Abstract:With its firm establishment as a neuropsychology subspecialty, forensic neuropsychological assessment is integral to many criminal and civil forensic evaluations. In addition to evaluating cognitive deficits, forensic neuropsychologists can provide reliable information regarding symptom magnification, malingering, and other neurocognitive and psychological issues that may impact the outcome of a particular legal case. This article is an overview and introduction to neuropsychological assessment in the forensic mental health context. Major issues impacting the current practice of forensic neuropsychology are summarized, and several examples from case law are highlighted.
Risk Assessment Interviews: Exploring the Perspectives of Psychologists and Indeterminate Sentenced Prisoners in the United Kingdom

Abstract:This study explores the forensic risk assessment interview from the perspectives of qualified prison-based psychologists and indeterminate sentenced prisoners in the United Kingdom. It focuses on the psychologist-prisoner relationship in the interview context. Twenty-one in-depth individual interviews were conducted with psychologists and prisoners and analysed using Grounded Theory methods. The analysis identified the following categories reflecting participants' descriptions of risk assessment interviews: "Emphasising Clarity and Transparency," "Collaborative Engagement," "Making a Respectful, Boundaried yet Human Connection," "Respecting Individuality," and "Having a Purposeful Conversation." Analysis demonstrated that these categories of meaning reflected the broader notion of risk assessment interviewing as "A Difficult Balancing Act." The views of prisoners and psychologists about the risk assessment interview were remarkably similar and provide some direction and guidance for practitioners navigating this challenging but essential aspect of forensic psychological work.

Abstract:Supervision and the supervisory role are essential aspects of clinical training and represent a distinct area of competency within clinical psychology. While guidance documents exist for clinical supervision, there is limited guidance regarding forensic assessment supervision, despite the recognition of forensic psychology as a specialty warranting its own set of unique principles and specialty-specific competencies. Although there is substantial overlap between clinical and forensic assessment supervision, significant differences also exist which can have a great impact on the nature of forensic assessment supervision. This article uses established principles, training, and practice considerations within the field of forensic psychology to highlight the core distinctions between clinical and forensic assessment supervision.

Abstract:Abstract Forensic science often involves the comparison of crime-scene evidence to a known-source sample to determine if the evidence and the reference sample came from the same source. Even as forensic analysis tools become increasingly objective and automated, final source identifications are often left to individual examiners’ interpretation of the evidence. Each source identification relies on judgements about the features and quality of the crime-scene evidence that may vary from one examiner to the next. The current approach to characterizing uncertainty in examiners’ decision-making has largely centered around the calculation of error rates aggregated across examiners and identification tasks, without taking into account these variations in behavior. We propose a new approach using IRT and IRT-like models to account for differences among examiners and additionally account for the varying difficulty among source identification tasks. In particular, we survey some recent advances (Luby 2019a) in the application of Bayesian psychometric models, including simple Rasch models as well as more elaborate decision tree models, to fingerprint examiner behavior.

Abstract:This article illustrates the complex sociocultural components in the forensic psychological assessment of a young Ethiopian woman's claim for political asylum due to a well-founded fear of persecution and for relief under the Convention Against Torture. It draws attention to the subtle social and cultural influences in the practice of forensic psychological assessment with an emphasis of reflective practice, which is contextualized in the interpersonal theory of Sullivan. In the interpersonal approach, the essential work of the assessor is to pay careful attention to the microinteractions between the client and the assessor as reflections of the interpersonal (meaning social and cultural) processes, eschewing the illusion of objectivity. In this case study, I illustrate the particular cultural dilemmas for client and assessor in conducting a forensic assessment of psychological trauma, including cross-cultural, gender, and legal difficulties in arriving at an informed, objective, and compassionate assessment of an individual seeking asylum after an especially brutal experience of torture. I argue that collaborative therapeutic assessment methods adapted for forensic practice offer an approach to assessment of psychological trauma that provides more accurate and compassionate assessment than so-called neutral standard forensic assessment practice.

Abstract:The popularity of forensic science television programs has created a hiring challenge for forensic science laboratories. Laboratories receive unprecedented numbers of applicants, yet struggle to identify highly-qualified candidates. Forensic examiners must possess a unique set of knowledge, skills, and abilities (KSAs) plus other characteristics. They must be critical thinkers, detail-oriented, decisive, and self-regulated; be able to communicate clearly and effectively within the laboratory, with customers (typically investigators or attorneys), and in the courtroom; and demonstrate the required core competencies. Currently, no validated instruments, standardized job descriptions, or lists of KSAs exist to aid in forensic science personnel recruitment and assessment, often resulting in high turnover leading to costly new recruitment and training cycles. This article describes how industrial/organizational psychology develops methods and tools to improve workforce selection; describes some tools currently in use in forensic science; and advocates for research and development of better tools for use in forensic science.

Abstract:Competence to stand trial is a legal construct used to identify those criminal defendants who have the requisite mental capacity to understand the nature and objective of the proceedings against them and to participate rationally in preparing their defense. This Practice Guideline has described how psychiatrists should evaluate individuals concerning their competence to stand trial. The Guideline describes acceptable forensic psychiatric practice for such evaluations. Where possible, it specifies standards of practice and principles of ethics and also emphasizes the importance of analyzing an individual defendant's case in the context of statutes and case law applicable in the jurisdiction where the evaluation takes place. The recommendations in the Guideline both reflect and are limited by evolving case law, statutory requirements, legal publications, and the current state of psychiatric knowledge. The authors have taken note of nationally applicable case law, federal constitutional standards, statutory language, and federal and state interpretations of the rights or statutes, recognizing that jurisdictions may differ in their specific interpretation or application of statutes or general constitutional standards. The review of cases concerning specific psychiatric diagnoses illustrates general U.S. trends, and psychiatrists must remain cognizant of their jurisdictions' interpretations of statutes or constitutional requirements. By surveying a variety of practices and approaches to data gathering and case analysis, the authors believe that this Guideline will stimulate additional collegial discussion about what is necessary and sufficient for adequate evaluations of adjudicative competence. The notion that psychiatrists should apply expertise to competence assessments stems from the principal that, before allowing a defendant to face criminal prosecution and possible punishment, courts need reasonable assurance--based, if necessary, on a careful, individualized evaluation--that the defendant has adequate mental capacity to make a defense. At a minimum, a psychiatrist's opinion about adjudicative competence should reflect an understanding of the jurisdictional standard and of how the defendant's mental condition affects competence as defined with the jurisdiction. The psychiatrist's report should clearly describe the opinion and the reasoning that leads to it. Psychiatrists who provide mental health expertise concerning adjudicative competence give trial courts information needed to assure that defendants can appropriately protect themselves and that criminal proceedings will be accurate, dignified,and just.
The effects of cognitive bias, examiner expertise, and stimulus material on forensic evidence analysis

Abstract:Forensic examiners have come under scrutiny due to high-profile exonerations, highlighting the consequences that contextual bias can have on investigations. Researchers have proposed solutions to reduce the effects of bias including blind testing and redacting task-irrelevant information. Practitioners have concerns over the limitations of some of this research that uses untrained students to examine complex pieces of forensic evidence (e.g., fingerprints) (1; but see 2 for studies including trained experts and/or actual casework). This study sought to (a) examine the effect of contextual bias on examiners' evaluation of forensic evidence by varying the amount of pre-comparison information available to participants, (b) compare student and expert examiners' performance and their vulnerability to contextual bias, and (c) examine the effects of contextual bias on examiners' evaluation of different types of forensic evidence. Expert fingerprint examiners and student participants were presented with varying amounts of pre-comparison case information and compared matching and non-matching fingerprint and footwear impression evidence. Results suggest no effects of blinding examiners from case information or redacting task-irrelevant information. As expected, expert fingerprint examiners were more likely to correctly identify matching fingerprints and correctly exclude non-matching fingerprints than students. However, expert fingerprint examiners were no better than student participants at comparing footwear impression evidence. These findings suggest that sample, stimulus selection, and discipline-specific training matter when investigating bias in forensic decision making. These findings suggest caution when using forensic stimuli with student samples to investigate forensic decision-making and highlight the need for more research on redaction procedures.

Abstract:Forensic risk assessments are used to determine sanctions, identify recidivism risk and inform implementation of risk reduction strategies. The best way to gather reliable data to inform decisions is important and the focus of this mixed-method study. Forty-five experienced professionals performed a risk assessment involving a young person who sexually offended (YSPO). They read a good-quality or a poor-quality interview and collateral information. Under half (42.2%) of participants provided the expected risk ratings. Some participants misidentified elements of good-quality interviewing (e.g. rapport, open questions). Ratings of fairness of the forensic interview were positively associated with increased sense of perceived interview quality. Confidence in risk-assessment decisions tended to be higher in the good-quality than the poor-quality interview group. Practitioners involved in the risk assessment of YPSO should receive effective/robust training in best practice interviewing so they can identify and implement empirically based interviewing techniques for care provision for YPSO.

Abstract:This article describes school's obligations related to bullying behavior, the assessment of bullying students and their victims, the evaluation of claimed damages due to bullying, and potential interventions for both individuals and school systems to reduce the frequency of bullying behavior. This article assists evaluators when assessing youth who are involved in bullying behavior, either as victims or perpetrators. Key areas highlighted include an overview of bullying behaviors, legal issues related to a school's responsibility in preventing or curtailing bullying behaviors, important components of a bullying assessment, and proposed interventions to minimize bullying.

Abstract:Historically, forensic evaluators have relied heavily upon various editions of the Diagnostic and Statistical Manual of Mental Disorders when rendering psycholegal opinions. The field of mental health is increasing moving toward dimensional models of personality and psychopathology in lieu of traditional DSM categorical models, though the domains of forensic psychology and psychiatry have been slow to make this transition. The current study therefore sought to examine forensic evaluators' familiarity with dimensional approaches to personality and psychopathology, namely the Alternative DSM-5 Model for Personality Disorders (AMPD) and the Hierarchical Taxonomy of Psychopathology (HiTOP). Forensic psychologists and psychiatrists ( N = 54) completed an online survey designed to assess their familiarity with these models, as well as to determine if forensics practitioners are using these models in clinical practice. Participants endorsed greater familiarity with the AMPD, with a large majority of participants indicating they were unfamiliar with the HiTOP model. Few participants endorsed using these models in their clinical forensic practice. Implications for making the transition to dimensional models within forensic evaluation are discussed, as are paths forward for future research.

Abstract:As Forensic Psychology continues to expand as an independent field, professionals regularly resort to psychological assessment tools to assess people involved within the justice system. The Personality Assessment Inventory (PAI) is a 344-item, self-report inventory that aims to provide meaningful information for diagnosis and clinical decision-making, specifically relating to psychopathology, personality, and psychosocial environment. Its applicability in forensic settings has been increasingly recognized on account of its benefits in comparison to other self-report inventories (e.g., MMPI-2, MCMI-III), since it includes scales that are relevant to forensic settings (e.g., violence risk levels, psychopathy, substance abuse), and the existence of profile distortion indicators is useful when dealing with highly defensive and/or malingering populations. The goal of this paper is to conduct a thorough review of the PAI's utility in forensic settings, by focusing on the relevant forensic constructs assessed by the PAI (e.g., personality disorders, psychosis, substance abuse, aggression, recidivism risk, and response distortion), as well as its application to offender and inmate populations, intimate partner violence contexts, family law cases, and forensic professionals. Overall, the PAI continues to gather international recognition and its relevance and usefulness in forensic settings is generally accepted and acknowledged.

Abstract:Forensic psychology has had a wide development within the legal sciences, providing adequate means and tools to facilitate the evaluative criteria of human behavior. In criminal matters, it leads, among other issues, to clarify the motivations of the accused and thus provide greater evidentiary certainty at the time of sentencing. The main objective is to analyze the application of forensic psychology in criminal evaluation and its impact on criminal proceedings, to understand its relevance, effectiveness and contribution to judicial decision making. To achieve this objective, the qualitative approach has been applied, with scientific methods such as analytical-synthetic, historical-logical, and inductive. Among the results, it has been shown that forensic psychology is not commonly used, due to the lack of accredited and specialized professionals, as well as of specific norms that lead to the promotion of a culture of its function and contribution to criminal law. It is essential to have medical, technical, and professional criteria that allow the application of fairer rules aimed at the protection of constitutional rights to ensure proper training and social reintegration of persons criminally punished.
A case law survey of the Personality Assessment Inventory: examining its role in civil and criminal trials

Abstract:Although professional surveys suggest that the Personality Assessment Inventory (PAI; Morey, 1991) is a popular instrument among forensic and correctional psychologists, relatively little is known about the specific types of legal cases in which it is applied, the particular types of questions it is used to address, or the extent to which its admissibility has been at issue in court cases. Using a comprehensive legal database, we surveyed all published U.S., Canadian, European, and Australian criminal and civil cases in which the PAI was administered. The PAI appears to be introduced by examiners in a wide variety of civil (e.g., child custody, personal injury) and criminal (e.g., insanity, competence) cases to aid in the assessment of a broad range of psychopathology. Additionally, the PAI seems to be used frequently to assess questions concerning potential dissimulation and response styles. Surprisingly, the admissibility of the PAI into evidence was never at issue in any of the cases reviewed.

Abstract:This study sought to provide more specific comparison groups for examiners using the MMPI-2-RF in criminal forensic evaluations, as well as to expand upon the existing literature by comparing defendants evaluated for Competency to Stand Trial (CST) and Criminal Responsibility (CR) on psychological functioning. In a large pre-trial criminal defendant sample (n = 486), significant differences were observed between defendants evaluated for CST and those evaluated for CR on scales reflecting emotional and externalizing dysfunction, but not thought dysfunction. Moreover, those opined competent to stand trial by forensic examiners scored lower than those opined incompetent on measures of psychoticism/paranoia, whereas those opined not criminally responsible were less likely to exhibit externalizing psychopathology relative to those opined to be criminally responsible. Implications for forensic psychology practice are discussed.

Abstract:In the recent years, professional activity of forensic medical examiners has been gaining publicity which necessitates knowledge of individual psychologic personality traits, the ability to effectively communicate, and high vocational culture on the part of each specialist. The specific character of professional contacts of a forensic medical expert is self-evident taking into consideration that he (she) has to deal with a great variety of persons including law enforcement officials, law breakers and criminal offence victims, men and women, young and aged people, representatives of different social groups, subjects in a specific emotional state, etc. In order to organize efficacious cooperation with all these individuals, the expert must develop high communicative competence, possess knowledge of psychology of communication, abilities and skills necessary for the establishment and maintenance of professional and business contacts.
Assessing change in dynamic risk factors in forensic psychiatric inpatients: relationship with psychopathy and recidivism

Abstract:This study explored change in dynamic risk for violence using the Clinical and Risk Management subscales of the Historical Clinical and Risk Management-20 version 3 (HCR-20 v3) and sought to determine whether change was associated with violent recidivism. The association between the magnitude of change and psychopathy was also assessed. Participants were 40 male (n = 32) and female (n = 8) forensic psychiatric inpatients discharged from a secure forensic mental health service. Results showed that participants significantly improved on the HCR-20v3 Clinical subscale but significantly worsened on the Risk Management subscale. Psychopathy was unrelated to change in Clinical and Risk Management subscales. The hypothesis that changes in dynamic risk would predict recidivism over and above total pre-treatment risk (HCR-20v3 Total score) and psychopathy was not supported. These results suggest that improvements in mental state risk factors alone are insufficient with regard to lowering violence risk.
