Abstract:When President Biden took office in January 2021, he immediately re-invigorated the United States' commitment to addressing climate change, including climate adaptation, through Executive Order 13990—Protecting Public Health and the Environment and Restoring Science to Tackle the Climate Crisis (January 20, 2021) and Executive Order 14008—Tackling the Climate Crisis at Home and Abroad (January 27, 2021). Federal agencies have continued to implement these and other climate-related executive orders. This article examines recent legal developments to summarize the United States' current policy approach to climate change adaptation, especially as such developments affect marine sector. Despite the natural tendency to focus on the federal government—and there have indeed been improvements in federal adaptation policy since the Biden Administration took office—this article also argues that focusing solely on the federal government reveals only one facet of important developments in the United States' climate adaptation policy. Instead, this article acknowledges and illuminates the pluralistic and federalistic structure of United States governance, concluding that much climate adaptation work occurs within tribes and through state and local governments, regardless of who sits in the Oval Office.

Abstract:The Biden administration has revitalized the United States' climate agenda. Current research on the U.S. climate mitigation policies has predominantly focused on individual policies and legislative measures, demonstrating a lack of a comprehensive and systematic analysis. To address this gap, this study establishes a systematic analytical framework for US climate mitigation policies, including the "Vertical Policy Hierarchy - Horizontal Policy Path - Policy Instruments" dimensions, drawing upon first-hand policy data to thoroughly assess the U.S. climate mitigation policy system, pathways, instruments, and potential policy outcomes. The study finds that, (i) Concerning the vertical policy hierarchies based on the government's governance structure, the U.S. federal government has been proactive in advancing climate mitigation policies. However, the government faces multiple risks arising from various factors, including elections, public opinion, limited authority, frequent economic and social unrest, and the ever-shifting domestic and international political factors. These vulnerabilities may undermine the effectiveness of policies. The Congress also encounters certain challenges of significant fragmentation and influence from diverse economic and political factors, which poses challenges to the enactment of related environmental legislation. Moreover, the Supreme Court's climate litigation rulings tend to exhibit a conservative and highly politicized nature. (ii) In terms of the horizontal policy path, which is categorized into six major focus areas, the U.S. climate mitigation policies have made positive strides in the general sector, buildings sector, transport sector, and agriculture and forestry sector. However, challenges persist in the energy sector and industry and business sector. (iii) An analysis of 706 policy instruments indicates that Financial/Fiscal Mechanisms and Direct Investment are the primary means of implementing U.S. climate mitigation policies. Since President Biden assumed office, Regulatory Reform has emerged as a significant breakthrough, accompanied by the gradual adoption of Commercialization Mechanisms and Governance Mechanisms. However, Market-based Mechanisms have encountered challenges in their implementation at the federal level. (iv) An analysis of the potential effects of policy instruments indicates that institutional requirements are a primary consideration; policy design emphasizes environmental justice and equity. Many policies demonstrate positive outcomes in terms of environmental effectiveness, economic effectiveness, and innovation. Policies are also beneficial in improving people's livelihoods, reducing inflation, increasing employment, while also exhibiting positive synergies and enhancing competitiveness. Combining these results and issues, this paper also discusses prominent trends in the policy and offers recommendations for climate decision-making in the United States and other countries.

Abstract:The international community is now acutely aware of the negative global impact of climate change. But efforts to advance global climate agendas will not go far without China and the United States leading the way, given the two major powers’ sheer economic size, global influence, and contributions to greenhouse gas emissions. A growing consensus is that China and the United States share common interests in promoting a global transition toward a carbon-free future. China-U.S. climate cooperation may also encourage other major carbon emitters to shoulder greater international responsibilities and help advance a global low-carbon agenda. This article previews the Biden administration’s climate and energy policies, analyzes the state and impact of China-U.S. interactions in climate governance and energy transition, and presents a set of policy recommendations on how to build trust and increase cooperation between the world’s largest economies and carbon emitters. Washington’s green recovery-centered climate plan will not go far without advancing international cooperation in industrial restructuring, infrastructure investment, emerging key resource development, and market demand. Likewise, Beijing’s ambitious goals of peaking carbon dioxide emissions by 2030 and achieving carbon neutrality by 2060 will also be difficult to attain if it cannot accelerate green economic growth at home and shoulder the joint leadership of climate governance abroad. In this context, China-U.S. climate cooperation and joint efforts toward carbon neutrality could serve as an icebreaker for the current frosty bilateral relationship.
Capacity of the U.S. federal system for cultural heritage to meet challenges of climate change

Abstract:The U.S. federal government is unbalanced in its capacity to recognize, manage, and engage cultural heritage as part of its response to climate change. Legislation from the 1906 Antiquities Act to Executive Order (EO) 13990 signed in 2021 has set an overarching approach in which heritage is understood to be primarily tangible places and things that should be conserved, foremost through monument and park boundaries and significance designations. Such conservation, however, does not protect heritage from impacts of climate change and how to manage these components of heritage is nearly invisible in recent climate-focused publications of the two agencies assigned by legislation to serve as leads for cultural heritage in the U.S. government. Yet further, the long-standing tangible approach to heritage does not incorporate emerging understandings of its intangible components and the diverse connections of all forms of heritage to place, meaning, identity, and global change goals of sustainability and equity. In contrast, analysis of 27 federal agency climate adaptation plans prepared in response to 2021 EO 14008 shows that multiple agencies not assigned lead roles for heritage recognize a range of responsibilities that include heritage as part of climate adaptation, mitigation, equity, and coordination with Indigenous communities. This paper explores U.S. heritage legislative history, the definition it helped create for heritage, more recent understandings of heritage, and relationships of these to climate change and how these are represented in climate work and plans across U.S. federal agencies. On these bases, recommendations are provided for research and policy steps.

Abstract:The United States recently passed major federal laws supporting the energy transition. Analyses suggest that their successful implementation could reduce US emissions more than 40% below 2005 levels by 2030. However, achieving maximal emissions reductions would require frictionless supply and demand responses to the laws' incentives and implementation that avoids polarization and efforts to repeal or undercut them. In this Perspective, we discuss some of these supply, demand and polarization challenges. We highlight insights from social science research, and identify open questions needing answers, regarding how to address these challenges. The stakes are high. The success of these new laws could catalyse virtuous cycles in the energy transition; their failure could breed cynicism about major government spending on climate change.

Abstract:This article argues that one of the most significant evolutions in global climate politics in recent years is the redefinition of power relations that has emerged since the 2009 Copenhagen summit. In the run-up to a potential new climate deal at the 2015 Paris summit, a new climate change diplomacy may be emerging among three actors that are in many respects the most powerful and influential: China, the United States and the European Union. The rise of China is affecting many areas of global governance, but nowhere is it more evident than in the case of climate change, where a very specific mix of power politics, economic interests and normative environments defines the direction of the debate. This article explores how the latter three elements are shaping and re-shaping “multiple bilateralisms”1 between the US, China and the EU and identifies tentative steps toward stronger collective action. The article concludes that a new, perhaps more decentralized but potentially more inclusive approach on climate change is being established.2

A rapid departure from this zone could easily pose a serious threat to our ability to adapt and thrive. Moreover, as we know, past episodes of rapid climate change drove many other species extinct. Still, the argument seems to persuade many people, and I wondered how this new and improved temperature record would fit into it. Along the way, I was also reminded why you should not easily trust anything you read on social media, even if you agree with it.

Abstract:Anthropogenic climate change has emerged as the most disruptive socio-political issue in the last few decades. The Kyoto Protocol’s failure to curb the rising greenhouse gases emissions pushed the UNFCCC-led negotiations towards a more flexible, non-binding agreement at the Paris COP21 meeting in 2015. The Paris Agreement’s hybrid approach to climate change governance, where flexible measures like the nationally determined commitments are balanced against the ambition of limiting the global temperature within the two-degree range, ensured the emergence of an increasingly complex and multi-stakeholder climate change regime. The article outlines the roadmap of the transition from the top-down approach of Kyoto Protocol to the legally non-binding, bottom-up approaches adopted for the post-Paris phase. The article outlines the post-Paris developments in international climate politics, which hold long-term geopolitical and geoeconomic implications. The article focuses on the fundamental shifts and balances within the UNFCCC architecture and examines the four fundamental features of this transition—the interpretation of differentiation and common but differentiated responsibilities, the evolving role of emerging economies in the negotiations, the rising profile of non-party stakeholders in shaping the climate action strategies and the emergence of climate justice movements as an alternate site of climate action.

Abstract:Public attitudes toward climate change influence climate and energy policies and guide individual mitigation and adaptation behaviors. Over the last decade, as scientific certainty about the causes and impacts of, and solutions to the climate crisis has increased, cities, states, and regions in the United States have pursued diverse policy strategies. Yet, our understanding of how Americans' climate views are changing remains largely limited to national trends. Here we use a large US survey dataset (N = 27,075) to estimate dynamic, state-level changes in 16 climate change beliefs, risk perceptions, and policy preferences over 13 years (2008-2020). We find increases in global warming issue importance and perceived harm in every state. Policy support, however, increased in more liberal states like California and New York, but remained stable elsewhere. Year-by-year estimates of state-level climate opinions can be used to support sub-national mitigation and adaptation efforts that depend on public support and engagement.

Abstract:Trump's domestic and foreign climate change policies have basically taken shape. He is using a wide array of presidential executive powers to gradually and systematically weaken or roll back Obama-era domestic and foreign policies on climate change. Trump's disregard of climate change is reflected in his announcement of withdrawing the U.S. from the Paris Agreement. The Trump administration's position on climate change is influenced by the U.S. domestic political factors and Trump's personal political views, rather than the claimed burdens imposed by the Paris Agreement on the United States. This blatant indifference on the part of the U.S. has significant implications for China and China-U.S. relations. After the U.S. withdrawal from the Paris Agreement, China faces mounting pressure from the international community to assume a leadership position on climate change. In response to Trump's stance on climate change, China should raise its nationally determined contribution (NDC) targets, rebuild the collective leadership system in global climate action by replacing the Group of Two (G2) with the Climate 5 (C5), and urge the United States to maintain its engagement in global climate action.

Abstract:This article reviews and assesses the outcome of the 21st Conference of the Parties (COP‐21) to the United Nations Framework Convention on Climate Change (UNFCCC), held in Paris in December 2015. It argues that the Paris Agreement breaks new ground in international climate policy, by acknowledging the primacy of domestic politics in climate change and allowing countries to set their own level of ambition for climate change mitigation. It creates a framework for making voluntary pledges that can be compared and reviewed internationally, in the hope that global ambition can be increased through a process of ‘naming and shaming’. By sidestepping distributional conflicts, the Paris Agreement manages to remove one of the biggest barriers to international climate cooperation. It recognizes that none of the major powers can be forced into drastic emissions cuts. However, instead of leaving mitigation efforts to an entirely bottom‐up logic, it embeds country pledges in an international system of climate accountability and a ‘ratchet mechanism’, thus offering the chance of more durable international cooperation. At the same time, it is far from clear whether the treaty can actually deliver on the urgent need to de‐carbonize the global economy. The past record of climate policies suggests that governments have a tendency to express lofty aspirations but avoid tough decisions. For the Paris Agreement to make a difference, the new logic of ‘pledge and review’ will need to mobilize international and domestic pressure and generate political momentum behind more substantial climate policies worldwide. It matters, therefore, whether the Paris Agreement's new approach can be made to work.

Abstract:Politics in the United States in 2021 was dominated by four major events and two non‐events, setting the stage for what was likely to be an acrimonious 2022. The major events were the storming of the Capitol and the inauguration of a new President, both in January, the US withdrawal from Afghanistan in August, and ongoing conflicts surrounding Covid‐19. The non‐events were the (non‐)passage of Joe Biden's Build Back Better plan and national voting rights legislation. The continuing drama concerned investigations arising from the Capitol riot, Supreme Court reconsideration of established law about libel and abortion, and challenges to redistricting based on the 2020 census as well as other electoral legislation, all in the run‐up to the 2022 election.

Abstract:Under the next cycle of target setting under the Paris Agreement, countries will be updating and submitting new nationally determined contributions (NDCs) over the coming year. To this end, there is a growing need for the United States to assess potential pathways toward a new, maximally ambitious 2035 NDC. In this study, we use an integrated assessment model with state-level detail to model existing policies from both federal and non-federal actors, including the Inflation Reduction Act, Bipartisan Infrastructure Law, and key state policies, across all sectors and gases. Additionally, we develop a high-ambition scenario, which includes new and enhanced policies from these actors. We find that existing policies can reduce net greenhouse gas (GHG) emissions by 44% (with a range of 37% to 52%) by 2035, relative to 2005 levels. The high-ambition scenario can deliver net GHG reductions up to 65% (with a range of 59% to 71%) by 2035 under accelerated implementation of federal regulations and investments, as well as state policies such as renewable portfolio standards, EV sales targets, and zero-emission appliance standards. This level of reductions would provide a basis for continued progress toward the country's 2050 net-zero emissions goal.

Abstract:Coal fired power plants in the US will have to clean up or close down under unprecedented new environmental rules announced by the Biden administration.The move is a key element of the president's commitment to decarbonise electricity by 2035 and all sectors by 2050. It includes new limits on air pollution from power stations, as well as tighter rules on the disposal of wastewater.The power sector is the second largest producer of climate changing emissions in the US, after transport. Abstract:e Paris Agreement is considered a groundbreaking international framework. It is the rst international treaty to agree to “holding the increase in the global average temperature to well below 2°C above pre-industrial levels.” It includes “pursuing e orts to limit the temperature increase to 1.5°C above pre-industrial levels” and sets a goal “to achieve a balance between anthropogenic emissions by sources and removals by sinks of greenhouse gases in the second half of this century.” In addition, this agreement is applicable to all parties. Each party shall communicate or update its Nationally Determined Contributions (NDCs) every ve years, and engage in adaptation planning processes and the implementation of actions, as appropriate. And as Japan had insisted, the new international framework is a fair and e ective one applicable to all parties. At the opening ceremony of the COP21 leaders’ segment, Prime Minister Shinzo Abe reasserted this policy, indicated that the new international framework should include the setting of a long-term goal as well as the establishment of a common process for the review of NDCs (Photo below) and also announced “Actions for Cool Earth 2.0 (ACE 2.0)”. Representing the Japanese government at the high-level segment, Minister of the Environment Tamayo Marukawa stated that the legal agreement should include a global long term goal, a cycle whereby all Parties communicate and update their NDCs, and a report and review system. Japan strongly welcomes and highly appreciates the adoption of the Paris Agreement, which is a fair and e ective international framework applicable to all parties.

Abstract:The science-society contract is broken. The climate is changing. Science demonstrates why this is occurring, that it is getting worse, the implications for human well-being and social-ecological systems, and substantiates action. Governments agree that the science is settled. The tragedy of climate change science is that at the same time as compelling evidence is gathered, fresh warnings issued, and novel methodologies developed, indicators of adverse global change rise year upon year. Meanwhile, global responses to Covid-19 have shown that even emergent scientific knowledge can bolster radical government action. We explore three options for the climate change science community. We find that two options are untenable and one is unpalatable. Given the urgency and criticality of climate change, we argue the time has come for scientists to agree to a moratorium on climate change research as a means to first expose, then renegotiate, the broken science-society contract.
