The Origin of Judicial Independence and Its Realization in China

Abstract:As a principle, judicial independence originated from the West Europe at first, and afterwards it was gradually affirmed by the laws of capitalist countries. In the last years of Qin Dynasty, the principle began to step into China. This principle also is affirmed by our constitution in operation. According to the author’s opinion, however, the judicial independence principle of our country is quite different from that of western countries. In order to proceed with better practice of this principle, we should notice the aspects afterwards as follows: to further streamline the relations between CPC’s leading and judicial independence; to deal correctly with the relations between the supervision of the People’s Congress and judicial independence; to carry on the vertical system of leadership in judicial authorities; to practise the special management of personnel and finance; to draw on the good experience of other countries; and to improve the ability for judicial authorities to exercise their functions and powers.
