Abstract:One of the greatest threats to the conservation of transboundary stocks is the failure of Regional Fisheries Management Organizations (RFMOs) to equitably allocate future fishing opportunities. Across RFMOs, catch history remains the principal criterion for catch allocations, despite being recognized as a critical barrier to governance stability. This paper examines if and how subsidies have driven catch histories, thereby perpetuating the legacy of unfair resource competition between distant water fishing nations (DWFNs) and coastal States, and how this affects ongoing allocation negotiations in the Indian Ocean Tuna Commission (IOTC). Using limited publicly available data on subsidies to Indian Ocean tuna fleets, we show that subsidies have inflated catch histories of many DWFN's. As long as historical catch remains the key allocation criterion, future fishing opportunities will continue to be skewed in favor of DWFNs, in turn marginalizing half of the IOTC member States, which collectively account for a paltry 4% of the current catch. Without better transparency in past subsidies data, accounting for this distortion will be difficult. We provide alternative allocation options for consideration, with our analysis showing that re-attributing DWFN catch to the coastal State in whose waters it was caught may begin to alleviate this historical injustice.

Abstract:Industrial-scale global fishing, driven by technology, market demands, and fuel subsidies, have threatened the sustainability of fish stocks. Poor fisheries data and government fuel subsidies, especially for external fishing fleets, enables wealthy nations to exploit the waters of coastal countries with less stringent fisheries management. Relations between the European Union (EU) and West Africa exemplify imbalances, in which EU interests overshadow local sustainability, leading to long-term declines in local fish stocks. At present, poor data and opaque agreements will make positive change difficult. However, the WTO’s 2022 Agreement on Fisheries Subsidies can be used to leverage positive change.

Abstract:Abstract While the science supporting fisheries management has generally been dominated by the natural sciences, there has been a growing recognition that managing fisheries essentially means managing economic systems. Indeed, over the past seven decades, economic ideas and insights have increasingly come to play a role in fisheries management and policy. As an illustration of this, the International Council for the Exploration of the Sea (ICES) has been actively seeking to expand the scope of its scientific expertise beyond natural sciences [another inter-governmental marine science organization which has done this over the same period is the North Pacific Marine Science organization (PICES)]. In particular, the recently created ICES Working Group on Economics set out to review current work and key future needs relating to economic research and management advice on marine capture fisheries. This article presents the results of this review and addresses how economic research can be incorporated into the science of ICES to provide integrated perspectives on fisheries systems that can contribute to the provision of advice in support of policy development and management decision-making for sustainable uses of living marine resources.

Abstract:Policies based on grants to specific economic sectors, such as the fisheries sector have become widespread over the last fifty years. Despite their long history, there is no consensus regarding their scope or effects. In recent years, European economic policy has been subject to substantial change, not only regarding the level of funding but also concerning support mechanisms for Member States in the form of grants.The primary objective of this article is to conduct a critical analysis of the impact of EU policies on fisheries subsidies. To this end, it was necessary to analyse the evolution of these subsidies over the period 1994–2012. The article highlights aid for modernising fishing vessels and reducing fishing efforts by scrapping vessels.

Abstract:The blue economy concept has been discussed at high-level policy fora since the 2012 United Nations Conference on Sustainable Development. Simultaneously, a burgeoning body of literature on the blue economy is emerging from academia. This scoping analysis uses data from journal articles and policy documents to provide a preliminary understanding of how small-scale fisheries in the blue economy are framed by academics and policymakers. We found that high-level policies include ideal proposals for fisheries and other ocean sectors, but in ways that suit industrial-scale fisheries and aquaculture more than small-scale fisheries. Academics highlight emerging uncertainties for small-scale fisheries. The review points out differences between small-scale and industrial-scale fisheries, particularly the social aspects that could make small-scale fisheries more suitable for achieving some of the stated goals of a blue economy. We conclude that, while the blue economy in its broadest sense is still a work in progress, it should be guided by clearly articulated goals in terms of governance that supports small-scale fisheries.

Abstract:In recent decades, fishing sustainability has been subject to intense international debate. Overfishing and contamination of the marine environment are elements that contribute to a reduction in fish stock and catches, often leading to declining income and employment, especially in rural areas. We present a sustainable fisheries model that promotes artisanal fishing while incorporating replacement rates of fish stock and actions that benefit the fishing industry. First, the sustainable fisheries model defines the guidelines and actions that may apply either together or independently, sequentially, or simultaneously, according to a defined budget. These concrete actions are quantified and incorporated into an environmentally extended input-output model to evaluate the economic impact on the Spanish fishing industry. The impact is complemented with an assessment of social impact (employment) and environmental impact (estimated reduction of CO2 emissions).

Abstract:Transboundary fish stocks complicate sustainable fishing strategies, particularly when stakeholders have diverse objectives and regulatory and governance frameworks. Pacific sardine (Sardinops sagax) in the California Current is shared by up to three fishing nations— Canada, the United States, and Mexico—and climate-driven abundance and distribution dynamics can complicate cooperative fisheries, leading to overfishing. This study builds on previous analyses by integrating ecosystem linkages into a game theory model of transboundary sardine fisheries under various climate scenarios. Cooperative fishing strategies that account for the ecosystem-wide value of sardine as forage for other species result in increased economic benefits compared to strategies that only account for the single-species value of sardine fisheries to a given fishing country. Total ecosystem landed value is maximized at a sardine fishing rate only somewhat lower than sardine FMSY, which is more precautionary but still allows the fishery to operate. Incorporating ecosystem dynamics into management-applicable models can highlight ways in which ecosystem-based fisheries management can improve both sustainability and profitability and help managers prioritize wider ecological research. Ecosystem-based management will be increasingly required to understand and adapt to the observed rapid shifts in species distributions due to climate change, and to design strategies to achieve sustainable and profitable fisheries amidst changing ecosystems.

Abstract:This article examines how distant-water fishing by wealthy nations depletes fish stocks and harms food security in developing countries while benefiting richer markets. It explores the impact of practices like bycatch, the use of fish aggregating devices, and illegal fishing on the Global South. The findings show that industrial fleets from wealthier countries use sophisticated technology to exploit poorly regulated fisheries, outcompeting local fishers and causing economic and ecological damage. Fisheries data analysis and algorithmic tracking are not working for developing nations either. The research calls for stronger international cooperation, better fisheries management, and support for small-scale fishers to protect livelihoods and ensure sustainable fish stocks.

Abstract:Recent international negotiations have highlighted the need to protect marine diversity on the high seas-the ocean area beyond national jurisdiction. However, restricting fishing access on the high seas raises many concerns, including how such restrictions would affect food security. We analyze high seas catches and trade data to determine the contribution of the high seas catch to global seafood production, the main species caught on the high seas, and the primary markets where these species are sold. By volume, the total catch from the high seas accounts for 4.2% of annual marine capture fisheries production and 2.4% of total seafood production, including freshwater fisheries and aquaculture. Thirty-nine fish and invertebrate species account for 99.5% of the high seas targeted catch, but only one species, Antarctic toothfish, is caught exclusively on the high seas. The remaining catch, which is caught both on the high seas and in national jurisdictions, is made up primarily of tunas, billfishes, small pelagic fishes, pelagic squids, toothfish, and krill. Most high seas species are destined for upscale food and supplement markets in developed, food-secure countries, such as Japan, the European Union, and the United States, suggesting that, in aggregate, high seas fisheries play a negligible role in ensuring global food security.

Abstract:In many countries, commercial and recreational fishing compete for access to marine resources. In some cases, recreational catch outweighs commercial harvest and may threaten species otherwise protected from commercial fishing. This has led to increasing calls for improved management of recreational fishing in the broader context of general fisheries management. As a result, fisheries managers face the challenge to decide how to allocate the available marine resources between competing uses. In this paper, we review and explain two common approaches that have been used to support recreational fishing allocation decisions. While economic activity analysis is an appropriate tool to assess how a change in resource allocation would affect regional economic activity (economic contributions and impacts), it is ill-suited to assess associated gains or losses in welfare of society as a whole (economic efficiency). Hence, economic activity analysis and social cost–benefit analysis complement each other, with each providing a different set of information answering a different set of questions. Unfortunately, both types of analysis use the term “economic value” suggesting that they are alternative approaches that provide the same information, whereas in fact they are not. If the objective of fishery managers is to ensure that society as a whole is made better off, the appropriate metric is economic value as defined by welfare economics. Under this definition, all goods and services provided by marine resources that are beneficial to humans have economic value. This includes non-use values such as the continued existence of an endangered marine species. The aim of this paper is to support managers and policymakers in allocating marine resources by reviewing relevant economic principles, concepts, and tools in the context of recreational fishing, including the use and challenges of estimating the non-market benefits generated by recreational fishing experiences.

Abstract:Fisheries subsidies regulation lies at the intersection of international fisheries and international trade governance regimes. Although eradicating harmful fisheries subsidies cannot be a panacea for illegal, unreported and unregulated (IUU) fishing, it is an essential first step to confront the problem head-on. The multilateral Agreement on Fisheries Subsidies, adopted by the World Trade Organization (WTO) in June 2022, provides an impetus for sovereign states to steer fisheries subsidies reform towards commonly agreed legality, sustainability and transparency benchmarks. This legal and policy investigation aims to give increased attention to the ultimate responsibility of national governments to exercise active fisheries jurisdiction over the identification and sanction of IUU fishing activities. With or without WTO prior judgements, a level of jurisdictional coherence is warranted to trigger a comprehensive and effective ban on IUU fisheries subsidies in as timely a manner as possible.

Abstract:The vast developmental opportunities offered by the world's coasts and oceans have attracted the attention of governments, private enterprises, philanthropic organizations, and international conservation organizations. High-profile dialogue and policy decisions on the future of the ocean are informed largely by economic and ecological research. Key insights from the social sciences raise concerns for food and nutrition security, livelihoods and social justice, but these have yet to gain traction with investors and the policy discourse on transforming ocean governance. The largest group of ocean-users – women and men who service, fish and trade from small-scale fisheries (SSF) – argue that they have been marginalized from the dialogue between international environmental and economic actors that is determining strategies for the future of the ocean. Blue Economy or Blue Growth initiatives see the ocean as the new economic frontier and imply an alignment with social objectives and SSF concerns. Deeper analysis reveals fundamental differences in ideologies, priorities and approaches. We argue that SSF are being subtly and overtly squeezed for geographic, political and economic space by larger scale economic and environmental conservation interests, jeopardizing the substantial benefits SSF provide through the livelihoods of millions of women and men, for the food security of around four billion consumers globally, and in the developing world, as a key source of micro-nutrients and protein for over a billion low-income consumers. Here, we bring insights from social science and SSF to explore how ocean governance might better account for social dimensions of fisheries.

Abstract:In this paper, we present a simplified framework to represent competition, coordination and bargaining in fisheries when they operate under financial and technological constraints. Competition within constraints leads to a particular type of mathematical game in which the strategy choice by one player changes strategy set of the other. By studying the equilibria and bargaining space of this game when players maximize either profit or fishing capacity, we highlight that differences in financial constraints among players leads to a tougher play, with a reduced bargaining space as the least constrained player can readily exclude another from the competition. The exacerbating effects of constraints on competition are even stronger when players maximize capacity. We discuss the significance of our results for global ocean governance in a current context characterized by financialization and technological development. We suggest that in order to maximize the chances of fruitful negociations and aim towards a fair sharing of sea resources, it would be helpful to focus on leveling current differences in the constraints faced between competing fishing systems by supporting local financial systems and technological control, before implementing sophisticated economic tools.

Abstract:International fisheries law is a broad field of international law within which significant state practice, instruments, and relevant fora are found at the global, regional, subregional, bilateral, and national level. For the purposes of this bibliography, the analysis of international fisheries law is limited to the law governing marine capture fisheries (other fisheries law definitions may include the regulation of aquaculture or inland fisheries). This bibliography also primarily approaches fisheries law as a matter of fisheries conservation and management under the international law of the sea. The two main treaties of global application which reflect its foundational framework are the 1982 United Nations Convention on the Law of the Sea (UNCLOS) and the United Nations Agreement for the Implementation of the Provisions of the United Nations Convention on the Law of the Sea of 10 December 1982 relating to the Conservation and Management of Straddling Fish Stocks and Highly Migratory Fish Stocks (UNFSA). As a starting point, one should consult the maritime zones established under UNCLOS and customary law, whereby the distribution of rights and obligations among the various capacities of states differs per maritime zone. As fish do not respect legal boundaries, special rules of international law that emphasize cooperation and management between states must be adopted and adapted for shared fish stocks such as transboundary fish stocks, straddling fish stocks, and highly migratory fish stocks. In addition, various treaties of global application dealing with specific issues exist, such as the 1993 Agreement to Promote Compliance with International Conservation and Management Measures by Fishing Vessels on the High Seas (Compliance Agreement) and, most recently, the 2009 Agreement on Port State Measures to Prevent, Deter and Eliminate Illegal, Unreported and Unregulated Fishing (PSMA). This global treaty framework is complemented by various global non–legally binding instruments, most of which were adopted under the Food and Agriculture Organization of the United Nations (FAO). On the regional level, countless multilateral and bilateral fisheries treaties have been concluded, and the field remains highly dynamic. Notably, many fisheries are nowadays managed by Regional Fisheries Management Organizations and Arrangements (RFMO/As) or bilateral fisheries commissions. As a thematically defined field of law, international fisheries law is not restricted to the rules governing conservation and management of marine fisheries, but may equally raise, among other issues, questions of general international law of the sea such as jurisdiction and maritime law enforcement operations, international environmental law, international trade law, international human rights law, and international dispute settlement.

Abstract:The decision to ban the pulse trawl by the European Parliament in early 2019 was influenced by public debate over its scientific and political legitimacy. In their 2019 paper in Marine Policy, Le Manach et al. continued this debate by making three claims. First, that the pulse trawl has substantial negative social and environmental impacts. Second, that it received 'illegal' subsidies from the European Union amounting to €20.8 million. And third, that the Dutch government and industry did not provide adequate transparency in the allocation of subsidies. These claims are misleading and, in some instances, demonstrably false: the ongoing science on the effects of the pulse trawl shows relatively positive impacts; following the conventional definitions of "harmful" and "fisheries subsidies" in the economic literature, harmful subsidies provided to pulse trawling only amount to €0.3 million, or less than 2% of Le Manach et al.'s estimate; and there is no evidence of intentional non-disclosure of information related to the distribution of subsidies by the Dutch government. Finally, we reflect on the consequences of the inaccuracies presented by Le Manach et al. in the governance of fishing gear innovation and their wider effect on the legitimacy of advocacy-based science.

Abstract:Commons scholarship has improved our understanding of how to govern resources for sustainability. However, it has also been critiqued for its focus on traits that are increasingly threatened by social and environmental trends. Fisheries are a key example of this challenge. While small-scale fisheries are critically important to the diets and livelihoods of millions, industrial fisheries now dominate fishing around the world. While these two systems are governed separately, there is substantial overlap between them, conceptualized as the growing influence of globalization on local common pool resource (CPR) systems. One of the most impactful, but least understood consequences of this convergence are the conflicts and competition between small-scale and industrial fisheries. We use empirical data from 396 cases of interactions at sea between globalized industrial and local small-scale fishers in Ghana from 1984-2013 to examine the conditions under which resource users conflict or cooperate, linking them to broader political and economic dynamics across scales. We consider the institutional factors that mediate these interactions, identifying policies to promote cooperative, and avert conflictual incidents. We further consider the long-term effects of these patterns of conflict and cooperation for the resilience or vulnerability of the resource system as a whole. We suggest that specific governance arrangements that reduce disparities between groups, promote bridging social capital, and enhance hybrid and cross-scale institutions offer the best potential to govern resource systems where traditional CPRs and market-oriented industries converge.

Euros vs. yuan: comparing European and Chinese fishing access in West Africa

Abstract:We compare the performance of European Union (EU) and Chinese fisheries access agreements with West African countries in terms of illegal and unreported fishing, economic equity, and patterns of exploitation. Bottom-up re-estimations of catch reveal that the EU (1.6 million t•year(-1)) and China (2.3 million t•year(-1)) report only 29% and 8%, respectively, of their estimated total catches (including estimated discards whenever possible) from West African countries between 2000 and 2010. EU catches are declining, while Chinese catches are increasing and are yet to reach the historic maximum level of EU catches (3 million t•year(-1) on average in the 1970s-1980s). The monetary value of EU fishing agreements, correlated in theory with reported catches, is straightforward to access, in contrast to Chinese agreements. However, once quantified, the value of Chinese agreements is readily traceable within the African economy through the different projects they directly cover, in contrast to the funds disbursed [to host governments] by the EU. Overall, China provides resources equivalent to about 4% of the ex-vessel value [value at landing] of the catch taken by Chinese distant-water fleets from West African waters, while the EU pays 8%. We address the difficulties of separating fees directly related to fishing from other economic or political motivations for Chinese fees, which could introduce a bias to the present findings as this operation is not performed for EU access fees officially related to fishing. Our study reveals that the EU and China perform similarly in terms of illegal fishing, patterns of exploitation and sustainability of resource use, while under-reporting by the EU increases and that by China decreases. The EU agreements provide, in theory, room for improving scientific research, monitoring and surveillance, suggesting a better performance than for Chinese agreements, but the end-use of the EU funds are more difficult, and sometime impossible to ascertain.

Abstract:Fuel is an important input in the fishing industry's activities, and fuel subsidies are aimed at generating more competitiveness and encouraging development. Nevertheless, they can also create incentives for fishers to exert more effort, thereby resulting in overexploitation. This paper estimates the economic value of fuel used by the Mexican fishing industry based on the elasticity of production with respect to fuel (ε C ) and the value of the marginal product (ρ C ) through the Cobb-Douglas and Trans-Log production function. The ε C and ρ C were estimated to be 0.52 and USD 3.1, respectively, with the latter contributing to only 8.3% of the fuel subsidy. Furthermore, a direct relationship is evident when observing the trends and the differences in means of the average price of fishery landings and the number of subsidies between 2011 and 2019. That is, the higher the prices and/or subsidies, the higher the levels of extraction. These results have important implications for fuel management and its relationship with the extraction of fishery resources, especially in countries where a subsidy policy is applied in an attempt to support the sector, but which at the same time can have a negative impact on fishery resources.

Abstract:Global climate change has already caused bottom temperatures of coastal marine ecosystems to increase worldwide. These ecosystems face many pressures, of which fishing is one of the most important. While consequences of global warming on commercial species are studied extensively, the importance of the increase in bottom temperature and of variation in fishing effort is more rarely considered together in these exploited ecosystems. Using a 17‐year time series from an international bottom‐trawl survey, we investigated co‐variations of an entire demersal ecosystem (101 taxa) with the environment in the Celtic Sea. Our results showed that over the past two decades, biotic communities in the Celtic Sea were likely controlled more by environmental variables than fisheries, probably due to its long history of exploitation. At the scale of the entire zone, relations between taxa and the environment remained stable over the years, but at a local scale, in the center of the Celtic Sea, dynamics were driven by inter‐annual variation in temperature. Fishing was an important factor structuring species assemblages at the beginning of the time series (2000) but decreased in importance after 2009. This was most likely caused by a change in spatial distribution of fishing effort, following a change in targeted taxa from nephrops to deeper water anglerfish that did not co‐vary with fishing effort. Increasing bottom temperatures could induce additional changes in the coming years, notably in the cold‐water commercial species cod, hake, nephrops and American plaice. We showed that analyzing co‐variation is an effective way to screen a large number of taxa and highlight those that may be most susceptible to future simultaneous increases in temperature and changes in exploitation pattern by fisheries. This information can be particularly relevant for ecosystem assessments.
