Empirical Study on the System of Jurors for Criminal Cases:A Case Study of J Province and C City’s Grass-roots Courts

Abstract:Under the circumstances of new judicial reform,the system of people’s jurors surface again as a heated topic. Our empirical survey indicates that the team structure of peo-ple ’s jurors have become more rational and the pilot courts have made positive trials in the reform of trial participation mechanism and power since the implementation of“Pro-visional Program on the Reform of People ’s Jurors”. Nevertheless,there are some problems as to the trial participation of jurors in pilot courts. It is argued that according to the value orientation of the jurors ’system and the overall requirement of reform a-bout the improvement of judicial trust the scope of criminal case trial participation should be defined,the qualifications of jurors should be more lenient,the model of col-legiate panel trial participation should be promoted,and a checKlist system for the que-ries to be answered by jurors should be developed so as to facilitate the reform and im-provement of the system of people’s jurors in China.
