On The Administrative Powers in the Field of Criminal Justice and Judicial Review System

Abstract:This paper elaborated the emergence of the judicial review system with the background of constitutionalism in modern rule-of-law states, and the features of administrative powers and its relationship with judicial power in the field of criminal justice. Besides, the paper gives analysis and review on the positioning of investigative power and prosecutorial power. And it concludes that the two powers, as administrative powers, embrace the feature as “wide-ranged” and “free-bounded”. The author holds that, according to the constitutionalism requirements of “limited government” and “right safeguard”, a judicial review system should be established in our country to regulate and check the power of investigation and procuratorate through performance of judicial writ and exclusion of illegal evidence, so as to realize the target of our consititution—“to safeguard human rights”.
