Abstract:The deep seafloor is teeming with life, most of which remains poorly known to science. It also constitutes an important reserve of natural resources, particularly minerals, that mining companies will start harvesting in the next few years (Nat Rev Earth Environ, 1, 2020, 158). In this context, broad biodiversity assessments of deep-sea ecosystems are urgently needed to establish a baseline prior to mining. However, significant gaps in our taxonomic knowledge and the high cost of sampling in the deep sea limit the effectiveness of conventional morphology-based surveys. In this issue of Molecular Ecology, Laroche et al. (Mol Ecol, 2020) capitalize on high throughput molecular methods to conduct one of the most detailed and rigorous surveys of the composition and biogeography of deep-seafloor metazoan communities to date. The authors show that deep seamounts in the Clarion Clipperton Zone are inhabited by rich metazoan communities that are distinct from those of the surrounding abyssal plains. These results have important conservation implications: if communities on deep seamounts were to persist after large-scale industrial mining operations on the surrounding plains, the seamounts would not serve as appropriate reservoirs to repopulate impacted areas.

Abstract:Some forty years ago, the UN Convention on the Law of the Sea 1982 (UNCLOS) created an unusual regime for states to collectively manage common natural resources on the international seabed beyond national jurisdiction (known as "the Area") through the International Seabed Authority (ISA). In the intervening years, scientists have increasingly been warning about the serious environmental risks of mining seabed minerals. At this pivotal point in time, when states are negotiating whether or not to allow seabed mining, this essay explores the risk of undermining by mining, that is, contravening international marine environmental law and the obligations and responsibilities of states thereunder by allowing commercial mining activities to commence. We argue that allowing seabed mining in the Area at this juncture, when so much about the deep ocean remains unknown, would risk frustrating a host of measures, achievements, and progress to enhance marine environmental protection, particularly in areas beyond national jurisdiction. We begin with an overview of the ISA and its work to date, before discussing potential interactions between seabed mining and marine environmental law and policies, with a particular focus on the new ocean biodiversity agreement. We conclude by urging states to take cognizance of their overarching duty to protect and preserve the marine environment and ensure that all decisions taken with respect to seabed mining are consistent with their obligations and responsibilities under international law.

Abstract:Commercial seabed mining seems imminent, highlighting the urgent need for coherent, effective policy to safeguard the marine environment. Reconciling seabed mining with the United Nations Sustainable Development Goals will be difficult because minerals extraction will have irreversible consequences that could lead to the loss of habitats, species and ecosystems services. A dialog needs to take place around social, cultural, environmental and economic costs and benefits. Governance of human interactions with the seabed is fragmented and lacks transparency, with a heavy focus on facilitating exploitation rather than ensuring protection. In the light of high uncertainties and high stakes, we present a critical review of proposed policy options for the regulation of seabed mining activities, recommend actions to improve seabed governance and outline the alternatives to mining fragile deep-sea ecosystems.

Abstract:In January 2017, the International Seabed Authority released a discussion paper on the development of Environmental Regulations for deep-sea mining (DSM) within the Area Beyond National Jurisdiction (the “Area”). With the release of this paper, the prospect for commercial mining in the Area within the next decade has become very real. Moreover, within nations' Exclusive Economic Zones, the exploitation of deep-sea mineral ore resources could take place on very much shorter time scales and, indeed, may have already started. However, potentially toxic metal mixtures may be released at sea during different stages of the mining process and in different physical phases (dissolved or particulate). As toxicants, metals can disrupt organism physiology and performance, and therefore may impact whole populations, leading to ecosystem scale effects. A challenge to the prediction of toxicity is that deep-sea ore deposits include complex mixtures of minerals, including potentially toxic metals such as copper, cadmium, zinc, and lead, as well as rare earth elements. Whereas the individual toxicity of some of these dissolved metals has been established in laboratory studies, the complex and variable mineral composition of seabed resources makes the a priori prediction of the toxic risk of DSM extremely challenging. Furthermore, although extensive data quantify the toxicity of metals in solution in shallow-water organisms, these may not be representative of the toxicity in deep-sea organisms, which may differ biochemically and physiologically and which will experience those toxicants under conditions of low temperature, high hydrostatic pressure, and potentially altered pH. In this synthesis, we present a summation of recent advances in our understanding of the potential toxic impacts of metal exposure to deep-sea meio- to megafauna at low temperature and high pressure, and consider the limitation of deriving lethal limits based on the paradigm of exposure to single metals in solution. We consider the potential for long-term and far-field impacts to key benthic invertebrates, including the very real prospect of sub-lethal impacts and behavioral perturbation of exposed species. In conclusion, we advocate the adoption of an existing practical framework for characterizing bulk resource toxicity in advance of exploitation.

Abstract:For the whole world to deliver net zero by 2050, large-scale mining is more critical for metals such as lithium, cobalt, platinum, palladium, REE, gallium, tungsten, tellurium, and indium as these metals are essential for green technology applications such as making wind turbines, solar panels, fuel-cells, electric vehicles, and data storage systems required to transition to a low-carbon economy. Since land-based mineral deposits are depleting fast, seabed resources are seen as a new resource frontier for mineral exploration and extraction. They include mainly deep-ocean mineral deposits, such as massive sulfides, manganese nodules, ferromanganese crusts, phosphorites, and REE-rich marine muds. Manganese nodules contain mainly manganese and iron, but also valuable metals like nickel, cobalt, and copper, as well as REE and platinum, which are used in making several high-technology and green technology products. For example, deep-sea mud enriched in REE (> 2000 μg/g) was found in the western North Pacific Ocean. High concentrations of REE range from 1,727 to 2,511 μg/g in the crust samples collected from the Afanasy Nikitin Seamount (ANS) in the Indian Ocean. However, these deposits usually have lower REE grades than land-based REE deposits such as carbonatite-hosted deposits but form greater potential volumes. Though the mining companies and their sponsoring countries are in the process of developing the required technologies to mine the three deep-sea environments: abyssal plains, seamounts, and hydrothermal vents, due to severe concerns about the possible environmental damages, the International Seabed Authority (ISA) has not granted any mining permissions so far, although deep-sea mining becomes inevitable in the future green energy revolution.

Abstract:Rising demand for minerals and metals, including for use in the technology sector, has led to a resurgence of interest in exploration of mineral resources located on the seabed. Such resources, whether seafloor massive (polymetallic) sulfides around hydrothermal vents, cobalt-rich crusts (CRCs) on the flanks of seamounts or fields of manganese (polymetallic) nodules on the abyssal plains, cannot be considered in isolation of the distinctive, in some cases unique, assemblages of marine species associated with the same habitats and structures. In addition to mineral deposits, there is interest in extracting methane from gas hydrates on continental slopes and rises. Many of the regions identified for future seabed mining are already recognized as vulnerable marine ecosystems (VMEs). Since its inception in 1982, the International Seabed Authority (ISA), charged with regulating human activities on the deep-sea floor beyond the continental shelf, has issued 27 contracts for mineral exploration, encompassing a combined area of more than 1.4 million km2, and continues to develop rules for commercial mining. At the same time, some seabed mining operations are already taking place within continental shelf areas of nation states, generally at relatively shallow depths, and with others at advanced stages of planning. The first commercial enterprise, expected to target mineral-rich sulfides in deeper waters, at depths between 1,500 and 2,000 m on the continental shelf of Papua New Guinea, is scheduled to begin early in 2019. In this review, we explore three broad aspects relating to the exploration and exploitation of seabed mineral resources: (1) the current state of development of such activities in areas both within and beyond national jurisdictions, (2) possible environmental impacts both close to and more distant from mining activities and (3) the uncertainties and gaps in scientific knowledge and understanding which render baseline and impact assessments particularly difficult for the deep sea. We also consider whether there are alternative approaches to the management of existing mineral reserves and resources, which may reduce incentives for seabed mining.

Abstract:Deep seabed mining operations, if permitted, could present significant risks to ocean ecosystems. Disturbance on any scale is likely to be long lasting and irreversible. Scant research to date has examined the impact that deep sea minerals extraction would have on cetaceans. The Clarion-Clipperton Zone (CCZ) is of particular interest to mining companies aiming to exploit polymetallic nodules. The CCZ, with an average depth of 5,500 m and an area of approximately 11,650,000 km 2 , is a habitat for cetaceans including baleen (mysticetes) and toothed whales (odontocetes). Of particular concern is anthropogenic noise. If permitted, commercial-scale mining is expected to operate 24-hours a day, at varying depths. The sounds produced from mining operations, including from remotely operated vehicles on the seafloor, overlap with the frequencies at which cetaceans communicate, which can cause auditory masking and behavior change in marine mammals. Cetaceans are already facing numerous stressors, including climate change, and many species are still recovering from centuries of exploitation. We argue the need for urgent research to assess more fully the potential impact of deep seabed mining on cetaceans.

Abstract:The increase in world population and the expected global development of the world economy after the COVID-19 pandemic will continue to impose unprecedented pressure on securing the supply of minerals. The World Bank report “Minerals for Climate Action: The Mineral Intensity of the Clean Energy Transition” finds that the production of minerals such as graphite, lithium and cobalt could increase by nearly 500% by 2050, to meet the growing demand for clean energy technologies. Many of these critical minerals are found in the deep seabed, the only place on earth where mineral resources have not been exploited yet. There is a strong need to ensure that these critical minerals will be extracted in a sustainable way, verifying the protection of the marine environment and biodiversity. The regulatory, financial and engineering challenges for deep sea mining are considerable, but in fact are not considered prohibitive, taking into account the remarkable achievements in recent years. On the other hand, it is evident that the existing modern ecosystem-based management approaches cannot be applied to deep sea areas without detailed knowledge of the individual species and ecosystems; most of the species living on the deep-sea floor remain unknown up until now. There is a need for the development of a new environmental management approach for each specific area. The successful procedures of Natura 2000 can be followed, and the necessary information on the existing environmental conditions has to be collected separately at every site for a minimum period of 10–15 years. Natura 2000, the world’s largest ecological network united under a single, uniform regulatory framework, is regarded as one of the conservations success stories in the global effort to protect biodiversity.

Abstract:Progress towards deep sea mining (DSM) is driven by projected demands for metals and the desire for economic development. DSM remains controversial, with some political leaders calling for a moratorium on DSM pending further research into its impacts. This paper highlights the need for governance architectures that are tailored to DSM. We conceptualise DSM as a type of complex orebody, which encompasses the breadth of environmental, social and governance (ESG) risks that make a mineral source complex. Applying a spatial overlay approach, we show that there are significant data gaps in understanding the ESG risks of DSM. Such uncertainties are compounded by fact that there are no extant commercial DSM projects to function as a precedent - either in terms of project design, or the impacts of design on environment and people. Examining the legislation of the Cook Islands and International Seabed Authority, we demonstrate how regulators are defaulting to terrestrial mining governance architectures, which cannot be meaningfully implemented until a fuller understanding of the ESG risk landscape is developed. We argue that DSM be approached as a distinct extractive industry type, and governed with its unique features in frame.

Abstract:A comprehensive understanding of the deep-sea environment and mining’s likely impacts is necessary to assess whether and under what conditions deep-seabed mining operations comply with the International Seabed Authority’s obligations to prevent ‘serious harm’ and ensure the ‘effective protection of the marine environment from harmful effects’ in accordance with the United Nations Convention on the Law of the Sea. A synthesis of the peer-reviewed literature and consultations with deep-seabed mining stakeholders revealed that, despite an increase in deep-sea research, there are few categories of publicly available scientific knowledge comprehensive enough to enable evidence-based decision-making regarding environmental management, including whether to proceed with mining in regions where exploration contracts have been granted by the International Seabed Authority. Further information on deep-sea environmental baselines and mining impacts is critical for this emerging industry. Closing the scientific gaps related to deep-seabed mining is a monumental task that is essential to fulfilling the overarching obligation to prevent serious harm and ensure effective protection, and will require clear direction, substantial resources, and robust coordination and collaboration. Based on the information gathered, we propose a potential high-level road map of activities that could stimulate a much-needed discussion on the steps that should be taken to close key scientific gaps before any exploitation is considered. These steps include the definition of environmental goals and objectives, the establishment of an international research agenda to generate new deep-sea environmental, biological, and ecological information, and the synthesis of data that already exist.

Furthermore, it presents a comprehensive analysis of the historical development of deep-sea mining technology and equipment, offering valuable insights into this field. By examining the current issues and obstacles faced in deep-sea mineral extraction, this study concludes that the future of deep-sea mining lies in the direction of automation, intelligence, and standardization. Additionally, it identifies the key technological advancements that need to be achieved in order to overcome the challenges associated with deep-sea mining.

Abstract:Madureira et al. (2023)published a timely article about the role of deep-sea mining in sustainable development – UN Agenda 2030. We take the opportunity to join the discussion initiated by the authors and highlight the known challenges in deep-sea mining discussions using rich, empirical social and natural science literature. Our premise is the following: sustainable development depends on careful assessment of pressing, known issues that need attention. Local problems require context-specific, local solutions to make propositions about the future and sustainability unambiguous and workable. Meaningful discussions on sustainability in relation to ocean and terrestrial mining depend on engagement with a broad body of literature, from anthropology to human geography, policy and governance research, among others. In sum, we hope to contribute to a more comprehensive interdisciplinary discussion on the contested topic of deep-sea mining and its role in sustainability.

Abstract:Today the International Seabed Authority (ISA), through its member States, is in the process of developing regulations to govern deep-sea mineral mining in areas beyond national jurisdiction, with self-imposed regulatory deadlines of July 2020. Given the complexities of the ISA's dual responsibility to both develop and protect the seabed for all of humanity over time, this article explores to what extent the standards established in the 1988 Convention on the Regulation of Antarctic Mineral Resource Activities (CRAMRA) might guide the ISA through its paradoxical mandate. Principles embraced in CRAMRA include the need for: i) sufficient information to ensure informed decisions, ii) consideration of impacts on dependent and associated seabed ecosystems; iii) requirements for comprehensive and cumulative impact assessments; iv) assurances of technological capacity to monitor key environmental parameters and measure change; v) effective operating procedures for accident responses, and vi) priority use of the precautionary principle. These principles with regard to mineral resource regulation in the icy and fragile Antarctic frontier operationalize the precautionary approach and can generate valuable lessons for regulating the future deep-sea mining industry to protect the remote, dark and similarly fragile deep ocean frontier.

Abstract:Ocean mining activities have been ongoing for nearly 70 years, making great contributions to industrialization. Given the increasing demand for energy, along with the restructuring of the energy supply catalyzed by efforts to achieve a low-carbon economy, deep seabed mining will play an important role in addressing energy- and resource-related problems in the future. However, deep seabed mining remains in the exploratory stage, with many challenges presented by the high-pressure, low-temperature, and complex geologic and hydrodynamic environments in deep-sea mining areas, which are inaccessible to human activities. Thus, considerable efforts are required to ensure sustainable, economic, reliable, and safe deep seabed mining. This study reviews the latest advances in marine engineering geology and the environment related to deep-sea mining activities, presents a bibliometric analysis of the development of ocean mineral resources since the 1950s, summarizes the development, theory, and issues related to techniques for the three stages of ocean mining (i.e., exploration, extraction, and closure), and discusses the engineering geology environment, geological disasters, in-situ monitoring techniques, environmental protection requirements, and environmental effects in detail. Finally, this paper gives some key conclusions and future perspectives to provide insights for subsequent studies and commercial mining operations.

Abstract:Deep-sea mining is likely to result in biodiversity loss, and the significance of this to ecosystem function is not known. “Out of kind” biodiversity offsets substituting one ecosystem type (e.g., coral reefs) for another (e.g., abyssal nodule fields) have been proposed to compensate for such loss. Here we consider a goal of no net loss (NNL) of biodiversity and explore the challenges of applying this aim to deep seabed mining, based on the associated mitigation hierarchy (avoid, minimize, remediate). We conclude that the industry cannot at present deliver an outcome of NNL. This results from the vulnerable nature of deep-sea environments to mining impacts, currently limited technological capacity to minimize harm, significant gaps in ecological knowledge, and uncertainties of recovery potential of deep-sea ecosystems. Avoidance and minimization of impacts are therefore the only presently viable means of reducing biodiversity losses from seabed mining. Because of these constraints, when and if deep-sea mining proceeds, it must be approached in a precautionary and step-wise manner to integrate new and developing knowledge. Each step should be subject to explicit environmental management goals, monitoring protocols, and binding standards to avoid serious environmental harm and minimize loss of biodiversity. “Out of kind” measures, an option for compensation currently proposed, cannot replicate biodiversity and ecosystem services lost through mining of the deep seabed and thus cannot be considered true offsets. The ecosystem functions provided by deep-sea biodiversity contribute to a wide range of provisioning services (e.g., the exploitation of fish, energy, pharmaceuticals, and cosmetics), play an essential role in regulatory services (e.g., carbon sequestration) and are important culturally. The level of “acceptable” biodiversity loss in the deep sea requires public, transparent, and well-informed consideration, as well as wide agreement. If accepted, further agreement on how to assess residual losses remaining after the robust implementation of the mitigation hierarchy is also imperative. To ameliorate some of the inter-generational inequity caused by mining-associated biodiversity losses, and only after all NNL measures have been used to the fullest extent, potential compensatory actions would need to be focused on measures to improve the knowledge and protection of the deep sea and to demonstrate benefits that will endure for future generations.

Abstract:Deep-sea polymetallic nodules (PMN) hold promise as a future resource, with various consortia like MOES, IOM, GSR, KORDI, and COMRA actively exploring mining possibilities. However, current technologies lack environmental sustainability. This study comprehensively compares the technologies proposed by different consortia for deep sea mining (DSM). It evaluates the designs and prototypes of key components like crawlers, conveyor belts, crushers, riser pipes, and slurry tailing discharge mechanisms for their technical feasibility and environmental impact. Environmental concerns regarding sediment disturbances, nodules pick-up methods, crushing, and tailing material filtration are addressed in this article. It is suggested that further research and development efforts are needed to optimize technologies and integrate effective environmental protection measures into DSM operations.

Abstract:Increasing interest in deep-seabed mining has raised many questions surrounding its potential environmental impacts and how to assess the impacts’ significance. Under the United Nations Convention on the Law of the Sea (UNCLOS), the International Seabed Authority (ISA) is charged with ensuring effective protection of the marine environment as part of its responsibilities for managing mining in seabed areas beyond national jurisdiction (the Area) on behalf of humankind. This paper examines the international legal context for protection of the marine environment and defining the significant adverse change that can cause “serious harm”, a term used in the ISA Mining Code to indicate a level of harm that strong actions must be taken to avoid. It examines the thresholds and indicators that can reflect significant adverse change and considers the specific vulnerability of the four ecosystems associated with the minerals targeted for mining: (1) manganese (polymetallic) nodules, (2) seafloor massive (polymetallic) sulphides, (3) cobalt-rich (polymetallic) crusts and (4) phosphorites. The distributions and ecological setting, probable mining approaches and the potential environmental impacts of mining are examined for abyssal polymetallic nodule provinces, hydrothermal vents, seamounts and phosphorite-rich continental margins. Discussion focuses on the special features of the marine environment that affect the significance of the predicted environmental impacts and suggests actions that will advance understanding of these impacts.

Abstract:Deep sea mining in the Area (seabed and subsoil beyond national jurisdiction) is regarded by some stakeholders as a threat to the achievement of Goal 14 of the United Nations, 2030 Agenda for sustainable development. However, the availability of metals and mineral resources will be crucial to comply with most Sustainable Development Goals . Despite the need to foster a circular economy and reduce waste to a minimum, it seems unlikely that the decarbonization of the economy could be achieved without primary mining. Future minerals supply, facing significant obstacles, can source from increased primary terrestrial and deep-seabed supply, or deep-seabed displacing terrestrial. This work develops principles and an integrated, holistic framework for deep-seabed mining to play a role in future demand through sustainable global sourcing and collective action on the global commons through the International Seabed Authority. Optimum global welfare requires balancing all the competing uses of the marine environment and their contributions to private and public benefits enjoyed by all Humanity, in both current and future generations, and weighted by equity concerns for a more progressive distribution as required by the United Nations Convention on the Law of the Sea.

Abstract:Although commercial deep seabed mining could provide the international community with new sources of metals and minerals, it can potentially cause adverse effects on the marine environment and biodiversity of the Area. To date, insufficient scientific knowledge has been obtained about the complex deep seabed ecosystems and the detailed impacts of deep seabed mining. The International Seabed Authority has begun to make provisions for exploiting mineral resources and related environmental protection requirements. The draft exploitation regulations take precautionary approaches such as stipulating rules, including environmental standards and guidelines, environment impact assessment, environmental management and monitoring plan, and regional environmental management plan. However, there are still apparent differences and controversies about these rules between States. This article elaborates on the evolution and content of drafted rules and explores the manifested specific divergences and interest conflicts in formulating these rules. Implementing precautionary approaches requires balancing potential serious environmental risks, available scientific evidence, and cost-effectiveness. This article also explores the essential requirements of taking precautionary approaches for governing commercial deep seabed mining. The ISA, sponsoring States, Contractors, scientists, experts, and public all play roles in the governance of imminent commercial deep seabed mining. Strengthening multi-subject participation in the ISA's law-making process for deep seabed environmental protection can be conducive to promoting consensus on taking precautionary approaches to govern commercial deep seabed mining.
