Abstract:<p>This study uses insights from tax practitioners and tax authorities to define and develop an estimate of ex‐ante tax risk that is independent of common tax outcomes studied in prior literature. Validation tests confirm that our tax risk measure (1) represents the predictable and unpredictable uncertainty inherent in the three sources of tax risk (i.e., economic risk, tax law uncertainty, and inaccurate information processing) and (2) is a construct different from tax avoidance, tax uncertainty, and general business risk. Using our tax risk measure, we address two research questions of interest to academics and practitioners. First, we examine the association between tax risk and long‐run tax avoidance and find a negative association between tax risk and future long‐run cash effective tax rates (ETRs). Second, we consider the extent to which unrecognized tax benefits (UTBs) reflect tax risk, tax avoidance, or financial reporting incentives and demonstrate that our tax risk measure explains a substantial portion of UTBs, incremental and relative to measures of information risk, conditional conservatism, unconditional conservatism, and tax avoidance. Our study offers a measure of tax risk that, consistent with the Scholes‐Wolfson paradigm, reflects the tax risk inherent in all business activities, not just tax avoidance activities; has unique industry effects; and contributes to our understanding of the factors that affect tax planning decisions and result in variation in firms' ETRs. Our findings will help managers and tax practitioners focus on industry‐specific tax risk components, assess risk during tax planning initiatives, exercise caution when engaging in additional risk if ETRs are low, and adapt tax risk strategies to fit specific company needs. In this article, we will discuss the definition of tax management, the different stages involved in the tax management process, and the differences in tax management in different countries. Secondly, this article also conducted case studies on tax management and tax risk prevention strategies, in order to deepen the understanding of these issues and their impact on the company's financial health. This article first provides the definition of tax management and tax risk prevention strategies, and then delves into the different stages involved in the tax management process. At the same time, this article emphasizes the importance of tax risk prevention strategies in enhancing the financial health of companies, and conducts in-depth analysis of cases.

Abstract:Journal of Accounting, Auditing &Finance, Ahead of Print. We examine the association between aggressive tax planning and labor investment efficiency among U.S. firms. Labor is an important input to production that is material to many firms, and prior research suggests that inefficient labor investments can negatively affect future profitability and growth. We provide evidence that firms engaging in aggressive tax planning are associated with deviations from expected labor investments, which is indicative of labor investment inefficiency. We find that our results are concentrated in labor underinvestment, consistent with risks and uncertainties from aggressive tax planning making firms more cautious when investing. Our findings are strongest among firms with greater tax risk, higher labor costs, and weaker corporate governance. Our study contributes to the literature examining tax planning consequences by providing evidence that a tradeoff exists between aggressive tax planning and investments in labor. Therefore, our results suggest that managers should carefully consider the cash flow benefits of tax planning in conjunction with the potential effects of lower labor investments to ensure that the overall long-term effect of the tax strategy is value-increasing.

Abstract:The advent of Sarbanes-Oxley shed light on fiscal risk. Then, the financial crisis led to the desire to minimize taxation. In order to quantify tax risk, it is necessary to duly weigh risks against return in terms of money, rewards and reputation. A risk intelligence approach should balance value creation with risk generation, while accomplishing income and profit targets between the risk appetite limits. Risk anticipation and the appraisal of rules for mitigating tax lifecycle risks regarding planning, forecasting, compliance and controversy represent genetic information in the chain of corporate DNA. The occurrence of an unforeseen tax risk is capable of creating a domino effect by affecting the other risks. This paper explores the concept of tax risk management with particular reference to the specific risk areas, by using literature and visual representation structure techniques in order to provide clarity and insight for the tax risk management field.

Abstract:This study examines the impact of enterprise risk management (ERM) programs on corporate tax planning. ERM is a holistic approach to managing an enterprise's entire portfolio of risks. We hand‐collect data on ERM adoption for a sample of Standard & Poor's 500 firms from 1993 to 2016. We empirically document that firms with ERM programs have lower cash effective tax rates than firms without ERM. Additionally, we find that the relation between ERM and tax avoidance is stronger among firms with more business segments. Finally, our results suggest ERM adoption offsets an increase in opacity and tax uncertainty typically associated with tax avoidance strategies. Overall, we provide evidence that ERM allows firms to exploit tax avoidance opportunities through enhanced coordination and communication.

Abstract:The article provides an overview of the theoretical aspects of corporate tax evasion and their impact on companies’ decisions. It is shown that the consequences of aggressive tax planning go beyond only financial consequences and cover such important aspects as corporate transparency, cost of capital and shareholder value of the company. Understanding the determining factors and the broad consequences of corporate tax evasion is important for tax authorities, which, taking into account the specifics of decision-making by company management, will be able to increase the effectiveness of control activities in terms of countering violations of tax legislation by legal entities.

Abstract:Business entities, even at the stage of formulating a business plan, perform an approximate analysis of costs and revenues, as well as examine ways to reduce tax liabilities in order to obtain greater profits. There is always a risk at all stages of activity of business entities, regardless of the sphere of their functioning. The difference may lie only in its degree in this case. Risk is generated by objective existing uncertainty, conflict, lack of information at the time of evaluation, management decision-making, ambiguity of forecasts, changes in the environment and in the system itself, evolution and transformation processes, lack of time for scientific substantiation of economic and financial values and support for appropriate decision-making. The enterprise, working in the dynamic external environment, faces a large number of economic, financial, tax and other types of risks, generating threats to its stable functioning and development. The optimization of its tax security is one of the main directions of increasing the level of economic security of the enterprise. It consists in identifying and analyzing all possible tax risks and reducing the negative impact on economic activity. The latter necessitates the formation and implementation of a balanced tax policy of the enterprise, which plays one of the key positions in the management system. So that changes in external factors would not significantly affect the economic activities of the enterprise. Appearance of modern methods of tax risks reduction is connected with changes in trends in taxation, taxpayers' behavior, increase of tax culture etc. The article outlines the directions of tax risks minimization as an element of tax policy of business entities. In our opinion, it is advisable: to calculate the tax burden on the financial condition of enterprises; to identify and assess tax risks using the map, matrix and table ranking of tax risks; to analyze carefully the contracts and make the source documents, which has a direct impact on the tax consequences.

Abstract:Our study aims to analyze the current state of, and avenues for, future studies into the tax risk literature. The construct of the corporate tax risk (tax uncertainty) has increasingly begun to attract significant interest from both academics and practitioners. Most previous studies discussing corporate tax behavior have also focused on tax planning, tax avoidance, and tax evasion. Studies investigating the tax risk are still very limited and it is an underexplored subject. Examining the tax risk is crucial because it relates to the tax outcomes arising from a firm’s taxation activities. Furthermore, analyzing the tax risk simultaneously with other tax behavior constructs may provide a deeper understanding. Despite the importance of the tax risk construct, there is no published literature review regarding the tax risk. Using a systematic review process, this study selected 37 articles published in 21 highly reputable journals listed in the Scopus database. The findings of this study are provided in two sections: (1) A discussion of the current studies of tax risk, including the theories, methods, and measurements of tax risk, its determinants and consequences; and (2) Recommendations for future research agendas. From the review, we find that tax risk research still tends to be limited and understudied; many relevant research gaps can be identified. Finally, we suggest several research directions into 12 themes: corporate governance, executive personal characteristics, executive compensation plans, ownership structure, firm-level characteristics, the external market, institutional factor, accounting and auditing, operating environment, regulators and regulation, reputational costs, and others.

Abstract:Both practitioners and academics are increasingly focusing their attention on the riskiness of firms' tax planning activities. In this study, we examine how external auditors respond to tax risk, measured using the volatility of firms' annual cash and GAAP (Generally Accepted Accounting Principles) effective tax rates. Consistent with the notion that tax risk represents a source of engagement risk that is priced by external auditors, we first document a positive association between audit fees and tax risk incremental to fee premiums arising from tax aggressiveness. We also find that knowledge spillover benefits related to the provision of tax nonaudit services moderate this positive association. In supplemental tests, we provide evidence on additional auditor responses to tax risk. In particular, we document that tax risk is positively associated with both audit report lag and the likelihood of the auditor reporting a tax-related material weakness in the client's internal controls. Our findings add to the growing literature at the intersection of corporate taxation and auditing, and to the literature distinguishing between the level and riskiness of firms' tax avoidance strategies.

Abstract:ABSTRACT Risk oversight by the board of directors is a key component of a firm's enterprise risk management framework, and recently, boards have paid more attention to their firm's tax-planning activities. In this study, we use a hand-collected sample of proxy statement disclosures about the board's role in risk oversight and provide evidence that risk oversight is negatively associated with both tax uncertainty and overall tax burdens. We find that risk oversight is most strongly associated with positions that yield permanent tax benefits and also with less risky tax-planning activities. Overall, the evidence suggests that board risk oversight is associated with more effective tax-planning practices.

Abstract:Multinational enterprises make use of aggressive tax planning strategies because they are able to operate in the legal vacuum that exists between nation states. The tax burden is not mitigated by falsifying the facts of tax-relevant events (as in the case of tax evasion) or through simulation of certain transactions (as in the case of sham), but through careful use of existing gaps between tax rates. The present article describes the current situation with normative gaps in global taxation and erosion of national governance due to the loss of sovereignty and the extraterritorial application of national law. It is argued that a legal vacuum represents a substantial cost for nation states. To reduce this cost, the current international proposals are considered. The article aims to clarify whether and to what extent the BEPS Project has contributed to redefining the concept of “legal vacuum” in the international tax system. In particular, the question is whether, in order to prevent aggressive tax planning schemes, OECD member states are required to avoid situations of double non-taxation and cases of no or low taxation associated with practices that artificially segregate taxable income from the generating activities.

Abstract:This paper examines whether a perceived increase in tax audit aggressiveness is associated with lower tax planning effort and a higher quality of internal tax control frameworks. Using survey data on corporate tax functions from approximately 200 firms from different countries, contrary to expectations, we find that neither internal nor external resources devoted to tax planning are lower for firms that perceive an increase in tax audit aggressiveness. Nevertheless, for these firms, we find a positive association with the quality of their tax control framework and their investments in the reputation management and communication skills of their tax department staff. In line with this, we find that an increase in perceived audit aggressiveness is directly (indirectly) associated with an increase in resources allocated to the tax function "controversy and audit defense" ("risk management and governance"). In addition, our results show a positive relationship between the quality of the tax control framework and the need for comprehensive improvements in human capital and internal processes, suggesting that the tax control framework affects the firms' perceptions of their tax capabilities and drives organizational changes. Overall, these findings are in line with the rationale that an increase in audit aggressiveness changes the costs of compliance errors such that firms improve the quality of their tax control framework to reduce future errors. In contrast, it remains unclear whether tax audit aggressiveness actually changes tax planning behavior, as we find no negative association with the firms' investment in tax planning.

Abstract:The tax expenditure of real estate companies is a cost second only to the cost of land and construction and installation, which has a significant impact on the profits and cash flow of real estate companies. To strengthen tax planning and risk management and control, full-time tax positions can be set up within the enterprise. Taxation runs through almost the entire process of real estate development and operation, and tax planning and tax risk management should also be run through, and all nodes need to be coordinated.

Abstract:We study whether the corporate tax system provides incentives for risky firm investment. We analytically and empirically show two main findings: first, risk-taking is positively related to the length of tax loss periods because the loss rules shift some risk to the government; and second, the tax rate has a positive effect on risk-taking for firms that expect to use losses, and a weak negative effect for those that cannot. Thus, the sign of the tax effect on risky investment hinges on firm-specific expectations of future loss recovery.
