Its predecessor, the European Political Cooperation (EPC) was established in the 1970s following the so-called Davignon Report of 1970, which called for cooperation in the field of foreign policy. Abstract:The European Union has declared ambitious objectives for a common European foreign policy since the end of the cold war. Through successive revisions of its constitutional treaties, it has built may of the institutions that might support such a common policy. Incremental changes and adaptation through experience of successive crises have strengthened practices of cooperation and consultation. Yet the retention of sovereignty over foreign and defence policy by national governments, and the unwillingness of national governments and parliaments to engage in any EU-wide reconsideration of strategic needs and objectives has left these common institutions without the permissive consensus needed to support effective shared action. National inhibitions about subordinating particular interests and assumptions to a wider European consensus have left the EU institutions without the ability either to promote shared European interests or to act effectively when those interests are threatened.

Abstract:The article summarizes the main common policies of the European Union. It was found that the common policies of the European Union are based on three main principles: allocation of competences, proportionality and subsidiarity. Common policies in certain areas are based on the fact that only the European Union has the right to adopt laws. Areas where the EU has exclusive powers include: customs union; rules of competitiveness within the single market; monetary policy (for eurozone member states); trade and international agreements; common fisheries policy. In some areas, legislation is adopted by both the EU member states and the EU institutions. It was analysed that such spheres include: the single market; employment and social policy; economic, social and territorial cohesion; agriculture; fishing; environment; consumer rights protection; transport; trans-European networks; energy; justice and fundamental human rights; migration and home affairs; public health; research and space; development cooperation and humanitarian aid. Also, in certain areas, the EU institutions helps member states create legislation, in particular, it concerns the following areas: public health (certain aspects), industry, culture, tourism, education, youth and sports, civil protection and administrative cooperation. In addition, it was found that scientists distinguished the following policies: common agricultural policy, common fisheries policy, rules of competitiveness, common foreign and security policy as the most important. It was analysed that the EU regulations, the Treaty on the European Union and the Treaty on the Functioning of the European Union are the legal basis of EU common policies. In addition, it was determined that all policies of the European Union are formed on the basis of long-term strategies that contain key directions of development.

Abstract:All books in this flagship series contain carefully selected substantial extracts from key cases, legislation, and academic debate, providing students with a stand-alone resource. The Area of Freedom, Security, and Justice (AFSJ) is now found in Title V of Part Three of the Treaty on the Functioning of the European Union. The subject matter dealt with by these provisions is important and politically sensitive, as it includes police and judicial cooperation in criminal matters, visas, asylum, immigration, and judicial cooperation in civil matters. This chapter is organized as follows. Section 2 considers the development of the three-pillar structure introduced by the Maastricht Treaty. Section 3 focuses on the rationale for the inclusion of the subject matter that comprises the AFSJ. Section 4 considers the general principles in the Lisbon Treaty that apply to all areas which comprise the AFSJ, including: Treaty objectives, competence, role of the principal EU institutions, judicial role, and an outline of the opt-outs that apply to the UK. The remainder of the chapter looks in more detail at criminal law and procedure. The UK version contains a further section analysing issues concerning the AFSJ and the UK post-Brexit.

Abstract:The article aims to provide a brief analysis of the EU approach on Space Traffic Management (STM), with a focus on the European Commission and the High Representative for Foreign Affairs and Security Policy (EC-HR) Joint Communication of 15 February 2022. After some references to the relevant international and EU legal framework, the Joint Communication will be examined, taking into account the definition of STM as well as the main policy actions and regulatory measures (a blend of binding and non-binding ones). This approach will be compared with other possible levels of intervention, such as international governance (a possible International Civil Aviation Organization - ICAO model), national law (as envisaged by the US in Space Policy Directive No. 3 of 2018) or self-regulation. The EU regulatory approach to STM seems to replicate the modus operandi adopted in other policy areas (such as climate change and digitalization). Issues concerning the legal basis of future EU secondary legislation on STM, however, cannot be overlooked. The emphasis on EU strategic autonomy and security issues linked to STM shows an increasing awareness in EU institutions of the Union’s geopolitical role. Abstract:The article analyzes the stages of formation of the common foreign and security policy of the Eu-ropean Union. The main events and decisions of world leaders that influenced the formation of the general idea of the world community about the common foreign and security policy are considered. The paper focuses on the constant desire of the European community to agree on the creation of a single effective mechanism for a common foreign and security policy of the EU. Although, in the initial stages of integration, the countries of the «European six» failed to initiate integration in the defense and political spheres. Integration continued to develop in other areas, and European countries and their leaders took new steps to converge in the regulation of the common security policy. The positive and negative consequences of each step of the evolution and formation of the common foreign and security policy of the European Union, as well as the reaction of EU member states and other leading countries to them are highlighted. The current global events that have a significant impact on the mechanism of implementation of EU security policy are analyzed. The opinions of scientists and practitioners, European and world leaders on the implementation of common foreign and security policy are studied. It has been proved that Ukraine, as the leader of the Eastern Partnership, needs to improve its status, use security issues to work out joint decisions on a closer military partnership between it and the EU countries.

Abstract:The article analyzes the provisions of founding treaties of the European Union, in particular, the Treaty on the European Union, the Treaty on the Functioning of the European Union, the Charter of Fundamental Rights of the European Union, the European Social Charter regarding their consolidation of the principle of gender equality, which has been formed since the adoption of the UN Charter as a fundamental international universal act, contributed to the further development and adoption of norms at the international universal and regional levels based on gender principle. Attention is focused on the features of EU acts and it is stated that they have expanded the principle of equality between women and men, including working conditions, social security, access to goods and services, balance between work and private life, maternity protection, parental leave and equal treatment in the workplace and as self-employed persons.Attention is paid to EU strategic acts in this sphere, including: Strategic commitments to ensure gender equality, Gender equality strategies, Gender Action Plan – putting women and girls’ rights at the heart of the global recovery for a gender-equal world. The directions and obligations contained in the specified acts are disclosed; the EU measures adopted for their implementation (development of relevant recommendations, adoption of directives, preparation of annual reports) are outlined and attention is focused on perspective directions of the Union’s activities in this area.Attention is focused on the activities of specialized agencies, bodies and other structures whose competence include issues of protection of human rights and gender equality as their integral component, among which are indicated: the Advisory Committee on Equal Opportunities for Women and Men, European Ombudsman, European Institute for Gender Equality, EU Agency for Fundamental Rights, European Women’s Lobby, European Network of Legal Experts on Gender Equality and Non-Discrimination. Their powers, legal basis of activity, competence and contribution to ensuring human rights in general and, in particular, the principle of gender equality within the EU, are characterized.

Abstract:The duty of loyalty, or loyal cooperation, (Art. 4(3) TEE, ex Art. 10 EC) governs the interactions between the Union and national legal orders and is linked to fundamental principles, such as effectiveness, primacy and respect of the Member States’ autonomy. In the field of EU external relations, the duty of loyalty may express different facets of the Union interest. As an expression of the obligation to effectively implement common rules, the duty of loyalty permits to understand how a mixed agreement in its entirety has to be considered as a source of European Union law. Besides, the duty of loyalty implies the need to ensure the effectiveness of EU law obligations in the exercise of the Member States’ retained competence. It results from the recent case law of the Court of Justice that Member States have the obligation to eliminate not only established, but also hypothetical incompatibilities between common rules and their prior international commitments (Art. 351(2) TFEU, ex Art. 307(2)EC). Furthermore, the duty of loyalty implies an obligation for the Member States to facilitate the exercise of the Union competence. It is the basis of their obligation to refrain from adopting a unilateral position and, in some cases, to act in the interest of the Union. Finally, the duty of loyalty, through the duty of close cooperation, contributes to the fulfillment of the requirement of unity of the external representation of the European Union and its Member States.

Abstract:The relevance of the topic has been summed up by the migratory crisis, the emergence of recent conflicts and the occasional instability near the cordons of the EU, as a result, he is forced to strengthen supranational governance in various fields. One of such areas is foreign policy, which in the context of changing the nature of security interactions plays an important role in the process of European integration. The object of the study is the EU as an international actor in the process of its formation and development. The subject is the foreign policy dimension of the EU's functioning, its conceptual, institutional and instrumental aspects.The aim of the article was to consider a number of approaches with different emphases in the interpretation of the European Union's foreign policy, definitions of "sovereignty" and "supranationality", the difference between normative and implementing supranationalism, the historical attitude of member states to the full preservation or delegation of sovereignty. in the formation of EU policy, the creation of new authorities and positions in the process of EU formation in the context and the factors influencing member states on the formation of common EU policy and determine the attitude of member states to the supranational level of governance, advantages and disadvantages for them.Conclusions. Member states are ambivalent about deeper integration in foreign policy. On the one hand, foreign policy cooperation can serve as a tool that allows Member States to pursue their national interests more effectively. However, in the absence of leadership in the EU, the supranational level can become an instrument of regulatory justification for projecting the priorities of individual member states on other members of the union. At the same time, the possibilities of its use remain limited due to serious differences in the strategic culture of the EU member states.

Abstract:Despite the importance of the Maastricht Treaty on European Union, little attention has been paid to the manner in which the negotiations were conducted or to an analysis of particular topics. This article addresses one particular aspect by focusing on Britain's participation in the Common Foreign and Security Policy negotiations. It emphasises that, notwithstanding London being portrayed as an ‘awkward’ member of the European Union, it was neither awkward nor isolated in the course of the CFSP negotiations. Moreover, Britain eventually accepted a formula which went further than its pre‐negotiating position. An important influence on this outcome was the Foreign and Commonwealth Office's stranglehold on the dossier. Conservative MPs were also generally more concerned about symbolic issues, including Economic and Monetary Union, the Social Chapter and the proposed federal goal. Greater freedom was therefore possible for negotiators within the area of CFSP, where Britain formed an effective alliance with other member states, most notably Italy.
