Abstract:The article describes the main issues of tort liability regulation in the context of the principle of justice and its implementation into the legislation and law enforcement practice of the Russian Federation and the People’s Republic of China (PRC). The comparative method of the study revealed critical differences in the provisions of Russian and Chinese tort law. The analysis of the domestic and foreign scientists’ works and judicial practice in disputes on compensation for harm contributed to findings and results related to the forms of justice implementation in these countries. The authors argue the dominance of procedural form of justice implementation in the Russian legal system but distributive form in the Chinese legal system. Positive and negative aspects of both forms are discussed. The reform of Chinese civil law which completely changed legal regulation of tort liability and excluded many of the controversial provisions of the previous PRC law on liability for offenses required new theoretical studies aimed at evaluating new laws. Comparison of the new tort law of the People’s Republic of China and the tort law of the Russian Federation is especially acute in connection with the objective to integrate the BRICS member countries against the background of the increasing conflicts in international arena. Optimization of legal norms by choosing the most effective model for the principle of justice would improve the protection of victims’ rights. In particular, the authors conclude that it is necessary to integrate the Russian and Chinese approach for determining the compensation and defining clear criteria for resolving disputes. In addition, possibility of the tort liability parties to agree on the procedure, time frame and amount of compensation should be set out under the law.

Abstract:The controversial formulation of paragraph 4 of Article 1109 of the Civil Code was the reason for its incorrect application. This led to the idea of the need for a restrictive interpretation of this norm. This approach, which originated in jurisprudence, has now been largely overcome by it, but it remains predominant in legal doctrine. Meanwhile, judicial practice has not yet formed a unified understanding of paragraph 4 of Article 1109 of the Civil Code. The present research aims to study the relevance of rejecting a restrictive interpretation of paragraph 4 of Article 1109 of the Civil Code. The article examines the history, foreign analogues, the nature and practice of application of this norm. As a result of the work the conclusion is made about the necessity of an expansive interpretation of paragraph 4 of Article 1109 of the Civil Code as a particular manifestation of the principle of good faith and the prohibition of abuse of right. Abstract:The object of tort law is the liability relationship of the infringement of civil rights.Right and interest are not paralleled.In tort law,the infringement of is the result of the infringement of rights.In a comparative law research,we found that all the foreign laws,especially the Japanese precedents,theories and the modification of the Civil Code,denied the existence of interests beyond rights.There was a kind of views in China that tort law should regularize not only the social relationship of the infringement of rights,but also the so-called relationship of the infringement of pure interests. It is not correct.In order to avoid arguments,we can also continue to use the regulations of Article 106 of the General Principles of the Civil Law: Citizens and legal persons who through their fault encroach upon state or collective property or the property or person of other people shall bear civil liability.

Abstract:Introduction: the authors examine the jurisprudence on claims concerning compensation for moral harm including that systematized in the Resolution of the Plenum of the Supreme Court of the Russian Federation No. 33 of November 15, 2022. The first explanations concerning compensation for moral damage were published almost 30 years ago, in 1994. Since then, great changes have occurred in social, economic, and cultural spheres, not to mention the development of legislation. The emergence of the citizens’ new legal interests and expectations with regard to the level of protection has required a more modern interpretation of the institution in question. Purpose: to identify trends in the interpretation and application of the rules on compensation for moral harm; to assess the legal positions set out in Resolution No. 33 in terms of their compliance with the legal doctrine, the potential for filling gaps in the legislation, the significance for the distribution of the burden of proof and more effective resolution of relevant disputes. Methods: dogmatic, historical, and comparative legal analysis. Conclusions: Resolution No. 33 generally reflects the approaches developed in the legal doctrine and judicial practice with regard to the grounds and conditions under which compensation for moral harm can be recovered, to the understanding of who the parties to this obligation are. The Resolution reflects the tendency toward expansion of the list of grounds for awarding compensation (for example, in case of damage to things of great non-property value to the victim; in case of illegal seizure of part of income and inability to maintain the previous standard of living). At the same time, the positions of the Supreme Court are characterized by excessive caution with respect to proof issues. The Plenum limited the effect of the presumption of moral harm to only some cases of violation of a natural person’s rights (damage to life or health, violation of consumer rights). There is no attempt in the Resolution to explain the criteria of causation and no mention of presumption of a causal link in certain circumstances, including in relation to illegal acts of public authorities and medical malpractice, where proving this precondition of liability may be difficult for the victim. Provision of detailed criteria for establishing the amount to be recovered as compensation for moral harm, instead of focus on the application of average amounts recovered in similar cases, is unlikely to have a significant impact on the practice of courts determining the amount of compensation in a rather arbitrary manner.

Abstract:Paragraph 1,Article 6 of The Law of Tortious Liability is the general clause of tortious acts.The literal interpretation and historical interpretation lead to a conclusion that it protects all kinds of rights and interests in private law,and protects them equally.But this answer will bring about serious negative effects.Therefore,a teleological reduction method must be adopted to clarify the factual elements in this rule,and the German restrictive model shall be followed.Regarding the rules under non-fault liability,fault-presumed liability and the responsibilities of "sharing losses fairly" or "reasonable reparation" ,most of them shall be interpreted to protect rights in rem only,or even certain kinds of rights in rem.The doctrinal arguments in this paper are based on a policy to balance the freedom on the one hand,and the security on the other.

Abstract:The law applicable to tortious liability involving a foreign element has become one of the most vexed questions in private international law. This can be attributed to technological advancements and the movement of people and goods across state lines. Accidents involving a foreign element are, therefore, reasonably foreseeable. Torts such as online defamation, accidents involving self-driving vehicles, and other technological acts involving a foreign element have heightened the possibility of cross-border torts. Considering the complexities associated with cross-border torts, the European Union (EU) has enacted the Rome II Regulation. The overarching objective of enacting the Rome II Regulation is to promote certainty and predictability when dealing with cross-border disputes, irrespective of the country of the court in which an action is brought in the EU. Conversely, Ghana relies on the broadly drafted section 54 of the Courts Act 459 of 1993 and common law principles of private international law to determine the aspects of choice of law. This has made the position in Ghana very uncertain and unpredictable due to the broad discretion given to courts under section 54 of the Courts Act, particularly in determining the law applicable to cross-border tort cases. Also, Ghanaian courts have applied the much-criticised double actionability rule to determine the rights and obligations of parties in cross-border tort cases. In light of the uncertain and unpredictable nature of Ghanaian law, some academics have suggested that Ghana adopt the traditional rule to determine the applicable law in torts. This article seeks to critically analyse the applicability of article 4 of the Rome II Regulation regarding non-contractual liabilities. The article compares how courts in EU member states have applied article 4 to determine the applicable law in torts, to how the Ghanaian courts use private international law rules to determine the applicable law in torts. The essence of the comparison is to ascertain whether Ghana can draw some legislative and judicial lessons from the position under article 4. In addition, the significance of the comparison is to determine whether the approach under the Rome II Regulation can serve as a basis for legal reforms in Ghana. Most importantly, the article explores the extent to which the legal approach under the EU law can bolster judicial certainty and predictability in Ghanaian law.

Abstract:Author in the article analyses unified conflict rules in international treaties of the Russian Federation in relation to the conflict rules’ mechanism of the Civil Code of the Russian Federation in determining applicable law to contractual obligations. Based on international treaties which contained conflict rules for contractual obligations author concludes that exclusively in relations among state parties of the Commonwealth of Independent States is applied a conflict rule based on an archaic lex loci contractus. At the same time article 1211 of the Civil Code of the Russian Federation and unified conflict rules of international treaties with states other than CIS’s parties based on contemporary and effective characteristic performance theory. The preservation of the lex loci contractus rule seems to be a conscious course of the post-Soviet states.

Abstract:The new Tort Liability Law of the People's Republic of China was finally adopted at the 12th Session of the Standing Committee of the 11th Chinese National People's Congress (NPC) on 26 December 2009 and came into effect on 1 July 2010. Thus a further great step in drafting a new Civil Code has been taken, after the enactment of the Contract Law in 1999 and the Law of Real Rights in 2007. In drafting the new Tort Law, the Chinese lawmakers have taken considerable account of foreign legal systems, but nevertheless it is a Chinese codification with many specific features which are of great interest for European lawyers. In the following the authors provide an overview of the most important provisions. As there exist no published legislative preparatory materials, no explanatory notes and no scholarly commentaries on the new Law, the authors had to overcome considerable difficulties in interpreting the new Law; the outcome is, of course, only a first and unavoidably subjective opinion.
Systematization of property claims in civil law

Abstract:The article deals with the problem of determining the list of real actions that could be taken to improve civil legislation and develop judicial practice. The main research method is comparative law. The article analyzes the civil codes of foreign countries on issues of property law protection, and also considers tort actions in defense of rights to things in common law. Attention is also paid to the historical development of the norms on the protection of property rights, starting from Roman private law. On the basis of historical analysis, a periodization of the development of ideas about real actions in civil law is proposed. On the basis of historical and comparative legal research, a system of real actions for Russian civil law de lege ferenda is proposed. The system of real actions includes five of its varieties and consists of the following methods of protection: a vindication action, a negatory action, an action for the recognition of a property right, an action for the acquisition of a property right, an action for the termination of a property right. At the same time, the problem of systematization of property actions remained unexplored for a long time due to the universal understanding of a negatory action. The rejection of such an interpretation of the negatory action allows us to take a new step and develop the revolutionary ideas of the pandektists in modern law.
Expertise in cases of compensation for moral damage caused by a crime

Abstract:On 15 November 2022, the Plenum of the Supreme Court of the Russian Federation published Resolution No. 33 "On the Practice of Application by Courts of the Norms on Compensation for Moral Damage", which replaced the 1994 clarifications. The peculiarity of the new ruling was an expanded list of circumstances, which, in the opinion of the highest court, the courts should be guided by when deciding the most difficult issue of applying compensation for moral harm in general - determining its amount. Numerous doctrinal studies are also devoted to the solution of this problem, the authors of which propose the introduction of appropriate formulas for calculating the amount of compensation, taking into account both the individual characteristics of the injured person and other circumstances relevant to the case (the degree of guilt of the offender, the intensity of the offence, etc.). At the same time, both the guidelines formulated by the Supreme Court and the formulas proposed in science do not take into account the difficulty in establishing the most important circumstance for the case of compensation for moral harm, the basis for its award - the presence of moral suffering as such. No matter how many reference points there are and no matter how accurate and unfolded the formulas are, the suffering caused by the offender, its depth, the degree of influence of the violation on the victim will always remain inaccessible for objective reasons for the court. As a consequence, these sufferings will inevitably be assessed by specific law enforcers on the basis of their own life experience, through the prism of their own perceived experiences and value systems, which means that the final amount of compensation will by definition be extremely subjective. The foregoing actualises the need to find such a way of establishing the existence of moral harm and the degree of moral suffering actually incurred by a person, which would allow the court to form a real picture of the actual psychological state of the victim in the most possible exhaustive way. The analysis of doctrinal studies shows a significant attention of authors to psychological and (or) psychiatric expertise - a mechanism, the use of which would significantly simplify the process of establishing the existence of grounds for compensation and, consequently, the determination of its amount. At the same time, despite a number of obvious advantages of such procedural measures, they also have a number of disadvantages: limited use in criminal proceedings, problems in the distribution of costs for their conduct and in the assessment of their evidentiary value in general. The use of forensic psychological and forensic psychiatric examinations is also complicated by the current narratives in law enforcement, which have become a consequence of contradictions in the positions of the Supreme and Constitutional Courts of the Russian Federation.
Reconstruction of Constituent Elements Theory of Tort by Interpretation

Abstract:With the enactment of the Tort Liability Law of PRC,the traditional constituent elements theory of tort has trapped into dilemma both in substance and in form.On the substantial level,the traditional theory does not distinguish interests from rights,so could merely solve simple and traditional cases of tort,and seems of less use when confronts complex and modern cases. On the formal level,there exists conflict between the traditional theory and the literal meaning of Paragraph 1,Article 6 of the Torts Liability Law.The traditional theory could not explain the relationship between Paragraph 1,Article 6 and Article 15 of the Tort Liability Law either. Therefore,it is necessary to reconstruct the constituent elements theory of tort according to the literal meaning of Paragraph 1,Article 6.That is,"infringement on right or interest" as provided by this paragraph should be considered as an independent constituent element of tort.As a result,it replaces the element of illegality in function and the element of damage in position.Thus the general constituent elements of tort include act,infringement upon right or interest,causation of liability establishment,and fault.These four elements are the common constituent elements of all kinds of tort liabilities provided by Article 15 of the Tort Liability Law.Meanwhile,compensation for damage,with two additional elements of damage and causation of liability scope,is merely one sort of tort liabilities. In order to apply the element of infringement on right or interest appropriately,it is suggested to introduce the theory of Interrelation which has been generally accepted in Japan.The theory aims to protect rights and interests distinctly,that is,rights and interests of different levels correspond to different standards of fault.To adapt to the function of this element,tort law should adopt a narrow view of right,in which right refers to absolute right with clear extension in the private law,while relative right,frame right and basic right should be classified as interests.
Punitive damages under the new Chinese Civil Code – a critical and comparative analysis

Abstract:Punitive damages have their roots in the common law system. Recently, punitive damages have been increasingly discussed also in non-common law jurisdictions. This Article scrutinizes whether it is viable for a jurisdiction with a civilian legal system to adopt punitive damages in the realm of tort law. It is argued that societal development has brought unprecedented challenges to tort law where merely compensatory damages can no longer provide sufficient remedies to victims. We conduct research mainly from the perspective of China, which has been very progressive in introducing punitive damages into various areas of private law in the past decades and recently codified it in its new Chinese Civil Code. The discussion of Chinese law is proceeded with a comparison with the German law, which is also a civilian legal system that used to have a great influence on the making of Chinese law. We find that the German private law put much emphasis on disgorgement damages, while the Chinese legislator put his trust in punitive damages. German disgorgement damages and Chinese punitive damages focus both on the avoidance of efficient breaches of ubiquitous individual legal rights, such as personality rights or intellectual property rights, but the Chinese legislator makes punitive damages also available in several other legal situations. We provide recommendations for the future implementation of the Chinese punitive damages law in order to maintain a balance between efficient protection for claimants and sanctions on wrongdoers.

Abstract:Contract is the law between the parties and binds parties of contact. When there is some economic relation between two contracts, the person who both are the parties of the two contracts may invoke the non - performance of the other party in the other contract to defense one self＇ s non - performance irt the other contract . The situation actually is the new type of the exception to privity of contract. Nowadays the legal theories don＇ t cover the situation, but in legal practice, there is a verdict supporting the defence. Abstract:Moral harm and the criteria for its determination have long been an object of scientific interest on the part of both legal scholars and practicing lawyers. The cross-sectoral nature of the problem of compensation for moral damage caused in connection with a committed crime leads to the need to clarify the issue of the procedure for considering cases of this category (in civil or criminal proceedings), as well as determining the conditions for its recovery. It is indicated that the fundamental factor is to establish the degree of guilt of the offender, the degree of physical and mental suffering for a citizen who is a victim of a criminal act. Conclusions and suggestions are made on possible improvement of procedural legislation and law enforcement practice in the field of consideration of cases related to compensation for moral damage caused by a crime. It is proposed to amend the Resolution of the Plenum of the Supreme Court of the Russian Federation «Some issues of the application of legislation on compensation for moral harm» dated December 20, 1994, No 10, supplementing it with criteria for determining the amount of compensation.

Abstract:The article deals with an actual and little-studied form of fictitious in law – fictitious legal relations. It is noted that fictitious legal relations are reflected in various branches of law, however, criminal liability is established for the most dangerous manifestations of them, enshrined in articles 197, 3222 and 3223 of the Criminal Code of the Russian Federation. The study of these crimes has shown that they contain some legal and technical defects that negatively affect the quality of the application of criminal legislation. It is concluded that it is necessary to consolidate the identical wording of fictitious bankruptcy in criminal and administrative legislation, to bring articles 3222 and 3223 of the Criminal Code of the Russian Federation into a unified form and supplement the note to article 3222 of the Criminal Code with the concept of fictitious registration of citizens of the Russian Federation, foreign citizens and stateless persons.

Abstract:This paper discussed the tort liability of bullying committed by multiple persons in various cases, based onTort Law of the People’s Republic of China and Theory of Respective Tort. According to whether the multiple bullies have common intent and conscious cooperation or not, multi-person bullying can be divided into joint bullying (with joint intent and conscious cooperation) and respective bullying (without conscious cooperation). There are two main research questions: 1) in the case of joint/group bullying, how to decide the liability of different roles among the group with common intention and conscious cooperation? Should bullying helper and bystander bear the tort liability? 2) on the occasion of respective bullying, how to identify the liability of different subjects (individuals or groups) without conscious cooperation when the interaction of their respective bullying action leads to cumulative same damage? The author believed that in joint bullying, the bullying helper and the bullies have a joint fault in the implementation of bullying, which constitutes joint tort and joint liability; while the tort liability of the bullying bystanders should be discussed based on their roles in the bullying action. In terms of multi-subject respective bullying, when the multiple bullying behaviors of the multiple subjects cause cumulative damage, those who constitute a typical respective tort shall bear sharing liability according to the causative potency; those who constitute a superposition of respective tort shall bear joint liability.
