Abstract:In this paper, we study the effects of using an algorithm-based risk assessment instrument to support the prediction of risk of criminalrecidivism. The instrument we use in our experiments is a machine learning version ofRiskEval(name changed for double-blindreview), which is the main risk assessment instrument used by the Justice Department ofCountry(omitted for double-blind review).The task is to predict whether a person who has been released from prison will commit a new crime, leading to re-incarceration,within the next two years. We measure, among other variables, the accuracy of human predictions with and without algorithmicsupport. This user study is done with (1)generalparticipants from diverse backgrounds recruited through a crowdsourcing platform,(2)targetedparticipants who are students and practitioners of data science, criminology, or social work and professionals who workwithRiskEval. Among other findings, we observe that algorithmic support systematically leads to more accurate predictions fromall participants, but that statistically significant gains are only seen in the performance of targeted participants with respect to thatof crowdsourced participants. We also run focus groups with participants of the targeted study to interpret the quantitative results,including people who useRiskEvalin a professional capacity. Among other comments, professional participants indicate that theywould not foresee using a fully-automated system in criminal risk assessment, but do consider it valuable for training, standardization,and to fine-tune or double-check their predictions on particularly difficult cases.

Abstract:This article applies neural network and conventional statistical models to predicting criminal recidivism. While having promising properties for predicting recidivism, the network models do not exhibit any advantage over the other methods in an application on a well-known data set. Analysis suggests that currently available prediction variables have limited information content for discriminating recidivists, regardless of the models or methods used.

Abstract:Despite efforts to support the re-entry of prisoners into society, a significant proportion of released offenders eventually return to crime. To identify areas for improvement within correctional facilities, researchers are directing their focus towards recidivism, the tendency of an offender to recommit a crime. Although past studies have identified factors that are correlated to recidivism, there is still uncertainty about the most significant combinations of factors that drive it. Due to the complexity of this issue, the goal of our project is to create a machine-learning model to predict whether an individual will relapse into crime. Such a model will help experts study the effectiveness of specific forms of punishment and develop personalized correctional programs to target individuals based on their recidivism risk factors. We applied the Decision Tree, Random Forest, and Gradient Boosted Decision Tree algorithms to classify a prisoner as likely to recidivate or not, tuning the hyperparameters to optimize accuracy. To evaluate our hypotheses, we analyzed the top nodes of our trees and confirmed several of our initial predictions. Furthermore, we found that an individual’s relative placement in their community, such as the percentage of individuals in their community with lower or equal education levels, was a significant predictor of recidivism. The results of this research may help law enforcement officers make more informed decisions about how to allocate their resources based on predictions of recidivism.

Abstract:Recidivism, the propensity of convicts to reoffend after release from prison on parole, is a domain that has both benefited from machine learning based decision support systems and experienced race-based bias in the predictions. In this paper we propose an approach to select a model to increase recidivism prediction accuracy while reducing race-based bias. We built several models that each use offenders' current arrest's criminal information and accrue past criminal history information based on different numbers of prior arrests cycles. We then monitor accuracy and inherent bias in the results for different sub-populations. Finally, from the various criminal history-based models developed, we select the one that offers minimal bias for different subpopulations while increasing the accuracy by using False Positive Rate Parity. The approach allows adaptation to the diversity in training data, different crime types, and varied length of prior arrest cycle history. We assessed model prediction performance using ten independent iterations of Monte Carlo cross-validation.

Abstract:Recent research has questioned the value of statistical learning methods for producing accurate predictions in the criminal justice context. Using results from respondents on Amazon Mechanical Turk (MTurkers) who were asked to predict recidivism, Dressel and Farid (2018) argue that nonexperts can achieve predictive accuracy and fairness on par with algorithmic approaches that employ statistical learning models. Analyzing the same data from the original study, this comment employs additional techniques and compares the quality of the predicted probabilities output from statistical learning procedures versus the MTurkers’ evaluations. The metrics presented indicate that statistical approaches do, in fact, outperform the nonexperts in important ways. Based on these new analyses, it is difficult to accept the conclusion presented in Dressel and Farid (2018) that their results “cast significant doubt on the entire effort of algorithmic recidivism prediction.”

Abstract:Objectives: We study interpretable recidivism prediction using machine learning (ML) models and analyze performance in terms of prediction ability, sparsity, and fairness. Unlike previous works, this study trains interpretable models that output probabilities rather than binary predictions, and uses quantitative fairness definitions to assess the models. This study also examines whether models can generalize across geographic locations. Methods: We generated black-box and interpretable ML models on two different criminal recidivism datasets from Florida and Kentucky. We compared predictive performance and fairness of these models against two methods that are currently used in the justice system to predict pretrial recidivism: the Arnold PSA and COMPAS. We evaluated predictive performance of all models on predicting six different types of crime over two time spans. Results: Several interpretable ML models can predict recidivism as well as black-box ML models and are more accurate than COMPAS or the Arnold PSA. These models are potentially useful in practice. Similar to the Arnold PSA, some of these interpretable models can be written down as a simple table. Others can be displayed using a set of visualizations. Our geographic analysis indicates that ML models should be trained separately for separate locations and updated over time. We also present a fairness analysis for the interpretable models. Conclusions: Interpretable machine learning models can perform just as well as non-interpretable methods and currently-used risk assessment scales, in terms of both prediction accuracy and fairness. Machine learning models might be more accurate when trained separately for distinct locations and kept up-to-date.

Abstract:We investigate a long-debated question, which is how to create predictive models of recidivism that are sufficiently accurate, transparent, and interpretable to use for decision-making. This question is complicated as these models are used to support different decisions, from sentencing, to determining release on probation, to allocating preventative social services. Each use case might have an objective other than classification accuracy, such as a desired true positive rate (TPR) or false positive rate (FPR). Each (TPR, FPR) pair is a point on the receiver operator characteristic (ROC) curve. We use popular machine learning methods to create models along the full ROC curve on a wide range of recidivism prediction problems. We show that many methods (SVM, Ridge Regression) produce equally accurate models along the full ROC curve. However, methods that designed for interpretability (CART, C5.0) cannot be tuned to produce models that are accurate and/or interpretable. To handle this shortcoming, we use a new method known as SLIM (Supersparse Linear Integer Models) to produce accurate, transparent, and interpretable models along the full ROC curve. These models can be used for decision-making for many different use cases, since they are just as accurate as the most powerful black-box machine learning models, but completely transparent, and highly interpretable.

Abstract:Criminal recidivism models are tools that have gained widespread adoption by parole boards across the United States to assist with parole decisions. These models take in large amounts of data about an individual and then predict whether an individual would commit a crime if released on parole. Although such models are not the only or primary factor in making the final parole decision, questions have been raised about their accuracy, fairness, and interpretability. In this paper, various machine learning-based criminal recidivism models are created based on a real-world parole decision dataset from the state of Georgia in the United States. The recidivism models are comparatively evaluated for their accuracy, fairness, and interpretability. It is found that there are noted differences and trade-offs between accuracy, fairness, and being inherently interpretable. Therefore, choosing the best model depends on the desired balance between accuracy, fairness, and interpretability, as no model is perfect or consistently the best across different criteria.

Abstract:Predicting criminal recidivism effectively is of major interest in criminology. In this paper, we study the ability of the support vector machines (SVM) to predict the probability of reincarceration. As a semi parametric approach, the SVM minimizes structural risk whereas nonparametric models, such as neural networks, minimize empirical risk. Furthermore, the SVM differs significantly from existing parametric models, such as logistic regression, in prediction of criminal recidivism. Due to the relatively new application of the SVM in predicting criminal recidivism in the field of criminology, a general framework is presented for how the SVM may become a supplemental or alternative method for recidivism prediction. Comparisons among logistic regression, neural networks, and the SVM are made with empirical testing results on a well-known recidivism data set. A combined prediction utilizing all three methods provides the most flexibility and accuracy in decision-making.

Abstract:Can machine learning improve human decision making? Bail decisions provide a good test case. Millions of times each year, judges make jail-or-release decisions that hinge on a prediction of what a defendant would do if released. The concreteness of the prediction task combined with the volume of data available makes this a promising machine-learning application. Yet comparing the algorithm to judges proves complicated. First, the available data are generated by prior judge decisions. We only observe crime outcomes for released defendants, not for those judges detained. This makes it hard to evaluate counterfactual decision rules based on algorithmic predictions. Second, judges may have a broader set of preferences than the variable the algorithm predicts; for instance, judges may care specifically about violent crimes or about racial inequities. We deal with these problems using different econometric strategies, such as quasi-random assignment of cases to judges. Even accounting for these concerns, our results suggest potentially large welfare gains: one policy simulation shows crime reductions up to 24.7% with no change in jailing rates, or jailing rate reductions up to 41.9% with no increase in crime rates. Moreover, all categories of crime, including violent crimes, show reductions; and these gains can be achieved while simultaneously reducing racial disparities. These results suggest that while machine learning can be valuable, realizing this value requires integrating these tools into an economic framework: being clear about the link between predictions and decisions; specifying the scope of payoff functions; and constructing unbiased decision counterfactuals. An algorithm for removing sensitive information: application to race-independent recidivism prediction

Abstract:Predictive modeling is increasingly being employed to assist human decision-makers. One purported advantage of replacing or augmenting human judgment with computer models in high stakes settings-- such as sentencing, hiring, policing, college admissions, and parole decisions-- is the perceived "neutrality" of computers. It is argued that because computer models do not hold personal prejudice, the predictions they produce will be equally free from prejudice. There is growing recognition that employing algorithms does not remove the potential for bias, and can even amplify it if the training data were generated by a process that is itself biased. In this paper, we provide a probabilistic notion of algorithmic bias. We propose a method to eliminate bias from predictive models by removing all information regarding protected variables from the data to which the models will ultimately be trained. Unlike previous work in this area, our framework is general enough to accommodate data on any measurement scale. Motivated by models currently in use in the criminal justice system that inform decisions on pre-trial release and parole, we apply our proposed method to a dataset on the criminal histories of individuals at the time of sentencing to produce "race-neutral" predictions of re-arrest. In the process, we demonstrate that a common approach to creating "race-neutral" models-- omitting race as a covariate-- still results in racially disparate predictions. We then demonstrate that the application of our proposed method to these data removes racial disparities from predictions with minimal impact on predictive accuracy.

Abstract:In an attempt to bridge the gap between research and practice in the domain of criminal risk assessment, this study compared the predictive accuracy of dynamic risk assessments attained via an exhaustive research protocol to that achieved by the proxy ratings generated by parole officers. After an initial prerelease assessment, 127 male offenders under community supervision in Ontario, Canada, were assessed by parole officers and researchers at three different intervals (i.e., 1, 3, and 6 months postrelease). Cox regression survival analyses with time-dependent covariates and receiver operating characteristic analyses revealed moderate to high levels of predictive accuracy in both research-based and parole officer ratings (area under the curve [AUC] = .79 and .76, respectively). The strongest prediction model combined the research-based time-dependent dynamic factors with static items (AUC = .86), thus offering provisional support for the inclusion of prospectively rated dynamic factors in risk assessment protocols.

Abstract:The Level of Service/Case Management Inventory (LS/CMI) is one of the most frequently used tools to assess criminogenic risk–need in justice-involved individuals. Meta-analytic research demonstrates strong predictive accuracy for various recidivism outcomes. In this exploratory study, we applied machine learning (ML) algorithms (decision trees, random forests, and support vector machines) to a data set with nearly 100,000 LS/CMI administrations to provincial corrections clientele in Ontario, Canada, and approximately 3 years follow-up. The overall accuracies and areas under the receiver operating characteristic curve (AUCs) were comparable, although ML outperformed LS/CMI in terms of predictive accuracy for the middle scores where it is hardest to predict the recidivism outcome. Moreover, ML improved the AUCs for individual scores to near 0.60, from 0.50 for the LS/CMI, indicating that ML also improves the ability to rank individuals according to their probability of recidivating. Potential considerations, applications, and future directions are discussed.

Abstract:Recidivism prediction scores are used across the USA to determine sentencing and supervision for hundreds of thousands of inmates. One such generator of recidivism prediction scores is Northpointe's Correctional Offender Management Profiling for Alternative Sanctions (COMPAS) score, used in states like California and Florida, which past research has shown to be biased against black inmates according to certain measures of fairness. To counteract this racial bias, we present an adversarially-trained neural network that predicts recidivism and is trained to remove racial bias. When comparing the results of our model to COMPAS, we gain predictive accuracy and get closer to achieving two out of three measures of fairness: parity and equality of odds. Our model can be generalized to any prediction and demographic. This piece of research contributes an example of scientific replication and simplification in a high-stakes real-world application like recidivism prediction.

Abstract:The rate of recidivism by criminals after their release from prison is high, which is harmful to society. Thus, it is socially significant to reduce their recidivism rate. This article uses public data from the state of Iowa in the United States. According to the data characteristics, such as having redundant samples and mixed attributes, we propose the following methods. First, we use a rough set attribute reduction algorithm based on probability distributions to reduce the redundant items. Second, the sample data are clustered with an improved clustering algorithm. Based on the traditional K-prototype clustering algorithm, the clustering algorithm is improved by changing the measurement method of the categorical attributes, changing the initial cluster center selection method, and weighting the attributes based on the information entropy. The clustering experiment results show that the improved clustering algorithm has a better clustering effect and higher clustering accuracy than the traditional K-prototype clustering algorithm. Finally, a back propagation neural network is used to predict the recidivism probability of the sample processed by the above algorithm. The final experimental results show that the two redundant attributes are successfully reduced by rough sets, which greatly reduces the run time of the model. Compared with the traditional K-prototype clustering algorithm, the improved K-prototype clustering algorithm proposed in this paper has a better effect on the various indicators and objective function. Finally, through neural network prediction, the prediction accuracy of this model reached 87.9%. At the same time, a large number of experiments on benchmark datasets verify the effectiveness of our proposed model.

Abstract:This study aims to improve the predictive performance of existing risk assessment tools and the predictive validity of the original Ministry of Justice Case Assessment Tool (MJCA) concerning recidivism rates using machine learning (ML) and examine whether the tool's predictive performance can be improved. With follow-up data on 5,942 individuals in Japanese Juvenile Assessment Centers, the study uses ML methods, such as the K-nearest neighbor algorithm, support vector machine, random forest, gradient boosting tree, and multilayer perceptron, to improve the MJCA's prediction power. The results show that the predictive validity of the original MJCA significantly improves for three of the six ML methods; gradient boosting tree, random forest, and multilayer perceptron have the highest predictive validity. The area under the receiver operating characteristic curve (AUC) for the gradient boosting tree is 0.75, significantly higher than the AUC of the original MJCA (0.67). We concluded that ML can improve the predictive validity of recidivism rates. Among the ML techniques, decision tree algorithms were better at predicting recidivism. The improvement, as with other findings, is less pronounced than the enormous impact that recent artificial intelligence methods have had on information processing. However, it is significant because recidivism risk assessment is important in determining the treatment for individuals who offend. Abstract:Recidivism prediction provides decision makers with an assessment of the likelihood that a criminal defendant will reoffend that can be used in pre-trial decision-making. It can also be used for prediction of locations where crimes most occur, profiles that are more likely to commit violent crimes. While such instruments are gaining increasing popularity, their use is controversial as they may present potential discriminatory bias in the risk assessment. In this paper we propose a new fair-by-design approach to predict recidivism. It is prototype-based, learns locally and extracts empirically the data distribution. The results show that the proposed method is able to reduce the bias and provide human interpretable rules to assist specialists in the explanation of the given results.

Abstract:Objective There is currently inconclusive evidence regarding the relationship between recidivism and mental illness. This retrospective study aimed to use rigorous machine learning methods to understand the unique predictive utility of mental illness for recidivism in a general population (i.e.; not only those with mental illness) prison sample in the United States. Method Participants were adult men (n = 322) and women (n = 72) who were recruited from three prisons in the Midwest region of the United States. Three model comparisons using Bayesian correlated t-tests were conducted to understand the incremental predictive utility of mental illness, substance use, and crime and demographic variables for recidivism prediction. Three classification statistical algorithms were considered while evaluating model configurations for the t-tests: elastic net logistic regression (GLMnet), k-nearest neighbors (KNN), and random forests (RF). Results Rates of substance use disorders were particularly high in our sample (86.29%). Mental illness variables and substance use variables did not add predictive utility for recidivism prediction over and above crime and demographic variables. Exploratory analyses comparing the crime and demographic, substance use, and mental illness feature sets to null models found that only the crime and demographics model had an increased likelihood of improving recidivism prediction accuracy. Conclusions Despite not finding a direct relationship between mental illness and recidivism, treatment of mental illness in incarcerated populations is still essential due to the high rates of mental illnesses, the legal imperative, the possibility of decreasing institutional disciplinary burden, the opportunity to increase the effectiveness of rehabilitation programs in prison, and the potential to improve meaningful outcomes beyond recidivism following release.

Abstract:When might human input help (or not) when assessing risk in fairness domains? Dressel and Farid (2018) asked Mechanical Turk workers to evaluate a subset of defendants in the ProPublica COMPAS data for risk of recidivism, and concluded that COMPAS predictions were no more accurate or fair than predictions made by humans. We delve deeper into this claim to explore differences in human and algorithmic decision making. We construct a Human Risk Score based on the predictions made by multiple Turk workers, characterize the features that determine agreement and disagreement between COMPAS and Human Scores, and construct hybrid Human+Machine models to predict recidivism. Our key finding is that on this data set, Human and COMPAS decision making differed, but not in ways that could be leveraged to significantly improve ground-truth prediction. We present the results of our analyses and suggestions for data collection best practices to leverage complementary strengths of human and machines in the fairness domain.
