Abstract:Abstract In a bid to implement the Electronic Transactions Act 2015, Tanzania initiated the adoption of a National Public Key infrastructure (PKI) framework. However, the plan has not been executed as expected because of certain gaps and ambiguities in the laws. This article examines the existing laws providing for the legal validity, admissibility and enforceability of electronic signatures especially using PKI; identifies the weaknesses of the existing laws and recommends new laws relevant to PKI that should be considered, and their rationale. Abstract:Electronic signature, owned by the owner is a matter of trust, and it may be difficult for the other contracting party to verify its authenticity , hence the importance of dealing with and organizing digital signature is of paramount importance., The aim of this study is to compare the legislation of the EU and Jordan in governing the responsibility of the authentication service provider concerning electronic signature, to find out whether there is a lack of organized legislation with regard to the work of electronic signature service providers. The article will also examine the adequacy of general regulations in supervising the duties of electronic service providers under Jordanian law. I will emphasize the importance of establishing specific regulations, and the need to establish special rules for this particular responsibility, especially with regard to the development of specific rules in line with the UNCITRAL model law on electronic signatures. As regards the EU directives on electronic signatures and other international legislations, it must be emphasized that the issue of electronic authentication services raises several legal problems that can be resolved. Among others the legal nature of the liability of electronic authentication service providers, their legal basis, and their establishment are still subject to legal controversy. In addition to the scope of this responsibility and the issue of determining the extent of compensation that can be imposed in the event of harm to the customer or others, the Jordanian legislators have not established a specific legal system for the responsibility of the employer and the electronic authentication provider to clarify all the ambiguities to which electronic banking operations are exposed to in order to create an independent and sustainable legislative environment for all the rapid technological development.

Abstract:Objective: The purpose of the article research of the topic is represented in showing the role of E-notification in accelerating the litigation proceedings in civil lawsuits, as it saves time, effort, and expense, as well as addressing the problems of traditional notification, and propose recommendations to complete the legal system concerned. Method: In the current research, which is based on the analysis of legal texts, the analytical approach and the comparative approach were adopted. A comparison was made among the" Iraqi Civil Procedure Law No. (83) of 1969 amended by Law No. (10) of 2016", and the UAE Federal Civil Procedure Law No. (11). ) for the year 1992 amended by Law No. (15) for the year 2021 and its bylaw No." (57) for the year 2018 amended by Law No. (75) for the year 2021". Results: Some valuable findings have been revealed such as The electronic notification is an effective way to accelerate the judicial proceedings because it prevents the recurrence of notification, and reduces the objection to the judgments in absentia due to the certainty of informing the defendant in addition to the ease of the notification process, regardless of the location of the defendants. Conclusion: The research employs theories that Electronic notification is a result of the advancement of current communication techniques as well as the pervasive use of mobile devices and the Internet across a variety of aspects of economic and social life. Despite this development, the Iraqi legislator still maintains the same traditional means that he put in place when enacting the Civil Procedure Code. He excluded the electronic means from all judicial proceedings from the scope of the electronic signature law, including proceedings related to the judicial notification. On the contrary, the UAE legislator adopted electronic judicial notification in order to accelerate such civil litigation proceedings.

Abstract:The internet environment, which transforms/changes our definitions of the concept of communication and our social life, and the new media order it brings, requires new and different legal regulations. The validity of social morality and legal rules that regulate the rules of living together in societies living in the unity of space and time, in an environment where space and time become meaningless, and people become anonymous with virtual identities apart from their real identities is debatable. The new media needs its own ethical and legal regulations that are compatible with the constantly changing conditions with the developments in technology. In this respect, it is essential that both states and international organizations can balance freedoms, especially personal rights and freedom of expression, on the one hand. On the other hand, it is essential to bring applicable rules in this area, which has a complex structure to control, independent of international borders. Freedom of expression has gained a strong, fast, and practical usage area with the development of new media technologies and the spread of social media platforms that allow user-derived content and interaction. However, social media platforms operating as global commercial enterprises may encounter significant problems in the process of balancing between the violation of personal rights and freedom of expression. Economic, political, and legal conflicts of interest between states, social media platforms, and users carry the regulations mentioned above to a sensitive dimension. This study is based on the freedom of expression and personal rights of Law No. 7253, which was adopted on 29.07.2020 and published in the Official Gazette on 31.07.2020. aims to be examined in context. These two rights, which are often contradictory and which are supposed to be handled within the framework of the concept of superior value, have found a new and largely uncontrolled area with social media platforms. On the other hand, with the heavy sanctions envisaged by Law No. 7253 includes the threat of turning social media platforms into a kind of censorship mechanism by encouraging them to remove content.
Electronic signature and attestation in conveyancing practice: A Malaysian legal perspective

Abstract:Background The Corona Virus Disease 2019 (COVID-19) pandemic brought about an unprecedented disruption to global business activities. Physical face-to-face activities must be restricted due to movement control order (MCO). The clients are required to sign the documents physically in the presence of the solicitor who must subsequently attest to the signature of the clients. The issue arises whether electronic signature (e-signature) and attestation are permissible under the laws of Malaysia. The aim of this research was to study the legality of e-signature and attestation in conveyancing practice in Malaysia and subsequently to propose recommendations to overcome these issues. Methods This is qualitative study and not an empirical study. The data was collected by library-based research from various primary and secondary data sources, including case law in Malaysia, written statutes, publication of journal and article. Results The Digital Signatures Act 1997 (DSA) and the Electronic Commerce Act 2006 (ECA) have legalised e-signatures. The DSA is the law that governs the digital signatures in Malaysia. ECA has listed a few documents which are not legally accepted if signed electronically, namely Power of Attorney, the Wills and codicils, the Trusts, and negotiable instruments. However, with regards to the issue of attestation of these documents, there are no clear laws which govern the attestation. The legal issue arises when the lawyers who have attested these documents are liable to be called as witness under the Evidence Act 1950 to testify their signature if these documents are tendered as evidence in any court proceedings. Conclusion Thus, it is suggested that there is a need for unique legal framework for e-signature and attestation in Malaysia due to the lack of specific laws which govern the issues of electronic signature and attestation.

Abstract:This research aims to investigate underlying factors that play role in citizens' decision to use e-government services in Turkey. UTAUT model which was enriched by introducing Trust of internet and Trust of government factors is used in the study. The model is evaluated through a survey conducted with Turkish citizens who are from different regions of the country. A total of 529 answers collected through purposive sampling and the responses were evaluated with the SEM (Structural Equation Modeling) technique. According to the results, Performance expectancy, Social influence, Facilitating conditions and Trust of Internet were found to have a positive effect on behavioral intention to use e-government services. Additionally, both Trust factors were found to have a positive influence on Performance expectancy of e-government services, a relation which, to our best knowledge, hasn't been tested before in e-government context. Effect of Effort expectancy and Trust of government were found insignificant on behavioral intention. We believe that the findings of this study will guide professionals and policy makers in improving and popularizing e-government services by revealing the citizen's priorities regarding e-government services in Turkey.

Abstract:Personal data is collected and stored more than ever by the governments and companies in the digital age. Even though the data is only released after anonymization, deanonymization is possible by joining different datasets. This puts the privacy of individuals in jeopardy. Furthermore, data leaks can unveil personal identifiers of individuals when security is breached. Processing the leaked dataset can provide even more information than what is visible to naked eye. In this work, we report the results of our analyses on the recent "Turkish citizen database leak", which revealed the national identifier numbers of close to fifty million voters, along with personal information such as date of birth, birth place, and full address. We show that with automated processing of the data, one can uniquely identify (i) mother's maiden name of individuals and (ii) landline numbers, for a significant portion of people. This is a serious privacy and security threat because (i) identity theft risk is now higher, and (ii) scammers are able to access more information about individuals. The only and utmost goal of this work is to point out to the security risks and suggest stricter measures to related companies and agencies to protect the security and privacy of individuals.

Abstract:Since its establishment in 1923,the parliamentary election system of the Republic of Türkiye has undergone an evolutionary development for almost a century.Specifically,it reflects the development from two-degree elections during the one-party period,to single-degree elections during the multi-party period,and from list-based majority system to proportional representation system.The parliamentary threshold and the allocation of seats based on the D'Hondt law have been the main features of Turkish parliamentary electoral system since the 21st century.Türkiye's transition from parliamentary system to presidential system,following the constitutional referendum of 2017,has been an important historical opportunity for the development of the country's electoral system.One of the new changes brought about by this is the birth of the electoral alliance mechanism.Historically,Turkish political parties have also cooperated in elections,but most of them ended in failure.With the introduction and implementation of'7102 Sayili Kanun',electoral alliance gained legal status for the first time.The major party alliances that emerged from this process represent a new form of party cooperation in Türkiye.Since the establishment of the presidential system,electoral alliance,as an important mechanism of the Turkish electoral system,have not only played an important role in Türkiye's general elections,but have also had a profound impact on Türkiye's political development today.
Basic electronic health record (EHR) adoption in **Türkiye is nearly complete but challenges persist

Abstract:Background: The digitalization studies in public hospitals in Türkiye started with the Health Transformation Program in 2003. As digitalization was accomplished, the policymakers needed to measure hospitals' electronic health record (EHR) usage and adoptions. The ministry of health has been measuring the dissemination of meaningful usage and adoption of EHR since 2013 using Electronic Medical Record Adoption Model (EMRAM). The first published study about this analysis covered the surveys applied between 2013 and 2017. The results showed that 63.1% of all hospitals in Türkiye had at least basic EHR functions, and 36% had comprehensive EHR functions. Measuring the countrywide EHR adoption level is becoming popular in the world. This study aims to measure adoption levels of EHR in public hospitals in Türkiye, indicate the change to the previous study, and make a benchmark with other countries measuring national EHR adoption levels. The research question of this study is to reveal whether there has been a change in the adoption level of EHR in the three years since 2018 in Türkiye. Also, make a benchmark with other countries such as the US, Japan, and China in country-wide EHR adoption in 2021. Methods: In 2021, 717 public hospitals actively operating in Türkiye completed the EMRAM survey. The survey results, deals with five topics (General Stage Status, Information Technology Security, Electronic Health Record/Clinical Data Repository, Clinical Documentation, Closed-Loop Management), was reviewed by the authors. Survey data were compared according to hospital type (Specialty Hospitals, General Hospitals, Teaching and Research Hospitals) in terms of general stage status. The data obtained from the survey results were analyzed with QlikView Personal Edition. The availability and prevalence of medical information systems and EHR functions and their use were measured. Results: We found that 33.7% of public hospitals in Türkiye have only basic EHR functions, and 66.3% have extensive EHR functions, which yields that all hospitals (100%) have at least basic EHR functions. That means remarkable progress from the previous study covering 2013 and 2017. This level also indicates that Türkiye has slightly better adoption from the US (96%) and much better than China (85.3%) and Korea (58.1%). Conclusions: Although there has been outstanding (50%) progress since 2017 in Turkish public hospitals, it seems there is still a long way to disseminate comprehensive EHR functions, such as closed-loop medication administration, clinical decision support systems, patient engagement, etc. Measuring the stage of EHR adoption at regular intervals and on analytical scales is an effective management tool for policymakers. The bottom-up adoption approach established for adopting and managing EHR functions in the US has also yielded successful results in Türkiye.

Abstract:Since the energy crises in the 1970’s, public and private decision makers are considering how to achieve a sustainable transition from fossil fuel based energy to sustainable and clean energies – namely renewable energies. Combined with the improvement of energy efficiency and the rational use of energy, renewable energy can provide everything fossil fuels currently offer in terms of heating and cooling, electricity generation and transportation. Renewable energy technologies posses many long term benefits including energy security, job creation, business opportunities, sustainable development and prevention of global warming.Turkey’s population is growing at an annual rate of 1.04%. If Turkey uses only traditional energy sources, it simply will not have enough energy capacity for its population. Renewable energy sources have the potential to make a large contribution to Turkey’s sustainable and independent energy future.Turkey aims to utilize its energy potential, including from renewable sources in a cost-effective manner. Turkey targets the share of renewable resources in electricity generation to be at least 30% by 2023 has in its 2009 Electricity Market and Security of Supply Strategy. Positive achievements have been obtained in renewable energy development and manufacturing in Turkey over the past decade. The renewable energy related legislation has been intensified. To meet its 30% target, the current promotion mechanism for renewable sources of electricity relies on feed-in tariffs for different renewable energy sources. Large hydropower is already competitive to conventional fossil-based electricity, so feed-in tariffs in the new RE Law are set to facilitate expanding the deployment of other, less mature renewable energy technologies.

Abstract:In this updated edition of the well-established practitioner text, Stephen Mason and Daniel Seng have brought together a team of experts in the field to provide an exhaustive treatment of electronic evidence and electronic signatures. This fifth edition continues to follow the tradition in English evidence text books by basing the text on the law of England and Wales, with appropriate citations of relevant case law and legislation from other jurisdictions. Stephen Mason (of the Middle Temple, Barrister) is a leading authority on electronic evidence and electronic signatures, having advised global corporations and governments on these topics. He is also the editor of International Electronic Evidence, and he founded the innovative international open access journal Digital Evidence and Electronic Signatures Law Review in 2004. Daniel Seng (Associate Professor, National University of Singapore) is the Director of the Centre for Technology, Robotics, AI and the Law (TRAIL). He teaches and researches information technology law and evidence law. Daniel was previously a partner and head of the technology practice at Messrs Rajah & Tann. He is also an active consultant to the World Intellectual Property Organization, where he has researched, delivered papers and published monographs on copyright exceptions for academic institutions, music copyright in the Asia Pacific and the liability of Internet intermediaries.

Abstract:In the world, ADR (Alternative Dispute Resolution) methods are becoming increasingly popular because of a heavy caseload of tribunals/courts, and the resolution of individual employment disputes through ADR is part of this trend. However, there have always been concerns regarding the use of ADR for the resolution of employment disputes, particularly due to the potential power imbalance between the disputants. These concerns are mutual in the comparison countries of this research: the United Kingdom (UK), with its long and honourable history of ADR in individual employment disputes, and Turkey, which has recently started to employ ADR methods for these disputes. The concerns revolve around: (i) whether confidentiality acts as a ‘curtain’ that prevents stakeholders from assessing whether the procedure is justly managed or whether employees have been pressured to settle; (ii) whether representatives are accessible, whether there are providers of legal counsel for employment disputes, and whether the governments offer legal aid for individuals who cannot afford the cost of representation; (iii) the types of evidence that can be submitted in ADR processes and whether there is an enforcement mechanism in case of resistance to providing necessary documents for ADR meetings. Consequently, it must be highlighted that the same set of rules should not be applied to all kinds of disputes. Due to the potential power imbalances in employment disputes, necessary precautions must be taken to ensure access to justice. On this basis, this research illustrates how ADR regulations in Turkey and the UK should be adjusted to align with the unique structure of employment disputes.

Abstract:The object of this article is an electronic digital signature that allows to identify the author of the document. An electronic digital signature is some details of the source document obtained by converting information using special cryptographic algorithms. In addition to determining the author, it also allows to check the accuracy of the information and evaluate its distortion from the moment of the formation of the signature itself. As part of the scientific work, a software product was created that was able to sign electronic documents using one of the well-known cryptographic algorithms, and the prospects for the development of this direction were also analyzed. Despite the fact that the electronic signature has not yet become widespread, there is a high probability that its widespread adoption in public and private institutions is expected in the very near future.

Abstract:This study aims to identify and analyze the acknowledgment of signatures on an electronic document in the evidence of civil procedural law in Indonesia, and to find out and analyze the implementation of civil dispute resolution submitted by the parties by means of electronic documents signed with digital signatures. The method used in this research is to use an empirical juridical approach. Electronic documents, in this case digital signatures, can be used as evidence in court, which is an extension of the evidentiary law in Indonesia after the ITE Law, but only has the power of proof as an underhand deed not as an authentic deed. In the process of settling a lawsuit for civil proceedings through litigation media, it is carried out amicably first by means of a peace made by the party concerned without the assistance of an authorized official. Efforts to settle through non-litigation media can be carried out in three ways, including arbitration, negotiation, and mediation.

Abstract:Science, Ethics, Solidarity... These three words are mottos of Psychiatric Association of Türkiye (PAT), since its foundation in 1995. In accordance, PAT has Code of Ethics for more than 20 years. There are many developments and changes both in practicing psychiatry and in the community in the last couple of decades. As a result, many new ethical questions, dilemmas and approaches arise for psychiatry. PAT had decided to update the Code of Ethics about two years ago and the updating process is almost on the edge of finalization. In this presentation, main points of the updated and newly written principles will be summarized with special references to recent developments in the world and updated or newly written international Code of Ethics such as, EPA, WPA, and several national associations' documents. One of the most important outcome and benefit of such an updating process is modelling the project on a participatory base, having wide feedback and inputs from experts (as many as possible, enriched by diverse interests of related disciplines) and reaching as many colleagues as possible from different working conditions. Abstract:Electronic litigation ensures the accessibility of trial proceedings and court records to the general public by utilizing electronic documents and an electronic case management system. Information Technology (IT) enables litigation to be conducted expeditiously. In this regard, electronic litigation not only facilitates fair and efficient trials but also enhances public trust in the judicial system. However, the implementation of electronic litigation requires the legislation for electronic litigation and the development of systems to facilitate its operation. Initially hesitating the adoption of electronic litigation, Japan fully embraced it by revising the Civil Procedure Act of Japan in 2022. This revision encompasses a broad range of modifications to the civil litigation system, including not only the digitalization of civil litigation, but also the introduction of expedited procedures, the implementation of a protective measure for party identification, and the establishment of procedures for the investigation of electronic evidence. The primary objective behind Japan's reform of civil litigation adopting electornic litigation is to enhance procedural efficiency and effectiveness, improve litigant accessibility, and ultimately uphold the principles of fairness in trials, thereby elevating the overall quality of the judicial process. This paper focuses on three key aspects: 1) online filing and service, 2) electronic courtroom, and 3) electronic case management. By conducting a comparative study on the provisions of electronic litigation between Japan and Korea, it can be expected to introduce implications with regard to electronic litigation in Korea.
