Abstract:For decades, the discipline of law and economics in the U.S. has offered a broader perspective to the analysis of legislation and jurisdiction compared to the European countries. While this is due to number of reasons, this article emphasizes the importance of the different legal cultures, offering analyses of the British, French, German and European legal framework. Although these differences seem to be rooted in structural differences and thus may persist for some time, there are areas of overlapping interests and similar approaches of applying methods of law and economics. The article focuses on these tendencies and offers a deeper analysis in the area of environmental protection.

Abstract:Increasing plastic pollution is looming worldwide, damaging biodiversity, marine ecosystems, and human health. At the global level, no overarching normative framework sets out the specific rules and principles of general application in international environmental law, leading to difficulties in compliance and enforcement of plastic pollution governance. Developing an effective and legally binding instrument to tackle this emerging issue is imperative. The United Nations Environment Assembly (UNEA) has called for developing an international legally binding instrument on plastic pollution, including in the marine environment, based on plastic’s full lifecycle approach. As one of the active participants in the negotiations, the European Union (EU) has discussed various aspects of the instrument in detail and sought to introduce the EU governance experience at the international level. This article develops a framework that considers contextual, actor, and process factors to assess the extent of achieving EU targets. On this basis, we argue that the EU’s objectives for the international instrument may be achieved at a high level. However, how the EU responds to challenges will also impact subsequent development, which may require the EU to adopt a more moderate stance and compromise on some controversial issues.

Abstract:The advent of plastic to the social situation has suppressed a series of demands from both the industry and the population, due to cost, durability and disposal. Because they can be rigid, malleable, opaque, translucent, easy or difficult to melt by the action of fire, some make them capable of serving as raw material for various products on the market, including those widely used in the food industry. In view of the above, the present study aims at a bibliographical review on the topic of microplastics, where the search will be to verify the primary and secondary steps necessary for the formation of the compound, its direct and indirect influence on food production, the physical-chemical processes through which compounds are obtained and the presence or absence of regulation regarding this environmental liability. The present study aims to analyze as a basis the search for knowledge of the primary and secondary formation of microplastics. Subsequently, together with its main objective, this study aims to search for the physico-chemical and thermodynamic phenomena involved in the process of formation and obtaining of microplastics, the polluting potential and, like all waste, its implications for human health. A study horizon was established covering the years 2015 to 2023, where 3,750 articles were found and after applying open access filters, duplication of publication, words present only in the abstract and not in the text, 49 articles remained that are the object of this study. The direct implications of microplastic pollution are already a relevant reason for discussion and subsequent regulation by managers, researchers, international organizations and society in general. Public health problems that can transform into microplastics, containment and adsorption mechanisms of these compounds in living organisms, are points to be pursued by academia as a whole. Contamination by these compounds was found in bottled mineral water, human milk, processed foods, seafood, showing the extent of contamination of this material.

Abstract:As the global challenge,environmental problem and protection do not rely too much on economic and political regimes.Countries tend to learn from each other.European Union embraces a most developed environmental legal system around the world;hence it inevitably becomes an object of reference and transplant within the context of environmental law.However,an prevailing notion in the EU environmental law study is that all the instruments,legislations and running conditions are faultless,and this is over-idealistic.This paper,after explicating the latest development of EU environmental law,pays great emphasis on the deficits of the rules of environmental law in EU.Then it draws a conclusion on the implication of EU environmental law to China not only based on the development but also on the deficits analyzed.

Abstract:The transition towards a circular economy in the EU requires that the legal framework does not create (legal) barriers, but rather enables or stimulates this transition. At this moment, however, the existing literature argues that the current legal system that governs the life cycle of materials and products—EU chemicals, product and waste legislation—might hamper the transition. This article looks into the legal framework for the transition of the product stream of electrical and electronic equipment (EEE) and more specifically into the general and specific applicable EU chemicals, product and waste legislation, as well as its implementation in the Netherlands. By means of both doctrinal and empirical legal research, this article identifies legal barriers, gaps and incentives in the current legal framework that governs the life cycle of EEE in light of the transition towards a circular economy (CE). To enable or stimulate the CE transition in the EEE chain, it appears that it would be desirable to improve the interaction within this legal system and better align it with the objectives of the CE and life cycle thinking. Moreover, this research shows that a different approach within EU chemicals, product and waste legislation could be beneficial for the CE transition. With regard to EEE, a holistic approach could enable a more circular EEE chain, either within the current sector-approach, or with a more product-specific or material-specific approach within the EU chemicals, product and waste legislation governing EEE.

Abstract:Plastic pollution has emerged as a global challenge necessitating collective efforts to mitigate its adverse environmental consequences. International negotiations are currently underway to establish a global plastic treaty. Emphasizing the need for solution-orientated research, rather than focusing on further defining the problems of widespread environmental occurrence and ecological impacts, this paper extracts insights and draws key patterns that are relevant for these international negotiations. The analysis reveals that (i) environmental rather than human health concerns have been the predominant driving force behind previous regulations targeting pollutants, and (ii) the decision to ban or discontinue the use of harmful pollutants is primarily affected by the availability of viable substitutes. These two key findings are relevant to the discussions of the ongoing Intergovernmental Negotiating Committee (INC) on the global plastic treaty and underscore the recognition of environmental consequences associated with plastic pollution while emphasizing the need to enhance the knowledge base of potential human health risks. Leveraging the availability of substitutes can significantly contribute to the development and implementation of effective strategies aimed at reducing plastic usage and corresponding pollution.

From domestic to global? Recent trends in environmental liability from a multilevel and comparative law perspective

Abstract:The law of environmental liability has already been the object of several comparative endeavours. This article seeks to bring a different perspective to the debate, by examining selected developments in the field through the lens of the emerging global environmental law scholarship. It brings the comparative method of analysis into a multi-level context with a view to identifying the emergence of common legal responses to the problem of liability and reparation for environmental harm across different jurisdictions and regulatory levels. The analysis will focus on a ‘novel’ set of environmental liability regimes, which specifically address damage to the environment and to natural resources, as distinct from more traditional categories of damage to property and other individual rights arising as a consequence of environmental pollution. These include: the United States Comprehensive Environmental Response, Compensation, and Liability Act, and the Oil Pollution Act, which constitute a pioneering attempt to envisage a public law-oriented system of liability and restoration for damage to natural resources; the European Union Environmental Liability Directive; and selected, recent international treaty developments. The article argues that, while adopted within different legal orders and regulatory contexts, these environmental liability regimes share common features, which correspond to the ontological aspects of environmental damage and ultimately reflect a common understanding of the environment as a global public good.

Abstract:This chapter reviews various types of market-based regulation and addresses the need for international harmonization. Reflexive law focuses on influencing the “self-referential” capacities of the social institutions subject to regulation. Reflexive law attempts to provide solutions to the gridlock of modern law. Reflexive solutions offload some of the weight of social regulation from the legal system to other social actors. One of the first major environmental statutes passed in the United States was neither market-based nor command-and-control. When the global dimension is considered, it becomes even more clear that the force of business, especially that of large multinational enterprises, must be enlisted in the environmental cause. Reflexive environmental law enlists businesses and other intermediary institutions in the struggle for environmental protection. The inadequacy of command-and-control regulation fuels the hottest growth industry in environmental law: “free market enironmentalism.” Environmental marketing regulation to identify “green products” is the more ambitious variant.
Left to interest groups? On the prospects for enforcing environmental law in the European Union

Abstract:There have been important changes in the enforcement of European Union environmental law over the last 25 years. Environmental law has traditionally been reliant on the European Commission, but the Commission has started to withdraw from enforcement. Instead, it is undertaking efforts to ‘outsource’ enforcement to environmental non-governmental organisations (NGOs) by systematically promoting access for such groups to national courts. While the Commission has indicated that it sees centralised and private enforcement as substitutes, the advantages and drawbacks of each mechanism are evaluated and it is concluded that both mechanisms have an important role to play. In particular, the private enforcement of EU environmental law is dependent on national opportunity structures that are unlikely to ever be fully liberalised and harmonised by EU procedural law. Private enforcement is therefore not a panacea for compliance problems, and the growing absence of a central enforcing authority is a cause for concern.

Abstract:In the last few years, the European Union (EU) has been creating a wide range of educational resources for teachers and students to encourage discussion in class on sensitive issues such as environmental protection and sustainability. Following the tradition of multimodal discourse analysis and research on ecolinguistics, this study aims to analyse the webpage "Environment, climate and energy", from the EU website Learning Corner , focussing on a sample of informative and didactic resources aimed at explaining the institution's environmental policies to younger generations. In particular, the analysis will try to detect the main verbal and visual discursive strategies employed by the EU in order to communicate the institutional discourse on environmental protection to the young and develop eco-friendly consciousness. Furthermore, the research will also take into account the intersemiotic relation of the collected data and see whether the EU employs any positive discursive features as alternatives to the mainstream environment discourses to promote sustainability and sensitize young citizens to it.
Unraveling the complexity of extended producer responsibility policy mix design, implementation, and transfer dynamics in the European Union

Abstract:Extended producer responsibility (EPR) for packaging was introduced to achieve closed‐loop end‐of‐life management and design for recyclability and is an integral part of the European Union's (EU) environmental policy mix. Despite common objectives, EPR systems differ across EU member states in design and implementation. Existing cross‐country comparisons often fall short of systematizing EPR and reflecting its complexity. Understanding the components and interdependencies of EPR is crucial for adjusting policy design. This article links previously isolated components of EPR and studies the design, implementation, and transfer of EPR systems in 25 European countries through a developmental approach. It extends EPR theory by systematizing EPR design features at three hierarchical levels: system scope, responsibility allocation, and instrument type. It then tests the approach by systematically examining similarities and differences, including a uniform coding process and cluster analysis. My results indicate that EPR for plastic packaging is becoming increasingly fine‐grained and diverse. I show that ''path‐dependencies'' emerge between certain features at the responsibility allocation level. I also find common implementation patterns across countries revolving around, for example, EPR market structure or producer responsibility type. System scope converges across countries, while instrument types are becoming increasingly multi‐faceted. I find that policy transfer mechanisms, such as first‐mover dynamics and geographic proximity, have likely influenced existing landscapes of EPR design across the EU. These insights provide an intriguing first step toward deeper analysis of EPR design and, if further extended, can be operationalized for future ex ante or ex post policy analysis of EPR system setups.

Abstract:The main policy addressing the packaging waste issue in the countries of the European Union has been to define recycling objectives along with Extended Producer Responsibility (EPR). With EPR, producers finance the recycling and management of waste generated by their products. Within this framework, they are expected to internalise waste management costs and engage in eco-design of their packaging, i.e., use less packaging and increase packaging recyclability (e.g., through substitution of materials). EPR has been extended worldwide over recent decades and applied to various waste streams. In this paper, by exploiting temporal variation of an original panel dataset of EPR compliance costs from 25 European countries (1998–2015) and four packaging materials, I evaluate for the first time whether these costs have led to packaging waste reduction and substitution of packaging materials. I find that the EPR financial incentive has resulted in very little (though statistically significant) packaging reduction and no systematic substitution effects between packaging materials.

Abstract:Sustainable development involves constant efforts to reduce pollution by using resources as efficiently as possible. One of the sources of pollution is waste from packaging, recovery, and of course, the possibility of recycling them. The research theme of this paper is the reverse logistics of plastic packaging, which allows the realization of the idea of circular economy and green logistics, which promotes the idea of sustainable development. The EU is strongly committed to issues related to the management of plastic packaging and waste to reduce environmental pollution and achieve circularity goals. Through this article, we aim to highlight the degree to which the EU member states are included in the plastic packaging recycling targets for the year 2030. To highlight the evolution trend for the recycling rate of plastic packaging, we used an advanced forecasting model that runs a series of variables in order to draw up a forecast as accurate as possible. After highlighting the recycling rates for plastic packaging at the level of the EU member states, we proceeded to outline some recommendations in order to encourage the EU member states to make the recycling process more efficient. The current study continues the series of studies dealing with the problem of recycling, but it covers a topic not addressed until this moment, namely the behavior of the citizen regarding the recycling activity seen through the prism of national culture. The current study aims to strengthen the specialized literature in this field and to offer innovative solutions that appeal to the respective national cultures regarding the availability of the populations of the EU member states to address the problem of recycling plastic packaging, not only from a legislative perspective but also from a cultural one. In conclusion, this study generates a model of approach to government policies regarding the recycling of plastic packaging considering the types of national cultures prevailing in the EU member countries, with this being possible by grouping the countries into culturally homogenous clusters. In this way, the environmental policies enunciated by governments can be adapted to convey the message in a more personal way, considering the cultural differences between the EU member states.

Abstract:This study reviews existing legal, institutional and policy tools and frameworks, relevant to the introduction and adoption of new marine litter clean-up technologies in two regional European seas, the Mediterranean and the Baltic. A combination of desk studies in six countries bordering the Baltic (Estonia, Germany, Sweden) and the Mediterranean (Greece, Italy, Tunisia), and interviews with experts and stakeholders, is used to identify key drivers and barriers to the adoption and diffusion of marine litter technologies. The main conclusion of the study is that the most influential pieces of legislation relevant to marine litter management are top-down EU policies, often forming the basis of regional and national plans. Moreover, the study finds that several drivers of marine litter technologies may at the same time be critical barriers. These factors include public awareness, consumer behaviour, enforcement of legislation, and the rise of SMEs engaged in recycling and eco-labelling of marine litter.

Abstract:Extended producer responsibility (EPR) initiatives have shown success in enhancing the independent collection of plastic waste, but the existing recycling industry framework poses challenges to achieving optimal recyclability levels. For addressing this issue, various legislative strategies, including non-profit EPR, door-to-door collection systems, and deposit refund schemes (DRS), have been implemented in some countries such as the UK and Germany. As plastic waste management responsibility is shared between consumers and producers in Europe, with consumers generating 40% of plastic waste and producers being responsible for the remaining 60%, this review examines the impact of EPR and DRS programs on consumer and producer behaviors. The article also explores the potential for circularity and sustainability of recycling technologies, including their challenges and limitations. The significance of this study lies in its examination of the impact of EPR and DRS programs on consumer and producer behaviors, providing insight into sustainable practices that promote waste minimization and foster the adoption of recycling methods. Ultimately, the review recommends quick action in four crucial areas, including standardization, infrastructure investment, partnership models, and the production of higher-value recycled materials, all of which require supply chain collaboration.

Abstract:Do impact studies guide policies, do policies direct impact studies, or are ideologies inspiring both? We analyse the proposed new European regulation on packaging and show that the expected benefits are much lower than those magnified by official declarations. Our debunk- ing of the Impact Assessment study, apart from the specific issues, raises concerns about how the European regulatory process is made. By doing so, he invites readers to reflect on the intricate relationship between impact studies, policy-making, and the ideological influences that may shape both.
Important issues in select European Union countries’ criminal environmental law in compliance with Directive 2008/99/EC

Abstract:This article analyzes issues in criminal environmental law in Poland, the Czech Republic and Germany, which implemented the provisions of the European Commission Directive 2008/99/EC. The provisions of this directive changed the scope of protection of environmental resources in these countries’ penal codes to varying extents. These three countries have been relatively successful in comprehensively implementing criminal directive provisions. This included changes in the special protection of Natura 2000 sites and ozone depleting substances. Legal systems are generally based on prevention and risk assessment, and the basic conditions of criminal responsibility for environmental crimes include “significant damage, causing damage to the health of another or animals and plants, damage to other property and also water, air, soil and environmental components which have significant value”. Additional aspects include environmental damage over larger areas and restoration costs. However, the greatest current problem is the vague definition of conditions of criminal responsibility, which makes it difficult to enforce legislation. The following postulates de lege ferenda were formulated: clarify the premises for offenses against the environment, specify the costs of remedying environmental damage, define critical emission standards for environmental crime, as well as specify activities in protected areas that threaten objects. This article emphasizes that an increased and better definition of the conditions of criminal responsibility for environmental crimes enacted by EU countries may contribute to more effective enforcement of infringements of environmental protection law.
