Abstract:How has the path of socialist rule of law with Chinese characteristics taken its form? How to define the essential features and basic hallmarks of the socialist rule of law with Chinese characteristics? These are pivotal issues that China's legal research and its law building have to scientifically respond to. This article holds that neo-democratist legality served as the prelude to the path of socialist rule of law with Chinese characteristics,and the initial experiences and profound lessons of the 30 years’ building of socialist legality since the foundation of the PRC to the Third Plenary Session of the Eleventh Central Committee of the Party laid the primary political precondition as well as the fundamental legal groundwork for its formation. In the process of its coming into being and developing,there has always been the company of the struggles against feudalism,ultra-leftism and westernization,which is a unique phenomenon in the world's history of building the rule of law. This article formulates the essential features and basic hallmarks of the socialist rule of law with Chinese characteristics as the following salient points:stick to the organic integration of the Party's leadership,people's democracy and law-based governance;stick to the organic integration of governing the country according to law and exercising the state power in accordance with law;stick to the organic integration of rule of law and rule by virtue;stick to the organic integration of building rule-of-law state and building law-based society;stick to the organic integration of basing on the national conditions and facing the world,and therefore stick to the organic integration of inheriting the quintessence of the traditional Chinese legal culture and borrowing the fruits of the civilization of rule of law achieved by human societies.
