Abstract:The Arctic has become a highly dynamic socio-ecological system due largely to the interacting forces of climate change and a suite of factors that we commonly group together under the rubric of globalization. The result is a cascade of developments that are accentuating the links between Arctic processes and global systems and generating new needs for governance to maintain sustainable human-environment relationships in the circumpolar north. This article addresses the resultant challenge of Arctic governance with particular reference to five themes: (i) the underlying drivers of change in the Arctic, (ii) the identity of legitimate stakeholders in responding to emerging issues of governance, (iii) the framing of Arctic issues for purposes of policymaking, (iv) calls for an international agreement for the Arctic Ocean, and (v) proposals for a comprehensive and legally binding treaty for the Arctic as a whole. The analysis yields negative conclusions regarding some popular proposals (e.g. calls for an Arctic Treaty). But this does not mean there is no need or no scope for innova- tive initiatives relating to Arctic governance. The conclusion sets forth a series of more modest but also more realistic recommendations aimed at enhancing good governance in this dynamic setting. Abstract:Interacting forces of climate change and globalization are transforming the Arctic. Triggered by a non-linear shift in sea ice, this transformation has unleashed mounting interest in opportunities to exploit the region's natural resources as well as growing concern about environmental, economic, and political issues associated with such efforts. This article addresses the implications of this transformation for governance, identifies limitations of existing arrangements, and explores changes needed to meet new demands. It advocates the development of an Arctic regime complex featuring flexibility across issues and adaptability over time along with an enhanced role for the Arctic Council both in conducting policy-relevant assessments and in promoting synergy in interactions among the elements of the emerging Arctic regime complex. The emphasis throughout is on maximizing the fit between the socioecological features of the Arctic and the character of the governance arrangements needed to steer the Arctic toward a sustainable future.

Abstract:The current wave of interest in Arctic affairs has struck with startling speed and remarkable force. Fueled by the writings of pundits asking provocative questions (e.g., “who owns the Arctic?”), this wave has now captured the attention of policymakers and begun to trigger policy responses (e.g., the May 2008 Ilulissat Declaration from the five Arctic coastal states). This article examines these developments from the perspective of governance, raising questions about underlying drivers, the identity of relevant stakeholders, the framing of issues for consideration in policy settings, and the extent to which a new regime for the Arctic Ocean or an even more ambitious legally binding convention or treaty for the whole Arctic region is needed. The general conclusion is that many proposals on offer in this realm are simplistic but that there is a strong case for taking a number of pragmatic steps to address specific problems of governance in the far North during an era of rapid change.

Abstract:The biophysical state change currently underway in the Arctic Ocean is opening up the region to new and intensified human activities. While the pace of development is not as rapid as many expected a few years ago, increased human activities are generating new needs for governance pertaining to the Arctic Ocean. The critical shortcomings of the existing arrangements applicable to this area arise from jurisdictional and sectoral fragmentation. A more effective governance system for the entire Arctic Ocean must rest on the constitutive foundation provided by the UN Convention on the Law of the Sea. The toolkit provided by the law of the sea includes at least four distinct though not mutually exclusive approaches: (i) the application of specific provisions of UNCLOS (e.g. Arts. 122 and 123) to address emerging needs for governance in the Arctic Ocean, (ii) the development of UNCLOS implementing agreements that are applicable to the Arctic Ocean, (iii) the use of measures adopted by UN specialized agencies (e.g. IMO, FAO), and (iv) the creation of subsidiary bodies, such as regional fisheries management organizations or regional seas arrangements, tailored to the circumstances of the Arctic Ocean. A critical review of these approaches reveals their strengths and weaknesses as mechanisms for meeting emerging needs for governance in the Arctic Ocean. The way forward is likely to feature the development of a multi-functional arrangement that applies to human activities in the entire Arctic Ocean and that allows for distinct categories of members possessing different rights and responsibilities.

Abstract:The Arctic is one of the key regions in relation to global climate change, experiencing radical transformations in environmental governance as well as challenges in terms of its ecological protection. The region is witnessing a number of irreversible climatic shifts, such as melting permafrost, rising sea levels, contamination of the Global Ocean, and changes in the lives of indigenous people. The Arctic is a global hot spot in climate change where international cooperation (scientific, environmental, diplomatic, etc.) should be a priority to overcome existing ecological challenges. This article provides detailed analysis of these issues from cross-disciplinary perspectives, bringing insights from economics, history, anthropology, international relations, and political science from the perspective of literature on environmental regionalism. The article analyzes a selection of heterogeneous actors, many of whom have contradictory rules, norms, and priorities. Analysis of the Arctic through the lens of regional environmental governance aspires to contribute to understanding of the complexity of existing challenges and their potential solutions. This article offers an analysis of the major findings in this topical collection. It contributes to the development of cross-disciplinary approach to the studies of the Artic and outlines a research agenda.

Abstract:ABSTRACTBiophysical changes underway in the Arctic have stirred a remarkable surge of interest and concern in many quarters, including non-Arctic states and non-state actors. This article explores the implications of these developments for the pursuit of governance in the region. Many reactions to this situation are more alarmist than alarming. But recent developments do provide an excellent opportunity to reassess the effectiveness of existing arrangements and to enquire about the need for new forms of governance. The article does not support the claims of those who argue that a comprehensive, legally binding Arctic treaty (or even an Arctic Charter) is required at this time. Rather, it argues the case for a somewhat messier but more effective tripartite governance complex featuring an agreement to set aside without extinguishing claims to extended continental shelf jurisdiction on the part of the littoral states, an effort to adjust the character of the Arctic Council to meet emerging needs in the Arctic, and a push to devise issue-specific regulative regimes to address concerns involving shipping, fishing, and off-shore oil and gas development.

Abstract:Some regions defined in biophysical terms are subject to shared authority and responsibility with regard to matters of governance. When such regions lie outside or beyond the limits of national jurisdiction, they constitute international spaces. Where they are subject to the jurisdiction of two or more states, they constitute shared spaces. Together, international spaces and shared spaces make up the domain of ecopolitical regions. Focusing on marine shared spaces, which we describe as regional seas, this book addresses issues of governance broadly defined, with a particular emphasis on the achievement of sustainability regarding human activities occurring in regional seas. We treat the Bering Strait Region and the Barents Sea Region as cases studies for an in-depth examination of this topic. In the process, we seek to contribute to understanding regarding the pursuit of sustainability in regional seas and ecopolitical regions more generally.

Abstract:The landscape of Arctic politics is shifting. Transregional issues have taken on increased prominence, and numerous non-Arctic states are developing a growing interest in Arctic affairs. Increasing tensions between Russia and the West have cast a shadow on the cooperative practices characterizing the work of the Arctic council. There is no shortage of efforts to address needs for governance in the Arctic relating to matters of shipping, fishing, energy development, scientific research and the protection of sensitive ecosystems. But a major challenge is to manage interplay among these discrete developments, avoiding friction and promoting synergy. What we can expect is the growth of an Arctic regime complex encompassing a number of distinct elements that all deal with matters relating to the Arctic but that are not hierarchically related to one another. An important priority in this regard will be to improve the integration of this evolving complex of institutional arrangements. Addressing this challenge is likely to emerge as a central role for the Arctic Council during the next phase of its development.

Abstract:Using case studies dealing with the role of the Arctic Council in maintaining the Arctic as a zone of peace and the effort to craft effective Sustainable Development Goals (SDGs), this essay explores opportunities for mutually beneficial interactions between practitioners and analysts seeking to enhance the performance of international governance systems. In both cases, progress has involved measures that depart from the traditional diplomatic focus on regulatory arrangements – the achievement of influence through an emphasis on agenda formation in the case of the Arctic Council and the adoption of a strategy of governing through goals in the case of the SDGs. This analysis does not contradict the arguments of those who say we must work toward a more radical transformation of international society to come to terms with the challenges of the Anthropocene. But it does show that we can make progress in addressing more specific problems by choosing to live on the science-policy interface.

Abstract:Abstract This Special Issue, based on the Third International Conference of the Transatlantic Maritime Emissions Research Network ( TRAMEREN ), Copenhagen, June 2019, examines emerging issues in Arctic environmental and climate change governance. The law of the sea performs a paramount role in stabilising a legal order in the ocean, including the marine Arctic. However, physical and ecological conditions surrounding the ocean may change over time, particularly in the era of climate change. Thus the antithesis between change and stability in the law of the sea is key when considering effects of climate change on the law of the sea. The six articles in this Special Issue provide insights into the development of the legal framework for governing the marine Arctic addressing, respectively, changing paradigms in the law of the sea, retreating coasts in the Arctic, environmental assessment, the Polar Code, fuel use regulation of Arctic shipping, and Arctic climate interventions.

Abstract:The Arctic plays a central role in the Earth’s climate and an increasingly important role in international relations and politics. As the region undergoes profound transformation due to combined impacts of anthropogenic climate change and global economic forces, new questions of governance come to the forefront of debates about the future of the region. This primer provides an essential overview of these changes as well as of the region’s governance system, which comprises many discrete and interacting elements. Contrary to popular claims, there is no lack of governance in the Arctic, but there are also challenges ahead of it. These challenges, however, are not unique to the circumpolar North and they represent some of the most pressing issues in governing human-environment relations in the Anthropocene. Therefore, lessons from the Arctic will have global relevance, and global experience can help to address the needs of Arctic governance.

Abstract:The forces of climate change and globalization are transforming the Arctic, tightening the links between this seemingly remote region and the world at large with regard to matters of environmental protection, sustainable development, and the pursuit of peace. This has triggered an explosion of both popular and scholarly interest in the far north. Much of the resultant literature is marked by persistent expectations that the Arctic will become the scene of escalating jurisdictional conflicts, resource wars, a new great game and even armed clashes during the coming years. Yet as the books considered in this review article make clear, these expectations are greatly exaggerated; there is much to be said for the proposition that armed conflict is less likely to occur in the Arctic than in most other parts of the world anytime soon. What is needed is an alternative paradigm to provide a basis for understanding the significance of the profound changes now eroding the old order in the Arctic and establishing a basis for framing innovative governance arrangements capable of ensuring the future of the Arctic as a zone of peace.

Abstract:Conditions in the Arctic today differ from those prevailing during the 1990s in ways that have far-reaching implications for the architecture of Arctic governance. What was once a peripheral region regarded as a zone of peace has turned into ground zero for climate change on a global scale and a scene of geopolitical maneuvering in which Russia is flexing its muscles as a resurgent great power, China is launching economic initiatives, and the United States is reacting defensively as an embattled but still potent hegemon. This article explores the consequences of these developments for Arctic governance and specifically for the role of the Arctic Council. The article canvasses options for adjusting the council’s membership and its substantive remit. It pays particular attention to opportunities for the council to play a role in managing the increasingly complex Arctic regime complex.

Abstract:That the Arctic is undergoing transformative changes driven in large part by external forces is no longer news. The high latitudes of the Northern Hemisphere, which are not themselves significant sources of anthropogenic emissions of greenhouse gases (GHGs) or short-lived climate pollutants (such as black carbon soot), are experiencing effects attributable to climate change that are equal to or greater than those occurring in any of the planet's other large regions. Prominent among these effects are rising surface temperatures, a deepening of the active layer of the permafrost, the collapse of sea ice, increases in the intensity of coastal storm surges made possible by the retreat of sea ice, the accelerated melting of the Greenland ice sheet, and the acidification of marine systems. The deposition of black carbon in the high north alone—almost 60 percent of which is thought to originate in Europe—appears to account for half or more of the increase in temperature occurring in the Arctic. Positive feedback processes, such as lowered albedo (that is, the capacity of Earth's surface to reflect incoming solar radiation back into space) following the melting of ice at sea and snow on land, have the effect of magnifying the impact of these external forces. Nowhere is the challenge of adapting to the impacts of climate change more urgent than in Arctic coastal communities confronted with the need to relocate to avoid physical destruction. And nowhere are the threats to individual species (for example, the polar bear) and whole ecosystems more severe than they are in the Arctic, where biophysical changes are outstripping the capacity of plants and animals to adapt to altered conditions.

Abstract:This article examines the existing governance arrangements applicable to the Bering Strait Region (BSR), assesses the emerging needs for governance in the region, and considers options for addressing these needs. Widely regarded as a critical chokepoint between the North Pacific and the Arctic Ocean (and its marginal seas), the BSR is subject to a variety of regimes, ranging from global constitutive arrangements (e.g., 1982 United Nations Convention on the Law of the Sea) to bilateral operational arrangements. The growth of human activities in the BSR, associated with transformative changes occurring in the Arctic in recent years, is generating new needs for governance. This article reveals options that can be used or ignored by decision makers, in contrast to recommendations that may involve advocacy, with the single objective of contributing to informed decision making in this realm.
Governing the Antipodes: International Cooperation in Antarctica and the Arctic

Abstract:ABSTRACTThe Arctic and the Antarctic appear to be polar opposites with regard to many matters, including the systems of governance that have evolved in the two regions. Antarctica is demilitarised, closed to economic development, open to a wide range of scientific activities, and subject to strict environmental regulations under the terms of the legally binding Antarctic Treaty of 1959 along with several supplementary measures that together form the Antarctic Treaty System (ATS). The Arctic, by contrast, is a theatre of military operations, a site of largescale industrial activities, a homeland for sizable groups of indigenous peoples, and a focus of growing concern regarding the environmental impacts of human activities. The Arctic Council, the principal international body concerned with governance at the regional level, operates under the terms of a ministerial declaration that is not legally binding; it lacks the authority to make formal decisions about matters of current interest. Digging a little deeper, however, one turns up some illuminating similarities between the governance systems operating in the antipodes. In this article, I pursue this line of thinking, setting forth a range of observations relating to (i) the history of governance in the antipodes, (ii) institutional innovations occurring in these regions, (iii) issues of membership, (iv) jurisdictional concerns, (v) the role of science, (vi) relations with the UN system, (vii) institutional interplay, and (viii) the adaptiveness of governance systems in the face of changing circumstances. The governance systems for the polar regions are not likely to converge anytime soon. Nevertheless, this analysis should be of interest not only to those concerned with the fate of Antarctica and the Arctic but also to those seeking to find effective means of addressing needs for governance in other settings calling for governance without government.

The author argues that all Arctic states can gain from cooperating to devise ways of exploiting Northern resources while protecting the region's ecosystems and cultures.

Abstract:The Barents Sea is an ecopolitical region bounded on the south by the north coasts of Norway and Russia, on the east by the 38th meridian, on the north by the Central Arctic Ocean, and on the west by the boundary of the Svalbard Fishery Protection Zone. The fact that much of this region has been largely ice free in modern times differentiates it from the rest of the maritime Arctic and has drawn the attention of both resource users and policymakers to the region. Norway and Russia, the key players in the Barents Sea Region, have developed a cooperative relationship in managing the shared natural resources of the region. Nevertheless, other states have interests in the region. Issues of governance in the Barents Sea Region involve growing needs for improved mechanisms to address the interplay among various elements of the complex of sectoral regimes applicable to the region and for agility in responding to rapid changes in the biophysical and socioeconomic conditions prevailing in the region.

Abstract:That the Arctic is experiencing transformative change is no longer news. But what are the implications of this development with regard to matters of governance and policy? This article makes the case that the answer to this question depends on the paradigm or discourse we employ as a conceptual framework for interpreting the meaning and significance of changes in the circumpolar Arctic. It contrasts interpretations produced by observers whose thinking is rooted in the neo-realist/geopolitical paradigm with those offered by others whose thinking rests on a socio-ecological systems paradigm. Although journalists and popular writers tend to gravitate toward the neo-realist/geopolitical paradigm, those who possess a more intimate knowledge of recent developments in the Arctic are inclined to base their thinking on the socio-ecological systems paradigm. Because the assumptions and precepts of paradigms or discourses are not falsifiable, it is fruitless to try to demonstrate that one of the two paradigms is somehow superior to the other. Nevertheless, for those dedicated to preserving the Arctic as a zone of peace, the socio-ecological systems paradigm has strong attractions.
