Abstract:With only 65% of Indian houses having access to the Internet, digital India faces a significant Internet divide across gender and city types. Rendering essential services inaccessible to almost a third of the population necessitates not only provisioning a fundamental right to Internet access but taking specific constructive steps to assure its simple, affordable and safe accessibility. Establishing such a right would also pave way for other ancillary rights required for data privacy, protection from Internet's possible harms and the requirement to be treated fairly. We first discuss two arguments on the universal right to Internet access; from Merten Reglitz, a senior lecturer on Global Ethics and from Vincent Cerf, one of the founding creators of the Internet who has had a profound influence on the field. We specifically argue why Internet access should be treated as a fundamental right. We discuss the learnings from India, contextualizing them with the global debate and argue for establishing Internet access as a fundamental right in India and elsewhere in the form of government legislation to eliminate Internet divide.

Abstract:This article dives into the ongoing debate on how to address concerns of personal safety and respect online, as well as consequences for exposure to polarizing and in various ways harmful information, while at the same time safeguarding the democratic essentials of freedom of expression and participation. It does so by examining the issue from a less common angle, namely who governs the Internet and the platforms where much of the toxic material appears. By applying a model of free speech regulation conceptualized by legal scholar Jack Balkin (2018a, 2018b), the article explores different theoretical future scenarios of Internet governance involving three main players, namely governments, private companies, and speakers. The analysis finds that depending on which player is at the forefront, the outcomes from the standpoint of participation and freedom of speech may be drastically different. While there is potential for transformation that can enable more ownership, transparency, and agency for citizens and news media, some potential paths will place ever-increasing control over the interests of users.

Abstract:The incumbent Government of India has staked a significant stock of its political capital in the "global positioning" of India as both "tech-savvy" and "open." It has made strenuous efforts since 2015 to facilitate the infrastructure necessary for realizing the vision of a "Digital India" with universal access and a fully integrated data infrastructure. The high rhetoric of "Digital India" is founded upon the biometric architecture of the Aadhaar platform, the world's largest and most ambitious "mechanism of 'legibility'," which, in turn, supports the further ambition of the "India Stack" and the realization of a transactional economy. In all respects, the state in India remains a key interest in incubating the platform economy, functioning as an orchestrator and an instrument in shaping market norms, and acting as a seller of bandwidth and a procurer of infrastructural development. In the international race to harness "smart" technologies for sustainable cities and the "fourth industrial revolution," the Government of India has provided incentives for a range of domestic start-ups while assiduously courting Silicon Valley giants on technology transfers and forging systemic partnerships with India's leading business houses to provide the necessary investments in digital infrastructure.

Abstract:China’s Internet governance is not immutable, nor is it dominated by the government, as portrayed by Western scholars. Based on an analysis of Beijing’s Internet governance policies and practices, this paper focuses on the evolution of China’s Internet governance from the non-governmental stage through the government control stage to the multi-actor coordination stage. In terms of governance paradigm, Beijing’s Internet governance is transitioning from one-way management to multi-dimensional governance, from offline management to online and offline integration, and from “prior control” to “panoramic governance.” In terms of governance system, Beijing’s Internet governance has evolved from an ad hoc pattern through problem-solving to a strategic planning paradigm. Internet governance in China has demonstrated three features, namely, pragmatism, state centralism, and preemption. These characteristics have paved the way for the rapid development of China’s Internet but also present many challenges.

Abstract:The Internet is now at the crossroads of the information and media spheres, at the juncture between private and public areas. Since the ‘90s, with the widespread use of the web and the domain name system the power to name, to identify, to search and to retrieve data on the Internet includes a deep societal and ethical dimension. Therefore one could identify multiple regimes of “governmentality” of the Internet following the track of the studies initiated by Michel Foucault. In fact, not so much the governance of the Internet but how the Internet governs the world. As a background of further analysis and researches the recent two Summits on the Information Society organised by the United Nations and held in Geneva in 2003 and in Tunis end of 2005 have agreed on a series of texts in form of Declaration of Principles, Plan of Action, Commitment and Agenda for the next five years*. In this context an impetus will be given to the bottom up “multistakeholders” approach. This will only be achieved if ethics, value and principles are put forward at the same level as any process of reflexivity. It is clear that the ambition and prospect of these texts and of the Agenda would need in order to be effective and implemented the formalization of common agreed principles and to set up adequate international instruments. In short this would imply a new social contract for the digital world.

Where The Light Gets In: Analyzing Web Censorship Mechanisms in India

Abstract:This paper presents a detailed study of the Internet censorship in India. We consolidated a list of potentially blocked websites from various public sources to assess censorship mechanisms used by nine major ISPs. To begin with, we demonstrate that existing censorship detection tools like OONI are grossly inaccurate. We thus developed various techniques and heuristics to correctly assess censorship and study the underlying mechanism involved in these ISPs. At every step we corroborated our finding manually to test the efficacy of our approach, a step largely ignored by others. We fortify our findings by adjudging the coverage and consistency of censorship infrastructure, broadly in terms of average number of network paths and requested domains the infrastructure surveils. Our results indicate a clear disparity among the ISPs, on how they install censorship infrastructure. For instance, in Idea network we observed the censorious middleboxes on over 90% of our tested intra-AS paths whereas for Vodafone, it is as low as 2.5%. We conclude our research by devising our own novel anti-censorship strategies, that does not depend on third party tools (like proxies, Tor and VPNs etc.). We managed to anti-censor all blocked websites in all ISPs under test.

Abstract:Governance of the Internet is a matter of global importance and concern. The multi-stakeholder (MS) and multilateral (ML) forms have been presented as two competing and plausible models of Internet governance. Drawing on actor–network theory (ANT) and building on an interpretive case study of rich archival data, this paper examines how the focal actor’s (i.e. the U.S. government’s) beliefs influence the choice of Internet governance form. It further explores the strategies of the focal actor to translate the interests of the ML network’s supporters, with a view to enrolling them in the MS governance network. The analysis shows how the focal actor has established the MS governance form through the Internet Corporation for Assigned Names and Numbers (ICANN) as an Obligatory Passage Point to keep the Internet successfully operational. The analysis also illuminates the combination of structural and collaborative strategies employed to allay the growing dissatisfaction with the MS governance form. The paper suggests that whilst the protocols and technical standards of the Internet are increasingly relegated to the background, the social and political network that Internet artefacts draw together in a meta-form has grown in prominence. It also argues that there may be a hierarchy of beliefs, which influence how actors enact their translation strategies. Finally, the paper discusses parallels between the MS/ML forms of Internet governance and IT governance in organizational contexts.

Abstract:Among the key global debates today, the governance of digital platforms has garnered widespread policy attention. As buoyant discourses celebrating innovation, opportunity and disruption jostle in equal measure with concerns about the rise and rise of digital monopolies, lawmakers and citizens are taking note of the escalating consequences of a no-holds barred ‘platformization’. As network-data architectures, platforms orchestrate the production and exchange of products and services by optimizing relationships among a network of actors, thereby transforming economic activity. Concerns about the platform economy extend to the adverse terms of market engagement for smaller players – workers, small producers and enterprises, developing nations – and the real world outcomes for local development. Regulatory deficits present an equally important challenge, as institutions struggle to respond to the public policy-making imperative in relation to the platform economy. IT for Change’s research project, ‘Policy Frameworks for Digital Platforms – Moving from Openness to Inclusion’ (2017 to 2019), unpacked the platformization phenomenon, focusing on the necessary institutional-legal arrangements for a future economy that furthers development justice. The project addressed two key questions: What are the social-relational architectures of the platform economy? What legal-institutional approaches can be used to future-proof the platform economy from inequality, injustice and exclusion?

Exploring the Cyber Governance Discourse: A Perspective from China

Abstract:This study aims to examine China's approach to the cyber governance, especially the discourse of Internet information, through a detailed investigation of the Provision on Ecological Governance of Internet Information Content. The findings in this study indicate that China's approach to the governance of Internet information possesses the following essential features: the clarification of the dialectical relationship between Internet freedom and order, the unification of carrying forward positive energy and restraining negative information, the people-oriented and bottom-up participatory approach to the ecological governance of Internet information, as well as the strictly prohibitive conducts of three key administrative counterparts. The underlying reasons for choosing such an ecological path to regulate the Internet information can be attributed to China's national configuration, including its political system, cultural tradition, status quo of the Internet development, and the pervasive cybersecurity challenges facing its society. It is thus argued that the governance of Internet information, characteristic of spatiality, can merely be construed within specific socio-political and cultural contexts. Albeit the spatiality of the governance of the Internet information, China's approach can serve as a model for other nations to develop their own governance discourses pertaining to the Internet information. This study aims not only to unpack the Chinese discourse of the ecological governance of Internet information but also to provide useful insights into the discourse and practices of global cyber governance.

Abstract:The cybersphere constitutes a global disagreement space where the contested, ongoing ties that link states and the internet come into being. In this paper, a critique of sovereignty and political economy is offered to evaluate contemporary controversies concerning authority, independence, regulation, and access to communications as matters of relationality, materiality, and disagreement. We review China's promotion of cyber sovereignty as a complicating episode that reflects the development stresses of the sphere. China wishes to establish guardrails for the practices of multipolar global digital capitalism; yet, it has ushered in a variety of internet-related global issues, including in security, privacy, material well-being, developmental justice, and planetary futures. These complex aims invite and expand the dialectical spaces animating the cybersphere.

Abstract:One of the most contentious and longstanding debates in Internet governance involves the question of oversight of the Domain Name System (DNS). DNS administration is sometimes described as a “clerical” or “merely technical” task, but it also implicates a number of public policy concerns such as trademark disputes, infrastructure stability and security, resource allocation, and freedom of speech. A parallel phenomenon involves governmental and private forces increasingly altering or co-opting the DNS for political and economic purposes distinct from its core function of resolving Internet names into numbers. This article examines both the intrinsic politics of the DNS in its operation and specific examples and techniques of co-opting or altering DNS’ technical infrastructure as a new tool of global power. The article concludes with an analysis of the implications of this infrastructure-mediated governance on network security, architectural stability, and the efficacy of the Internet governance ecosystem.

Abstract:The standards development organization’s (SDO) role in Internet governance is notable given its central place in society. The bulk of decision-making for the Internet takes place in technical standards fora, such as the Internet Engineering Task Force (IETF) and World Wide Web Consortium (W3C), which have no formal state or public sector body membership. Recent years have seen a significant degree of spill-over of highly politicized policy areas such as data protection, digital rights management, security, and bandwidth and spectrum to SDOs, policies which were formerly domains of the nation state. SDOs are grappling with the efficiency of cloud storage, limits of spectrum use, and autonomy and management of devices. Security questions abound as demonstrated by the Cambridge Analytica scandal and Snowden revelations. The book breaks new ground by exploring decision-making within SDOs. It provides an invaluable insight into a world, which, although highly technical, affects the way in which citizens live and work on a daily basis. The work stands out from existing literature on Internet governance, which focuses on international organizations such as the United Nations (UN), the Internet Governance Forum (IGF), and the Internet Corporation for Assigned Names and Numbers (ICANN). As such, it adds significantly to the trajectory of research that explores the relationship between politics and protocols. It explains the interplay between different interests and whether civil society and other actors are able to defend and promote citizens’ rights within SDOs. As such, it contributes to knowledge about how the public interest is promoted.

Abstract:The article discusses the transformations of technology in the last two decades, especially those related to privacy, based on the digital rights perspective. It debates how the concept of privacy is grounded on the distinction between public and private, a spatial metaphor no longer applicable in the face of the ubiquity of information and communication technologies. Hence, there is a premise stating the personal is increasingly more political nowadays, due to the phenomenon of surveillance capitalism. To anchor the theoretical debate in an empirically informed discussion, the work analyzes discourses about digital rights used in the main sessions of the Internet Governance Forum. The goal is to map the main Forum controversies about digital rights and their relation with contemporary democracies. Using a combined methodology based on both quantitative and qualitative data from the main sessions of the event, the analysis starts from a survey of the recurrence keywords related to the research; privacy, rights, surveillance, and freedom. From these results, a qualitative analysis of the discourses mobilized in these activities is conducted. The outcomes of the empirical analysis are then discussed from examples of technology regulation in the United States and the European Union. Abstract:This article identifies the current global ‘techlash’ towards the major digital and social media platforms as providing the context for a renewed debate about whether these digital platform companies are effectively media companies (publishers and broadcasters of media content), and implications this has for twenty-first-century media policy. It identifies content moderation as a critical site around which such debates are being played out, and considers the challenges arising as national and regionally based regulatory options are considered for digital platforms that are ‘born global’. It considers the shifting balance between the ‘social contract’ of public interest obligations and democratic rights of free speech and freedom of expression.

Jio sparks Disruption 2.0: infrastructural imaginaries and platform ecosystems in ‘Digital India’

Abstract:In recent years, Reliance Jio’s offer of 4G services, guaranteeing free voice calls and ‘unlimited’ data streaming, lead to disruption in the Indian telecom market with other cellular operators losing their revenue and customer base. To comprehensively analyze this churn in the Indian telecom industry and its impact on mobile phone customers, the article argues for observing the entanglement of infrastructural and platform-related discourses at three levels of operation: Jio’s strategies to capture the Indian telecom market and the responses by the leading incumbent service provider (Airtel), ordinary citizens’ phone use practices and infrastructural encounters, and the government’s vision for India’s digital future. Connecting pipes to platforms, Jio made infrastructural investments (in spectrum, cell towers, and fiber optics networks) to promote its suite of apps (JioTV, JioChat, and JioMoney). Ordinary citizens relate their access/proximity to telecom infrastructure (cell antennas) to their ability to effectively use apps on their phones. ‘Digital India’ vision purportedly facilitated infrastructural growth to create platforms that would support demonetization and facilitate transparent governance. Through such a three-pronged analysis, I conceptualize ‘infrastructural imaginaries’ that are coproduced by states and citizens, and lie at the intersection of structured state policy/corporate initiatives and lived experiences/affective encounters of ordinary citizens.
