Abstract:Moral harm and the criteria for its determination have long been an object of scientific interest on the part of both legal scholars and practicing lawyers. The cross-sectoral nature of the problem of compensation for moral damage caused in connection with a committed crime leads to the need to clarify the issue of the procedure for considering cases of this category (in civil or criminal proceedings), as well as determining the conditions for its recovery. It is indicated that the fundamental factor is to establish the degree of guilt of the offender, the degree of physical and mental suffering for a citizen who is a victim of a criminal act. Conclusions and suggestions are made on possible improvement of procedural legislation and law enforcement practice in the field of consideration of cases related to compensation for moral damage caused by a crime. It is proposed to amend the Resolution of the Plenum of the Supreme Court of the Russian Federation «Some issues of the application of legislation on compensation for moral harm» dated December 20, 1994, No 10, supplementing it with criteria for determining the amount of compensation.

Abstract:For a long time, the practice of criminal proceedings was based on the approach in which the moral damage in property crimes was not recognized by the bodies of preliminary investigation as a reason for civil law claims to compensate such damage as resulting from the crime. The conducted analysis of the opinions of different scholars showed that the overwhelming majority of proceduralists support the possibility of compensating moral damage in property crimes. The author pays special attention to a criminal case of fraud with intentional breach of contract in the sphere of entrepreneurship, where the bodies of preliminary investigation refuse to recognize the founder of the company that suffered property damage as the victim, and where the rights of the injured organization are represented by a bankruptcy trustee supervising the bankruptcy of the company. Using the decisions of the Constitutional Court of the Russian Federation on this problem, and the decrees of the Plenary Session of the Supreme Court of the Russian Federation, the author concludes that the procedural interest of the founder of the organization liquidated during criminal proceedings, and acting as the injured organization in the criminal case, consist in obtaining an independent procedural status of a victim, which gives this person an opportunity to actively participate in criminal prosecution, directly protect the rights and lawful interests or the injured organization alongside the bankruptcy trustee, and bring a civil action for the compensation of moral damage caused by the crime.

Abstract:Introduction: the authors examine the jurisprudence on claims concerning compensation for moral harm including that systematized in the Resolution of the Plenum of the Supreme Court of the Russian Federation No. 33 of November 15, 2022. The first explanations concerning compensation for moral damage were published almost 30 years ago, in 1994. Since then, great changes have occurred in social, economic, and cultural spheres, not to mention the development of legislation. The emergence of the citizens’ new legal interests and expectations with regard to the level of protection has required a more modern interpretation of the institution in question. Purpose: to identify trends in the interpretation and application of the rules on compensation for moral harm; to assess the legal positions set out in Resolution No. 33 in terms of their compliance with the legal doctrine, the potential for filling gaps in the legislation, the significance for the distribution of the burden of proof and more effective resolution of relevant disputes. Methods: dogmatic, historical, and comparative legal analysis. Conclusions: Resolution No. 33 generally reflects the approaches developed in the legal doctrine and judicial practice with regard to the grounds and conditions under which compensation for moral harm can be recovered, to the understanding of who the parties to this obligation are. The Resolution reflects the tendency toward expansion of the list of grounds for awarding compensation (for example, in case of damage to things of great non-property value to the victim; in case of illegal seizure of part of income and inability to maintain the previous standard of living). At the same time, the positions of the Supreme Court are characterized by excessive caution with respect to proof issues. The Plenum limited the effect of the presumption of moral harm to only some cases of violation of a natural person’s rights (damage to life or health, violation of consumer rights). There is no attempt in the Resolution to explain the criteria of causation and no mention of presumption of a causal link in certain circumstances, including in relation to illegal acts of public authorities and medical malpractice, where proving this precondition of liability may be difficult for the victim. Provision of detailed criteria for establishing the amount to be recovered as compensation for moral harm, instead of focus on the application of average amounts recovered in similar cases, is unlikely to have a significant impact on the practice of courts determining the amount of compensation in a rather arbitrary manner.

Abstract:The subject of this study is the social and legal nature of compensation for damage or other reparation for harm caused by environmental crimes. Currently, at the legislative level, there is no exhaustive list of possible ways to compensate for the rights violated as a result of a committed socially dangerous act containing all the signs of a crime. As a result, law enforcement agencies in the course of proceedings in a specific criminal case are vested with the right to independently assess specific post-criminal positive activity of a person who committed a crime and decide on its compliance with the method of making amends. At the same time, delegated powers in theory are perceived ambiguously. The purpose of the authors is to determine the essence and admissibility of a broad interpretation of the concept of "compensation for damage or other reparation for harm" in criminal law. Based on the analysis of provisions of current criminal legislation, clarifications of the Plenum of the Supreme Court of Russian Federation, investigative and judicial practice, doctrinal studies in the field of criminal, as well as environmental law, the authors come to the following conclusion. The list of ways to make amends for the harm caused by environmental crimes cannot be exhaustive (closed), and specific post-criminal socially beneficial actions must be legal and not infringe on the rights of third parties.

Abstract:It discusses the problematic issues of consideration and resolution in a criminal case of a civil claim for compensation for property damage or compensation for moral damage caused by a criminal offense. The essence and content of the "civil claim in the criminal process" is determined, the advantages are noted, and the problems of a civil lawsuit in the criminal process of Ukraine are discussed. The authors propose to consider the filing of a civil claim as a right of the victim, corresponding to the obligation of the criminal prosecutor's office and the court to take measures for the timely reparation of damages. Some reasons are revealed that complicate the implementation of the principle of inevitability of civil liability for a crime committed simultaneously with the procedure for convicting the perpetrator. As a conclsuion se proposes to develop new approaches to the institution of a civil lawsuit in the criminal process of Ukraine, contributing to the improvement of the activities of the criminal prosecution authorities and the court to restore the violated civil rights of victims of crime.

Abstract:In this article, an analysis of the norms of the current Italian legislation, which determines the grounds and procedure for compensation of moral damage, is carried out for the completeness of the regulation of social relations arising from the reasons for compensation of moral damage, as well as some problems that arise in judicial practice in the compensation of moral damage are considered. Taking this into account, the concept of moral damage was considered and its relationship with types of damage was analyzed, the procedure for applying various regulatory acts, the mechanism for regulating the compensation of moral damage, shortcomings and opportunities for improvement of this mechanism were analyzed; the available criteria for determining the amount of monetary compensation, the composition of persons who have the right to demand the protection of violated civil rights through compensation are evaluated. The subject of research in this article is the consideration of the causes of the emergence of the legal construction of compensation for moral damage, the study of the evolution of the mechanism of legal regulation of compensation for moral damage in Italy. The relevance of the study is due to the importance of studying the peculiarities of the regulation of the civil legal mechanism of the institution of compensation for moral damage and the need to systematize views on the understanding of the development of the mechanism of legal regulation of the institution of compensation. It is also necessary to note the importance of conducting a comparative analysis of moral damage compensation as a way of protecting civil rights. Several formulations of the concept of moral damage are named, a lot of attention is paid to the problems of defining this concept, conditions of responsibility for causing damage. The author notes that the experience of compensating moral damages in Italy can be useful to take into account when developing the legal regulation of Ukraine. The principle of compensation for moral damage reflects the recognition of the fact that the violation of rights can cause not only material damage, but also damage to the psychological well-being and dignity of the victim. Italian law allows persons who have suffered non- pecuniary damage to seek compensation from the person who caused such damage. Compensation for moral damage includes not only financial compensation, but also recognition of the violation of rights and public correction. Ukraine also has legislation regulating the compensation of moral damages, but the positive experience of Italy can be taken into account for its further improvement. For example, a possible perspective is the expansion of the categories of cases when compensation can be provided, as well as the clarification of the criteria for determining the amount of compensation. However, before implementing any changes in Ukrainian legislation, it is important to carefully study and adapt Italy's experience to the specific needs and peculiarities of Ukrainian society and the legal system. It is also necessary to ensure a high level of protection of the rights of persons who have suffered moral damage, and to ensure the implementation of compensation claims in a practical way.

Abstract:On 15 November 2022, the Plenum of the Supreme Court of the Russian Federation published Resolution No. 33 "On the Practice of Application by Courts of the Norms on Compensation for Moral Damage", which replaced the 1994 clarifications. The peculiarity of the new ruling was an expanded list of circumstances, which, in the opinion of the highest court, the courts should be guided by when deciding the most difficult issue of applying compensation for moral harm in general - determining its amount. Numerous doctrinal studies are also devoted to the solution of this problem, the authors of which propose the introduction of appropriate formulas for calculating the amount of compensation, taking into account both the individual characteristics of the injured person and other circumstances relevant to the case (the degree of guilt of the offender, the intensity of the offence, etc.). At the same time, both the guidelines formulated by the Supreme Court and the formulas proposed in science do not take into account the difficulty in establishing the most important circumstance for the case of compensation for moral harm, the basis for its award - the presence of moral suffering as such. No matter how many reference points there are and no matter how accurate and unfolded the formulas are, the suffering caused by the offender, its depth, the degree of influence of the violation on the victim will always remain inaccessible for objective reasons for the court. As a consequence, these sufferings will inevitably be assessed by specific law enforcers on the basis of their own life experience, through the prism of their own perceived experiences and value systems, which means that the final amount of compensation will by definition be extremely subjective. The foregoing actualises the need to find such a way of establishing the existence of moral harm and the degree of moral suffering actually incurred by a person, which would allow the court to form a real picture of the actual psychological state of the victim in the most possible exhaustive way. The analysis of doctrinal studies shows a significant attention of authors to psychological and (or) psychiatric expertise - a mechanism, the use of which would significantly simplify the process of establishing the existence of grounds for compensation and, consequently, the determination of its amount. At the same time, despite a number of obvious advantages of such procedural measures, they also have a number of disadvantages: limited use in criminal proceedings, problems in the distribution of costs for their conduct and in the assessment of their evidentiary value in general. The use of forensic psychological and forensic psychiatric examinations is also complicated by the current narratives in law enforcement, which have become a consequence of contradictions in the positions of the Supreme and Constitutional Courts of the Russian Federation.

Abstract:The purpose of the article is to conduct a comprehensive analysis of the theoretical and practical aspects of compensation for moral damage caused to an individual in connection with the treatment or provision of other medical services. The theoretical and legal grounds for moral damage in the medical sphere were investigated in accordance with the legislation of Ukraine, Hungary, Slovakia, Czech Republic, England, Sweden, and New Zealand. The practical experience of compensation for moral damage inflicted by medical workers was summarized on the basis of an analysis of cases that were considered by the European Court of Human Rights. In particular, 15 cases have been investigated, which clearly indicate that the court makes a lawful decision in favor of victims and awarding compensation to them for moral damage. According to the results of the study, the main shortcomings in the Ukrainian legislation on the compensation of moral damage in medicine were identified. In particular, there is proved the imperfection and collision of the normative base, which requires unification. A significant disadvantage is the lack of any criteria and limits in the legislation of Ukraine for determining the amount of inflicted moral damage. The necessity of introducing into the legal system of Ukraine the mechanisms for ensuring the implementation of compensation for moral damage caused by the provision of paid medical services is substantiated. In the context of this, it is proposed to create a special insurance fund for insurance payments, as well as to introduce the practice of conducting psychologico-psychiatric and psychologico-medico-psychiatric examinations to confirm the fact of causing moral harm.

Abstract:The employee is always the weaker party in labor relations, because it is the owner who determines the nature, regime and conditions of work, wages, the procedure for calculating fees and penalties. Taking into account the above, the Basic Law of Ukraine guarantees protection against illegal dismissal to all workers. In the case of abuse on the part of the owner, the employee, among other things, has the right to demand compensation for moral damage in the case when illegal dismissal led to his (her) suffering. The purpose of our article is to determine the specifics of compensation for moral damage, caused under the specified circumstances. In the course of the research, the conditions, under which moral damage at dismissal is deemed to have been caused by, were clarified. The grounds for the establishment of labor relations, which are an employment agreement, a contract as a specific form of an employment agreement, and a civil law contract, were defined. It is proved, that the fact of being in an employment relationship can be established extra judicially (by conducting negotiations with the employer or sending appeals simultaneously to the territorial bodies of the State Labor Service of Ukraine and the State Tax Service of Ukraine) or in court (on the basis of Article 315 of the Code of Civil Procedure Code of Ukraine). It is established, that moral suffering of the person, who was illegally dismissed, can be manifested in the victim's negative mental states (stress, depression, anxiety), which are reflected in his (her) consciousness. It is substantiated, that Ukrainian legislation does not directly list actions causing employee’s suffering; however, the Labor Code of Ukraine does not contain any restrictions or exclusions for compensation for moral damage in case of violation of the latter's labor rights. It is stated, that a three-month time limit applies to claims for moral damages in cases, provided for by labor legislation. However, in the case of exceeding it for valid reasons, the district, district in the city, city or city and district court may reinstate it

Abstract:The objective of this article is to reflect on the institution of extra patrimonial damage, more specifically moral damages. In most cases, the satisfaction of the reparation and compensation of the moral damage is given from the sole and exclusive perspective of the plaintiff, not taking into consideration the preventive, pedagogic/punitive effect of the defendant, causing an unbalanced relationship between the parties, frustrating the plaintiff in the search for Justice and reparation. As a consequence, companies/organizations repeatedly continue to practice such illicit acts against the person and the community, without even seeking to improve the situation. The contribution of the article aims to reflect, regarding the subject, taking into consideration the 02 (two) perspectives: plaintiff and defendant, related to the moral damage and the new adjectivation of the damage, contributing to the balance of the parties, in relation to the satisfaction of the repair in a fair way, with division into two premises: a) satisfaction of the right of personality, of the dignity of the human person; and b) the effectiveness of the discouragement for acts committed by the opposing party.

Abstract:The article is devoted to the study of the institution of compensation for moral damage in the field of labor, i.e. in cases where the employee’s labor rights are violated by the employer, and as a result, moral damage is caused, which is subject to compensation. Since the issue of compensation for moral damage in labor law remains debatable to this day, as there is no unambiguous scientific or legislative solution to it. Although the institution of compensation for moral damage in the field of labor is an important guarantee of the protection of workers’ rights. During the research, the current domestic legislation and the views of scientists on the raised issue were analyzed. In particular, it is stated that compensation for non-pecuniary damage in labor law has its own characteristics compared to compensation for non- pecuniary damage in civil law. Thus, the specifics of compensation for non-pecuniary damage in the field of labor lies in the subject structure of this legal relationship - the employee and the employer, where the employer has the obligation to compensate non-pecuniary damage, and the employee has the right to receive it in the presence of negative consequences of the violation of labor rights. Attention has been drawn to the fact that compensation for moral damage in labor law is proposed to be considered in three aspects: as compensation for moral damage caused to the employee; as an independent, special and universal type of employer’s responsibility; and as a way of protecting the rights of the employee in labor relations. It was concluded that the labor legislation regarding the legal regulation of issues of compensation for moral damage to the employee needs improvement, since it lacks a definition not only of compensation of moral damage in labor law, but also of moral damage in labor law, which , in turn, leads to the fact that the inflicted moral damage is not actually perceived as damage, it is simply ignored. At the same time, although the introduction of the institution of compensation for moral damages in labor law did not solve all the problems regarding the protection of human labor rights, it is evidenced by the fact that the constitutional provisions on the recognition of a person as the highest social value and the guarantee of his physical and moral safety by every state are gradually being implemented in the labor legislation.

The aim of the article is to study the influence of moral and ethical components and pragmatic approach in the compromise solution of criminal conflict between the state, the perpetrator and the victim of the legal nature of the right to compromise in the criminal process of Ukraine and the author’s definition of «right to compromise». in the criminal process of Ukraine «. The results of scientific research by the author of this issue were the conclusion that morality, in some cases, prevails over the imperative of legal liability for what is done in case of guilty remorse, evaluation and willingness to voluntarily make amends to the victim, compensating the latter. . A clear example of this is the mechanisms for exercising the right to compromise in criminal proceedings, which are enshrined in law and at the legislative level. After analyzing the moral and ethical and pragmatic components of the legal nature of the right to compromise in criminal proceedings, the author’s definition of the right to compromise in criminal proceedings in Ukraine – the right to receive values, benefits of a regenerative nature, which corresponds to the duty of the perpetrator both for the victim and for society, in order to restore the disturbed public peace, security and law and order.

Abstract:The article describes the main issues of tort liability regulation in the context of the principle of justice and its implementation into the legislation and law enforcement practice of the Russian Federation and the People’s Republic of China (PRC). The comparative method of the study revealed critical differences in the provisions of Russian and Chinese tort law. The analysis of the domestic and foreign scientists’ works and judicial practice in disputes on compensation for harm contributed to findings and results related to the forms of justice implementation in these countries. The authors argue the dominance of procedural form of justice implementation in the Russian legal system but distributive form in the Chinese legal system. Positive and negative aspects of both forms are discussed. The reform of Chinese civil law which completely changed legal regulation of tort liability and excluded many of the controversial provisions of the previous PRC law on liability for offenses required new theoretical studies aimed at evaluating new laws. Comparison of the new tort law of the People’s Republic of China and the tort law of the Russian Federation is especially acute in connection with the objective to integrate the BRICS member countries against the background of the increasing conflicts in international arena. Optimization of legal norms by choosing the most effective model for the principle of justice would improve the protection of victims’ rights. In particular, the authors conclude that it is necessary to integrate the Russian and Chinese approach for determining the compensation and defining clear criteria for resolving disputes. In addition, possibility of the tort liability parties to agree on the procedure, time frame and amount of compensation should be set out under the law.

Abstract:"Criminal law, like other branches of law, is subject to the same moral principles, however, it is in criminal cases that a judge often resorts to ethical categories, since the type of punishment imposed may affect not only the restriction of the accused’s fundamental rights and freedoms, but also the future security of society. The purpose of the Article is to analyse the phenomena of morality and law as related categories in the administration of justice in criminal cases, and the importance of maintaining a balance between them when assessing evidence and imposing punishment in order to render a fair and impartial court decision. Given the peculiarities of the goal, the author has chosen a systematic approach based on general scientific and special scientific research methods, including systemic and structural, formal legal, comparative legal and other methods. Based on the legal analysis of current Ukrainian case law, the author identifies the real ethical challenges, which a judge faces when considering criminal cases and how to overcome them, resulting in a moral and fair decision supported by the law. The author also focusses on the insufficient coverage of numerous moral challenges in criminal cases among Ukrainian judges and provides suggestions on possible measures to improve educational activities in this area. Rehabilitation in criminal cases of private prosecution: problems of theory and practice

Abstract:Urgency of research. According to Articles 2, 17, 46 of the Constitution of the Russian Federation, the human being, his rights and freedoms are recognized as the supreme value, and observation and protection of these rights and freedoms is a duty of the State; every citizen is guaranteed judicial protection of his rights. Criminal proceedings, which from a social point of view serve as a tool to protect the rights of victims of crimes, are based on a public-law basis. The initiation of criminal proceedings, preliminary investigation and trial are the responsibility of the competent public authorities. At the same time, in the case of unlawful or unjustified prosecution of a person, the harm caused to him is compensated at the expense of the federal budget in the framework of the rehabilitation procedure. At the same time in Russian criminal proceedings there is the so-called private prosecution: for some offenses criminal prosecution is initiated and carried out only by the victim, who is granted the status of a private prosecutor. The state in cases of private prosecution is represented only by the court, which resolves the criminal-legal conflict between the victim and the accused. Problem Statement. Since state bodies do not prosecute cases of private prosecution, the question arises whether rehabilitation of defendants, against whom the case was terminated or acquitted, is admissible. Currently, the legislation provides rehabilitation in cases of private prosecution only in cases where the court of first instance issued a verdict of guilty, which was subsequently overturned by a higher court. At the same time, the question of whether the accused, against whom there was no conviction and the criminal prosecution was terminated in the court of first instance, is entitled to compensation is not resolved. On the one hand, the accused, being subjected to criminal prosecution, has undergone certain negative consequences. On the other hand, it is not clear whether the private prosecutor should be considered «guilty» of making an unsubstantiated accusation. There is a clear competition between two constitutionally guaranteed rights: the right of the victim to protection from crime, including through independent appeal to court to bring the perpetrator to criminal liability, and the right of the person to compensation of damage caused by unjustified criminal prosecution. Objectives and methods of research. The purpose of the study is to establish the grounds for the emergence of a person’s right to rehabilitation and to compensation for harm caused by unjustified criminal prosecution, to determine the subject and the procedure of compensation for harm. Research objectives: to analyze the legislation on rehabilitation in cases of private prosecution; to systematize the normatively enshrined grounds for the right to rehabilitation in this category of cases; to clarify the possibility of compensation in cases where the criminal prosecution was carried out only by a private prosecutor; to determine the procedure for compensation. The methodological basis of the study was the method of dialectical materialism. General scientific methods of scientific knowledge were used: logical, systematic, functional, induction and deduction, analysis and synthesis, as well as special methods: comparative-legal, formal-legal. Results and key conclusions. In cases of private prosecution it is necessary to distinguish occurrence of the defendant’s right to rehabilitation in the criminal procedural sense (when the court of first instance rendered a guilty verdict, which was subsequently overturned by a higher court), and the right to compensation for damages (when the criminal prosecution was carried out by a private prosecutor and was terminated by the court of first instance). At the same time, the right to compensation arises only if the victim’s actions are malicious and if they constitute crimes such as slander or knowingly false denunciation. In other cases, the victim exercises their constitutional right to access to justice and to protection from crimes.

Abstract:The article reveals the role and issues of civil liability for breach of contract. It is determined that without the possibility of bringing the violator to justice, the performance of a civil obligation itself loses the quality of obligation and gives the debtor contempt for performance. Responsibility can take many forms. The most important of these are damages and damages by the debtor to the creditor. The main and universal form of liability is compensation for damages caused by breach of obligation. Conditions different from those provided for in the Civil Code may be established by law or contract for the implementation of a specific form of liability. The essence of liability for breach is that it, first, reimburses the creditor for property losses caused by breach of obligation by the debtor; secondly, encourages the debtor to properly fulfill the obligation; third, punishes the debtor for non-performance or improper performance; fourth, to some extent, it encourages the creditor to enter into an obligation, as it provides compensation for possible losses caused by the failure of the counterparty; fifth, it confirms in the eyes of others the facts of the debtor's indiscipline. It is important in determining the civil liability for breach of contract to comply with the principles of good faith and reasonableness of the parties to civil relations, which should be applied in assessing the actions of the debtor. Prosecution is the implementation of the sanction of the legal norm established in the case of a civil violation. That is, the liability to which a violator of a civil obligation can be held is one of the most important institutions of civil law. The issue of civil liability for breach of contract is a very important element of protection of the human right to civil protection.
Disgorgement of profits: analysis of judicial practice

Abstract:The rule of disgorgement of profits is set out in paragraph 2 of Article 15(2) of the Civil Code of the Russian Federation (hereinafter – Civil Code) as a general remedy. Disgorgement of profits is called this rule in common law countries. It is analyzed. The idea of equity is a basis to force a person who has violated someone’s right to transfer the unlawful profit from such a violation to the plaintiff. The idea that an offender is not allowed to benefit from unlawful or dishonest conduct is supported by judicial practice and doctrine, and is enshrined in Article 1(4) of the Civil Code. There is little practice in applying this rule. Examples include violations of intellectual property rights, other absolute rights, negative confidentiality obligations, contracts, etc. In other cases, disgorgement of profits may arise from the specifics of the violated responsibility. The practice of disgorgement of profits from violation of fiduciary duties is considered. It is established that the nature of disgorgement of profits by violating someone’s right is not certain. The law uses the term «lost profits». Therefore, this institution can be interpreted as a way to calculate losses equal to profits. The defendant may refute this and provide evidence that the plaintiff himself would not have made such a profit. Is it allowed however to take all the profits from the defendant, if the plaintiff has no damages, and the defendant’s profit is large? Should the full profit of the defendant from the violation of the plaintiff’s right belong only to the plaintiff? It is possible to limit the compensatory nature of civil liability and to highlight its preventive and punitive function in the case of «cynical» violations.

Abstract:The implementation of EU legislation into Ukrainian domestic legislation is becoming more and more relevant, given Ukraine’s determination to follow the European integration route and the grant of EU candidateship to Ukraine in the summer of 2022. Competition law is undoubtedly one of the current priority fields for the EU, as it ensures and guarantees the development of the internal market. Simultaneously, in recent years, not only the creation of a competitive environment but also the provision of a right to compensation for damages caused by an infringement of competition law, as a specific type of compensation outside the traditional branch of civil law, has been crucial in the EU. To address the peculiarities of compensation for damages in competition law, the EU adopted Directive 2014/104/EU. The adoption of Directive 2014/104/EU and the outline of its main provisions and principles were based on several landmark decisions of the CJEU. For Ukraine, the issue of compensation for damages in competition law is new and unexplored in the scientific, let alone legislative, field, as there are almost no scientific publications on this question.Therefore, it is vital for Ukrainian legal science and practice to explore the formation and development of provisions regulating the issue of compensation for damages caused by infringements of competition law in the judgments of the CJEU and EU legislation, as well as the fundamental principles and provisions set out in Directive 2014/104/EU. All eight principles, enshrined in the Damages Directive serve as a basis for numerous provisions of the Directive. Among these, the principle of full compensation for damages, which is reflected in almost every norm related to consumer rights, can be considered fundamental for the entire field of compensation in EU competition law.It is critical to implement the defined principles and other provisions of the Damages Directive in Ukrainian competition legislation once Ukraine wins the war.

Abstract:The object of research in this article is the legal aspects of compensation for harm caused to children who have been subjected to violence in the virtual space. The development of information and communication technologies has led to the emergence of new types of violence, such as cyberbullying, online harassment and child pornographic content. In this regard, the motivation of the study is the need to analyze compensation for harm as a way to protect the rights of children who have suffered from violence in the online environment. The authors used methods for analyzing research data conducted in the field of law, psychology and information technology, reviewed existing legislative measures and international standards regulating this problem, and also analyzed the effectiveness of legal mechanisms for protecting children from virtual violence. Recommendations are offered to improve the protection of the rights of children subjected to violence in the virtual space. The article was prepared under the project IRN BR 27882414 “Program for the support and rehabilitation of child victims of violence: practical implementation of a network of modular resource centers.” The presented results are important for solving the problem of compensation for harm to children subjected to violence in the virtual space. They can be used to create rehabilitation and assistance programs for children who have suffered from online violence and for further research into the problem.
