Abstract:The market order in modern market economy must be established on the foundation of effectivecontract systemand property rights system. Transforming to market economy is ,in the micro aspect ,torealize a transformation fromrelationship trading to contract trading.Contract tradingis inseparable fromownership,i .e .,property rights .The protective systemof property rights means the protective systemofcontract rights . The protection of property rights has two strata . The first stratumis the automatic pro-tection of market , whichis concretely embodied by the rights of equal value exchange and equal competi-tion. The second stratumis the governmental protection when market protectionisineffective .Infact ,thefloating of property rights is ani mportant approachto protecting property rights . The foundation of prop-erty rights floatingis that the property rights organizationin enterprises must allowthe floating of it .Theinitial definition of property rightsislessi mportant . What isi mportant is that the re-adjust ment of proper-ty rights is engagedintrading. At present ,the chaos of the order of trading between enterprisesis oftencausedby the agents’acts . Therefore,the relationship of trust-agencyis not only anissue of the responsibility of the a-gent to the trustee,but also there need some policies to regulate the agents’market behavior .
