Abstract:The purpose of this paper is to analyze what are the changes in the legal regulation on food in the European Union (EU) and in the Common Market of the South (MERCOSUR) that have occurred in recent times to account for the impact on the actions of legal and natural persons as consumers in integrated spaces. It starts from the premise that -currently- there are three purposes pursued by legislation issued both locally and regionally: food safety, quality and competitiveness. The regional legal framework must ensure that the rules applied to food allow a wide offer to ensure competition in the regional market, and at the same time that food is safe and of high quality so that consumers have the possibility of choosing freely. The jurisprudence of the Court of Justice of the EU (CJEU), exemplifies, through its interpretation - in selected cases - of the norms concerning the multiple facets - from the introduction and circulation (commercialization) of a food in the regional market- and allows reflection from the public (member states-third states) and private (operators and consumers) spheres on the importance of the rules. The main data collection technique used -in this work- is the analysis of documentation from the EU regulatory framework, both original and secondary law - in particular, Parliament and Council regulations, or directives - as well as the analysis of jurisprudence of the CJEU, through which secondary data is collected -mainly Decisions of the Common Market Council (CMC), Resolutions of the Common Market Group (GMC), Directives of the Common Market Trade Commission (CCM)-. In relation to the data analysis procedures, qualitative and comparative analyses are used.

Abstract:This contribution examines the development of the European Union’s nutrient policy from 2000 to 2022. It focuses on the policy’s shift orienting toward expert knowledge and technological innovations in nutrient recovery and recycling, and explores the resulting (de)politicization of the policy area. Drawing on evolutionary policy change, agri-food (de)politicization, and agri-food technology innovation research, a three-phase development is identified through qualitative document and public feedback data analysis. The policy development started with a focus on environmental issues and nutrient scarcity in the 2000s (phase 1), expanded to nutrient recycling as a means to close the nutrient-food loop in the mid-2010s (phase 2), and began utilizing secondary nutrient sources for agri-food production and to ensure a stable supply of fertilizers in the 2020s (phase 3). The study shows that while expert knowledge and technological advancements have steered sectoral policies toward a circular agri-food system, they have also led to the EU’s nutrient policy adopting a technocratic approach, privileging specific expert insights and depoliticizing the policy area. The findings highlight the intricate relationship between technological innovation, policy evolution, and public engagement in shaping the European agri-food system.

Analytical and Comparative Jurisprudence

Abstract:The study is devoted to a comprehensive analysis of EU agricultural legislation, its complex structure and evolution, primarily through the prism of Ukraine’s European integration efforts. It is argued that the Common Agricultural Policy (CAP) is a key legislative document that promotes sustainable agricultural development, environmental protection, and rural development. The article examines the key components of EU agricultural law, its dynamic relationship with social needs and the political agenda of the entire European society. For the period up to 2027, the CAP, which is currently being reformed, is aimed at prioritising environmental sustainability and regional adaptability. It is noted that this strategic shift promotes the introduction of individual approaches to the implementation of agricultural policy, emphasising coherence and efficiency in various European agricultural ecosystems. A central element of this initiative is the allocation of significant EU funds for environmental and climate goals, in line with the overarching Green Deal strategy. The analysis of legislative trends demonstrated the Union’s differentiated approach to the development of a unified agricultural policy. The author argues that environmental and climate initiatives, organic agriculture, and animal welfare measures underline the EU’s commitment to biodiversity conservation, soil quality improvement, and minimising the effects of climate change. Rural development initiatives promote investment in infrastructure and the socio-economic resilience of rural communities. In addition, it is emphasised that strategic actions targeting market support, combating unfair trade and ensuring product quality underline the EU’s commitment to maintaining market stability, transparency and increasing consumer confidence in European products. The comprehensive review identifies the main trends shaping EU agricultural policy, including an increased focus on environmental sustainability, rural diversification, social ethics, and food safety. This reflects the EU’s integrated approach to agricultural governance, which combines economic imperatives with environmental and social considerations. In turn, this will serve as a valuable resource for the national legal system in terms of making informed decisions and aligning national policies with the European acquis.

Abstract:This Special Issue stems from some of the insights at the "Future of Food Law" Conference held at Wageningen University and Research (WUR) in 2023, prompting an examination of the Farm to Fork (F2F) Strategy's achievements and shortcomings. With the von der Leyen Commission's term concluding, the paper critically assesses key aspects of the F2F Strategy, laying the foundation for an in-depth discussion presented in six contributions. The exploration extends from US and EU perspectives to national considerations, moving even further and beyond the boundaries of the Strategy. It encompasses emerging views on food safety, fostering fair and sustainable agri-food production models, encouraging healthier and democratic food choices, and reevaluating decision-making distribution from EU to Member States in sustainability regulatory actions. This issue aims to probe how agri-food regulatory frameworks should adapt to current challenges, acknowledging new economic, social, and environmental expectations. As a frame to the six contributions, this paper addresses the substantial delay in implementing crucial food law interventions, with a focus on the legislative Framework for Sustainable Food Systems (SFSF). The paper concludes by outlining potential scenarios for the future of EU food law, emphasising the necessity for establishing a guiding principle of sustainability for food systems.

Abstract:The 2004, 2007, and 2013 enlargement of the EU opened up free trade opportunities, increasing trade flows and demand for products of agriculture. On the one hand, the integration processes have intensified competition between countries, and on the other hand, they have created new opportunities for them. The aim of the study was to evaluate the effect of European integration on the competitiveness of the agricultural sector in countries that acceded to the EU in or after 2004. The assessment of the competitiveness of the agricultural sector was made using the following indicators: land and labour productivity in agriculture, importance of the agricultural sector in the economy of the EU countries, agricultural trade balance, importance of agricultural export in total export of the EU countries, trade coverage ratio, Grubel–Lloyd intra-industry specialization indicator, and Balassa comparative advantage indicator. The analysis was carried out from 2004 to 2020 with the Eurostat statistical database. The outcome of surveys implies that a gap still exists between the old and the new member states of the European Union (EU) in the efficient utilisation of their production factors, despite an increased dynamics of growth in labour productivity compared with the old member states, the so-called EU-15. The overall competitive position of all EU-13 countries in agricultural trade on the common EU market has improved; however, individual analysis reveals disparities between respective member states. In 2020, net exporters with comparative advantage were Hungary, Bulgaria, Lithuania, and Croatia, and net importers with comparative disadvantage included Poland, Czechia, Slovakia, Estonia, and Malta. Latvia and Romania improved their competitive position in agricultural trade.

Abstract:The emergence of the global administrative sector and its new forms of knowledge production, expert rationality, and standardization, remains an understudied topic in science studies. Using a coproductionist theoretical framework, we argue tha the mutual construction of epistemic and legal authority across international organizations has been critical for constituting and stabilizing a global regime for the regulation of food safety. The authors demonstrate how this process has also given rise to an authoritative framework for risk analysis touted as ‘‘scientifically rigorous’’ but embodying particular value choices regarding health, environment, and the dispensation of regulatory power. Finally, the authors trace how enrollment of the Codex Alimentarius in World Trade Law has heightened institutional dilemmas around legitimacy and credibility in science advice at the global level. Taken together, the case illustrates the importance of attending to the iterative construction of law and science in the constitution of new global administrative regimes.

Abstract:Food safety regulation is a key policy area that has witnessed an increasing alignment of risk and regulation. This paper examines the emergence and operation of co-regulation – a hybrid form of regulation in which public and private actors coordinate their respective regulatory activities – within the increasingly risk-based approaches to food safety management. On the basis of an analysis of emerging co-regulatory arrangements to food safety in the European Union, the paper contends that there are considerable difficulties in implementing such hybrid arrangements and deepens the basic preconditions under which they can attain the social goal of safe food supply. Specifically, it is argued that a regulatory framework that fosters public oversight and warrants data sharing and information exchange between the public and private actors involved is needed for the attainment of that goal. This framework has to be responsive to changing risk profiles and industry environments to ensure that food safety controls are risk-based, transparent and not captured by industry interests. This is particularly crucial for encouraging voluntary compliance as well as efficient allocation of limited regulatory resources.

Abstract:All over the world, a large proportion of the population consume insects as part of their diet. In Western countries, however, the consumption of insects is perceived as a negative phenomenon. The consumption of insects worldwide can be considered in two ways: on the one hand, as a source of protein in countries affected by hunger, while, on the other, as an alternative protein in highly-developed regions, in response to the need for implementing policies of sustainable development. This review focused on both the regulations concerning the production and marketing of insects in Europe and the characteristics of edible insects that are most likely to establish a presence on the European market. The paper indicates numerous advantages of the consumption of insects, not only as a valuable source of protein but also as a raw material rich in valuable fatty acids, vitamins, and mineral salts. Attention was paid to the functional properties of proteins derived from insects, and to the possibility for using them in the production of functional food. The study also addresses the hazards which undoubtedly contribute to the mistrust and lowered acceptance of European consumers and points to the potential gaps in the knowledge concerning the breeding conditions, raw material processing and health safety. This set of analyzed data allows us to look optimistically at the possibilities for the development of edible insect-based foods, particularly in Europe.

Abstract:The European Union (EU) is often depicted as global regulatory power. This contribution contends that this depiction, while not unfounded, is misleading. It aims to clarify under what conditions the EU converts its regulatory capability into influence. Specifically, it seeks to resolve the puzzle of the EU's poor performance in the setting of global food safety standards within the Codex Alimentarius Commission. The argument is deceptively simple. The EU's limited influence is due to it being a preference outlier. In a context where standards can be agreed by voting, the stringency of the EU's regulations, rather than being a source of influence, is a liability. This extreme case demonstrates that the EU's ability to exercise international influence is affected by the constellation of preferences and the distribution of power. This contribution, therefore, contributes to the emerging literature that contends that the EU's international effectiveness can be understood only with explicit reference to the international context within which it is operating.

Abstract:The EU is about to relax its oversight of genetically modified organisms, focusing on plants and products that are obtained through certain new genomic techniques. The aim is to promote new genomic techniques as an innovative technology and employing it as a means to transform agriculture to sustainability. The present contribution describes and evaluates the planned reform. It discusses whether standards of legal certainty and legitimacy are met, how environmental side-effects are taken into account, how sustainability goals are integrated, what socio-economic effects are to be expected, and whether higher rank law is respected. As several shortcomings are found an alternative approach is submitted that combines a certain easing of administrative oversight with better integration of sustainability goals. Auspices for organic and conventional GMO-free agriculture are also sketched out.

Abstract:The majority of the nations around the world have become melting pots of civilization, leading to an increasing interconnectedness of the global food system. However, with the long-winded food supply chains there exists information asymmetry between the consumers and the food they consume, making them more vulnerable to the outbreaks of diseases caused by tainted food. As an assurance that food is acceptable for human and animal consumption, food safety averts any exposure to food frauds and foodborne illness outbreaks therefrom. For this reason, the law endows the food regulators and the food business operators (FBOs) with the “trace, alert, and recall” tools at all levels of a food supply chain to regulate the safety of both the domestic as well as the imported articles of food. As a risk assessment and management tool, traceability furthers the mandate of law enforcement in facilitating and targeting the recall or removal/withdrawal of articles of foods.

Abstract:Insects are increasingly being considered as an attractive source of protein that can cater to the growing demand for food around the world and promote the development of sustainable food systems. Commercial insect farms have been established in various countries, mainly in Asia, but in Europe, edible insects have not yet emerged as a viable alternative to traditional plant- and animal-based sources of protein. In this paper, we present an interdisciplinary overview of the technological aspects of edible insect farming in the context of the EU regulations and marketing. Based on a review of the literature, we have concluded that edible insect farming can be a viable business sector that significantly contributes to the overall sustainability of food systems if the appropriate regulations are introduced and food safety standards are guaranteed. However, the success of the edible insect industry also requires consumer acceptance of entomophagy, which is rather low in Western societies. Therefore, targeted marketing strategies are indispensable to support the implementation of edible insect programs.

Abstract:Transnational private regulation has been woven into the fabric of modern food safety governance. In this paper we explore the question of how domestic state actors respond to this development. We address this question in a detailed case study on the Global Food Safety Initiative (GFSI) and domestic food safety authorities in Canada, China, the Netherlands and the US. Why and to what extent do these domestic actors engage with GFSI in their regulatory activities, and what are the effects? To develop a better understanding of the how and why of this interaction, the paper builds on the concept of ‘regulatory enrolment’ developed by Black (2003). As will be argued, enrolment offers a proper analytical lens through which the nature of interplay between various actors in a regulatory regime can be better appreciated and the capacity of that regime as a whole can be enhanced in smart and innovative ways.

Abstract:This study investigates how proponents and critics of gene editing in agriculture and food (GEAF) employ expectations—discourses with future‐oriented impacts—as they compete to secure desired futures and mobilise social processes and resources towards their goal of influencing GEAF (re)regulation and agro‐food systems within the EU. We draw on 27 semi‐structured interviews and 53 Euractiv media articles to identify and analyse GEAF proponents' and critics' responses to the 2018 European Court of Justice regulatory decision that GEAF will be regulated as genetically modified organisms. Despite similar themes of environmental sustainability, food security and winners and losers in agricultural innovation systems, proponents' and critics' discourses reflect divergent expectations of GEAF. We argue that both groups link their expectations with concerns about path dependencies in technological innovations and agro‐food systems, which serve to influence emerging political, public and elite perspectives on GEAF. Although to some extent performative, these concerns offer important insights that should be problematised and engaged within GEAF governance spaces. This study is conceptually framed by the socio‐technical futures, path dependency and political economy of food and agriculture literature.

Abstract:Food safety has received a great deal of attention in both developed and developing countries in recent years. In China, the numerous food scandals and scares that have struck over the past decade have spurred significant food safety regulatory reform, which has been increasingly oriented towards the public-private partnership model adopted by the Europe Union's (EU) food safety regulatory system. This paper analyzes the development of both the EU's and China's food safety regulatory systems, identifies the current challenges for China and additionally considers the role of public-private partnership. The success of co-regulation in the food regulatory system would bring significant benefits and opportunities for China. Finally, this paper recommends additional measures like training and grants to improve the private's sector effectiveness in co-regulating China's food safety issues.

Abstract:AbstractA selection of Food Engineering research including food structure engineering, novel emulsification processes, liquid and dry fractionation, Food Engineering challenges and research with comments on European Food Engineering education is covered. Food structure engineering is discussed by using structure formation in freezing and dehydration processes as examples for mixing of water as powder and encapsulation and protection of sensitive active components. Furthermore, a strength parameter is defined for the quantification of material properties in dehydration and storage. Methods to produce uniform emulsion droplets in membrane emulsification are presented as well as the use of whey protein fibrils in layer-by-layer interface engineering for encapsulates. Emulsion particles may also be produced to act as multiple reactors for food applications. Future Food Engineering must provide solutions for sustainable food systems and provide technologies allowing energy and water efficiency as well as waste recycling. Dry fractionation provides a novel solution for an energy and water saving separation process applicable to protein purification. Magnetic separation of particles advances protein recovery from wastewater streams. Food Engineering research is moving toward manufacturing of tailor-made foods, sustainable use of resources and research at disciplinary interfaces. Modern food engineers contribute to innovations in food processing methods and utilization of structure–property relationships and reverse engineering principles for systematic use of information of consumer needs to process innovation. Food structure engineering, emulsion engineering, micro- and nanotechnologies, and sustainability of food processing are examples of significant areas of Food Engineering research and innovation. These areas will contribute to future Food Engineering and novel food processes to be adapted by the food industry, including process and product development to achieve improvements in public health and quality of life. Food Engineering skills and real industry problem solving as part of academic programs must show increasing visibility besides emphasized training in communication and other soft skills.

Abstract:This paper identifies major future trends and driving factors and perspectives and challenges resulting from them for European agriculture and food sectors until the year 2020. The focus of the paper is an analysis of key driving forces and the provision of a well developed reference scenario under the assumption of continued CAP reform and taking into account the framework discussions in the Doha Development Round. To assess the impact of policies the paper also examines a liberalisation (no support) and regionalisation (maximum support) scenario. In terms of policy options the paper shows that the structural change process in agriculture (measured in terms of agricultural share in GDP) is a long-term process that continues with or without policy changes. The EU is facing an increasing diversity of structure and structural adjustment. The livestock sector (especially cattle) faces important challenges and restructuring. Alternative policy settings may not produce very different effect on the overall production as factor markets adjust. However, the regional impact on the environment and on the number of farms may prove to be more significant.

Abstract:The objective of this article is to assess the competitiveness of the European food industry from an economic and legal perspective. Knowledge of its present competitiveness and improvement opportunities are lacking. To close this knowledge gap, we measured the competitiveness of eight subsectors, benchmarked them with four leading world economies, assessed the effect of differences in legal requirements, and predicted future developments using scenario analysis. International economics indicators supplemented with data on legal issues from a survey conducted by leading experts were used to measure competitiveness. The results show that the EU food industry's competitiveness is weak. The legal system was positively evaluated compared to the U.S. system, but major improvements are possible. The recommendations are to improve economies of scale, economies of scope, ICT‐based supply chain management, and exploit cultural differences through innovation, within a more flexible and streamlined legal framework.
