Abstract:Drawing on first-hand empirical data, this article analyses how guanxi dynamics facilitate judicial career mobility in China's legal system. Based on the varying perceptions and behaviours of judges with respect to guanxi, we distinguish guanxi dynamics: the default overt-guanxi and the emerging covert-guanxi. In the former, judges perceive guanxi as being justified by social norms and employ guanxi practice openly and sometimes abusively. In the latter, judges adopt a more prudent attitude towards guanxi and employ it in a more devious and deceptive manner. They comply with formal procedures and grant an increasingly important role to professionalism, which disguises guanxi's genuine influence and maintains formalistic legitimacy. These dynamics have evolved in step with increases in market competition, institutional certainty and political control that have occurred since the 2000s; the covert-guanxi mode is gradually supplanting the overt-guanxi mode, illustrating the continued persistence of guanxi in contemporary China.

Abstract:In China, ″typical classes″ refers to cases already happened and with special significance. ″Typical Cases″ issued by the Supreme Court can be divided into″Typical Cases of the Local Courts″ and ″Typical Cases of the Supreme Court″. The former is the judgment by the local courts, which are discussed by the sentence committee of the Supreme Court and published in The Supreme Court Gazette of the People’s Republic of China. The latter is the judgment of the Supreme Court published in The Supreme Court Gazette of the People’s Republic of China with a typical significance and guideline function. In fact, to assure that similar cases can be similarly dealt with, ″Typical Cases″ can be a reference and guideline for the local courts. To adopt the implementation of the ″Typical Cases″, it should properly expand the authorization scope of ″typical cases″, let the Superior Court undertook the function of authorizing ″typical cases″, and the Supreme Court only retains the register and review power. Administrative cases due to the application of local decrees, autonomous decrees and local government regulations should be reviewed by the Superior Courts. It should abrogate case instruction system, substituted with ″typical cases″ guidance system. It should incorporate the formula methodology of ″typical cases″, let the sentence committee of People Courts to authorize ″typical cases″, and publish it with serial numbers. It should also be applied to the ″typical cases″ published by the Superior Courts. From a comparative law viewpoint, case law cannot be the equivalence of ″typical cases″. China lacks the related survival environment for case law, but case law should be the direction of the future development of ″typical cases″.

Abstract:This article examines the historical process of Chinese civil service development from ancient dynasties to the present. Ancient Chinese concepts and thinking about the management of the state and officials are considered, the system of state examinations in imperial China “keju" is presented, the process of formation and development of the system of state service in recent history after the formation of the PRC is analyzed, the specifics of the modern institute of management of civil servants are revealed. It is emphasized that at each stage of historical development, the public service system ensured the effective exercise of power and the adaptation of state institutions to the changing external and internal conditions of existence and sustainable development of the state.

Abstract:The Judicial Yuan, a model of supreme judicial organization peculiar to China's recent history, was one of the outcomes of several decades of evolution from the legal reform in the late Qing dynasty to the passage of Constitution of the Republic of China (ROC) in 1947. Its predecessor, the Dali Yuan established in 1906 by the Qing government, not only had the supreme judicial power and the power of abstract interpretation, but also enjoyed the power of interior administration independently from the outset. The Judicial Yuan, established in 1928, inherited the judicial administrative power of Dali Yuan and further expanded it. The Judicial Yuan also inherited Dali Yuan's power to unify the interpretation of law and regulations, and expanded the power of abstract normal control (Normenkontrolle) to constitutional interpretation. The Council of the Grand Justices of the Judicial Yuan had developed the paradigm of constitutional court and shared similarities with the Federal Constitutional Court of Germany. It is safe to conclude that even before the promulgation of the Constitution of the ROC, the Judicial Yuan was fairly well-developed in institutional terms. The key characters of the ROC Judicial Yuan include the special arrangement of judicial administration, a centralized judicial review by the Council of the Grand Justices and a diverse judicial trial mode.

Abstract:In general,Chinese ancient judicial system is based on the Confucian thought.The text aims at considering the ancient judicial activities within the context of Chinese traditional legal culture,and reappear the particular context of such activities,as a result two kinds of abnormal elements were reached.That is,a kind of sentiments: judging cases willfully,not according to laws;a contradiction: tying ways to make wrong verdicts.Such phenomenon almost exists in the all historical periods in the feudal society,and is also the particular production of Chinese ancient legal culture.

Abstract:Abstract In spite of all the vicissitudes that Chinese society underwent from the Qin (221-206 bc ) to the Qing ( ad 1644-1911) dynasties, the system of social government throughout this period as a whole was markedly different from that of Zhou. While the post-Qin dynasties adopted fa or laws to govern the nation, it was li or rituals that dominated in Zhou as a norm of social control. Hence the key to a fruitful inquiry into the administrative evolution of society from Zhou through Qing, a period spanning over two thousand years, lies in the investigation of the political shift from Zhou as a kingdom to Qin as an empire. Since li is a system of ritual propriety representing a consensus of both the upper and lower social strata on the constitution of state power, it is fundamentally different from fa due to its lack of a binding or coercive force. An artificial reorganization of society by a new form of social government called for a new political system known as junxian zhi (郡縣制), a bureaucratic system of centrally appointed local magistrates in “prefectures and counties.” The compulsory force of the law was guaranteed by the national army, and so a system of military officialdom ensured the command and monopoly over the army by the monarch. A fluid bureaucratic system, which enabled the ruling sovereign or monarch to delegate his authority to ministers and local officials, replaced the hereditary system of power by clan lineage. This paper begins with an analysis of the differences between the Confucians’ idea of rule by li and the Legalists’ idea of rule by law, and ends with a discussion on the birth and characteristics of the system of prefectures and commanderies.

Abstract:With the establishment of the socialist legal system,government agencies and law enforcement organizations at various levels are beginning to set up a series of judicial ceremony.The present judicial ceremony system in China,however,is defected by the deficiency of a systematic categorization in content,inadequacy of professional characteristics in action,and the consequent difficulty in implementation.The author holds that judicial ceremony should be bound up with the occupational ethic and social moral norms.
Attribution and Judicial Control in Chinese Court Judgments: a Corpus-Based Study

Abstract:The present corpus-based study deals with attribution in court judgments from three perspectives: the forms of appellate judgments, authorial voices in appellate judgments, and attribution to the sources of law. The results in the study are threefold. First, all the appellate judgments from Mainland China and Taiwan are the judgment of the court; both single-opinion judgments and multiple-opinion judgments are found in the appellate judgments from Hong Kong. Secondly, only institutional self-references are found in the appellate judgments of Mainland China and Taiwan. Thirdly, more divergent forms in terms of sources of law are found in Hong Kong in contrast with Mainland China and Taiwan. Through the analysis of the results obtained in this study, the author argues that in Hong Kong the individual judge’s power is foregrounded and what is backgrounded is the court. In contrast, in the Mainland China and Taiwan judgments, one can only hear the voices of the court rather than those of the individual judge. The discursive presentation of focusing on different power agents can find its root in social construction, because the discursive structure is constrained by and representative of social structure.

It points to the distance between the two civilizations, in terms of the concept of a “debt of justice” owed by the state, the autonomy of the judicial power, and judicial ethics. It opens a debate on the cultural elements that define the judicial truth-making process in various legal systems.

Abstract:Manchu-Han dual position was one of the distinguishing features of the official system in Qing Dynasty.How did Manchu and Han officials allocate powers and how did it operate in the practice of such a special section as the Board of Punishments? Due to the Qing government's whitewash and concealment from mentioning it,researchers often have regrets at the lack of literature for evidence. The present article used historical materials available,from language and personnel policies perspectives, to make a rough sketch showing how powers moved from Manchu to Han officials on the Board of Punishments in the Qing Dynasty and revealing the great contrast between the Manchu officials virtually monopolizing the Board in the early Qing Dynasty and the appearance of so-called Specialists in Charge of the Board phenomenon in the late Qing Dynasty.The article pointed out that the Qing government had repeatedly affirmed ethnic discrimination policies,such as Mandarin and Mounted Archery,which aimed at increasing the status of the Manchu and lowering the Han to strengthen the ruling ethnic group identity and cohesion.However,with the irresistible ethnic integration and intrinsic trends in the development of system and culture,the tides of pursuing fair trial and requiring specialized judicial personnel in judicial field finally broke the fence of ethics and language.

Abstract:The present study deals with the relationship between terminology evolution and legal development. Altogether 100 Chinese legal terms are randomly collected from Chinese statutes in order to examine the legal development in China from 1912 to the present. The results demonstrate that terminology evolution acts as a prerequisite and driving force for legal development in China via three evolution patterns: localization, internationalization and standardization. Terminology evolution serves as the mechanism for absorbing, communicating and mediating legal rules, which renders Chinese legal terminology more suited to its social and cultural contexts, and hence promotes overall legal development. It is also observed that terminology evolution is not only playing a vital role in the development of the legal system in China, but also acting as the beneficiary of such legal development.

Abstract:Reinterrogating prisoners is an important system of reversing court sentence in ancient China.In Eastern Han dynasty,affected by the idea of Tian Ren Gan Ying(Heaven is generally influenced by man's activities),reinterrogating prisoners became an important system of dispelling calamities through sacrifice and was inherited by the subsequent Dynasties.Such a system had a function of safeguarding social stability and stabilizing mentalities of victims.However,it also had a great deal of negative influence over disaster prevention and judicial review in ancient China,and as a result impeded social justice and even failed to be implemented properly.

Abstract:Abstract In legislative texts, deontic modality helps define rights, privileges, obligations, and responsibilities. Based on a corpus of Chinese civil laws from 1949 to 2015, the study investigates the development of deontic modality in Chinese civil legislative discourse and examines the variations of deontic modality diachronically from a quantitative, functional perspective, thereby shedding lights on variations of legal text. This study shows that patterns of deontic modality manifest different features in different stages. The changes of linguistic forms of deontic modality show evidence of the adaptive feature in legal language. From a quantitative perspective, the study suggests that a corpus-driven approach helps examine the development and evolution of deontic modality diachronically. It also contributes to an understanding of deontic modality mechanisms by providing both empirical evidence and theoretical insights.

Abstract:For most of the time during the last two millennia, China was a dynastic empire ruled by an emperor with the assistance of a highly developed mandarinate of imperial organs. “Administrative law” in the modern sense of a set of legal norms enacted by the legislature or developed by the judiciary that simultaneously empower and constrain state organs and officials for the purpose of protecting the rights and liberties of subjects or citizens did not exist in traditional China. But there did exist for more than two millenniums elaborate and sophisticated rules regulating the powers and functions of each component of the highly complex and extensive machinery of imperial organs and officials, and prescribing in detail the duties of officials as well as the multiple and complicated monitoring, supervisory and disciplinary mechanisms applicable to the exercise of powers and performance of duties by officials in different state organs. By the late 19th century, Qing China’s increasing subordination to Western imperialism and semi-colonialism convinced significant numbers of Chinese political and scholarly elite that there was a desperate need for China to “save” and strengthen itself by pursuing modernization. In the legal and political domains, this generally meant extensive borrowing or transplant of Western political and legal institutions. After China's defeat by Japan in the Sino-Japanese War of 1894–1895, Japan’s experience of successful modernisation was widely admired by Chinese intellectuals, and the Japanese model was perceived as one that China should imitate in its self-strengthening efforts. This essay will therefore begin with the introduction and reception of Japanese administrative law in China in the late Qing Dynasty. It will then survey the study of comparative law and the influence of foreign law on the development of Chinese administrative law in the Republic of China era (1911–1949) and after the establishment of the People's Republic of China (1949-). Major developments in Chinese administrative law in both the Republican era and the Communist era will also be briefly outlined as the context of administrative law scholarship. It will be seen that the story of the study of comparative and foreign administrative law in modern China is very closely intertwined with the story of the development of Chinese administrative law itself.

Abstract:Starting with the analysis of Qin bamboo text Wei Li zhi Dao,which makes three requirements for the officials,namely conduct,competence and political attitudes,combining with Qin's Officials as Teachers system,this article points out Qin's requirements for the and reflects that through one unified and regarding Officials as Teachers,the Qin Dynasty tried to achieve their political thinking of the of law.Furthermore,this article theoretically analyzes the state of Qin's rule of law and its ideological approach,and illustrates that through the integration of different levels of standards such as ceremony,custom and law,the Qin Dynasty tried to make a set of unified social evaluation mechanism and social order model,and by shaping the who were its political terminals,the Qin Dynasty tried to realize the implementation of its political vision in the folk areas.Finally,based on a case-study analysis of Yu Shu,this article tries to clarify the intrinsic link between the rule of law ideas and dense laws and the intrinsic links of these unfavorable situations,such as the severe and cruel officials and local strong boycotts.
