Abstract:The sexual equality is embodiment of constitutional right to equality.But present acts in our country usually endow female with some special rights,namely preferential treatment,the typical case is act of guaranteeing female rights,which contains a kind of opportunity of constitutional judgment from academic perspective.In case of late revised act of guaranteeing female rights,we learn fact by view of a new constitutional thinking method,that measures of preferential treatment towards female embodies essential right to equality,and is provided with basis of constitutional justice by test of the things essence.In meantime,the preferential differences conform with proportionality principle,therefore it is sexual equality that matches constitution spirit.
