Abstract:The ubiquitous and global ecological footprint arising from the rapidly increasing rates of plastic production, use, and release into the environment is an important modern environmental issue. Of increasing concern are the risks associated with at least 16,000 chemicals present in plastics, some of which are known to be toxic, and which may leach out both during use and once exposed to environmental conditions, leading to environmental and human exposure. In response, the United Nations member states agreed to establish an international legally binding instrument on plastic pollution, the global plastics treaty. The resolution acknowledges that the treaty should prevent plastic pollution and its related impacts, that effective prevention requires consideration of the transboundary nature of plastic production, use and pollution, and that the full life cycle of plastics must be addressed. As a group of scientific experts and members of the Scientists' Coalition for an Effective Plastics Treaty, we concur that there are six essential "pillars" necessary to truly reduce plastic pollution and allow for chemical detoxification across the full life cycle of plastics. These include a plastic chemical reduction and simplification, safe and sustainable design of plastic chemicals, incentives for change, holistic approaches for alternatives, just transition and equitable interventions, and centering human rights. There is a critical need for scientifically informed and globally harmonized information, transparency, and traceability criteria to protect the environment and public health. The right to a clean, healthy, and sustainable environment must be upheld, and thus it is crucial that scientists, industry, and policy makers work in concert to create a future free from hazardous plastic contamination.

Abstract:International policy discussions on plastic pollution are entering a new phase, with more than 100 governments calling for the launch of negotiations for a new global plastics agreement in 2022. This article aims to contribute to efforts to identify effective international policy levers to address plastic pollution. It takes stock of the evolution of views and perceptions on this complex and multi-faceted topic—from concerns about marine pollution and waste management towards new strategic directions that involve the entire plastics life-cycle and include climate and health impacts associated with the proliferation of plastics. It also traces the progressive development of responses—from voluntary approaches involving multiple stakeholders to national and international approaches focused on regulation. The paper is informed by desk research, a literature review and participation by the authors in informal and formal global governance processes on plastic pollution, the environment and development in the United Nations and World Trade Organization between 2019 and 2021. It also draws on empirical findings from a novel and original database on the life-cycle of plastic trade created by the authors. The paper argues that the important focus on downstream dimensions of plastic pollution—and strategies to address them—needs to be complemented by a broad life-cycle and “upstream” perspective that addresses plastic pollution at its source. It highlights the political economy tensions and inconsistencies at hand, observing that while some countries are taking concerted efforts to reduce pollution (including through bans on certain kinds of plastic and plastic products); to promote more circular plastic economies; and to reduce the carbon footprint of plastics (as part of a wider effort to decarbonize their economies), trade and investment in the plastic industry continues to rise. The paper argues that to reduce plastic pollution, emerging global governance efforts must integrate international environmental law and cooperation with a complementary and enabling global framework that addresses the economic, financial, industrial and trade policies needed to drive the necessary transformation of the plastics sector.

Abstract:Plastic pollution has emerged as a global challenge necessitating collective efforts to mitigate its adverse environmental consequences. International negotiations are currently underway to establish a global plastic treaty. Emphasizing the need for solution-orientated research, rather than focusing on further defining the problems of widespread environmental occurrence and ecological impacts, this paper extracts insights and draws key patterns that are relevant for these international negotiations. The analysis reveals that (i) environmental rather than human health concerns have been the predominant driving force behind previous regulations targeting pollutants, and (ii) the decision to ban or discontinue the use of harmful pollutants is primarily affected by the availability of viable substitutes. These two key findings are relevant to the discussions of the ongoing Intergovernmental Negotiating Committee (INC) on the global plastic treaty and underscore the recognition of environmental consequences associated with plastic pollution while emphasizing the need to enhance the knowledge base of potential human health risks. Leveraging the availability of substitutes can significantly contribute to the development and implementation of effective strategies aimed at reducing plastic usage and corresponding pollution.

Abstract:Every year, the global production of plastic waste reaches a staggering 400 million metric tons (Mt), precipitating adverse consequences for the environment, food safety, and biodiversity as it degrades into microplastics (MPs). The multifaceted nature of MP pollution, coupled with its intricate physiological impacts, underscores the pressing need for comprehensive policies and legislative frameworks. Such measures, alongside advancements in technology, hold promise in averting ecological catastrophe in the oceans. Mandated legislation represents a pivotal step towards restoring oceanic health and securing the well-being of the planet. This work offers an overview of the policy hurdles, legislative initiatives, and prospective strategies for addressing global pollution due to MP. Additionally, this work explores innovative approaches that yield fresh insights into combating plastic pollution across various sectors. Emphasizing the importance of a global plastics treaty, the article underscores its potential to galvanize collaborative efforts in mitigating MP pollution's deleterious effects on marine ecosystems. Successful implementation of such a treaty could revolutionize the plastics economy, steering it towards a circular, less polluting model operating within planetary boundaries. Failure to act decisively risks exacerbating the scourge of MP pollution and its attendant repercussions on both humanity and the environment. Central to this endeavor are the formulation, content, and execution of the treaty itself, which demand careful consideration. While recognizing that a global plastics treaty is not a panacea, it serves as a mechanism for enhancing plastics governance and elevating global ambitions towards achieving zero plastic pollution by 2040. Adopting a life cycle approach to plastic management allows for a nuanced understanding of possible trade-offs between environmental impact and economic growth, guiding the selection of optimal solutions with socio-economic implications in mind. Abstract:The discharge and dumping of plastic debris into the world's oceans has become an increasingly serious form of marine pollution in recent years. To counter such practices, a number of international agreements containing specific prohibitions against dumping plastics into the marine environment have been promulgated. The 1972 London Dumping Convention, Annex V to the MARPOL Convention, and the 1978 MARPOL Protocol cite plastic pollution as unlawful in international waters. Though not yet in force, particular provisions mandating protection and preservation of the marine environment in the 1982 Law of the Sea Convention abo add considerable legal sway. Six special agreements of the UN Regional Seas Programme and three other relevant regional instruments contribute to banning pollution by dumping plastic substances in designated ocean areas. Given the large number of states that have legally committed themselves to being bound by one or more of these international agreements, a firm normative foundation appears to have evolved that prohibits marine plastic pollution. The full normative quality of this rule, however, will depend on the degree to which it is adhered to in state practice.

Abstract:Negotiations for a global treaty on plastic pollution1 will shape future policies on plastics production, use and waste management. Its parties will benefit from a high-resolution baseline of waste flows and plastic emission sources to enable identification of pollution hotspots and their causes2. Nationally aggregated waste management data can be distributed to smaller scales to identify generalized points of plastic accumulation and source phenomena3-11. However, it is challenging to use this type of spatial allocation to assess the conditions under which emissions take place12,13. Here we develop a global macroplastic pollution emissions inventory by combining conceptual modelling of emission mechanisms with measurable activity data. We define emissions as materials that have moved from the managed or mismanaged system (controlled or contained state) to the unmanaged system (uncontrolled or uncontained state-the environment). Using machine learning and probabilistic material flow analysis, we identify emission hotspots across 50,702 municipalities worldwide from five land-based plastic waste emission sources. We estimate global plastic waste emissions at 52.1 [48.3-56.3] million metric tonnes (Mt) per year, with approximately 57% wt. and 43% wt. open burned and unburned debris, respectively. Littering is the largest emission source in the Global North, whereas uncollected waste is the dominant emissions source across the Global South. We suggest that our findings can help inform treaty negotiations and develop national and sub-national waste management action plans and source inventories.

Abstract:The harm caused by marine plastic pollution to the wider environment highlights its importance as a governance issue. The Fifth United Nations Environment Assembly (UNEA) adopted a resolution, "End Plastic Pollution: Towards an International Legally Binding Instrument", which represents a shift towards globalism in the governance of marine plastic pollution. This resolution focuses on the circular economy of plastics and highlights the role of corporations in contributing to a more socially responsible society, thereby increasing emphasis has been placed on the Extended Producer Responsibility (EPR) system that integrates the two factors referred to above. This paper provides a full technical explanation of the EPR system and its implementation in entities such as the European Union, the United States, and China. The challenges faced when integrating the EPR system into international legal instruments for plastic governance were identified, including the different national perspectives, the absence of a supervisor in the public domain, the obscurity of its application, and the lack of supporting measures for the implementation of the system. Therefore, new standards and requirements in the governance of marine plastic pollution and the advantages associated with implementing the full-life-cycle obligations under the EPR system on plastic producers should be fully considered. On this basis, the positioning and implications of the EPR system should be clarified by obligation-oriented regulation and extension-based interpretation. Moreover, the extended and prolonged applicability of the system, including the original sources of marine plastic wastes and considerations of the full-life-cycle of plastics, should be achieved in pursuit of improvements and upgrades in application and complementary policies. If this can be achieved, it is hoped that the goals of protecting human health and controlling plastic pollution can be achieved, contributing to the development of an ocean-based economy and a better world.

Abstract:Plastic wastes have recently emerged as one of the alarming threats to the marine environment. The issue of contamination of marine plastic is not new; it has been recognized for over half a century. The problem can no longer be ignored, thanks to growing media attention and incidents such as the finding of the Great Pacific Garbage Patch. This issue is addressed by a number of legal approaches. Plastic litter reduction standards were adopted by the International Maritime Organization (IMO) 30 years ago. Annexes to the convention of MARPOL are designed to aid in the fight against plastic pollution. Other mechanisms of maritime law can be used to combat this issue as well. The fundamental cause of the issue, and thus the solution is located on land. The directives of the European Union can serve as useful models for decreasing marine pollution. In May 2018, the new European Union restrictions are proposed to target the ten most commonly detected single-use plastic products in coastal areas of Europe, as well as lost and abandoned fishing gear. These multinational conventions serve as a source of inspiration for the governments of other countries of the world. The acceptance and application of these legal approaches and conventions could change the game in the fight against marine pollution.

Abstract:The United Nations Environment Assembly (UNEA) recently adopted a resolution with a mandate to negotiate a new international legally binding instrument (a treaty) on plastic pollution. The mandate includes the need to ‘prevent’ as well as ‘reduce’ and ‘eliminate’ plastic pollution through a ‘comprehensive approach that addresses the full life cycle of plastic’. Unsustainable production and consumption of virgin (primary) plastic polymers represents the single greatest threat to preventing plastic pollution and risks undermining the incoming treaty. However, current discussions on a global plastics treaty overlook upstream measures that address virgin plastic production and consumption, focusing instead on midstream and downstream measures on product design and waste management. Abstract:Plastic pollution accumulating in an area of the environment is considered “poorly reversible” if natural mineralization processes occurring there are slow and engineered remediation solutions are improbable. Should negative outcomes in these areas arise as a consequence of plastic pollution, they will be practically irreversible. Potential impacts from poorly reversible plastic pollution include changes to carbon and nutrient cycles; habitat changes within soils, sediments, and aquatic ecosystems; co-occurring biological impacts on endangered or keystone species; ecotoxicity; and related societal impacts. The rational response to the global threat posed by accumulating and poorly reversible plastic pollution is to rapidly reduce plastic emissions through reductions in consumption of virgin plastic materials, along with internationally coordinated strategies for waste management.

Abstract:Society has become increasingly reliant on plastics since commercial production began in about 1950. Their versatility, stability, light weight and low production costs have fueled global demand. Most plastics are initially used and discarded on land. Nonetheless, the amount of microplastics in some oceanic compartments is predicted to double by 2030. To solve this global problem, we must understand plastic composition, physical forms, uses, transport and fragmentation into microplastics (and nanoplastics). Plastic debris/microplastics arise from land disposal, wastewater treatment, tire wear, paint failure, textile washing and at‐sea losses. Riverine and atmospheric transport, stormwater and disasters facilitate releases. In surface waters plastics/microplastics weather, biofoul, aggregate, sink, are ingested by organisms and redistributed by currents. Ocean sediments are likely the ultimate destination. Plastics release additives, concentrate environmental contaminants and serve as substrates for biofilms, including exotic and pathogenic species. Microplastic abundance increases as fragment size decreases, as does the proportion of organisms capable of ingesting them. Particles 90%) and the abundance of polymeric products therein. Scientific challenges include improving microplastic sampling and characterization approaches, understanding long term behavior, additive bioavailability, and organismal and ecosystem health risks. Abstract:To date, much effort has been placed on quantifying plastic pollution and understanding its negative environmental effects, arguably to the detriment of research and evaluation of potential interventions. This has led to piecemeal progress in interventions to reduce plastic pollution, which do not correspond to the pace of emissions. For substances that are used on a global scale and identified as hazardous, there is a need to act before irreversible damage is done. For example, the history of dichlorodiphenyltrichloethane's (DDT) use has demonstrated that legacy chemicals with properties of persistence can still be found in the environment despite being first prohibited 50 years ago. Despite the growing evidence of harm, evidence to inform actions to abate plastic pollution lag behind. In part, this is because of the multifaceted nature of plastic pollution and understanding the connections between social, economic and environmental dimensions are complex. As such we highlight the utility of integrative systems approaches for addressing such complex issues, which unites a diversity of stakeholders (including policy, industry, academia and society), and provides a framework to identify to develop specific, measurable and time-bound international policies on plastic pollution and meet the ambitious yet necessary goals of the UN Plastic Treaty.

Abstract:The Intergovernmental Negotiating Committee on Plastic Pollution seeks to address, among other issues, the science-policy interface of plastic pollution in the forthcoming international legally binding instrument on plastic pollution, including in the marine environment (ILBI) to be finalised in 2024 by the United Nations Environment Assembly (UNEA). Given the importance of protecting the marine environment from plastic pollution, this paper reviews ILBI and argues that the UNEA should by Resolution establish an independent scientific committee. The committee should have an overarching global, regional, and local presence with institutional openness and accessibility to elucidate the science behind plastic pollution. This paper proposes that an independent scientific approach is preferrable to a combined science-policy institution seen in Secretariats and Conference of Parties in some conventions. The latter often exhibit numerous weaknesses. Establishing an independent scientific committee will ensure the science behind plastic pollution is robust, credible, and effectively informs policy decisions.
