Abstract:<span>Climate change, biodiversity loss, marine degradation and a pandemic have marked 2020. This article introduces a Special Issue that interrogates transnational environmental law in the context of the Anthropocene and invites reflection on the meaning and role of law in light of changing planetary realties. How law interacts with and governs the global environmental problems is a challenge that legal scholars have approached with vigour over the last decade and, more recently, the concept of the Anthropocene has become a topic that researchers have also begun to grapple with. One avenue of research that has emerged to address global environmental problems is transnational environmental law. Adopting 'transnational law' as a lens or framework through which to analyse environmental law takes a broader approach to the ways in which law may be assessed and deployed to meet global environmental challenges. The collection of articles within this Special Issue provide a timely intervention into the theoretical and practical approaches of transnational environmental law in a time of significant global uncertainty and environmental crisis.</span>

Abstract:Significance International and national law have not stemmed the tide of rapidly accelerating environmental change. In response to this challenge, we highlight examples from the United States and the European Union of the untapped capacity of existing laws to enhance social-ecological resilience to these continual changes. The recommendations we advance regarding how to mine existing legal instruments to enhance resilience are agenda-setting, and they represent a far more feasible approach to addressing emerging environmental challenges than proposing politically untenable new laws or major amendments to existing laws. We show that governance can make substantial advances in addressing environmental change in the short term by exploiting those existing untapped capacities, and we offer principles and strategies to guide such initiatives.

Abstract:Abstract As Patricia Birnie cautiously and prophetically put it in the inaugural issue of this journal (INEA 1, January 2001, p. 74), “we do not know whether States and the tentative regimes they have so far established can withstand the pressures of globalization of trade and degradation and over-exploitation generated by advances in technologies for locating, fertilizing, harvesting, processing and modifying natural resources and biodiversity. This is truly terra incognita in which such seeds of destruction may already be implanted.” Among the 600 or so papers and reviews published in INEA from 2001 to 2020, more than 70 deal wholly or partly with legal aspects of environmental problems and the international dimensions of environmental justice. While the main focus of INEA has been on issues of public international (inter-state) law , there have also been important inputs drawn from comparative legal analysis (of national legislation and judicial decisions) and from “transnational administrative law” that influence the effectiveness of multilateral treaties and their associated international institutions. Novel concepts and practices emerging from the environmental field (such as recourse to a range of “soft law” principles; flexible delegated standard-setting in the face of global change; and equitable differentiation of compliance duties) have inspired developments in related areas of contemporary international law-making and law-applying. At the same time, the very proliferation of multilateral and bilateral environmental instruments raised new questions and expressions of alarm over “treaty congestion” and “fragmentation” within the international law system. It is not the intention of this paper to explore the general interaction of international environmental law with neighboring disciplines such as international economic law or human rights law, but simply to record the “seismographic” impact of INEA on legal-intellectual discourse over these past two decades. To some extent, the role of the Journal in identifying both new prospects and new risks in this field could indeed be likened to that of a “canary in the coal-mine.” The lessons so learnt may thus offer new insights to help in averting the destruction which Birnie visualized, and to advance inter-generationally and intra- generationally shared values of environmental justice.

Abstract:Nature-based solutions are claimed to offer an effective approach to tackle societal challenges and promote biodiversity. While research has mainly focused on biodiversity and material ecosystem services, non-material contributions and relational values of urban green spaces remain underexplored. How to balance the benefits of nature, well-being, and relational values in their design and performance evaluation remains unclear. To elicit the values expressed in public communication regarding the benefits of urban nature projects in Flanders, three online repositories that feature diverse nature-based solutions projects in the region were chosen. Using coding and quantitative content analysis of standardized descriptions from these repositories, this study found that relational values were most abundant (55%), followed by instrumental values (30%) and intrinsic values (15%), consistently so over socio-demographic and physical contexts. It was also discovered that larger projects have a higher level of multifunctionality, which is calculated based on the variety of values and value dimensions expressed, and that participation—although considered key—rarely reports on inclusivity. The findings suggest that in Flanders, a greater emphasis is placed on relational values associated with urban nature. A broader value scope for the design, management, and evaluation of urban green spaces tailored to the local context is recommended.

Abstract:Abstract The Climate Change Convention, together with developed and developing countries, is taking measures to be more effective in combating climate change with the gear of modern methods and innovations. However, the technology mechanism has launched a series of initiatives aimed at exploring the potential of artificial intelligence to accelerate and scale up groundbreaking climate solutions, both in mitigation and adaptation efforts. To address the research questions, a comprehensive literature review is conducted to identify existing gaps and establish a foundational understanding of the legal and cybersecurity landscape in climate technology transfer. Different countries and organizations may adopt disparate cybersecurity measures, making it challenging to ensure a cohesive and standardized approach to safeguarding climate-related technologies. This fragmentation could result in inefficiencies, confusion, and a lack of interoperability. The urgency for a holistic and adaptive approach at the confluence of environmental law and digital security, the evolution of legal frameworks, the fortification of cybersecurity measures, and the ethical dimensions of technology transfer are integral components of a resilient foundation for a sustainable and secure future in climate technology exchange.

Abstract:It is widely recognised that mitigating anthropogenic impacts on the environment depends on the cooperation between stakeholders in the policy-making sector. However, challenges to the implementation of environmental policies continue to be identified. It has been suggested that the reason for the failure of environmental legislation lies in the Homo economicus model, which is based on self-interest and the prioritisation of the economy over the well-being of the environment. This paper proposes that other factors such as non-compliance, gaps in research and information as well as regime type also influence the implementation success of environmental laws. A semi-systematic literature review was conducted to critically examine the reasons for non-implementation of water law in Global North and Global South countries. The results show that non-compliance stems from the ambiguity in key concepts. This leads to misinterpretation, lack of legal enforcement and misinformation from educational differences between the Global North and Global South. This suggests that the underlying foundational principle of environmental laws, which are formed in treaties, are a significant reason for the failure of environmental laws. Furthermore, insights into the regime type and economically dependent countries can contribute to the level of policy implementation. The findings of this paper can help to understand the fragmented perspectives on the reason for environmental failure. Further, it opens topics for discussion on how to improve international environmental laws to allow for appropriate adoption into national legislation.

From domestic to global? Recent trends in environmental liability from a multilevel and comparative law perspective

Abstract:The law of environmental liability has already been the object of several comparative endeavours. This article seeks to bring a different perspective to the debate, by examining selected developments in the field through the lens of the emerging global environmental law scholarship. It brings the comparative method of analysis into a multi-level context with a view to identifying the emergence of common legal responses to the problem of liability and reparation for environmental harm across different jurisdictions and regulatory levels. The analysis will focus on a ‘novel’ set of environmental liability regimes, which specifically address damage to the environment and to natural resources, as distinct from more traditional categories of damage to property and other individual rights arising as a consequence of environmental pollution. These include: the United States Comprehensive Environmental Response, Compensation, and Liability Act, and the Oil Pollution Act, which constitute a pioneering attempt to envisage a public law-oriented system of liability and restoration for damage to natural resources; the European Union Environmental Liability Directive; and selected, recent international treaty developments. The article argues that, while adopted within different legal orders and regulatory contexts, these environmental liability regimes share common features, which correspond to the ontological aspects of environmental damage and ultimately reflect a common understanding of the environment as a global public good.

Abstract:The aim of this project is to explore the ways in which, in the absence of traditional forms of government in a global setting, the law can discipline the transnational exercise of private power by a variety of market actors (from rating agencies, technical standard-setters and multi-national agribusinesses to vulture funds). Traditionally, the cross-border economic activities of non-state actors fall within the remit of an area of the law known as ‘private international law’. However, despite the contemporary juridification of international politics, private international law has contributed very little to the global governance debate, remaining remarkably silent before the increasingly unequal distribution of wealth and authority in the world. By abandoning such matters to its public international counterpart, it leaves largely untended the private causes of crisis and injustice affecting such areas as financial markets, environmental protection, pollution, the status of sovereign debt, the bartering (or confiscation) of natural resources and land, the use (and misuse) of development aid, (unequal) access to food, the status of migrant populations, and many more. On the other hand, public international law itself, on the tide of managerialism and fragmentation, is now increasingly confronted with conflicts articulated as collisions of jurisdiction and applicable law, among which private or hybrid authorities and regimes now occupy a significant place. According to the genealogy of private international law depicted here, the discipline has developed, under the aegis of the liberal divides between law and politics and between the public and the private spheres, a form of epistemological tunnel-vision, actively providing immunity and impunity to abusers of private sovereignty. It is now more than time to de-closet private international law and excavate the means with which, in its own right, it may impact upon the balance of informal power in the global economy. This means both quarrying the new potential of human rights in the transnational sphere, and rediscovering the specific savoir-faire acquired over many centuries in the recognition of alterity and the responsible management of pluralism. In short, adopting a planetary perspective means reaching beyond the schism between the public and private spheres and connecting up with the politics of international law.

Abstract:We ask how environmental justice and urban ecology have influenced one another over the past 25 years in the context of the US Long-Term Ecological Research (LTER) program and Baltimore Ecosystem Study (BES) project. BES began after environmental justice emerged through activism and scholarship in the 1980s but spans a period of increasing awareness among ecologists and environmental practitioners. The work in Baltimore provides a detailed example of how ecological research has been affected by a growing understanding of environmental justice. The shift shows how unjust environmental outcomes emerge and are reinforced over time by systemic discrimination and exclusion. We do not comprehensively review the literature on environmental justice in urban ecology but do present four brief cases from the Caribbean, Africa, and Asia, to illustrate the global relevance of the topic. The example cases demonstrate the necessity for continuous engagement with communities in addressing environmental problem solving.

Abstract:This article serves as a tool to set the scene in this special issue on the manner in which the European Union (EU) engages transnational policy networks (TPNs). It paints a canvas of the main themes to be treated in articles that span a variety of thematic areas. Six main lines of inquiry are developed to better feed into the various themes covered by the specific articles. The lines of inquiry used include modalities or ways in which the EU influences TPNs around the world, TPNs' influence of policy and decision-making within the EU, conditions under which engagement between the EU and TPNs can be considered successful, the identity and location of the TPNs, and the utility or otherwise of an EU strategy to weaken or strengthen engagement with TPNs.

Abstract:Despite its noble intentions and some victories, environmental law has been and continues to be complicit in driving the processes and paradigms that give rise to the Anthropocene. Environmental law is also unable to respond to the regulatory challenges that arise from the Anthropocene's complex Earth system. We need a new legal paradigm that is better fit for purpose in the Anthropocene called <i>Earth system law</i>. A key reason for environmental law's failures and an obstacle preventing its transformation, is its reluctance to embrace and respond to the notion of the Earth system. My hypothesis is that the Earth system metaphor should be key in rethinking environmental law with the ultimate view to constructing Earth system law for the Anthropocene. The primary purpose of this paper is to explore what the Earth system metaphor entails and what it might imply for environmental law's transformation to Earth system law.

Abstract:The disciplinary heritage of examining human–environment relationships continues to be vital but needs continual updating. In the Australian context, four threads of work can make key contributions in the next few decades: (1) recognising the depth of colonial heritage in 20th-century environmental thought, (2) supporting new Indigenous Geographies, (3) articulating environmental imaginaries beyond the settler-Indigenous binary and (4) responding to precarity and volatility with new ecologies. These threads each have distinct research trajectories – in terms of both their heritage in Geography and their development this century. They nevertheless have in common significant potential to help the discipline address the central shared challenge of contemporary life: facing climate change with commitments to justice. I consider wider implications, including three risks we need to be alert to. One risk is eco-fascism. Another is the re-naturalisation of environmental change as climate change impacts are exacerbated. The third is the amount of energy that needs to go into analysing and negotiating our volatile institutional contexts, potentially at the expense of what we have hitherto understood as core scholarly business.

Abstract:Nature-Based Solutions concepts and practices are being used worldwide as part of attempts to address societal challenges but have also been criticised for not dealing with deeper transformations needed to face urgent issues including biodiversity loss, climate change and inclusion. In this paper, we explore how an inclusive, integrated and long-sighted approach, emphasising a more radical integration of nature within cities, might support the transformations needed to endure major contemporary challenges. Addressing important emerging critiques of Nature-Based Solutions, we consider the potential of a more incisive form of Nature-Based Thinking (NBT) in cities, based on more holistic perspectives. The paper draws on a reflective and iterative research process that engaged both the research and practice communities through a symposium and a series of futures workshops that together explored the potential of NBT to develop future nature-cities relations in Europe and Latin America. The results of the reflective process suggest that notions of nature with people-not for people- new organisational structures, and the intention and capacity to apply long-term perspectives, are needed when planning for NBS interventions aimed at sustainable urban development. This includes developing a cultural-structural change based on new and inclusive understandings of human-nature relations, and novel governance paradigms that allow cross-sectoral coordination and engagement of local stakeholders beyond formal organisational structures.

Abstract:Objective: The legal framework governing ecological preservation and sustainability is best appreciated via research into the history and impact of environmental legislation on the "green" notion. It explains how laws and regulations affect the environment, shifting business models, government regulations, and individual attitudes and actions in a more sustainable direction. In a world where environmental legislation, sustainable practices, and ecological challenges are on the rise, it is crucial to have this knowledge. There are several obstacles in the way of the growth and consequences of environmental law on the "green" idea, including the need to strike a balance between economic interests and ecological preservation, the need to ensure worldwide harmonization of rules, and the need to adjust legal frameworks to handle developing environmental difficulties. Method: This paper proposes the Contrastive Exploration and Influence of Environmental Law (CE&IEL), which will examine the development and current relevance of environmental law, focusing on its transformative effects on sustainable practices within the "green" framework. The research has a number of potential uses, including informing policy decisions by illuminating the ways in which environmental laws affect "green" practices, assisting industries in aligning with sustainable regulations to increase corporate responsibility, and assisting educational institutions in integrating legal and ecological perspectives to better prepare students for careers in environmental governance. Result: Computerized models (CM) are used in the growth and impacts of environmental law on green to foresee how shifting environmental legislation would affect green business practices. Conclusion: This strategy helps policymakers, industries, and researchers understand the dynamic interplay between legal reforms and their impact on developing ecological consciousness through the use of simulated trials of alternative legal approaches, revealing previously unknown insights.

Abstract:In the quest for effective environmental governance, the integration of legal and cultural pluralism within conservation strategies emerges as a critical factor, especially in regions marked by rich ethnic diversity and complex historical legacies. This paper explores the symbiotic relationship between state conservation efforts and the engagement of local communities, with a particular focus on the Indigenous Maroon communities in the Blue and John Crow Mountains (BJCMs) of Jamaica. It underscores the imperative of aligning conservation objectives with the aspirations and traditional practices of these communities to foster sustainable ecosystems and safeguard Indigenous autonomy. Central to this discourse is the development of collaborative frameworks that respect and incorporate the legal and cultural dimensions of pluralism, thereby facilitating a co-managed approach to environmental stewardship. This study emphasizes the role of collaboration and trust as pivotal elements in cultivating a mutual understanding of the interdependencies between state law and Indigenous law. This research advocates for a reciprocal exchange of knowledge between the state and community members, aiming to empower the latter with the resources necessary for effective environmental protection while respecting their legal autonomy. This approach not only enhances conservation initiatives overall, but also ensures that these efforts are informed by the rich cultural heritage and traditional ecological knowledge of the Maroon communities. By examining the conservation practices and governance challenges faced by the Maroons in the BJCMs, this paper reveals the nuanced dynamics of implementing state-led conservation laws in areas characterized by cultural and legal pluralism. The findings highlight the necessity for state regulatory frameworks to enable collaborative governance models that complement, rather than undermine, the traditional governance structures of the Maroons. This research contributes to the broader discourse on environmental governance by illustrating the potential of culturally informed conservation strategies to address environmental threats while respecting and reinforcing the social fabric of Indigenous communities.

Abstract:European Community law is firmly established as part of the law syllabus, yet as a subject of teaching and research in Britain it is barely fifteen years old. This unusual conjunction of accepted status and relative youth offers teachers and students of European Community law a great opportunity. Such is the possibility of exercising a potentially decisive influence on the development of European Community law, not only as an intellectually fascinating subject of study, but also as a significant element in the dominant ideologies and practices of the contemporary world. But how and where can we best devote our attention? In answering this question, we may choose to build or not on certain basic foundations. Two points are crucial, however, to the continued vitality of our common project: first, that we develop a more critical understanding of European Community law, and second, that we move in new directions.
