Abstract:The article (in Italian) proposes critical considerations on the relationship between criminal law, genocide denial and freedom of expression. After a brief summary on the genesis of the notion of 'genocide' in international criminal law, it looks at the scholarly debate discussing its applicability to the Armenian case. The analysis then focuses on the implications of ECtHR Grand Chamber judgement on the Perinçek v. Switzerland case. These implications become the starting point for am axiological and teleological critique of the use of criminal law to sanction opinions (included despicable opinions), and of the underlying theory of 'militant democracy' formulated by Carl Loewenstein in 1937. The final sections of the article, in light of this critique, propose an alternative model of 'tolerant democracy', finding evidence of its necessity, inter alia, in some unforeseen and contradictory consequences of the aggravating circumstance of genocide denial introduced in Italian criminal law.
