Abstract:Intellectual property rights are exclusive.That means,in intellectual property law,there is a contradiction be-tween the proprietary of intellectual property products and the public legitimate need for intellectual property products.In re-cent years,the reasonableness of intellectual property law was being questioned and criticized a lot.Actually,the move-ments,which are represented by open source movement and oppose intellectual property rights,bring reflection for intellec-tual property system.It promotes the properly use of intellectual property products which have both public and private at-tributes.In this way,intellectual property law can achieve the goal of fair and justice.
