Abstract:After Uruguay round,technical barriers have become a major form for trade protection,replacing tariff barriers.However,technical barriers are not quite equal to trade protection,for it exists as it should be.In the view of origins of technical barriers,we can identify the two concepts----technical barrier and trade protection in three aspects technical difference,externality and sole protectionism;the first two aspects which we should take for granted and adopt a correct attitude to treat,the last aspect a variant of trade protection by which we should safeguard our interests.

Abstract:Chinese higher education has experienced dramatic development since the reform and opening-up in 1978 and especially the great expansion in 1999. The entry to WTO brings a fresh dynamic and opportunity to Chinese higher education. Under the new impetus, the pressing demands of cross-border higher education in China are mainly to expand access, raise funds, improve the quality of human resources and exert national soft power. On joining the WTO, China made efforts to integrate itself into the international community though the development and improvement of legislation, policies, and regulations in higher education that have achieved positive outcomes. However, some current challenges and barriers, including capacity building, administration and management, quality assurance, and qualification recognition still block the further development and need to be removed. The promotion of cross-border higher education in the future not only requires more strategic planning and policy support from central and local governments and higher education institutions, but also depends on a series of institutional transitions and deep reforms to meet the challenges and grasp the opportunities brought by WTO/GATS.

Abstract:Abstract This research studies the impacts of technical barriers to trade ( TBT ) on trade performance of 103 countries over the period 1995–2008. The paper analyzes how TBT influences the trade probability, trade volume and trade duration. The trade volume is further decomposed into the number of products traded (extensive margin) and the trade value of each product (intensive margin). It is found that TBT imposes inconsistent impacts on the different components of trade, and that the effects differ by country. First, TBT reduces trade probability, but increases the volume and duration of existing trade relationships. Second, the positive effect of TBT on trade volume is mainly driven by an increase in the extensive margin, and the effect on the intensive margin is not statistically significant. Finally, TBT raised by developed countries have a stronger negative impact on trade probability, while TBT implemented by developing countries have a greater positive effect on trade volume.

Abstract:With the continuous development of China's economy, foreign trade in the national economy has been increasing. In foreign trade, export trade accounted for a large proportion, but due to technical level, export product structure, trade surplus and other reasons, in recent years China’s export products frequently encountered technical barriers to trade (TBT) in developed countries. In the development of contemporary international economic and trade, TBT are playing an increasingly important role, its influence and role has been far beyond the general trade measures. In the world, especially the developed countries, on their own technical advantages, apply more and more targeted, flexible, extensive, covert and mandatory TBT as an important means of protecting their industries. TBT has become the main means and advanced forms of national trade protectionism. China's accession to the WTO faced dual challenges in breakthroughs in foreign technical barriers and the protection of the domestic market. Due to the concentration of China's export market, the weakness of export products and the fact that China has not yet established its own TBT system, early warning mechanism and other reasons, TBT impact on China is significant. According to statistics, nearly five years, 71% of China's export enterprises, 39% of the export products are foreign TBT restricted, and thus cost and risk losses of Chinese enterprises are increasing year by year. In 2005 and 2006, about 25.1% and 31.4% of China's export enterprises were aﬀected by foreign TBT, with total losses of US $ 28.8 billion and US $ 35.92 billion respectively. Agricultural products, electrical and mechanical, energy, mining, textile and other products are the main target products that developed countries implement TBT towards China. Therefore, our government and enterprises must take corresponding measures to resolve these unfavorable factors to ensure China's position and interests in international trade.

An Empirical Study of the Impact of Technical Trade Barriers on China's Agricultural Exports since the Establishment of WTO Based on the Two-stage Gravity Model of Multilateral Resistance

Abstract:China's agricultural exports have suffered a great deal of technical trade barriers since the foundation of WTO in 1995.China's related export companies,farmers and agricultural prices have been adversely affected.Through the establishment of the two-stage gravity model based on the multilateral trade resistance,this paper makes a quantitative analysis of the trade effects of technical trade barriers from 1995 to 2011.The empirical results show that different technical trade barriers have different trade effects,although TBT and SPS significantly reduce trade breadth,but the effect of SPS is stronger than that of TBT.Moreover,TBT lowers trade depth,but SPS is able to effectively enhance trade depth.In addition,the paper divides China's trade partners into developed and developing countries,and makes a comparative analysis of U.S.,EU and Japan.

Abstract:This paper investigates the effects on firms' occupational structure of shocks induced by the introduction of Technical Barriers to Trade (TBTs) in importing countries. We rely on the Specific Trade Concern (STC) data released by the WTO to identify trade-restrictive TBT measures, combined with matched employer-employee data for the population of French exporters over the period 1995-2010, and with information on the list of product-destinations served by each French exporter. Controlling for time-invariant firm/occupation effects and for time-varying sector/occupation shocks, IV estimates show that exporters respond to increased complexity associated with restrictive TBTs at destination by raising the share of managers at the expense of blue collars, white collars and professionals. This evidence is consistent with the growing literature exploring how firms organize their workforce composition in presence of exogenous (foreign) shocks; and it is also related to the well-beaten literature on the labour market effects of trade.

Abstract:Trade has long been an axiomatic characteristic of globalization, although international rules governing trade are of more recent vintage. Notably in the post-World War II period, an ever increasing number of countries began negotiating treaties to reduce, first, tariff barriers and, later, non-tariff barriers (government measures of any sort) that could impede the cross-border flow of goods. The rationale, in part, was that countries that became more entwined economically would be less likely to go to war with each other. It wouldn't be in their own economic interests to do so, or at least that of the firms based within their borders but engaged in transnational trade and dependent upon global supply chains. At first primarily an undertaking of developed (high-income) countries, developing (low and middle-income countries) slowly enjoined in what, in 1995, became the World Trade Organization. The WTO locked in scheduled declines in tariffs (border taxes), albeit with lesser obligations on developing country members (a problematic nomenclature given the vast geographic, economic, and development differences between such countries, but which nonetheless persists within the WTO). Importantly, a slew of new agreements that coincided with the establishment of the WTO also sought to liberalize trade in services (not just goods) (The General Agreement on Trade in Services), create new rules for agricultural trade (Agreement on Agriculture), expand intellectual property rights protections (The Agreement on Trade-Related Aspects of Intellectual Property Rights), limit trade-distorting government subsidies (Agreement on Subsidies and Countervailing Measures), and ensure that government food, health, or environmental regulations would not pose an unnecessary barrier to trade (the Technical Barriers to Trade and the Sanitary and Phytosanitary Measures Agreements). Outside of the WTO system, bilateral or regional investment treaties granting special rights to foreign investors to sue governments for actions perceived to affect the value of their investment (such as direct expropriation or passage of new laws and regulations considered 'tantamount to expropriation') similarly exploded in number, dispute frequency, and the size of monetary claims. The breadth and depth of these post-1995 Agreements meant that few areas of general public health concern are potentially untouched.

Abstract:This paper investigates the impact of restrictive TBTs on firms’ extensive margins (export participation and exit probability), intensive margins (export value) and pricing strategy (export price). To this end, product-level restrictive TBTs and firm-level export are combined and an instrumental-variable approach is utilized. The results show that the imposition of restrictive TBTs adversely affect firms’ intensive and extensive margins, but not significantly affect firms’ price on average. More importantly, firms of different types, in the sense of firm sizes, number of destination markets and ownership types, are affected differently. Given the same restrictive TBTs, firms with higher productivity suffer less, while firms with lower productivity are more vulnerable to the trade barriers.

Abstract:The purpose of the dissertation at hand is to contrast the AdA (Agreement on the Implementation of Article VI of the GATT'94) with anti-dumping investigations carried out by and against the EU. It has been usual to suppose that WTO Members apply the AdA's flexible rules in a protectionist manner. However, hardly any treatise on contingent protection is concerned with this facet of global trade law. The question, also, of the volume of dumped imports, in the sense of negligibility, the impact of geopolitical factors, the extent of protectionism and malpractices in the review phase, has scarcely been examined. Is it true that anti-dumping instruments are being misused in view of the flexible rules of the Anti-dumping Agreement? For, admittedly, malpractices have been forthcoming ever since the WTO came into being. Sharp distinctions are made through a critical examination of inspection documents on the one hand and sixty-six charts which scrutinise every section of the investigative process on the other. The study identifies contingent protectionism in sectors of geopolitical importance, tit-for-tat in the imposition of anti-dumping measures and partiality in the various rates of duties. Furthermore, it identifies malpractices in the determination of negligiblity, normal value, export prices, injury and margins of dumping. The findings shed new light on the functioning of the US International Trade Administration, the DG Trade EU and the PRC Trade Remedy Investigation Bureau. Finally, a solution is sought through the formulation of a new general theory on the detection of sales outside the natural course of world trade and a definition of sales within the ordinary course of trade.

Abstract:As tariffs have declined to a low level, the trade literature has paid increasing attention to the impact of non-tariff measures. Unlike tariffs, non-tariff measures could act as both a barrier to trade and a catalyst for quality upgrading. This study examines the effect of technical barriers to trade (TBTs) on trade margins and quality upgrading at the firm level. To do so, we utilise rich Chinese Customs data recording the universe of export transactions from 2000 to 2012, matched with the Annual Survey of Industrial Firms and the World Trade Organization’s Specific Trade Concerns database. We find that TBTs imposition results in higher probability of exit. Surviving exporters enjoy larger sales and charge higher export prices. We also find robust evidence for the quality upgrading effects of TBTs. Firms upgrade their product quality by expanding their research and development and importing more intermediate inputs and capital goods. The positive impact of TBTs on quality upgrading offsets that on price increases, resulting in lower quality-adjusted export prices. This suggests the net welfare-enhancing effect of TBTs for the consumers of imported products. The results hold after controlling for potential endogeneity and across various specifications.

Abstract:Abstract The Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS Agreement) sets a floor but not a ceiling for intellectual property protection. Examining the EU’s geographical indications regime for wines, this article considers the question of when a World Trade Organization member’s measures taken to implement the TRIPS Agreement might contravene the member’s obligations under the Agreement on Technical Barriers to Trade (TBT Agreement). A technical regulation apparently permitted by the TRIPS Agreement may be inconsistent with the TBT Agreement where it does not in good faith pursue a legitimate objective or where it is incongruent with or poorly calibrated to its objective. In particular, the compatibility with the TBT Agreement of EU regulations that prohibit the labelling of wines with the relevant grape variety name where the variety name ‘contains or consists of’, ‘evokes’ or ‘forms an integral part of’ a GI is open to doubt.

Abstract:Digitisation has significantly impacted international trade. This book explains the impact of digitisation on trade in services, the ensuing concept of 'digital services' and the different types of trade barriers these services face. This book establishes that the legal framework that applies to trade in services also applies to digital services. It elaborates on the scope of the General Agreement on Trade in Services (GATS) and how to classify digital services. The relevant GATS obligations are subsequently applied to several case studies that illustrate the barriers to digital services trade. These case studies demonstrate the impact of the applicability of GATS to digital services on countries' international obligations. Finally, the book maps the electronic commerce-related provisions in in regional trade agreements (RTAs). Six extensive e-commerce RTAs are compared in depth and it is considered whether they add substantially to the existing multilateral obligations applicable to digital services trade.

Abstract:ABSTRACT This paper studies the trade-restriction and trade-promotion effects that technical barriers to trade (TBTs) have on export performances of Chinese firms over the period 2001–2006. Different from tariffs and most traditional non-tariff measures, TBTs can impose both positive and negative impacts on exports. On the one hand, TBTs increase the compliance costs and have the trade-restriction effect. On the other hand, TBTs improve product quality and mitigate uncertainty, which enhances demand and promotes trade. We investigate how TBTs influence the extensive and intensive margins of a firm’s exports and how the impact varies with the size, productivity, and ownership of a firm. Specifically, we look into a firm’s entry and exit decisions, export value, unit price, and quantity. The estimated results show that TBTs decrease both the extensive and intensive margins of small firms, and they improve the export performances of large firms. The finding indicates that while small firms that cannot meet the technical standards will leave their markets, large firms will stay in their markets and expand their export volumes. The trade effects of TBTs also change by characteristics of the importing country and sector.

Abstract:Objective. The objective of our study is to analyse the status and peculiarities of tariff regulation of international trade in the XXI century. Methods. The following methods and techniques of cognition were used in the research process: analysis and synthesis, induction and deduction (to substantiate the importance and role of tariff regulation of international and foreign trade in the XXI century, to identify factors influencing the development of international trade), generalisation and systematisation (to substantiate the state and peculiarities of the development of tariff regulation of international trade in the XXI century), analysis of time series (to identify trends and patterns of tariff regulation of international trade in 2006-2022), graphical (for visual representation of the peculiarities of tariff dynamics in WTO countries). Results. The article notes that despite the changes that have taken place in international trade in general and in the system of its regulation in particular, tariff regulation remains the main authorised means of regulating international and external trade. By 2022, international trade is expected to reach USD 30 trillion, with trade in goods, especially manufactured goods, dominating the structure. It is established that one of the aspects of liberalising trade is to reduce or eliminate tariffs. It is noted that the reduction of tariffs is much slower in the period 2006-2021 than in the period 1996-2005. Average applied tariffs in WTO countries for all product groups will decrease from 10.1% in 2006 to 8.9% in 2021; tariffs on agricultural products will be significantly higher than on non-agricultural products (14.8% vs. 8% in 2021); average tariffs applied to all product groups were significantly lower in developed countries than in developing countries and LDCs; average tariffs applied by developed countries decreased by 1.7%, by developing countries by 1.7% and by LDCs by 1.2%; the highest average tariffs were recorded in Africa and the Americas and the lowest in Europe; the share of duty-free goods under the most favoured nation regime in the WTO countries has been steadily increasing; there has been a slight but steady decline in the share of tariff peaks, which are tariffs exceeding 15 per cent; the number of trade agreements, including preferential trade agreements, has been growing steadily, with agreements covering not only trade in goods but also trade in services, etc. According to the analysis of WTO data, in 2022 most WTO countries have an average bound tariff not exceeding 50%; average bound tariffs vary significantly across WTO countries and product groups; average bound tariffs for most WTO countries range from 20-59% for agricultural products, 10-39% for non-agricultural products; average applied tariffs for agricultural products range from 10-19%, up to 10% for non-agricultural products; significant discrepancies between average bound tariffs and average applied tariffs remain; in the majority of WTO countries, ad valorem tariffs dominate the tariff structure; there are significant differences between countries in the number of bound tariffs applied; in the vast majority of WTO countries, MFN tariffs are applied to a large number of products - the number of products subject to MFN tariffs varies between 5000 and 10000.
