Abstract:"Human-powered Search" to some extent plays an important role in public supervision,but it inevitably brings a lot of negative effects.The core of Faye Wong case,a typical case of privacy violation by human-powered search,is about how to cognize the privacy infringement and the contents and limits of its corresponding obligation.Right protection needs cost,so when the attainable cost of right is lower than its profit,the obligee would have enough drive to protect his right.The Tort Law through decreasing the right protection cost encourages the infringed to protect their right and through increasing infringement cost stops potential infringement impulse.Based on the consideration of cost and profit and the balance of the interests of all parties,legal remedy for cyber infringements reflects an interesting theme that "it is easy to guard against gentlemen but difficult against villains"
