Abstract:The theory of the forms of administrative action,under the framework of Legal Hermeneutics,functions to institutionalize,bridge and preserve.It mainly serves to judicial review,procedural control and rights remedy.Traditional theory of the forms of administrative action merely survives the current expansion of administrative functions,especially due to the neglect of substantive policy facet of administration.Therefore,the first improvement over the traditional theory of the forms of administrative action should be done by the regulatory tools and its theory of selection under the framework of legal policy study.Such responsibility should be taken up by the public law scholars,because they are familiar with the public law theory and the norm structure,which can supplement the value standard and norm framework described by the pure regulatory tools.Furthermore,the author believes that the modern theory of the forms of administrative actions should include one base point(traditional forms of administrative action)and three theoretical improvements(the theory of regulatory tools,the theory of administrative process and the modeling of administrative law relationship).Finally,the new structure of the theory of the forms of administrative action could reflect the new growing point of the modern administrative law studies.
