Abstract:Transnational constitutionalism is both a sociological given and a legal challenge. We observe the emergence of ever more legally framed transnational arrangements with ever more power and impact. Do such arrangements deserve to be called legitimate rule in Habermasian terms? Is it at all conceivable that the proprium of law can be defended against the rise of its informal competitors? This article opts for a third way that listens to neither the siren songs on law beyond the state nor to the defences of nation‐state constitutionalism as the monopolist of legitimate rule. The proposed alternative suggests that transnational legal ordering of the European Union should build on its reconceptualization as a 'three‐dimensional conflicts law' with a democracy‐enhancing potential. This reconceptualization operationalizes the 'united in diversity' motto of the Draft Constitutional Treaty of 2004, preserves the essential accomplishments of Europe's constitutional democracies, provides for co‐operative problem solving of transnational regulatory tasks, and retains supervisory powers over national and transnational arrangements of private governance.

Abstract:The present volume provides a thorough analysis of the Lisbon Treaty carried out by leading experts in the field of European constitutionalism. Beyond the discussion of the principal reform steps, it addresses fundamental questions of European constitutional development, being insofar of particular interest for everyone legally or politically interested in Europe. Alongside the presentation of main aspects of the institutional reform as well as major changes in EU-policy fields, the study is specifically focused on the constitutional dimension of the Reform Treaty. In addition to an in-depth appraisal in terms of constitutional theory, special consideration is attached to basic constitutional elements of the Lisbon Treaty, like the protection of fundamental rights. Furthermore, ways of future treaty amendment and new solutions for potential ratification crisis are discussed. The present volume is the result of the European Constitutional Law Network’s conference held 2008 in Sofia. Coordinated by its founding member Ingolf Pernice, the network gathers academics and judges from more than twenty states, in view of transnational dialogue as well as academic cooperation.

Abstract:The European Union rides through troubled waters. Its original reliance on law as the object and agent of the integration project and on the “economic constitution,” which the Economic and Monetary Union (EMU)—as accomplished by the Treaty of Maastricht— expected to complete, have proven unsustainable. Following the financial and sovereign debt crises, individuals perceive the EMU, with its commitments to price stability and monetary politics, as a failed construction precisely because of its reliance on inflexible rules. The European crisis management seeks to compensate for these failures by means of regulatory machinery which disregards the European order of competences, takes power from national institutions, and burdens—in particular—Southern Europe with austerity measures; it establishes pan-European commitments to budgetary discipline and macroeconomic balancing. This abolishes the ideal of a legal ordering of the European economy, while the economic and social prospects of these efforts appear gloomy and the Union's political legitimacy becomes precarious. A fictitious debate between Carl Schmitt and Jürgen Habermas addresses the present critical constellation, where a number of Schmittian notions seem alarmingly realistic. This essay pleads for a more modest Europe committing itself to “unity in diversity,” the motto of the ill-fated Constitutional Treaty of 2003.
Multi-arena players in the making? Conceptualizing the role of national parliaments since the Lisbon Treaty

Abstract:Over the last years, the role of national parliaments (NPs) in the European Union (EU) has been upgraded in several ways, most importantly through the Early Warning System (EWS) and a new role in Treaty revisions established by the Treaty of Lisbon (ToL). These provisions formally turn national legislatures into EU actors in their own right that can act both individually and collectively at the EU level, as well as independently of their national governments. As a result, the EU legislative process now presents them with multiple arenas in which they can be simultaneously active – a perspective so far neglected in the literature. The aim of this research agenda is therefore threefold: to take stock of the impact of these provisions by contrasting the formal structures and the actual involvement of NPs; to propose a conceptualization of this new role of NPs in EU affairs as ‘multi-arena players’; and to sketch new avenues for research.

Abstract:This article introduces the collection of articles of the special issue and provides a discussion of the common themes linking these contributions. The article stresses the continuing significance of the Maastricht Treaty and illustrates the various ways in which the key reforms of the early 1990s still matter today. This includes not only the bearing that the decisions at the time of the Maastricht Treaty have had on the current crisis of the Eurozone, but also the developments in the areas of foreign policy and justice and home affairs. Indeed, the very move towards ‘pillarisation’ as well as key institutional changes such as the creation of the co-decision procedure and the elevation of the European Council all continue to play an important role today. The article concludes with some reflections about the legacy of the Maastricht Treaty, highlighting both the achievements of the treaty but also the shortcomings in terms of enhancing democratic legitimacy and engagement with civil society — indicating the key challenges that the Union still faces today.

Abstract:The Treaty of Lisbon stipulates that the EU shall accede to the European Convention on Human Rights('ECHR'),which ends the lasting controversy perplexing the EU legal system,and predicts the integration of the two European human rights protection mechanisms.Due to the lagging behind of EU human rights protection mechanism,EU's accession to the ECHR has become urgent and necessary.With an aim to uphold the autonomy of EU Law,the European Court of Justice('ECJ')once gave a negative answer to the EU's accession in the early 1990s.However,in practice the frequent interplay between ECJ and European Court of Human Rights demonstrates the necessity of EU's accession.The Lisbon Treaty has provided sufficient legal basis for EU's accession,and EU has also put it on agenda.However,considering all those legal issues which have to be addressed in the accession process,the realization of EU's accession is bound to be a time-consuming process.

Abstract:This article examines how the Lisbon Treaty's changes to the European Union's (EU's) Area of Freedom, Security and Justice (AFSJ) have affected its ‘democratic deficit’. How this issue is perceived depends on one's conceptual understanding of democratic legitimacy. This article reviews key scholarly perspectives on this matter and organizes these according to Schmidt's concepts of ‘inputs’, ‘throughputs’ and ‘outputs’. The article then applies this framework to specific innovations of the Lisbon Treaty, including new roles for the European Parliament and Court of Justice in the AFSJ. The article concludes that the EU's latest treaty has improved its democratic deficit in some regards, but that many issues of democratic legitimacy remain.

Abstract:The Maastricht Treaty, which created the European Union (EU), was signed in Maastricht on February 7, 1992, and it entered into force on November 1, 1993, after being ratified by the then 12 member states of the European Communities. The Intergovernmental Conferences (IGCs) on Political Union (PU) and Economic and Monetary Union (EMU) where the member states negotiated the amendments to the founding treaties took place against the turbulent geopolitical background of the fall of the Berlin Wall (1989), German unification, and the end of the Cold War. The new treaty amended the Treaty Establishing the European Economic Community (EEC) and established the European Community (EC) as the first pillar of the Union. It also amended the Treaty Establishing the European Coal and Steel Community (ECSC) and the Treaty Establishing the European Atomic Energy Community (EAEC). It further added two pillars of intergovernmental cooperation, namely Common Foreign and Security Policy (CFSP) in a second pillar and Justice and Home Affairs (JHA) cooperation in a third pillar. Overall, the Maastricht Treaty constituted one of the most important treaty changes in the history of European integration. It included provisions on the creation of an Economic and Monetary Union (EMU), including a single European currency. It tried to increase the democratic legitimacy and efficiency of the decision-making process through empowerment of the European Parliament (EP) and the extension of Qualified Majority Voting (QMV). Next to introducing the principle of subsidiarity and the concept of European citizenship, it further developed existing policies such as social policy and added new ones including education, culture, public health, consumer protection, trans-European networks, industrial policy, and development cooperation.
The legitimation of the European Union in the news media: three treaty reform debates

Abstract:The news media is a major forum for the discursive legitimation of the EU. This article analyses media debates in the context of three attempts at reforming EU primary law in the past decade: the Nice Treaty; the Constitutional Treaty; and the Lisbon Treaty. Focusing on four member states – the United Kingdom, Ireland, Germany and Austria – our study shows that the EU's legitimacy is discursively constructed according to distinct patterns, most of which are remarkably similar across countries and stable over time. In the context of the EU Constitution, legitimation debates became more intensive and more critical; however, these developments were largely reversed when the Lisbon Treaty was debated. This suggests that, in the media arena, the much-discussed politicization of European integration is an episodic occurrence, rather than a unidirectional trend.

Abstract:Though best known for its coverage of key policy areas, the Maastricht Treaty also introduced important institutional reforms. Building on the Single European Act, these pertained mainly to strengthening the legislative role of the European Parliament and extending the scope of qualified majority voting to more policy areas. Treaty-based institutional reform continued in the post-Maastricht period. Due to the twin challenges facing the EU in the aftermath of Maastricht — Central and Eastern European enlargement, and the gaping ‘democratic deficit’ — the focus of such reform shifted to the modalities of qualified majority voting and the size and composition of the Commission. The highly contentious nature of these issues thwarted effective institutional reform in the 1990s, overshadowed the work of the 2002–2003 Constitutional Convention, and dominated the intergovernmental conferences preceding the failed Constitutional Treaty and the subsequent Lisbon Treaty.

Abstract:On paper, the Lisbon Treaty radically changed the way in which EU law is implemented by defining a new institutional balance in Articles 290 and 291 TFEU, bringing decision-making in this area more in line with the traditional Community method. However, the real reform brought by the Lisbon Treaty depends on how the political institutions and the Courts interpret and apply the new Treaty rules. An analysis of seven years of post-Lisbon institutional practice and case law shows that in reality the institutions have largely undone Lisbon’s reform, meaning that the post-Lisbon institutional balance in this area largely resembles the pre-Lisbon one and that decision-making in this area fails to align with the Community method ideal type.

Abstract:This article provides a genealogy of the broad patterns of belief that contributed to the democratic reforms contained in the Treaty of Lisbon. Based on an analysis of European Union documents, the article draws three primary conclusions. First, EU democracy is a composite of concepts. This is due to the fact that the institutions which had primary responsibility for negotiating treaty changes – the European Council, the European Parliament and the European Commission – drew on distinct “governance traditions” in formulating their reform proposals. Second, our understanding of which changes introduced by the Lisbon Treaty were intended to be democracy-enhancing should be significantly broadened. This becomes evident once it is understood how certain reforms are connected to the three institutions’ wider webs of belief. Third, two factors explain continuing limitations on the democratic character of the Union: conflicts over what democracy should mean in the context of the EU and the purpose or motivation behind the Lisbon Treaty reforms, what is labeled here a “system maintenance” view of democracy. In addition to these substantive contributions to the study of the EU and democracy, the article also outlines the main analytical components of a genealogical approach.

Abstract:European Monetary Union (EMU) is one of the cornerstones of the post-Maastricht European project. Inasmuch as the Maastricht Treaty adopted a binding horizon for the creation of a unitary currency comprising the vast majority of the Member States, the Treaty provided for the blueprint, as of 1992, to initiate, in the area of monetary policy, the still lasting process of the European project’s political integration. As a result, the first pillars of a European economic policy followed, creating an edifice under the name of EMU that is still in the making, but has nevertheless developed, at this point, into a crucial pillar of the European Union’s (EU) constitutional charter.

Abstract:This article analyses the treaty provisions introduced by the L isbon T reaty with regard to the E uropean U nion's ( EU ) provision of humanitarian aid to third countries [with a particular focus on Article 214 Treaty on the Functioning of the European Union ( TFEU )]. It first examines how the new treaty framework affects the competences and the procedures that have been laid down with regard to humanitarian aid. It then considers the general international legal principles that, according to Article 214 TFEU , apply to the Union's provision of humanitarian aid. The article seeks to clarify what the obligations of ‘coordination’ and ‘complementarity’ entail. Finally, the article considers the requirement that a E uropean V oluntary H umanitarian A id C orps is set up.

Abstract:With the Treaty on European Union, or the Maastricht Treaty, into force in November 1993, the member-states of the European Community (EC) appeared to be embarking on a far-reaching enterprise to enhance the authority of Community institutions. Continuing a process that had begun with the Single European Act (SEA), into force in 1987, Maastricht increased the powers of the European Parliament. It established mechanisms whereby EC countries were to seek to improve policy coordination in such diverse areas as social affairs, high technology, border controls, immigration, and anti-crime efforts. It committed the EC members to work toward the establishment of a common foreign and security policy. Most importantly, it laid out a path and timetable for qualified EC members to achieve Economic and Monetary Union (EMU) by the end of the 1990s.

Abstract:Abstract In A Cosmopolitan Legal Order: Kant, Constitutional Justice, and the ECHR , we sought to demonstrate the power of Kantian theory to explain – or at least meaningfully illuminate – (1) the defining characteristics of modern, rights-based constitutionalism; (2) the evolving law, politics and constitutional architecture of the European Court of Human Rights (ECHR); and (3) the emergence of a global, cosmopolitan commons, featuring inter-judicial dialogue at its core. This article responds to contributors to the special symposium on the book. In Part I, we defend our account of a Kantian-congruent, domestic system of constitutional justice. Part II reflects on the ECHR as an instantiation of a cosmopolitan legal order, and on the European Court’s case law – particularly its enforcement of the proportionality principle. In Part III, we assess the evidence in support of a broader ‘constitutionalization’ of international human rights law.

Abstract:Since its creation in 1974 the European Council has turned into the key institution in the institutional architecture of the EU polity. The Maastricht Treaty on the European Union was a history-making product of this body of heads of state or government. For the institutional evolution of the European Council itself the Maastricht Treaty confirmed and reinforced trends starting with the Hague summit in 1969. This article covers the pre-history of the European Council as well as the road from the birth of the European Council in Paris, 1974, to the Maastricht Treaty and the next steps via two treaty revisions and the constitutional convention to the Lisbon Treaty in 2009. This article will not only try to satisfy some historical curiosity, but point out fundamental factors, explaining why Union executive leaders have invested time and energy in the labour-intensive and partly frustrating exercise of the making and working of their club: this key institution helped them to emerge as powerful multi-level players in a multi-institutional architecture.

Abstract:The European Union's security and defence policy (ESDP) was invented 10 years ago and has been operational for more than five years. During this period the EU has launched over 20 ESDP missions allowing the organization to be engaged in international crisis management in various ways. The coming years will reveal whether the European Union is able to meet its ambitions to carry out a greater number of more complex ESDP missions in higher-risk theatres. While the EU has stepped up the plate to meet these challenges, the three case studies discussed in this article (EULEX Kosovo, EUPOL Afghanistan, EUFOR Tchad/RCA) reveal that the path paved with good intentions might in this case indeed lead to hell. Whereas the new Treaty of Lisbon introduces quite a few institutional changes to the current treaty regime of foreign affairs and security policy, it is questionable whether these innovations will significantly improve the decision-making and leadership on issues of ESDP and, consequently, the effectiveness of the Union as an international crisis manager.

Abstract:This chapter explores the historical construction of Portugal’s relationship with the European Union from the revolution to the present day, during which there emerged a high level of support for the EU among Portuguese publics, and a marginalisation of opposition to integration from the radical left. This broad consensus is the product of a discursive strategy which associates European integration with a particular vision of Portuguese modernity connected with processes of democratisation and economic growth. The depoliticisation of European integration has been challenged as more policies have moved to the European level and particularly in the wake of the recent financial crisis. These events have served to expose the shifts in both how and where politics is practised in the Portuguese context as well as offering opportunities to (re)politicise the European Union as an issue of social contestation and an issue through which national institutions and politics can be challenged.
