Abstract:Several African countries and regional organizations are investing in the establishment of a plant variety protection system modeled on the UPOV 1991 Convention, which currently provides the strongest, international standard for plant variety protection. Whereas proponents argue that strong protection of breeder's rights will incentivize breeding and the introduction of new varieties for farmers, opponents fear that the proposed legal framework is unsuitable for African countries as it may hamper traditional farming practices of using and exchanging farm‐saved seed. These informal or farmer‐managed seed systems supply more than 80% of the total food crop seed used by farmers. The challenge for African countries is to strike a balance between protecting the interests of breeders through the incentive function of plant breeder's rights for the commercial market, and the leeway that needs to be provided to smallholder farmers that depend on informal sources for their seed security and survival. And to do so in a practical and legally enforceable manner. This paper explores how African countries and regional organizations can establish such balance through a differentiated approach to plant variety protection, which sets different levels of protection for different crops in relation to different categories of farmers.

Abstract:The establishment of intellectual property rights (IPRs) for plant varieties has caused considerable controversy, but there is relatively little empirical evidence on performance and options in developing countries. This paper summarizes the results of a recent five-country study, concentrating on the conduct of plant variety protection (PVP) regimes. It examines PVP in the context of other mechanisms that provide incentives for plant breeding. It discusses the principal options available to developing countries and examines the ability of PVP to offer protection from competing firms and from on-farm seed saving. It also looks at the administrative and management requirements of PVP regimes. Although the paper does not discuss patent protection for biotechnology it examines the IPR requirements for the introduction of transgenic varieties. Developing countries need to establish an appropriate PVP system, but PVP should be seen as part of a broader strategy for seed system development.

Abstract:Breeders persistently supply farmers with the best varieties in order to exceed consumer demand through plant-breeding processes that are resource-intensive. In order to motivate continuous innovation in variety development, a system needs to provide incentives for plant breeders to develop superior varieties, for example, exclusive ownership to produce and market those varieties. The most common system is the acquisition of intellectual property protection through plant variety protection, also known as the breeder’s right. Most countries have adopted the system established by the International Union for the Protection of New Varieties of Plants (UPOV). To be granted plant variety protection, the variety should prove to be unique by meeting three requirements: distinctness, uniformity, and stability. This review summarizes (1) the plant variety protection via UPOV convention, (2) technical methods for distinctness, uniformity, and stability testing via phenotype, molecular markers, and sequencing as well as their challenges and potentiality, and (3) additional discussions in essentially derived variety, value for cultivation and use testing, and open source seed initiative.

Abstract:Nigeria does not currently have a plant variety protection system. Three key reasons why Nigerian law and policy makers should pay attention to plant variety protection are the country's evolving agricultural sector, susceptibility to external pressures and pending international obligations. From 2010, successive Nigerian governments have promoted private sector investments in agriculture, contributing to the increase in the number of agribusinesses in the country. Agribusinesses tend to lobby for the introduction or reform of national plant variety protection systems to suit their business interests. Furthermore, as a founding member of the World Trade Organization (WTO), Nigeria has a pending obligation under Article 27.3(b) of the Agreement on Trade‐Related Aspects of Intellectual Property Rights (TRIPS) to protect plant varieties through a patent system, a sui generis system, or a combination of systems. This article argues that Nigeria should proactively introduce a plant variety protection system designed to suit its socio‐economic realities before it is pressured to adopt an unsuitable system. In assessing the options under TRIPS vis‐a‐vis the small‐scale centered agricultural sector in Nigeria, the article finds that the best‐suited option for the country is a sui generis system which protects the interests of both small‐scale farmers and agribusinesses.

Abstract:In 2000, African countries expressed reservation over the adoption of UPOV Act of 1991 as a model of plant breeders’ rights (PBRs) for TRIPS- compliance. For the continent, an acceptable system of PBRs protection would include the protection of the “rights of communities and their indigenous knowledge, as well as the rights of farmers and fishermen, and their innovations, technologies and practices”. One and half decades after, Africa has virtually reversed itself and embraced the UPOV-PBRs system notwithstanding the latter’s narrow focus on breeders and marginal reference to farmers. This Article critically explores the concerted sites of pressures, especially free trade and economic partnership agreements, and related policies through which Africa appears to have capitulated and upturned its policy position on PBRs. The continent’s present priority over the implementation of PBRs through various regional and national legal initiatives currently at the instance of African Intellectual Property Organization (OAPI), the African Regional Intellectual Property Organization (ARIPO), the Southern African Economic Community (SADC) and specific country initiatives are explored. The article highlights the basis for the incongruity of Africa’s newfound interest in the UPOV-PBRs system – a regime not designed for the farmer-centered tenor of African agriculture. It calls attention to the continued relevance of Africa’s 2000 Model Law, especially as it applies to PBRs and recommends reality assessment as an important step toward the formulation of IPRs system suited for stakeholders in African agriculture for the continent’s food security and food sovereignty.

Abstract:Together with other laws affecting agriculture, Kenya's plant varieties protection legislation was radically amended in 2012. The amendments were mainly driven by the quest to comply with international obligations, principally the 1991 UPOV Convention. However, the country is also a contracting party to other international treaties affecting seeds such as the International Treaty on Plant Genetic Resources for Food and Agriculture and the WTO Agreement on Trade Related Aspects of Intellectual Property Rights. Moreover, the national Constitution obligates statutory recognition and protection of the ownership of indigenous seeds and plant varieties, their genetic and diverse characteristics, and their use by the communities of Kenya. The obligations deriving from all these international agreements must be fulfilled against a backdrop of farming systems that are predominantly smallholder farmer‐based. This article discusses how the amendments in the new Kenya plant variety protection law depart from the former legal regime and analyzes whether the current regime is compliant with international obligations, and the implications for smallholder farmers.

Abstract:The interplay between intellectual property rights for new plant varieties and public interests, particularly farmers' rights, is critically examined within the context of global agricultural practices and Sustainable Development Goals (SDGs). According to the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), World Trade Organization (WTO) members shall establish a mechanism to grant effective protection to new plant varieties. There are two typical compliance mechanisms with TRIPS: the model developed by the International Convention for the Protection of New Varieties of Plants (UPOV Convention) and India's sui generis system. A comparison from the sustainable development perspective is conducted through the textual analysis of the regulations of each model. The results show that the UPOV Convention cannot advance the achievement of Sustainable Development Goals and might have adverse effects. Conversely, India's sui generis system represents a more balanced approach, addressing the needs of the farmers, the community, and environmental protection alongside those of breeders and benefitting sustainable development. The conclusion advocates for revising the UPOV Convention to incorporate broader concerns, including farmers' rights and environmental sustainability, to ensure a more equitable approach to the protection of plant varieties.

Abstract:The prospects for plant variety protection to deliver improved varieties of self‐pollinating crops is assessed using the experience of the Australian wheat breeding sector as a natural experiment. The analysis is based on detailed new data on the agronomic performance of all wheat varieties released by Australian breeders between 1976 and 2011. The results indicate that plant variety protection, and associated reforms, led to a substantial fall in breeder output. Qualitative evidence indicates that this was caused by a combination of fewer research spillovers, lower release standards, and a possible fall in total investment in breeding.

Abstract:New varieties of plants possess powerful monopoly nature, so developed countries can control the economies of scale and tempo of developing countries by means of information, technology and related rights. The author analyzes the improper protection of intellectual property and its efficiency losses, and concludes that intellectual property protection can safeguard hegemony countries. In 2003 Japan amended "Seeding Act" mainly aiming at Chinese exported farm produce. The author discusses the possible influences exerted by Japanese "Seeding Amendment Act" on Chinese exported farm produce, and concludes that the most fundamental and effective countermeasure in China is to breed independently and hold independent intellectual property. The urgent affair is to amend the International Union for the Protection of New Varieties of Plants (UPOV) in which China participated.
Towards a Fair Scope of Protection for Plant Breeders’ Rights in an Era of New Breeding Techniques: Proposals for a Modernization of the Essentially Derived Variety Concept

Abstract:Plant breeders’ rights (PBRs) are an important IP right, and as plant breeding has a crucial role to play in sustainability, it is vital that innovations in plant breeding receive the appropriate innovation incentives. The full breeders’ exemption ensures that there is always free access to the plant variety protected by a PBR for developing new varieties. The price to pay for this exemption is that PBR holders cannot prevent third parties from taking advantage of their efforts and investments in developing a new variety. This invites free-riding, at the detriment of the PBR holder. The concept of “essentially derived varieties” (EDV), introduced in 1991, provided a “fix” for this problem. It allows PBR holders to extend, at least to some extent, the scope of protection of their PBR to those varieties which use all or most essential characteristics of the initial protection variety. Decades have passed, but no adequate interpretation of the complex EDV concept has been found. The advent of new breeding techniques (NBTs) has made the discussion about a fair scope of protection of PBRs all the more relevant. This necessitates a modernization of the EDV concept, if the PBR system is to remain relevant and continue to be an innovation-incentivizing mechanism. I argue that a broader scope for the EDV concept is essential and fair. Determining what essential derivation is will remain a difficult task also in the future. This is why I have additionally proposed a collaborative reward model, which will facilitate the functioning of the EDV system and is capable of providing more legal certainty in this area.

Abstract:Plant innovation is expensive. It is therefore crucial to protect the intellectual property of the breeder as all plant varieties are living self-reproducible material. Intellectual property protection of plant innovation varies from country to country. Plant varieties are not patentable in Europe. Protection of biotechnological inventions is obtained by patent if the invention is new, has an inventive step and industrial applicability. The protection conferred by a patent to a biotechnological invention also applies to varieties in which it is inserted, namely transgenic varieties. In Europe the exceptions to the protection of conventional and transgenic varieties are the same, namely, under certain conditions, the possibility of using farm-saved seeds and access to the genetic diversity of the protected variety for breeding. The possibilities of protection depend on national laws and examples of various countries including developing countries growing transgenic varieties are presented.

Abstract:To address the issues of food insecurity within the context of land degradation, extreme poverty and social deprivation, this review seeks first to understand the main constraints to food production on smallholder farms in Africa. It then proposes a highly-adaptable, yet generic, 3-step solution aimed at reversing the downward spiral which traps subsistence farmers in hunger and poverty. This has been found to be effective in greatly increasing the yields of staple food crops and reducing the ‘yield gap’. This solution includes the restoration of soil fertility and ecological functions, as well as the cultivation, domestication and commercialization of traditionally-important, highly nutritious, indigenous food products for income generation and business development. A participatory approach involving capacity building at the community-level, leads to the development of ‘socially modified crops’ which deliver multiple environmental, social and economic benefits, suggesting that increased agricultural production does not have to be detrimental to biodiversity, to agroecological function, and/or to climate change. These are outcomes unattainable by attempting to raise crop yields using conventional crop breeding or genetic modification. Likewise, the livelihoods of smallholder farmers can be released from the constraints creating spatial trade-offs between subsistence agriculture and (i) international policies and (ii) globalized trade.

Abstract:China passed its plant variety protection act(PVPA) in 1997 and it has effects on Chinese breeds market and new technologies adoption of farmers,which causes extensive concern of the academic circles.We use a system model to study the impact of PVPA on seed prices and planted area for plant variety.We find out that protected varieties have higher prices than unprotected varieties.In the applying stage,PVP doesn't show much impact on seed price,but lead to the 33% decrease of planted area at the same time.After the new species acquires the protection authorization,the seed price will increase to 1.63 yuan/kg,but it doesn't show much impact on planted area.

Abstract:Abstract China passed its Plant Variety Protection Act (PVPA) in 1997 which allowed us to do some initial testing of this proposition. We used a unique dataset on the applications of the new Plant Variety Protection (PVP), morphological characteristics, and institutional sources of all the important varieties of rice in three provinces of China to estimate the determinants of plant variety protection applications in China. The evidence suggests that both the government and private research programs are responding to economic and policy incentives and investing in plant variety protection as economists would expect profit maximizing firms to invest. The discussion of the evolution of the seed industry suggested that the combination of the new seed law in 2000 and the new plant variety protection regulation had changed the structure of the seed industry and provided an important incentive to invest in PVPs both by public research institutes and commercial firms. Finally, there is some preliminary evidence that private firms have smaller incentives to develop new varieties than to purchase the new varieties.

Abstract:Pesticides are the major technology used in the management of field and postharvest losses due to pests. There is growing demand for effective alternatives that present low health risks and conserve ecosystems and biological diversity. Pesticidal plants are increasingly used as alternatives where synthetic products are unaffordable, have limited availability or are ineffective. Plant materials, however, are often used inefficiently and their effective use requires optimisation. In Africa wide-scale uptake of pesticidal plants remains limited despite the success of pyrethrum in some countries and other pesticidal plant products in China and India. This is mainly due to lack of data on efficacy and safety, inconsistent efficacy of plant products, the prohibitive cost of registration, and an inadequately developed conventional pesticides sector. Globally, the demand for botanicals is poised to grow due to an increasing shift in consumer demand for safe food, increasing organic farming, lobbying by environmentalists and the increasing pressure from new regulations on internationally traded foods in Europe. These demands can only be met by formalising production, marketing and use of pesticidal plants. This has to be supported by friendly registration procedures, sustainable forest management, propagation and cultivation of pesticidal plants. This paper presents a critical review of the enabling environment required for wide-scale adoption and commercialisation of botanical pesticides in sub-Saharan Africa. We conclude that regulations and protocols for production, marketing and trade need to be reviewed to facilitate the development of the botanicals sector in Africa.

Progress and Challenges for Implementation of the Common Market for Eastern and Southern Africa Policy on Biotechnology and Biosafety

Abstract:In 2001, the Meeting of the COMESA Ministers of Agriculture raised concerns that proliferation of genetically modified organisms (GMOs) could impact significantly on trade and food security in the region. This triggered studies on a regional approach to biotechnology and biosafety policy in Eastern and Southern Africa. The studies and stakeholder consultations revealed that farm incomes would increase if they switched from conventional varieties of cotton and maize to genetically modified (GM) counterparts. Commercial risks associated with exports to GM sensitive destinations, e.g., EU were negligible. Intra-regional trade would be affected since exports of GM sensitive commodities, such as maize, cotton, and soya bean, mainly go to other African countries. These findings justified the need to consider a regional approach to biosafety and led to the drafting of a regional policy in 2009. The draft policies were discussed in regional and national workshops between 2010 and 2012 for wider ownership. The workshops involved key stakeholders including ministries of agriculture, trade, environment, national biosafety focal points, biosafety competent authorities, academia, seed traders, millers, the media, food relief agencies, the industry, civil society, competent authorities, and political opinion leaders. The COMESA Council of Ministers in February 2014 adopted the COMESA policy on biotechnology and biosafety that takes into account the sovereign right of each member state. Key provisions of the policy include recognition of the benefits and risks associated with GMOs; establishment of a regional-level biosafety risk-assessment system; national-level final decision, and capacity building assistance to member states. The policies are the first regional effort in Africa to develop a coordinated mechanism for handling biosafety issues related to GMO use. A regional approach to biotechnology and biosafety is expected to foster inter-country cooperation through the sharing of knowledge, expertise, experiences, and resources.

Abstract:The relationship between plant resources and traditional communities in Africa is inseparable. For centuries, indigenous communities have been depending on their cultural innovations and practices for health and food. Plant resources are part of the traditional knowledge system of indigenous communities in Africa. Colonialism and the scramble for Africa led to plant resources being opened to bioprospecting by western scientists and multinational pharmaceutical firms. They engage in secluded locations around Africa in order to find ‘new drugs from exotic plants’ for profit-making or patent rights. The advent of technology has witnessed a lot of illegal exploitation and commercialization of plant resources (biopiracy). The traditional knowledge system is being eroded with disregard to the welfare of the owners of the knowledge to sustainably manage it. The paper looks at the challenges, the existing legal framework to appreciate if it’s adequate to ensure the sustainability of the traditional knowledge system in Africa.
