Abstract:Having read your Editorial entitled “Psychiatric institutions in China” (July 3, p 2),1The LancetPsychiatric institutions in China.Lancet. 2010; 376: 2Scopus (1) Google Scholar we are upset about the misfortune of the farmer. However, as psychiatrists from China we do not agree with the conclusion that psychiatric hospitals in the country are used to prevent people from exercising their freedom of expression. We believe that the reasons behind this tragedy should be explored rather than blame simply apportioned to the Chinese government. Civil servants in the local town authority forged the supporting documents after a land dispute with the farmer and his friend, and then sent them to a psychiatric hospital. After admission, the farmer was diagnosed with “paranoid psychosis” and received involuntary treatment, as reported in the newspaper. However, we should emphasise that this was a crime committed by local civil servants and cannot lead to the conclusion that psychiatric hospitals in China are used for political purposes. As far as we know, in recent years there have only been occasional cases of compulsory admissions to psychiatric hospitals, usually related to family economic conflicts. Hence, we see no evidence to support the Editorial's conclusion that there are many such tragic cases in China. One likely reason for this case is the lack of a national mental health act in China. In 1985, a committee started drafting such an act, with the draft revised 15 times until 2005.2Yan DX Wang J Chen ZW Chinese Mental Health Act after 24 years of giving birth will be born during the year.China Newsweek. 2009; June 26; (in Chinese).Google Scholar Unfortunately, the final version is yet to be released. At this point, there are no national guidelines on involuntary psychiatric admissions. People who are suspected of having psychiatric disorders are often compulsorily admitted to psychiatric hospitals with consent forms signed by relatives. Homeless people suspected of having psychiatric disorders are often certified for psychiatric treatment by local civil and public security departments.3Yu CH Wang HQ Sun W Liu DH Analyses of admission of homeless psychiatric patients (in Chinese).Med J Chinese People's Health. 2007; 19: 756-757Google Scholar It is sometimes unclear who should apply for the discharge of the “patient”. The principle in many regions of China is that the person who signed the consent form for admission should apply for the discharge.4Shen XW China's Mental Health Act is not released after twenty-five years' drafting, and compulsory admission leading to a debate.China Newsweek. 2010; June 3; (in Chinese).Google Scholar This could explain why the farmer was detained in the psychiatric hospital for 6 years. To avoid similar cases, the national mental health legislation should be finalised and implemented as soon as possible. In addition, we would like to call for continual monitoring by the media and improved ethical training for mental health professionals. We declare that we have no conflicts of interest.
