embedded in emerging technologies such as Virtual Reality (VR), Augmented Reality (AR), and Mixed Reality (MR) to access sensors that read brain activity. These can be grouped under the umbrella term Extended Reality (XR). While BCI technology is disrupting the way data is collected, interpreted, and utilized within IoT networks, it is important to consider the potential privacy and security threats that it poses. Previous and not-so-recent cybersecurity research only scratched the surface in terms of security and privacy aspects of the then-emerging neural and brain-connecting technologies. However, recent advances in reconstructing language, music tracks, and imagery solely based on decoding neural signals pose a significant risk of mental privacy invasion and cybersecurity abuse. In this paper, we present an analysis of the potential threats posed by the integration of BCI with VR, AR, and MR. We analyze the involvement of major technological players in shaping BCI and XR advancements, examining the potential for these technologies to create detailed user profiles and reshape the monetization of user data in the ever-more-aggressive data-driven economy. We also outline a position view on the cybersecurity aspects that are not related to privacy and profiling per se, for example, cybersecurity attacks on the brain (e.g., ``brain rewriting'' attacks) facilitated by potentially vulnerable XR-BCI devices and software. The paper concludes by emphasizing the need for further research on the privacy and security implications of XR-BCI integration and inviting deeper exploration of the topic beyond theoretical papers and toward a more applied experimental setup.

Abstract:With the close integration of science and technology and health, the broad application prospects of healthy interconnection bring revolutionary changes to health services. Health and medical wearable devices can collect real-time data related to user health, such as user behavior, mood, and sleep, which have great commercial and social value. Healthcare wearable devices, as important network nodes for health interconnection, connect patients and hospitals with the Internet of Things and sensing technology to form a huge medical network. As wearable devices can also collect user data regardless of time and place, uploading data to the cloud can easily make the wearable device’s system vulnerable to attacks and data leakage. Defects in technology can sometimes cause problems such as lack of control over data flow links in wearable devices, and data and privacy leaks are more likely to occur. In this regard, how to ensure the data security and user privacy while using healthcare wearable devices to collect data is a problem worth studying. This article investigates data from healthcare wearable devices, from technical, management, and legal aspects, and studies data security and privacy protection issues for healthcare wearable devices to protect data security and user privacy and promote the sustainable development of the healthcare wearable device industry and the scientific use of data collection.
