Differences in the Paradigm of Data Portability Protection and China's Solution

Abstract:The answer to the paradigm of data portability protection is not uniform in national legislation and reality. In legislation, the interest of data subjects in personal data is recognized as a right by creating legal provisions, reflecting the legislator’s concept of “empowerment and protection”; in reality, the right to data portability is not an absolute right in the general sense, and data as an object is not clear and specific. In order to balance the multiple interests that exist on top of data circulation, it must resort to more regulation of data carrying behavior, force the emergence of a “behavior regulation” model. For China, a more feasible protection option is to adopt both the “rights-based model” and the “behavioural regulation model”, where data portability can be improved under the framework of personal information protection law, or resort to more behavioural regulation of data controllers in the field of competition law. The right to data portability on paper can be transformed from a misinterpretation of the “proliferation of rights” to an “imperial sword” that promotes the free flow of data.
