Abstract:Data mining reproduces colonialism, and Indigenous voices are being left out of the development of technology that relies on data, such as artificial intelligence. This research stresses the need for the inclusion of Indigenous Data Sovereignty and centers on the importance of Indigenous rights over their own data. Inclusion is necessary in order to integrate Indigenous knowledge into the design, development, and implementation of data-reliant technology. To support this hypothesis and address the problem, the CARE Principles for Indigenous Data Governance (Collective Benefit, Authority to Control, Responsibility, and Ethics) are applied. We cover how the colonial practices of data mining do not align with Indigenous convictions. The included case studies highlight connections to Indigenous rights in relation to the protection of data and environmental ecosystems, thus establishing how data governance can serve both the people and the Earth. By applying the CARE Principles to the issues that arise from data mining and neocolonialism, our goal is to provide a framework that can be used in technological development. The theory is that this could reflect outwards to promote data sovereignty generally and create new relationships between people and data that are ethical as opposed to driven by speed and profit.

Abstract:Internationally, governments and scientists are bound by legal and treaty rights when working with Indigenous nations. These rights include the right of Indigenous people to control the conduct of science with Indigenous nations. Unfortunately, in some cases, individual scientists and scientific teams working with biological and genetic data collected from Indigenous people have not respected these international rights. Here, we argue that the scientific community should understand and acknowledge the historical harms experienced by Indigenous people under the veil of scientific progress (truth) and implement existing standards for ethical conduct of research and sovereign control of data collected within Indigenous communities (reconciliation). Specifically, we outline the rationale for why scientists, scientific journals and research integrity and institutional review boards/ethics committees should adopt, and be held accountable for upholding, current international standards of Indigenous data sovereignty and ethical use of Indigenous biological samples.

Abstract:Indigenous nations and communities in the United States have rights as sovereign governments to exercise control and ownership over all data and information generated by or from the tribes, tribal members, or tribal resources. Indigenous nations exercise these rights through data ownership policies established in response to unethical research practices in research involving Indigenous communities. Most universities in the U.S. have "openness in research" policies to ensure academic freedom to publish freely, exercised by retaining university control of data. Here, we describe our study of cultural ecosystem services in the St. Louis River estuary region (Nagaajiwanaang in the language Ojibwemowin) in Duluth, Minnesota, and Superior, Wisconsin, U.S., an area that includes portions of the 1854 and 1842 Ceded Territories and reservation lands of a local band of Ojibwe (hereafter referred to as "the Band"). In this university-led, Band-supported study, both the university and the Band sought ownership of data collected based on their respective policies, resulting in a research delay of nearly a year. We found that open research policies that do not consider Indigenous sovereignty can hamper collaboration between university researchers and tribal nations, even when there is broad agreement on research goals and objectives. University open research policies that do not explicitly address Indigenous sovereignty fall short of the open research principles they intend to support and should be revised. Formal adoption of principles for ethical research with sovereign tribal governments by universities is needed to improve coordination and trust among university and tribal researchers and members.

Abstract:Concerns about secondary use of data and limited opportunities for benefit-sharing have focused attention on the tension that Indigenous communities feel between (1) protecting Indigenous rights and interests in Indigenous data (including traditional knowledges) and (2) supporting open data, machine learning, broad data sharing, and big data initiatives. The International Indigenous Data Sovereignty Interest Group (within the Research Data Alliance) is a network of nation-state based Indigenous data sovereignty networks and individuals that developed the 'CARE Principles for Indigenous Data Governance' (Collective Benefit, Authority to Control, Responsibility, and Ethics) in consultation with Indigenous Peoples, scholars, non-profit organizations, and governments. The CARE Principles are people– and purpose-oriented, reflecting the crucial role of data in advancing innovation, governance, and self-determination among Indigenous Peoples. The Principles complement the existing data-centric approach represented in the 'FAIR Guiding Principles for scientific data management and stewardship' (Findable, Accessible, Interoperable, Reusable). The CARE Principles build upon earlier work by the Te Mana Raraunga Maori Data Sovereignty Network, US Indigenous Data Sovereignty Network, Maiam nayri Wingara Aboriginal and Torres Strait Islander Data Sovereignty Collective, and numerous Indigenous Peoples, nations, and communities. The goal is that stewards and other users of Indigenous data will 'Be FAIR and CARE.' Abstract:This research examines the impact of digital neo-colonialism on the Global South and encourages the development of legal and economic incentives to protect Indigenous cultures globally. Data governance is discussed in an evolutionary context while focusing on data sharing and data mining. Case studies that exemplify the need to steer global data law towards protecting the earth, while addressing issues of data access, privacy, rights, and colonialism in the global South are explored. The case studies highlight connections to indigenous people's rights, in regard to the protection of environmental ecosystems, thus establishing how data law can serve the earth from an autochthonous lens. This framework examines histories shaped by colonialism and suggests how data governance could be used to create healthier balances of power.

Abstract:The Sociological Review, Ahead of Print. Responding to the current data monopoly by Big Tech firms, there is increasing interest in the potential for collective ownership of data in a 'data commons'. This article aims to introduce the topic to non-specialists, highlight the broader social significance of data ownership, and reframe the data commons as a problem of social interaction rather than regulatory design. It critically engages with existing work on the data commons to suggest alternative directions for research which draw on humanities and interpretive social science approaches. It recommends the addition of research that (1) includes knowledge from non-Western legal traditions to overcome objections to the possibility of data ownership, (2) studies existing social relations of data governance rather than seeks to design ideal regulations, (3) prioritises a focus on the social and communicative practices involved in a data commons rather than seeing it as a solution to a specific problem, and (4) analyses the meaning-making practices of people as they engage in their own data governance, and the evolving narrative around what constitutes a data commons. The purpose of this alternative research agenda is to provide discursive scaffolding for the ongoing regulatory work on the data commons, while ensuring that its full potential remains imaginatively open.

Abstract:There is increasing potential to improve the research and reporting on the health and wellbeing of Indigenous and Tribal peoples through the collection and (re)use of population-level data. As the data economy grows and the value of data increases, the optimization of data pertaining to Indigenous peoples requires governance that defines who makes decisions on behalf of whom and how these data can and should be used. An international a priori PROSPERO (#CRD42020170033) systematic review was undertaken to examine the health research literature to (1) identify, describe, and synthesize definitions and principles; (2) identify and describe data governance frameworks; and (3) identify, describe, and synthesize processes, policies and practices used in Indigenous Data Governance (ID-GOV). Sixty-eight articles were included in the review that found five components that require consideration in the governance of health research data pertaining to Indigenous people. This included (1) Indigenous governance; (2) institutional ethics; (3) socio-political dynamics; (4) data management and data stewardship; and (5) overarching influences. This review provides the first systematic international review of ID-GOV that could potentially be used in a range of governance strategies moving forward in health research.

Abstract:Many Indigenous people have a deep mistrust of research, with some describing research as one of the "dirtiest" words in Indigenous language. The histories and experiences behind such mistrust are long and painful. Given what has been perceived as Indigenous objectification at the hands of largely Anglo-European others for research from which they fail to benefit, many communities now refuse research unless it is undertaken under certain, Indigenous-defined circumstances. Such refusal is a move away from others purposes and a move towards autonomy and self-determination. For some, this is a statement of sovereignty and it applies to all areas of endeavour, including the new frontiers of research and the structures that support them, such as datification of knowledge. This article examines data sovereignty from the perspective of Indigenous peoples. While data sovereignty has become a ubiquitous concern, Indigenous data sovereignty arises from contexts specific to Indigenous peoples. The focus of this article is to provide a brief overview of recent data sovereignty developments, along with the context that lies behind these activities. Through this examination, implications for trust in scholarly communications will be discussed.

Abstract:Concerns about the ethical use of data, privacy, and data harms are front of mind in many jurisdictions as regulators move to impose tighter controls on data privacy and protection, and the use of artificial intelligence (AI). Although efforts to hold corporations to account for their deployment of data and data-driven technologies have been largely welcomed by academics and civil society, there is a growing recognition of the limits to individual data rights , given the capacity of tech giants to link, surveil, target, and make inferences about groups. Questions about whether collective data rights exist, and how they can be recognized and protected , have provided fertile ground for researchers but have yet to penetrate the broader discourse on data rights and regulation.

The wisdom of claiming ownership of human genomic data: A cautionary tale for research institutions

Abstract:This article considers the practical question of how research institutions should best structure their legal relationship with the human genomic data that they generate. The analysis, based on South African law, is framed by the legal position that although a research institution that generates human genomic data is not automatically the owner thereof, it is well positioned to claim ownership of newly generated data instances. Given that the research institution exerts effort to generate the data, it can be argued that it has a moral right to claim ownership of such data. Combined with the fact that it has an interest in having comprehensive rights in such data, it appears that the prudent policy for research institutions is to claim ownership of the human genomic data instances that they generate. This policy is tested against two opposing policy positions. The first opposing policy position is that research participants should own the data that relate to them. However, in light of data protection legislation that already provides extensive protections to research participants, bestowing data ownership on research participants would offer little benefit to such individuals, while leading to significant practical problems for research institutions. The second opposing policy position is that the concept of ownership should be abandoned in favour of data custodianship. This opposing position is problematic, as avoiding reference to ownership is a denial of legal reality and hence not a useful policy. Also, avoiding reference to ownership will leave research institutions with limited legal remedies in the event of appropriation of data by third parties. Accordingly, it is concluded that the wisest policy for research institutions is indeed to explicitly claim ownership of the human genomic data instances that they generate.

Abstract:The international context of Indigenous mental health and wellbeing has been shaped by a number of key works recognizing Indigenous rights. Despite international recognitions, the mental health and wellness of Indigenous Peoples continues to be negatively affected by policies that ignore Indigenous rights, that frame colonization as historical rather than ongoing, or that minimize the impact of assimilation. Research institutions have a responsibility to conduct ethical research; yet institutional guidelines, principles, and policies often serve Indigenous Peoples poorly by enveloping them into Western knowledge production. To counter epistemological domination, Indigenous Peoples assert their research sovereignty, which for the purposes of this paper we define as autonomous control over research conducted on Indigenous territory or involving Indigenous Peoples. Indigenous sovereignty might also be applied to research impacting the landscape and the web of animal and spiritual lives evoked in a phrase such as "all my relations." This narrative review of material developed in the Canadian context examines the alignment with similar work in the international context to offer suggestions and a practice-based implementation tool to support Indigenous sovereignty in research related to wellness, mental health, and substance use. The compilation of key guidelines and principles in this article is only a start; addressing deeper issues requires a research paradigm shift.

Building a Culture of Data Sharing: Policy Design and Implementation for Research Data Management in Development Research

Abstract:A pilot project worked with seven existing projects funded by the International Development Research Center of Canada (IDRC) to investigate the implementation of data management and sharing requirements within development research projects. The seven projects, which were selected to achieve a diversity of project types, locations, host institutions and subject areas, demonstrated a broad range of existing capacities to work with data and access to technical expertise and infrastructures. The pilot project provided an introduction to data management and sharing concepts, helped projects develop a Data Management Plan, and then observed the implementation of that plan. In examining the uptake of Data Management and Sharing practice amongst these seven groups the project came to question the underlying goals of funders in introducing data management and sharing requirements. It was established that the ultimate goal was a change in culture amongst grantees. The project therefore looked for evidence of how funder interventions might promote or hinder such cultural change. The project had two core findings. First that the shift from an aim of changing behaviour, to changing culture, has both subtle and profound implications for policy design and implementation. A particular finding is that the single point of contact that many data management and sharing policies create where a Data Management Plan is required at grant submission but then not further utilised is at best neutral and likely counter productive in supporting change in researcher culture. As expected, there are significant bottlenecks within research institutions and for grantees in effectively sharing data including a lack of resources and expertise. However, a core finding is that many of the bottlenecks for change relate to structural issues at the funder level. Specifically, the expectation that policy initiatives are implemented, monitored, and evaluated by Program Officers who are the main point of contact for projects. The single most productive act to enhance policy implementation may be to empower and support Program Officers. This could be achieved through training and support of individual POs, through the creation of a group of internal experts who can support others, or via provision of external support, for instance by expanding the services provided by the pilot project into an ongoing support mechanism for both internal staff and grantees. Other significant findings include: the importance of language barriers and the way in which assumptions of English language in materials, resources, services and systems permeate the entire system; that data infrastructures are poorly served by current funding arrangements and tools, particularly where they are obliged to seek continuing funding through project grants. There are also fundamental questions raised by the status of digital objects as "data". The concept of data is part of a western scientific discourse which may be both incompatible with other cultures, particularly indigenous knowledge systems. More importantly that discourse may be incompatible with values-based approaches that seek to respect indigenous knowledge through a commitment to retaining context. With the possible exception of the last finding, none of these issues are exclusive to development research. The Development Research context surfaces them more strongly through its greater diversity of goals and contexts. In many ways this project illustrates not that Development Research has particular special needs, but that it is a site that surfaces issues in policy design and implementation deserving of more consideration across the research enterprise.

Abstract:This article explores the technology underpinning the decentralized data revolution and encourages Indigenous Peoples (IPs) to secure their Indigenous Data Sovereignty (IDSov) over the Metaverse and Web3. More specifically, this article will survey blockchain technologies, exploring some disturbing colonial uses and providing an international legal framework that IPs can use to advance their IDSov internationally and domestically. This article will consider the role that cryptocurrencies, smart contracts, decentralized oracles, non-fungible tokens (NFTs), decentralized finance (DeFi), and decentralized autonomous organizations (DAOs) might play in advancing IDSov as it relates to western conceptualizations of Web3 and the Metaverse. The worldwide web's global data structure is undergoing a seismic shift that will significantly impact IPs. As inherent sovereigns, IPs are uniquely positioned to use and regulate these technologies in manners consistent with their cultural values and international indigenous human rights instruments. However, the march toward Web3 also looms menacingly over IPs. As such, we intend to examine IPs' novel risks and opportunities with Web3 and the Metaverse. We conclude by encouraging IPs to become fluent in the minutia of these technologies and to exert their inherent sovereignty over these nascent technologies in international and domestic arenas by building culturally informed systems to address their particularized needs. Future research should look toward the specific hurdles, and successes IPs are experiencing as they apply the technologies and principles discussed here.

Abstract:Globally, there is a growing acknowledgment of Indigenous Peoples' rights to control data related to their communities. This is seen in the development of Indigenous Data Governance standards. As health data collection increases, it's crucial to apply these standards in research involving Indigenous communities. Our study, therefore, aims to systematically review research using routinely collected health data of Indigenous Peoples, understanding the Indigenous Data Governance approaches and the associated advantages and challenges. We searched electronic databases for studies from 2013 to 2022, resulting in 85 selected articles. Of these, 65 (77%) involved Indigenous Peoples in the research, and 60 (71%) were authored by Indigenous individuals or organisations. While most studies (93%) provided ethical approval details, only 18 (21%) described Indigenous guiding principles, 35 (41%) reported on data sovereignty, and 28 (33%) addressed consent. This highlights the increasing focus on Indigenous Data Governance in utilising health data. Leveraging existing data sources in line with Indigenous data governance principles is vital for better understanding Indigenous health outcomes.

Abstract:This article addresses the clash between Western and Indigenous understandings of how cultural heritage should be governed, protected and treated through law, especially in the digital environment. Specifically, the focus is on the ways in which the Western intellectual property rights (IPR) system often stands in contrast with Indigenous practices and ethics. This problem is approached through a single, intrinsic and descriptive case study related to the digital cultural heritage of the Sámi people: the Digital Access to Sámi Heritage Archives project. The article shows how the current IPR framework governing Indigenous cultural heritage is often misaligned with Indigenous worldviews. However, the study reveals that there is room to develop more sustainable, just and inclusive practices by complementing the existing legal rules with soft-law mechanisms, such as norms and customs, co-created with Indigenous communities.

Abstract:Persistent, unresolved issues stemming from a legacy of scientific exploitation and bio-colonialism have kept many tribal nations from participating in genomic research. The Center for the Ethics of Indigenous Genomic Research (CEIGR) aims to model meaningful community engagement that moves toward more inclusive and equitable research practices related to genomics. This article reflects on key successes and challenges behind CEIGR's efforts to shape Ethical, Legal and Social Implications (ELSI) research in ways that are informed by Indigenous perspectives, to locate community partnerships at the center of genomics research, and to conduct normative and empirical research with Indigenous communities that is grounded in the concepts of reciprocity, transparency and cultural competency. The structure of CEIGR represents an important shift away from a traditional model centered on a university-based principal investigators toward a partner-centered research approach that emphasizes equity and community control by distributing power and decision-making across all CEIGR partner sites. We discuss three features of CEIGR that have contributed to this shift towards an equitable, community-driven partnership: 1) balancing local priorities with collective goals; 2) distributing power in ways that promote equitable partnerships; and 3) capacity building and co-learning across partner sites. The discussion of these three areas in this article speaks to a particular strength of our Center: the interdependence among partners and collective willingness to maintain a plasticity of leadership that creates space for all of our partners to lead, support, exchange and strengthen ELSI research.
