Abstract:In this paper we examine and compare the formal systems of law and finance in China and India and the alternative institutional arrangements and governing mechanisms in the two countries, and the relation between the development of these systems and their economic growth. China differs from most of the countries studied in the law, institutions, finance, and growth literature: Its legal and financial systems as well as institutions are all underdeveloped, but its economy has been growing at a very fast rate. More importantly, the growth in the Private Sector, where applicable legal and financial mechanisms are arguably poorer than those in the State and Listed sectors, is much faster than that of the other sectors. The system of alternative mechanisms and institutions plays an important role in supporting the growth in the Private Sector, and they are good substitutes for standard corporate governance mechanisms and financing channels. Despite its English commonl aw origin and British-style judicial system and democratic government, there is enough documented evidence to suggest that the effective level of investor protection and the quality of legal institutions in India are quite weak as well. Once again, this has evidently not prohibited growth. We find that to a large extent Indian firms conduct business outside the formal legal system and do not rely on formal financing channels from markets and banks for most of their financing needs. Instead, firms across the board, and in particular, small and medium firms, use non-legal methods based on reputation, trust and relationships to settle disputes and enforce contracts, and rely on alternative financing channels such as trade credits to finance their growth. The scope, methodologies, and results of our paper paint a more complete picture of the law-finance-growth nexus and how businesses and investors respond to the limitations of legal system and formal financial system than existing studies.

Abstract:This paper discusses the evolution of international banking regulation standards in two intersected dimensions: regulatory capital versus economic capital; rule- based regulation versus process- oriented regulation. Just like the old accord incorporated with elements of economic and process- oriented approaches,the new accord still keeps elements of regulatory and rules - based capital regulation. The change in regulatory approach represented by the new accord, however, is substantial and important for it is a change in both of the dimensions.

Abstract:<p>Financial regulation and financial innovation tend to show a dynamic game process of 'regulation-innovation-re-regulation-re-innovation'. This paper constructs an evolutionary game model to simulate the above phenomena for analyzing the stable equilibrium strategies between financial institutions and regulation institutions. Previous studies mainly stay in a theoretical perspective; instead, this study uses the financial and macroeconomic data of the U.S. during 1947–2007 to numerically demonstrate the dynamic evolution paths of financial regulation and financial innovation. This study finds that the financial regulation and financial innovation of the U.S. presents a dynamic adjustment process by promoting the development of each other. Both regulatory and innovative strategies should be coordinated in the evolutionary progress in a timely and coordinated reason. This study has great referential value for policy makers to balance regulation and innovation in the financial industry and for avoiding financial crises.</p>
Firms as Surrogate Intermediaries: Evidence from Emerging Economies

Abstract:A firm can finance investment either by borrowing or by drawing on cash balances, so that financial asset and liability changes tend to have opposite signs. In contrast, financial intermediaries borrow in order to lend, so that financial asset and liability changes have the same sign. Large non-financial firms in China and India behave like intermediaries rather than textbook non-financial firms. We explore the role of nonfinancial firms in the shadow banking system. The evidence from China and India is in contrast to US non-financial firms, which conform to the textbook predictions. Preliminary. Abstract:In this paper we present a new data set on bank credit in four categories: home mortgages, consumer credit, bank loans to non-bank financials, and loans to non-financial business, for 74 economies over 1990–2013. We offer a full description of sources and methods of data collection and construction and comparisons with adjacent data sets. We document key trends including the shift in bank credit allocation away from traditional business lending. The literature suggests substantial consequences of this 'debt shift' for growth, income distribution and macroeconomic resilience, which motivated this data construction. A second contribution is to analyze drivers of debt shift in fixed-effects and system-GMM regressions for the full sample and separately for advanced and emerging economies. We find that debt shift is larger in advanced economies with a stronger presence of foreign banks and higher trade. Financial deregulation strongly correlates with debt shift.

Abstract:Shadow banking activities in transition economies have drawn scant attention in the literature. This paper examines a particular form of shadow banking business embedded in the operation of non-financial firms in China and transition economies in Central and Eastern Europe (CEE), in which firms borrow in order to lend. We verify its existence, especially in China and Russia, by two strategies to track the abnormal correlations between financial accounts. By exploring the national/regional variations, we find that a better development of financial market and legal system deters firms in both CEE and China from engaging in re-lending business. We also confirm that Chinese firms participate less actively in re-lending if they have better growth prospects and are located in cities with better development of high-tech industries.

Abstract:We investigate how external credit market development affects corporate earnings management, by studying the impact of the U.S. interstate banking and branching deregulations on the intensity of accruals-based and real earnings management. We find that the banking and branching deregulations significantly decrease both accruals-based and real earnings-management intensity among firms in deregulated states. The effect is stronger for those deregulated states that have lower bank branch density before deregulation and states that have greater out-of-state bank entry after deregulation. The impact on corporate earnings management is channelled through increased banking competition and credit supply providing firms with easier access to external financing. The findings are robust to various endogeneity concerns. We further document that interstate banking and branching deregulations reduce the instances of financial results being subsequently affected by accounting restatements and improve firms' information environment.

Abstract:Financial innovation is inextricably tied to asymmetric information and therefore sets the stage for financial crises. Over history, every truly meaningful crisis has had elements of asymmetric information, particularly affecting innovative financial instruments that are primary market liabilities. But financial innovation, by definition, occurs outside the regulated financial sector. Indeed, that is often the point of financial innovation! Hence, limiting regulators' scope of supervision to one narrow legally-defined sector of institutions sets a natural stage for regulatory arbitrage and crises. In such a system, crisis will always "surprise" supervisors, for whom financial innovations outside their narrow legally-defined charge do not exist. Everything will look like systemic risk, merely because banks reside in a financial system! Today, off-balance sheet structured finance-based funding, the regulatory approval of banks' use of credit default swaps for hedging capital needs, and the preponderance of non-bank subsidiaries in bank holding companies after Gramm-Leach-Bliley led to multiple sources of unrecognized risks that took regulators by "surprise," not because they were unknown but because regulators refused to look outside their narrow charges to see the wider financial system. Similarly, however, any attempt to change regulations will inextricably affect other non- or differently-regulated institutions, thereby leading to "unintended" (not unavoidable) consequences.

Abstract:To address how technological progress in financial intermediation affects the economy, a costly-state verification framework is embedded into the standard growth model. The framework has two novel features. First, firms differ in the risk/return combinations that they offer. Second, the efficacy of monitoring depends upon the amount of resources invested in the activity. A financial theory of firm size results. Undeserving firms are over financed, deserving ones under funded. Technological advance in intermediation leads to more capital accumulation and a redirection of funds away from unproductive firms toward productive ones. Quantitative analysis suggests that finance is important for growth.

Abstract:This article focuses on the rise of FinTech over the past ten years, particularly with respect to the role of technology-based platforms in the provision of credit. In this specific context, P2P lending has acquired an increasing importance, with a larger share of loans having been originated through P2P platforms instead of traditional banking channels. This trend has been welcomed by policy-makers as a move towards alternative market-based finance, which should contribute to better risk diversification by moving risks away from systemic financial institutions. At the same time, this shift presents a number of regulatory questions that have remained largely unexplored. This is so because the nature and role of P2P platforms has remained loosely defined, which means that it has been difficult to identify relevant regulatory challenges emerging from these channels of finance.This research tackles two inter-related questions. First, it addresses the conceptual redefinition of financial intermediation. This allows understanding the function of P2P platforms, and whether they have supplemented the intermediation role traditionally conducted by banks. Second, it explores the risks that arise in connection with P2P lending channels. This second enquiry highlights outstanding policy and regulatory issues that have remained unexplored or downplayed in current debates.

Abstract:The rise of Decentralized Finance ("DeFi") on the Ethereum blockchain has enabled the creation of lending platforms, which serve as marketplaces to lend and borrow digital currencies. We first categorize the activity of lending platforms within a standard regulatory framework. We then employ a novel grouping and classification algorithm to calculate the percentage of fund flows into DeFi lending platforms that can be attributed to debt created elsewhere in the system ("debt-financed collateral"). Based on our results, we conclude that the wide-spread use of stablecoins as debt-financed collateral increases financial stability risks in the DeFi ecosystem.

Abstract:By summarizing the existing main papers, we conclude that firms with abundant growth opportunities are usually financed with debts with such characteristics as less, premature, convertible, callable, secured and etc., which are helpful to reduce the information asymmetry and agency costs between the lenders and borrowers, whilst maintaining the managerial flexibility of the firm. Hence we get some policy implications for Chinese financing systems.

Abstract:Standard models of capital flows to emerging market economies focus on debt flows and a pecuniary externality. However, by offering better risk sharing, international equity flows can render such externality unimportant, yet many economies fail to attract equity investment in a large quantity. We propose a theory of endogenous composition of capital flows that highlights two asymmetries. In our model, poor institutional quality leads to an inefficiently low share of equity financing as well as an inefficiently high volume of total inflows. Somewhat surprisingly, a social planner would often impose taxes on both equity and debt inflows. Abstract:We examine the impact of intensifying competition laws on corporate debt financing choice. Analogous to the argument that intensifying competition spurs improvements in corporate governance, which decreases the demand for bank monitoring and hence bank debt, we find a negative association between stringent competition laws and bank debt reliance. This effect is amplified for firms with lower information quality, firms in concentrated industries, and firms in countries with weaker institutional environments. Additional analyses show that the bank debt-reducing effect of competition increases overall firm value, which demonstrate the value-enhancing effect of regulated competition. Our study is contributory to the recent debate on reforming competition laws to promote economic growth.

Abstract:The rich scholarship on the politics and finance of sovereign debt tends to take for granted debt's most basic form: as a private contract. Nevertheless, legal challenges have been central to the contemporary evolution of sovereign debt dynamics thanks to litigating strategies rendered possible by - mostly standard - contractual stipulations in international sovereign bonds. By using a debt-as-private-contract lens, the paper highlights how exposed sovereign debtors present themselves to these global transactions, how foreign sovereign bond contracts anchor otherwise footloose finance in particular jurisdictions, and how contractual changes sparked by outlier cases of protracted litigation or recent turbulence in debt exchanges have been key to global efforts to reform debt governance around market-based parameters. The legal battle between Argentina and its holdout creditors in US courts is analyzed here to illustrate these dynamics given its significance in sparking contractual revisions. Ultimately, it is clear that credit and contract are inextricably linked. Contractual evolution is revealing of the legal risks taken on by sovereign debtors and their creditors in private markets. The cost of debt hence may go beyond relatively predictable financial calculations.

Abstract:This paper establishes the evolutionary game model of collective financing between commercial banks and small -and -micro -sized enterprises.The investigations were conducted on the two parties′strategies trend in the dif-ferent cases which are secured loans and unsecured loans in the context of self -guarantee mechanism formed in enter-prises group.Through the game analysis,we conclude that the unsecured collective financing mode does not increase the credit risk of bank.The given mode can both reduce the cost of examination and expand the channels of middle business of commercial bank.For small -and -micro -sized enterprises,it will not only mitigate the problem of information o-pacity,but also prevent the enterprises default risk.Furthermore,this approach lowers the financing threshold and gives a new way of thinking to solve the financing problems of small -and -micro -sized enterprises.
