Abstract:This essay, a companion piece to “Discipline and Punish: despatches from the citation manual wars and other (literally) unspeakable stories” [Law's cultural mediations, special edition. 2001. Griffith Law Review 10(2)], undertakes a situated and critical cultural analysis of US law, with particular attention to the law school's insistent “training for hierarchy” and the interrelationship of that training with the bodies and texts that are constitutive of judge-made law in the United States. This essay revisits the early orientation of cultural studies work towards interrogating subject-formation and critically positioning and problematizing the scholarly subject and the various institutions, discourses and practices that produce both her subject position and her critical practice. At the same time it also stages an anti-racist, anti-sexist, and anti-classist engagement with the congeries of mechanisms by which hegemony is inscribed, reproduced, and accorded value by a range of practices to do with disciplinary texts and their production within US legal institutions. Both “semiotic”/“textualist” and “culturalist”, then, in orientation, this essay finds little space for celebration or play, although it alludes in its title, inter alia, to Inventing the Abbots, an artifact of popular US cinema that was at once both a reinscription of the family romance and an exploration of the mutually reinforcing and corrosive effects of class, sexism and secrets/silence. Finally, the essay seeks to explore questions raised by Meaghan Morris and Gayatri Spivak about the possibility or radical transformation through such critical cultural practice and the risks of iteration that is complicity, of submission to and collaboration with disciplinary violence, and of the complex politics of negotiation.
