Abstract:The digital economy has developed with the continuous development of technology and the increasing popularity of the Internet. As a product of the market economy, trademark law is also facing significant challenges in the new economic era. In the Internet age, the emergence of digital marketing has led companies to invest in keyword search advertising. This paper analyzes the potential trademark infringement risk of keyword search advertising and the negative impact on trademarks and corresponding enterprises through theoretical analysis and synthesis of research results, including the destruction of enterprise marketing effects, misleading consumers, and damaging brand reputation. At the same time, this paper proposes two possible mitigation measures based on the analyzed content of official statements and strengthens the image correspondence between keyword pages and brands. Firstly, the official statement is used as a benchmark to deal with fake, informal, and unauthorized channel advertisements, and secondly, the keyword result page is professionalized by paying for it.

Abstract:With the flourishing of Web 2.0, Internet has become the largest information depositary, which contains huge personal information of Web users. The information related to a specific person is usually scattered on various pages in different websites. However, today’s Internet has been highly crawled and indexed by search engines. The malicious attacker may collect a specific person’s information via search engines and obtain some privacy-sensitive information. Therefore, we observe a new type of privacy problem on the Internet: Privacy Mining via Search Engines. Our experiment shows this problem is serious yet easily ignored; it is a potential threat to Web users. We present a privacy mining model for describing the process of privacy leakage via search engines. To prevent this kind of privacy attack, we propose a method called Anti-Index and extend robots.txt to ERobots.txt with the fine-grained access control policies from the perspective of website constructors. In addition, we suggest a new service: automatically detecting potential dangers of privacy leakage for Web users. We also discuss several challenging problems about the privacy mining via search engines.

Abstract:"Human-powered Search" to some extent plays an important role in public supervision,but it inevitably brings a lot of negative effects.The core of Faye Wong case,a typical case of privacy violation by human-powered search,is about how to cognize the privacy infringement and the contents and limits of its corresponding obligation.Right protection needs cost,so when the attainable cost of right is lower than its profit,the obligee would have enough drive to protect his right.The Tort Law through decreasing the right protection cost encourages the infringed to protect their right and through increasing infringement cost stops potential infringement impulse.Based on the consideration of cost and profit and the balance of the interests of all parties,legal remedy for cyber infringements reflects an interesting theme that "it is easy to guard against gentlemen but difficult against villains"

Abstract:Web search engine has become a very important tool for finding information efficiently from the massive Web data. With the explosive growth of the Web data, traditional centralized search engines become harder to catch up with the growing step of people's information needs. Abstract:There is no doubt that Search Engines are playing a great role in Internet usage. But all the top search engines Google, Yahoo and Bing are having a critical flaw called "Openness of a Search Engine". An Internet user should be allowed to get the search results only when requested through Search engine's web page but the user must not be allowed to get the search results when requested through any web page that does not belong to the Search Engine. Only results of a search engine should be available to the Internet user but not the Search Engine. This paper explains the critical flaw called "Openness of Search Engine" with a case study on top 3 search engines 'Google', 'Yahoo' and 'Bing'. This paper conducts an attack based test using J2EE framework and proves that 'Google' passed the test and it strongly protects its Critical Search System, where 'Yahoo' and 'Bing' are failed to protect their Search Engines. But previously 'Google' also had other high severity issues with the Openness of search engine; this paper reveals those issues also. Finally this paper appeals strongly to the all top Search Engines to fix their critical flaws of "Openness of Search Engine".

Abstract:A new commercial promotion model named paid-ranking service takes a lot of challenges to China's current legal system.The widely debated issue is whether the search engine providers are liable when they provide technical support for the direct infringement on one's intellectual property.The legal nature of the paidranking services is a pre-issue of the disputes in judicial practice.In the case of no provisions in current legal system,the judge's practical wisdom gradually formed a unified rule of adjudication which requires the search engine providers examine the web keywords in paid-ranking services.The rule of adjudication implies important economic rationality.On one hand,it can take full advantage of information superiority of the " private monitor" to prevent infringement of intellectual property.On the other hand,it can also regulate the market of paid-ranking services by doing half the work and getting double result.

Abstract:There are enormous risks of trademark infringement in the daily op-eration of social media platform because of the uncertainty of users ’identities and the diversity of the content on the platform .Trademark infringements on the plat-form often manifest as squatting other ’s trademark on a username and releasing in-formation on the infringement products and services .The infringement analysis concerning the squatting on a username could draw lessons from the solutions on <br> the dispute between domain name and trademark which focus on existence of the confusion and the bad faith of the squatter .The social media platforms do not in-volve directly in these deals and can only be held contributorially liable for trade -mark infringement when they know or should know the existence of the trademark infringement .In addition to legal reliefs , the perfection of the verification mecha-nism can also protect the trademark rights of the enterprises and the legitimate rights and interests of Internet users .

With the increasing prevalence of counterfeit products and unauthorized sellers, it is crucial to address the issue and explore effective strategies to safeguard intellectual property in the online marketplace. This article aims to provide an updated outlook on the violation of trademark rights on e-commerce platforms. It delves into the complexities surrounding the identification, prevention, and enforcement of trademark infringement in the rapidly evolving digital ecosystem. By examining recent cases and developments in legal frameworks, this article seeks to shed light on the strategies employed by both brand owners and platforms to combat these infringements. This study examined and discussed the main types of trademark infringements in the online environment, such as selling counterfeit goods or gray imports, cybersquatting, domain infringements, illegal use of the trademark on the Internet, violations of the trademark rights on the website and etc. The article discusses whether the search engine will be held liable for placing contextual advertising using a keyword in the form of someone else's trademark. The article also analyzes issues of trademark infringement in the online environment in China by analyzing a couple of notable case studies, while exploring the issue of website blocking. As a result of the study, the authors proposed certain measures to combat the distribution of counterfeit products in the online environment to prevent further trademark infringement.
