A Preliminary Exploration on Some Issues Relating to China's Anti-Monopoly Legislation

Abstract:The major purpose of anti_monopoly law is to maintain an environment for free and fair competition. The target of anti_monopoly law should be to contain monopolizing behavior and various restrictive practices. To make anti_monopoly law more effective, its executive organs should be independent from other administrative agents and empowered with some functions in policy_making so as to control administrative monopoly. So far as the detailed legislative provisions are concerned, the law should be maintained with enough flexibility. It may be better for our anti_monopoly legislation to define the regulating target in nature while leaving certain room for judges to make their own discretion than to provide them a definite listing.
