On the Key Problems Related to the Legislation of Government Open

Abstract:To realize the legislation of the government open in China, the following key problems need to be solved: (Ⅰ) The administrative organs should be the obligors in the issue of government open instead of the departments of legislation, jurisdiction and the state-held enterprises. (Ⅱ) The national secrets, administrative secrets and private secrets should be accurately defined and make clear that they will be three major exceptions that will not be open to the public. (Ⅲ) Besides the combination of initiative discovery and discovery on requisition, the process of government open should include preparing discovery and inner discovery implemented in our local legislation. And (Ⅳ) the obligors of the government open should assign particular departments and people to take up the concrete work. An information committee should be set up and given the case-censoring function as a supplement to the traditional remedies such as administrative reconsideration and administrative litigation.
