Abstract:Currently,with the development of China's society and economy,traditional marriage value outlook changes obviously,on the one hand,devoice rate is continuously high,on the other hand,husband and wife loyalty agreements increase.In the face of this agreement,some courts pronounce that it is effective but some courts pronounce it is ineffective,the results are paradox and the related people are confused,in addition,in the Explanation III of Marriage Law of People's Republic of China made by Supreme Court,the change of the attitude to husband and wife loyalty agreement triggers extensive dispute.In perspective of value,husband and wife loyalty agreement not only enhances the implementation of marriage loyalty obligation,maintains the safety of marriage,consolidates the marriage,has no intervention with the marriage but can satisfy the demand of humanity,as a result,the agreement has justification,from the perspective of legal effect,China's Marriage Law does not prohibit the implementation of will autonomy on disloyal affairs except bigamy and cohabitation and can not deduce that the loyalty of husband and wife should be legally defined,therefore,on the basis of justification,husband and wife loyalty agreement can engage the legal consequence about the disloyal affairs and their real behaviors,whose attribution belongs to general agreement since the agreement-made and in which the engaged compensation for the interest of non-fault party in marriage and compensation sum are necessary restricting method and are not originally objective,thus,laws should regulate it.

Abstract:As an ancient system of marriage ,engagement is provided in relevant laws and regulations in most coun-tries.And in China,it is included in moral adjustment ,not in written laws.Engagement does not disappear in real life despite the lack of legal provisions .In fact ,this phenomenon is still widespread based on the traditional culture influence .Property disputes resulted from dissolution of engagement continue to increase ,so there are many engage-ment disputes without relevant laws ’ adjustment.Legislators should concern and respond to social reality ,and im-prove engagement legislation so as to unify judicature and safeguard the dignity of law .

Abstract:The marital loyalty agreement refers to the commitment that husband and wife should be loyal to each other and should not have an affair with the opposite sex in marriage.From the content of the agreement and the ways of bearing the liability for breach of the commitment the marital loyalty agreement belongs to a general civil legal relationship.The marital loyalty agreement is consistent with the principle of autonomy of the will because the concerned parties dispose of the right of personal freedom that belongs to the category of civil suit,which promotes social harmony instead of infringing social public interests.Therefore,the validity of the marital loyalty agreement should definitely be approved.

Abstract:The validity of loyalty agreement is controversial and courts in different regions have different viewpoints on this issue . Some courts make judgments to support the agreement but others dismiss the cases or overrule the claims .Whether it is valid or not, supportive or not , if the validity of loyalty agreement is limited to legal obligation in our discussion , a loyalty agreement will have no legal basis and thus can't be acted through judicial channels .The way to overcome this dilemma is to see loyalty from the perspective of natural obligation which will also meet the needs for legal reason .A loyalty agreement can neither produce contrac-tual obligation according to contract law nor produce legal obligation such as nominate identity protocol according to marriage law . A loyalty agreement can only lead to natural obligation .In consideration of judicial humility on family affairs ,the courts should re-strain themselves and it's better to exclude the disputes of loyalty agreement from jurisdiction .

Abstract:Background. The wife’s obligations under marriage law are contrary to Islamic law.. This difference raises questions about the suitability of the law with social values. Social history records significant developments in the role of the wife in the dynamics of household affairs. Aims. To analyze the basis of Article 34 paragraph 2 of the Marriage Law concerning the wife's obligation to manage household affairs and theoretical views on the purpose of the law on the article. Methods. Normative legal research uses a conceptual approach to explore the understanding of the basis of law. Data were obtained through literature studies and analyzed descriptively based on the theory of the purpose of law. Results. Article 34 paragraph 2 iin terms of justice, reflects distributive and commutative justice. The fair division of roles between husband and wife is reflected and affirms equality in lineage and family identity. Justice will be achieved by avoiding exploitation or inequality in the exchange of roles. The wife's obligations in terms of benefits are considered an effort to achieve the greatest possible benefits for individuals and families. Consistent and clear application of the law is very important in terms of certainty. The history of marriage law shows the complexity in the interpretation and application of the law. Efforts to create legal certainty have been made through the unification and simplification of laws, as well as the affirmation of norms that regulate the wife's obligations firmly and unambiguously.

Abstract:China's Marriage Law of 1981 is presented with a brief commentary. The law encompasses the responsibilities of spouses, parents, children, grandparents, and siblings to one another. The new law is contrasted with the 1950 Marriage Law, which prohibited such feudal practices of former times as arranged marriages and child betrothals. The 1981 law is concerned with equality and the lawful needs of women, children, and the aged. Family planning is encouraged. Divorce is made easier to obtain. Abstract:Abstract The need to fulfil treaty obligations in good faith bases both the principle of pacta sunt servanda under Article 26 of the Vienna Convention on the Law of Treaties and the principle of loyalty under Article 4(3) of the Treaty on European Union. This article seeks to understand the precise relationship between the two principles. It argues that the principles are different embodiments of the same root concept. In particular, it argues that loyalty is a more sophisticated and specific version of the concept, since it establishes that the relevant states and institutions must take account of each other's efforts to fulfill their obligations faithfully. While the Court of Justice of the European Union has observed the consequent need for greater flexibility when determining Member State liability, it has not done so consistently, especially in the context of EU external relations. Lastly, this article proposes that the presented conceptualization of loyalty and pacta sunt servanda could help us understand how other international subsystems might develop the basic concepts in general international law.
