Abstract:This article investigates the role of parliamentary amendment powers in the Budget process from a comparative perspective. It is proposed that the ability of Parliament to change the Budget depends on two sets of necessary conditions: the actual configuration of powers vested in Parliament and a set of factors determining the role of committees in the Budget process. It is concluded that even if the South African Parliament were to immediately gain amendment powers in budgetary matters, committees do not yet have the capacity to effectively utilise them. The article therefore proposes the introduction of amendment powers in conjunction with a set of procedural and institutional changes.

Abstract:Budgeting is a rule-driven process that regulates the raising and spending of public money. Detailed rules govern the submission of bids for resources by spending units, review of these bids by the Finance Ministry or another central organ, compilation of the annual budget, legislative action including the voting of appropriations, expenditure of funds during the financial year, and reporting on financial stocks and flows. Why have many national governments adopted new budget rules when they have a plethora of old ones? The new rules do not replace – although they may modify – existing rules, thereby adding to the complexity of established budget processes, and often adding as well to the time it takes to complete the main steps in the annual budget cycle. Why add to the complications of an already difficult process? If it is because the old rules do not work, why is it expected that new ones will make much of a difference? Furthermore, the old rules generally empower budget-makers by enabling them to allocate resources according to the preferences of government. Fiscal rules, by contrast, constrain budget-makers, taking away much of their authority to decide aggregate revenue and spending policy. These rules typically prescribe the balance between revenue and spending policy. Every fiscal rule is a limit on the exercise of political will. Why have democracies accepted or imposed fiscal limits on themselves, and why should we expect these limits to be effective when they run counter to the preferences of voters and politicians?...

Abstract:This paper presents different aspects of regulating parliamentary debate in the second half of the 19th century in the Croatian Parliament (Sabor) and other parliaments in a comparative discourse. This includes parliament's constituent session, preparation and course of parliamentary debate, MPs’ motions and interpellations, MPs’ freedom of speech, voting and adoption of conclusions. The analysis will be based on a comparison of the rules of procedure of the Croatian Parliament (1861-1918), the 1848 Frankfurt National Assembly (Frankfurter Nationalversammlung), the 1848 Imperial Diet in Vienna (Reichstag), the Imperial Council (Reichsrat), the Hungarian Parliament and parliaments of some German lands in the second half of the 19th century as well as a collection of precedents serving as a basis for the operation of the British Parliament (the so-called Westminster procedure) and the rules of the United States Congress. Moreover, acceptance and modification of individual aspects of the Westminster procedure or provisions in the procedural rules of other countries will be presented as examples suggesting that the transfer of ideas and practices in parliamentarianism in Croatia and other European countries in the 19th century should be viewed through the prism of multidirectional influence and creative receptions.
Can parliament govern the transport transition? How the German Bundestag scrutinizes rail projects

Abstract:Background The paper aims to elucidate to what extent the German Parliament exerts control over rail planning. Parliament has the budgetary right, but information asymmetries vis-à-vis the railway company Deutsche Bahn and the Ministry of Transport make parliamentary control difficult. Methods Recently, Germany has instituted a parliamentary review process that allows the Parliament to take up concerns by the public affected by rail projects. We use the principal-agent theory to model this new institution. Parliament delegates rail planning to the Deutsche Bahn, while the Federal Railway Authority serves as a budget watchdog, and parliament uses input from public participation as a deck-stacking procedure. The paper first situates the institutional innovations—the new parliamentary oversight procedure—against the former logic of railway planning. Second, based on the documentation of parliamentary oversight, we analyze for which demands by the affected public the Parliament uses its power to change rail projects. Results The paper showed that public participation matters. The German Parliament introduced expensive changes to rail projects. In particular, demands that had been voiced in well-institutionalized public participation (that is, when municipalities, regional associations, etc., were engaged in long-term institutionalized dialogues with the Deutsche Bahn) were more likely to be addressed. An Extra budget was then allocated to, for example, noise-regulating measures. Conclusions To sum up, the German Parliament uses information gained in public participation in combination with its budget rights to exert control over railway planning for conflictual projects. Thus, Parliament takes a more active role in railway planning. Whether this also leads to more acceptance for rail projects, is an open question.

Abstract:Fiscal deficit and too much public debt is a difficulty that governments of modern countries have to confront with in common.Compared with static balanced budget,why budget is not balanced and how to balance it with legal measures may be more important.The ultimate aim of legal control over fiscal deficits is always to balance budget while endeavor should be invoked to turn traditional balance of financial income and expenditure into overall economy balance,as for which the provisions in German Economic Constitution concerning overall economy balance may serve as the best reference for China.In terms of promoting balanced budget with special law,the US balanced budget rule of deficits-reduction is a model.Though held unconstitutional in a judicial review for it attempts to moderate and break through the check and balance of the federal power its legislative attention to reduce or eliminate fiscal deficits proves a failure to some extent,it is still be deemed a best institutional example for theoretical study of the"promotive economic law."

Abstract:For the past decade, scholars and practitioners have developed indexes to measure both legislative powers in general, and of the legislative power of the purse, in particular. Initial focus was on the development of a comprehensive index of legislative powers, and on assessing the ex-ante role of the legislature in the budget process. This article substantially deepens extends previous research on ex-post oversight, by developing a more comprehensive index to measure ex-post oversight, by using more up-to-date data bases and by including more countries. We can partially confirm the emerging consensus that ex-post budget oversight is stronger in parliamentary – and especially Westminster – systems than in countries with other forms of government, thereby somewhat offsetting the previously identified weaknesses of Westminster parliaments in budget formulation. When used in combination Wehner’s [2006. Assessing the power of the purse: An index of legislative budget institutions. Political Studies, 54, 767–785] index of ex-ante legislative oversight, this index provides a comprehensive picture of legislative power of the purse regarding the budget process.
British "Parliamentary Sovereignty": Its Theory Evolution and Concept Analysis

Abstract:British parliamentary sovereignty is traditionally defined as a "legal sovereignty" ,which refers to the supreme power held by the Parliament without any restriction in legislation but being subject to "political sovereignty". This paper assumes that the contemporary political sovereignty is the supreme jurisdictional power,which,based on the constitution,is exercised by the national government composed of legislative,executive and judicial branches. A jurisprudent sovereignty,"legal sovereignty" in broader sense,embodies the recognition of the supreme constitutional power and the principle of sovereignty equality in international law. It is,indeed,complementary to political sovereignty. Thus,as in other democracies,real sovereign in Britain is British people,and political sovereignty,based on the (unwritten) British constitution,is respectively exercised by British legislative,executive and judicial powers,among which the supreme legislative one,i.e.,"legal sovereignty" in its narrow sense,actually is part of political sovereignty. Due to the traditional characteristics of its constitution,the Commons are free from any containment by any government agency. Nevertheless,neither are the commons final holders nor the sole exercisers of British sovereignty.

Abstract:Purpose The purpose of this paper is to propose a model that allows analyzing exchange and use of fiscal information by the roles of actors involved in the budget process and to apply the proposed model to the 2018 Czech state budget debate. The aim is to identify approaches used by the members of the Chamber of Deputies (members of the parliament (MPs)) when gathering information to be used in their decision making on the state budget, and to evaluate usefulness of the information provided through the executive’s budget proposal. Design/methodology/approach This paper is the observatory study of the Czech 2018 state budget debate based on a set of unstructured interviews with newly elected MPs. Findings When it comes to the MPs deciding about the state budget the executive’s budget proposal seems to be an insufficient source of information as the MPs relied heavily on various information brokers during the budget debate. The use of information and communication technologies in the process of information provision lags behind its potential. Practical implications The authors suggest two possible ways to improve the effective transparency of the Czech state budget debate: standardization of the chapter books and making them available to every MP as well as to the general public, and adding the budget proposal to the Monitor budget explorer – a publicly available budget explorer provided by the Ministry of Finance. Originality/value The originality of this paper lies in the proposal of the Fiscal Information Ecosystem Model and its application to the 2018 Czech state budget debate which shows how the members of the Czech Chamber of Deputies gathered information they needed in their decision making.

Abstract:The experience of the most influential interstate formation in Europe – the European Union, which occupies the second place in terms of GDP and the third in terms of population. is instructive in all its spheres of functioning, in particular in the field of budget law. Given the accelerated movement of Ukraine to the European community, the «budget experience» of the European Union is certainly the most indicative and instructive, since it was formed on the basis of a generalization of best practices of all member countries of the European continent. The article deals with a set of the main EU budget regulations: the Treaty on the Functioning of the European Union; Treaty on European Union; EU financial regulations; Regulation of the European Parliament and of the Council (EU, EURATOM) 2018/1046 of 18 July 2018 on financial rules applicable to the general budget of the Union on amendments to the regulations (EU) No 1296/2013, (EU) No 1301/2013, (EU) No 1303/2013, (EU) No 1304/2013, (EC) No 1309/2013, (EC) No 1316/2013, (EC) No 223/2014, (EC) No 283/2014 and Decision No 541/2014/ЄS and repealing Regulation (EU, Euratom) No 966/2012. On the basis of a detailed analysis of these documents, the fundamental positions of the EU budget process in general and the principles of the EU budget in particular are ordered, structured and described (they include the principles: unity, reliability of the budget, annuity, balance, unit of account, universality, detail, prudent financial management and productivity, transparency). Proposals for the implementation of the principles of the EU budget to the domestic budget law are carried out.

Abstract:Abstract I review research on the relationship between democracy and government indebtedness. I first discuss whether the extent to which politicians use fiscal policy for reelection purposes is conditioned by a country’s experience with democracy. Political budget cycles are not confined to young democracies, but evidence suggests that in younger democracies such cycles are more likely and also stronger than in more mature democracies. Next, I discuss whether the use of fiscal policy by the incumbent increases his/her chances for reelection. Research discussed suggests that political parties in government benefit to some extent if fiscal policy turns expansionary before elections occur.

Abstract:Open information of government organizations is a subject that should interest all citizens who care about the functionality of their governments. Large-scale open governmental data open the door to new opportunities for citizens and researchers to monitor their government's activities and to improve its transparency. Over the years, various projects and systems have been processing and analyzing governmental data using open government information. Here, we present the Collecting and Analyzing Parliament Data (CAPD) framework. This novel generic open framework enables the collection and analysis of large-scale public governmental data from multiple sources. We used the framework to collect over 64,000 parliaments' protocols from over 90 committees from three countries. Then, we parsed the collected data and calculated structured features from it. Next, using the calculated features, we utilized anomaly detection and time series analysis to uncover various insights into the committees' activities. We demonstrate that the CAPD framework can be used to identify anomalous meetings and detect dates of events that affect the parliaments' functionality, and help to monitor their activities.

Abstract:This study explores the intricate interplay between female representation in national parliaments and government fiscal policies, with a specific focus on fossil fuel subsidies, environmental taxes, and expenditure, in the context of climate change mitigation. Using a sample of 160 countries over the period from 1997 to 2022, this empirical analysis demonstrates the positive relationship between the presence of female parliamentarians and environmentally friendly fiscal measures. While women in the parliaments reduce the amount of the subsidies granted to fossil fuels, they levy environmental taxes and increase environmental spending. The findings illustrate the pivotal role of female parliamentarians in advocating for environmental legislation and transcending political ideologies and national boundaries. Addressing potential concerns of endogeneity by employing additional control variables, omitted variables, and instrumental variable analyses, this study emphasises the robustness of the results. Notably, this study finds that a critical mass of at least 30% female representation in parliaments enhances the efficacy of environmental policy outcomes. This research highlights the multifaceted impact of gender diversity on fiscal policies related to environmental protection, offering valuable insights for policymakers and organisations committed to sustainability and gender equality.

Abstract:The modern state plays a significant role in securing public resources in order to provide them to all of its citizens. The state needs to secure a certain amount of income to perform this function. The institution that best exemplifies that manner in which the state acquires and directs its income is the budget. Given that a budget sets forth the financial plans for a specific period in detail, the process of creating and controlling a budget is very significant. An efficient mechanism of controlling the creation and implementation of the budget needs to exist in order to ensure that the acquired state income is managed to the benefit of the citizens. Budget control can be performed by administrative bodies, independent bodies and the parliament, as the body that adopts the budget and the final financial statement. Thus, the subject of this paper is administrative, institutional and political budget control. Throughout the paper, the author will also provide a brief overview of some positive law solutions from the Republic of Serbia. Administrative control is based on the hierarchical principle, institutional control is performed by auditing institutions, while political control is conducted by the parliament, as the highest representative body.

Abstract:Abstract There has been a wide-ranging discourse among scholars as to whether a hierarchical budget process contributes to increased fiscal discipline. During the 1990s such reforms were introduced in Sweden and Norway. These countries are characterized as being quite equal. However, they faced contrary economic challenges, with an accelerating debt in Sweden contrasting with huge resource revenues in Norway. Nonetheless, they shared equal political challenges by being characterized by minority as well as coalition governments, and even a large proportion of minority, coalition governments. This study confirms that there has been significantly increased fiscal discipline during the parliament’s budget approval process. The outcome has been supported by reforms to the preparation of the budget approval, which have been centralized to the parliaments’ standing committees on finance. The study supports the framework for evaluation of budget processes in von Hagen and Harden (1995). However, there are two significant modifications which stands out as supplements to the framework. First, strong limitations on amendments may be less important under a regime of top-down budgeting than anticipated in their framework. Second, the importance of centralizing the budget preparation in one specific committee, normally the standing committee on finance, may be stronger than anticipated by von Hagen and Harden.

Abstract:This article addresses the problem of the EP’s role in the process of multi-level governance illustrated with the example of EU expansion policy through the accession of the West Balkan states. As an effect of the European integration process, resulting in the transfer of decision-making competences from the state level to the transnational level, nation-states have lost their monopolistic position in the European decision-making process. This has enabled the formation of multi-level political system within the EU. Within the system, there is a multi-level governance model, with the EP as its crucial element. This article reveals an important role of the EP as a transnational decision-making centre, which with its specific competences (giving consent to the accession of a country to the EU, giving consent to sign international agreements crucial for the integration process, budget rights, co-decisions on the form of the EU law with an ordinary law making procedure) considerably forms the policy of the EU in relation to the Balkan countries. The explanation of the policy’s functioning and its outcomes are based on the concept of multi-level governance, which is analyzed herein in depth.

Abstract:This chapter examines the role that political parties play in the working of democracy. Political parties are among the major actors in democratic politics. Whether or not in power as the result of victory in free and fair elections, the governments of most countries have effectively been in the hands of party leaders. When governments were not in the hands of party leaders, most often because party government was interrupted by a military takeover. The chapter first considers various definitions of a political party before tracing the origins of political parties. It then describes the functions of parties and the ways in which parties are organized, regulated, and financed. It concludes with an analysis of the role of parties in the stabilization of democracy in the late twentieth and early twenty-first centuries, as well as challenges confronting parties in the new millennium.

Abstract:This paper attempts to examine which factors explain public participation in the budget process in an international comparative approach. In particular, we investigate which socioeconomic, institutional, and political factors promote public engagement in the central government budget process. Using a sample of 93 countries, our results indicate that Internet penetration, population diversity, governmental financial situation, and budget transparency determine opportunities for public engagement in the central government budget process. In addition, we show that not only budget transparency promotes public participation but also public participation is necessary to enhance budget transparency.We examine which factors explain public participation in the budget process in an international approach. Internet, population diversity, governmental financial situation and budget transparency impact public engagement in the central government budget process. Not only budget transparency promotes public participation, but also public participation is necessary to enhance budget transparency.

A New Perspective of Government Budget Supervision under Public Finance Framework

Abstract:The budget supervision under the public finance framework should include two levels,i.e.the basic level and the target level.The basic level is to supervise such activities as the budget preparation,implement and adjustments and the final budgeting to make all of them in line with the related laws.And the target level is to supervise the government activities and the flowing direction of the public resources through budgeting.In practice,the two levels of supervision are not distinguished in China,and enough attention is not paid to either of them,which has resulted in a series of problems.In order to make the government budget play a better role in the public finance system,China has to clarify the relationship and importance between the two levels of budget supervision on the basis of the law and stipulate the supervision procedures for the government budget in details,so as to guarantee the sound using of public resources to satisfy the public needs.
