Abstract:Information publicity system is a guarantee in law in exploiting government information resources.This paper discusses the reasons for establishing such a system,and based on the Japanese Freedom of Information Act,discusses the main content of information publicity system.

Abstract:Regulations on Open Government Information of the People's Republic of China prescribe that "may not disclose government information" involves state secrets,commercial secrets or individual privacy.While state secrets are totally non-discloseable,commercial secrets and individual privacy may be disclosed by administrative agencies with the consent of the rightholders or if administrative agencies believe that non-disclosure might give rise to a major impact on the public interest.Furthermore,state secrets and commercial secrets should be defined according to the Maintenance of State Secrets Law and the Anti Unfair Competition Law,but individual privacy should be defined on a case.Last but not least,to accurately define the aforementioned conceptions helps to implement Regulations on Open Government Information of the People's Republic of China.

Abstract:The legislation of information publication is a necessary means to realize democratization and vitrification of politics.Although spirit of information publication of government affairs is shown somewhat in certain codes and laws,subjects like its principles and procedures,contents and forms etc.are still to be explored.With information publication being essence of civilian government and intellectual condition of democratization,any information with exception of that involving national safety and legal secrecy should enjoy freedom of publication in advance.What legislation of information publication should confront is reconfirmation of base line of national secrecy and clear up of the right of lawful damage,which works as byproduct of secrecy legislation.The government spokesman system,as ceremonial means of information publication,should avoid functional alienation.Public and social interests are right plea when information publication clashes with privacy protection,accordingly,public figure's privacy,when associating with public affairs,should be scoped within public information.

Abstract:As a fundamental right,the right to know has its constitutional implications.Right to know is not prescribed in our constitution,but it is confirmed in local government regulations,in important party and national documents.So it is proper to use constitutional interpretation method,to incorporate right to know into fundamental constitutional right.As an administrative decree to guarantee the right to know of citizen,Ordinance of Access to Government Information should deal with its relationship with National Secrecy Act,Archives Act and "Regulations and related documents",should coordinate its relationship with "right to dossiers",with privacy.The administrative dispute emerges from freedom of information constitutes a new type of administrative litigation,it needs our actively response in administrative litigation theory and practice,only this can indeed guarantee the right to know of citizens.

Abstract:Defining the exemptions becomes the core of information publicity in practice.In order to prevent power abuse,concepts of state secrets,trade secrets and individual privacy as well as other exemptions should be clarified appropriately.To analyze the above concepts,the connotations of state secrets,trade secrets,etc.should be restricted,meanwhile,value measure principle should be established,concrete subtype of exemptions be defined,and gradient connotation structure be adopted,as well as necessary supervision space be guaranteed.All in all,exemptions should be adjusted strategically to realize the value of information publicity.

Abstract:The free flow of information and ideas is a core part of any thought on democracy and is essential for the successful respect of human rights. It has the potential to cause human rights violations to occur in secret, there is no way to reveal a corrupt and inefficient government, and many other things. Based on this background, this research is based on the formulation of the problem 1) Philosophical Basis of Public Bodies as Public Information Providing Institutions in the Era of Public Information Openness; 2) Existence of the Information Commission as Administrator and Law Enforcer in Public Information Disclosure; 3) Public Entity's Liability Against Disputes Public Information From the Aspects of Administrative Law, Civil Law and Criminal Law. This research is a legal research (legal research). The approach in this research is a statutory, conceptual, and case approach. The conclusions of this study include: Freedom of information is the spirit of democratization that offers freedom, but in this freedom the state can function itself effectively and efficiently without neglecting democratic principles. The effective enactment of the UU KIP in Indonesia starting April 30, 2010 opened a new era of public information disclosure in the country. The enactment of this law is part of the implementation of the spirit of transparency as the fulfillment of citizens' human rights to know public information (right to know) guaranteed by Article 28F of the 1945 Constitution of the Republic of Indonesia.

Abstract:The Publicity of government information depends on both security regimes and public mechanism.In America,two mechanisms make good convergence under the Constitutional Framework,and the security regimes can promote the process of the government information disclosure.In our country,the situation is difficult to satisfactory.Because the open mechanism and confidentiality mechanisms are in parallel and lack of effective path of convergence,the security management is not only difficult to become the help of the government information disclosure,but also degenerated into the constraints forces.It is difficult to meet the situation which government information disclosure needs.Therefore,we should learn from the experience of the United States,and coordination legislation under the constitutional framework to establish the publicity of government information integration management mechanism.

Abstract:This article conducts a juridical analysis of public information disclosure in government systems in the digital era. The purpose of compiling this article is to identify legal issues related to public information disclosure in the digital era and provide appropriate legal solutions to overcome these problems. The research method used is a literature study by analyzing laws and regulations related to public information disclosure, as well as collecting the latest data and information about the use of information technology in government in a descriptive-analytical manner. The study results show that public information disclosure is a basic principle in a democratic government system that is fundamental for strengthening government accountability and encouraging public participation in policy-making. In the digital era, public information disclosure is becoming increasingly important, but it also requires the protection of information security and privacy because public information disclosure in the digital era has complex legal implications, such as issues of information security, personal data protection, and copyright issues. This article suggests that the government strengthen regulations regarding public information disclosure in the digital era, including developing strict information security standards and protecting intellectual property rights. In addition, the government also needs to increase public awareness about their right to obtain public information and develop an effective and efficient information system to facilitate access to public information.

Abstract:The Open Government Information Regulation requires government information open to public,the ambivalence of openness and secret keeping reflected in the regulation itself and the inadequacy of judicial protection of individual right to know are huge challenges to the open government information system.Logic contradiction and conflict of legal provisions between open information system and secret - keeping system,together with the weak role of courts in reviewing agency action with respect to government information openness creates both institutional barriers and harsh environment for an open government.This paper analyzes those challenges and calls for reforms of secret - keeping system and a more active role of courts in the context of open government information context.
